Retail Trading Hours Regulations 1988

The Regulations centre on a small number of legal concepts which are deployed to implement the Act’s regulatory regime. These concepts are: prescribed shop categories; prescribed goods and services; certificates; administrative forms and the chief executive officer’s role; prescribed goods for filling stations; prescribed services; and the metropolitan area definition.

Prescribed shop categories and goods and services. Regulation 7 prescribes 11 categories of “special retail shops” for the purposes of section 10(4)(a) of the Act, and, for each category, it lists the goods and services that are “prescribed in relation to a special retail shop of that category” for the purposes of section 10(4)(b). The Table is highly granular. For example, “Domestic development shops” (item 4) include an extended list that expressly excludes some items (for example, free standing furniture other than shelving units, and electrical items other than ceiling fans) while including flat pack timber furniture and specific gardening and DIY supplies. “Pharmacy” is tied to what may be sold under the Pharmacy Act 2010 (reg 7 Table, item 3). “Duty Free Shops” are linked to the Commonwealth Customs Act 1901 permissions (reg 7 Table, item 7). Each category also includes “calico or similar re‑useable shopping bags” as a permitted good.

Certificates and forms. The Regulations require that applications under section 11(1) of the Act for both small retail shop certificates (regulation 6) and special retail shop certificates (regulation 8(1)) be made in a form approved by the chief executive officer. Regulation 8(2) specifies that the certificate for special retail shops is Form No. 6, and the Schedule reproduces that form and the standard conditions attached to it. Form No. 6 contains two express conditions: notification of change of ownership, directorship or nature of business within 14 days (mirroring regulation 9), and display of the certificate in a prominent position (mirroring regulation 10).

Chief executive officer. Regulation 3 defines “chief executive officer” for the Regulations and links the approval of forms and certificate administration to that official. The Schedule Form No. 6 repeats the requirement that the chief executive officer be notified of changes and be the issuer of the certificate.

Prescribed goods for filling stations. Regulation 11, inserted in 2016, prescribes an itemised list of goods that may be sold at all filling stations for the purposes of section 14A(1)(b) of the Act. The Table contains 28 itemised categories ranging from food (with an express exclusion for fresh meat beyond certain prepacked quantities) to light globes, torches, local artist works, swimming pool chemicals, coolers and vehicle accessories.

Prescribed service. Regulation 12 prescribes a single service under section 3 of the Act, namely the provision of bays for display of secondhand vehicles for sale at a car market.

Metropolitan area. Regulation 4 fixes the geographic meaning of “metropolitan area” for the Act by reference to the Planning and Development Act 2005 Schedule 3, which localises where some aspects of the Act and Regulations will apply.

Penalties. The Regulations specify two particular monetary penalties, each at $1,000, for failure to notify changes to ownership/directorship/nature of business (regulation 9) and for failure to display the certificate (regulation 10). No other penalty amounts are provided in these Regulations. The Regulations do not set out broader enforcement procedures or infringement notice mechanisms; they leave certificate issuance and form approval to the chief executive officer.

Overall, the core legal mechanism is classification: the Regulations translate statutory categories into operational lists of goods and services and attach procedural duties to certificate-holding businesses. The chief executive officer functions as the administrative gatekeeper for forms, certificates and notifications.

The Regulations affect a concentrated set of actors in the retail and administrative parts of the supply chain. The primary affected parties are retail operators who seek to rely on the Act’s special or small retail shop categories, filling station operators, car market organisers, and the chief executive officer and department responsible for administering the Act.

Retail shop operators. Any business that seeks certification under section 11(1) of the Act as a small retail shop or a special retail shop must use a form approved by the chief executive officer (regulations 6 and 8(1)). The many categories in regulation 7 will particularly affect retailers whose product mix sits close to the lists in the Table: art and craft sellers, souvenir shops, pharmacies (linked to Pharmacy Act 2010), domestic development or hardware-style shops (including builders’ supplies and garden products), marine craft retailers, video rental or sales shops, duty free shops subject to Customs Act permissions, motor vehicle spare parts shops (with a detailed carve-out for items), sports venue retail operators, newsagencies and bookshops, and retail operations inside higher standard hotels (hotel tourist shops). The presence of highly specific inclusions and exclusions (for example, exclusions of certain types of furniture or electrical items in item 4) means operators must map their product mix to the Table to determine whether they fit a prescribed category.

Filling station operators. Regulation 11 prescribes a list of 28 itemised goods that may be sold at filling stations, which places product constraints on convenience retailing at petrol stations. The list clarifies permissible non-fuel sales and explicitly limits fresh meat sales to prepackaged quantities not exceeding 500 g. Filling station operators therefore must ensure inventories comply with regulation 11 when relying on the Act’s relevant provision (s 14A(1)(b) as referenced).

Car market operators. Regulation 12 prescribes the provision of bays for display of secondhand vehicles at a car market as a “prescribed service” under section 3 of the Act. Entities operating car markets and providing display bays are directly captured.

Chief executive officer and department. The chief executive officer has an operational role: approving forms (regulations 3, 6 and 8), issuing Form No. 6 certificates (regulation 8(2) and Schedule), receiving notifications of changes from operators (regulation 9), and being the addressee for display obligations. The Schedule and regulation text repeatedly centralise administration with that official.

Hotel operators. Item 11 in regulation 7 covers “Hotel Tourist shops” and ties eligibility to hotels classified “4” or “5” star under a Minister-approved classification scheme or hotels “in the opinion of the chief executive officer of an equivalent standard” (footnote 3 reproduced in the Schedule). That wording gives the chief executive officer an evaluative role in determining whether a hotel qualifies for the category.

Consumers and suppliers. Indirectly, consumers and upstream suppliers are affected by what goods shops can lawfully sell while relying on a category or certificate; for example, those buying at filling stations or hotel tourist shops will be constrained by the lists. Suppliers of goods that are expressly excluded by a category’s list may find purchasers cannot qualify for certain regulatory statuses.

Regulatory advisers, compliance professionals, and local government enforcement officers will be affected by the need to interpret the lists, ensure certificates and display requirements are met, and advise clients on product categorisation versus the Table.

The Regulations therefore create discrete compliance obligations for a targeted set of businesses and centralise administrative decision-making in the chief executive officer. The monetary costs are small per contravention ($1,000 for two specific breaches), but administrative costs and operational adjustments can be material where product lines sit on the margins of the prescribed categories.

Duties

• Application forms. An applicant for a small retail shop certificate must apply in a form approved by the chief executive officer (regulation 6). Likewise, an application for a certificate certifying a retail shop as a special retail shop must be in a form approved by the chief executive officer (regulation 8(1)). The Regulations therefore impose the duty to use approved forms for certificate applications. Form No. 6 is prescribed as the special retail shop certificate (regulation 8(2) and Schedule).
• Notification of change. The operator of a small retail shop or special retail shop is required to notify the chief executive officer within 14 days of any change in ownership, directorship or nature of business (regulation 9). Non-compliance attracts a specified penalty of $1,000.
• Display of certificate. The operator of a small retail shop or special retail shop must display the certificate issued under section 11(2) of the Act in a prominent position, clearly visible to staff and members of the public, within the retail shop (regulation 10). Non-compliance attracts a specified penalty of $1,000.
• Product limits for filling stations. For filling stations, the Regulations prescribe a definitive list of goods that may be sold (regulation 11 Table). If an operator relies upon the filling station provision in the Act (s 14A(1)(b) as referenced), the operator must ensure their stock fits within the prescribed list.
• Service provision for car markets. For car market operators, providing bays for display of secondhand vehicles is a prescribed service under section 3 of the Act (regulation 12). Where that status confers rights or obligations under the Act the operator must ensure the service is provided in the manner contemplated by the Act and Regulations.

Rights and legal effects as governed by the Regulations

• Certificate-based status. The Regulations create the administrative pathway to obtain certificate-based statuses referenced in the Act. By specifying categories and associated goods and services (regulation 7), the Regulations list what counts as a special retail shop for the purposes of the Act’s section 10(4)(a) and what goods/services are prescribed for a special retail shop of that category under section 10(4)(b). The legal effects that flow from holding such a certificate are conferred by the Act, and the Regulations provide the classification framework and procedural requirements for obtaining and maintaining certificate status.
• Prescribed scope of retailing for particular premises. The Table in regulation 7 and the Table in regulation 11 create clear, statutory limitations on what is prescribed for particular shop categories and for filling stations. Operators who comply with those lists can rely on the Regulations when asserting they fall within the Act’s defined categories; conversely, operators who step outside those lists risk losing the factual basis for certificate status or for reliance on a filling station exception under the Act.
• Administrative discretion of chief executive officer. Form approval and certificate issuance are administratively controlled by the chief executive officer (regulations 3, 6, 8 and Form No. 6). The Schedule also reflects a specific evaluative discretion in the hotel tourist shop category, where qualification may be by ministerial classification or “in the opinion of the chief executive officer” (regulation 7 Table item 11 and accompanying footnote 3). That discretion affects the substantive right to be classified as a hotel tourist shop.

Observations about duty-right interaction

• The Regulations place the onus on businesses to self-identify their category and product offerings against a statutory list and to manage record-keeping and notifications accordingly. The two explicit monetary penalties are modest, but the regulatory consequence of misclassification can be loss of certificate status and consequent change in the business’s regulatory treatment under the Act.
• The Regulations do not specify appeal or review rights against decisions by the chief executive officer, nor do they set out an enforcement timetable. Those procedural matters, and the legal rights that emanate from certificate status, are matters for the Act and for general administrative law outside the Regulations’ text. The Regulations, however, make the chief executive officer the focal point for approvals, certificates and notifications, centralising administrative gatekeeping.

The Regulations contain a narrow set of explicit monetary penalties and otherwise leave enforcement mechanics largely to the Act and the administering department. The two specified penalties within the Regulations are identical in quantum and targeted in scope.

Monetary penalties specified in the Regulations

• Failure to notify changes. Regulation 9 establishes a penalty of $1,000 for the operator of a small retail shop or special retail shop who fails to notify the chief executive officer of any change in ownership, directorship or nature of the business within 14 days of the change.
• Failure to display certificate. Regulation 10 establishes a penalty of $1,000 for the operator of a small retail shop or a special retail shop who fails to display the certificate issued under section 11(2) of the Act prominently and visibly to staff and members of the public within the retail shop.

Scope and limits of enforcement detail in the Regulations

• The Regulations do not themselves set out enforcement agencies, investigative powers, infringement notice procedures, administrative penalty regimes beyond the two specified penalties, or conviction processes. They identify the chief executive officer as the administrative official for form approval and certificate matters (regulation 3), and they make that official the recipient of notifications and the issuer of certificates (Schedule Form No. 6). The text does not prescribe the manner in which a failure to comply will be detected, how notices are to be served, or which agency will prosecute (if prosecution is the enforcement route), nor does it provide for graduated sanctions, compliance orders, or remediation steps.
• Because the Regulations make the certificate and notification regime central to the Act’s operation, enforcement of the Act’s substantive trading hours rules will plausibly involve checking certificate status and whether display and notification obligations have been met. The Regulations do not, however, create an independent compliance audit mechanism or a schedule of inspections.

Practical enforcement consequences and risks for operators

• The monetary exposure under the Regulations is capped, in statutory form here, at $1,000 for the two enumerated breaches. That amount is fixed in the Regulations’ text. Operators should therefore be aware that the Regulations create modest direct fines for the two duty failures, but indirect enforcement consequences could be larger if the Act uses misclassification as a basis for wider penalties under other sections, or if criminal or civil consequences under the Act are triggered by non-compliance. The Regulations do not state those consequences; practitioners must read the Act alongside the Regulations to assess total enforcement exposure.
• Administrative discretion held by the chief executive officer (form approval, certificate issuance, and opinion-based qualification of some categories) creates implementation risk. Decisions by the chief executive officer could, in practice, be followed by correspondence, administrative review or judicial review procedures outside the Regulations themselves. The Regulations do not provide an internal appeal or objection mechanism.

Likely enforcement triggers

• Failure to display a certificate or failure to notify change of ownership/directorship/nature of business are express triggers for the specified penalties.
• Sale of goods at a filling station that are outside the detailed list in regulation 11 may give rise to enforcement action where a filling station is relying on the Act’s filling station provision (section 14A(1)(b) as referenced). The Regulations make the list explicit, simplifying enforcement by providing a clear statutory benchmark.
• Selling goods at a business that claims special retail shop status but whose products fall outside the prescribed list in regulation 7 could trigger challenges to the certificate’s continued validity; the Regulations themselves do not set out revocation procedures, but this is a foreseeable compliance and enforcement locus.

In short, enforcement detail in the Regulations is narrow and administrative. They prescribe two monetary penalties and a set of objective lists that simplify compliance assessment (particularly for filling stations and category classification), but the broader enforcement architecture and potential additional sanctions are matters for the Act and the administering department rather than for these Regulations alone.

The Regulations explicitly reference and depend on provisions of several other laws and on the Act itself. Those cross‑references allocate substantive legal meaning and spatial scope, and they import statutory standards from separate legislative regimes.

Retail Trading Hours Act 1987. The Regulations are made under and for the purposes of the Retail Trading Hours Act 1987. They repeatedly refer to specific sections of the Act, for example section 10(4)(a) and (b) in relation to the prescription of special retail shop categories and goods (regulation 7), section 11(1) concerning certificate applications (regulations 6 and 8), section 11(2) as the source of certificates which must be displayed (regulation 10 and Schedule Form No. 6), section 14A(1)(b) in relation to filling station goods (regulation 11), and section 3 for the definition of a prescribed service (regulation 12). The Regulations therefore operationalise and populate key definitional and procedural inputs the Act requires.

Planning and Development Act 2005. Regulation 4 fixes the meaning of “metropolitan area” for the purposes of the Act by referring to the Planning and Development Act 2005 Schedule 3. That import fixes geographical coverage for any parts of the Act or Regulations that apply differently inside or outside the metropolitan area. The Regulations do not reproduce the geographic description; they adopt it by reference.

Pharmacy Act 2010. The “Pharmacy” category (regulation 7 Table, item 3) ties the goods and services that a pharmacy may sell to what “may be sold or provided at a pharmacy in accordance with the Pharmacy Act 2010”. That explicit tie imports the substantive regulation of pharmacy practice and permitted sales from the Pharmacy Act 2010 into the retail trading hours classification regime. Thus, pharmacy operators rely simultaneously on the Pharmacy Act’s allowances and the Regulations’ prescription when making claims under the Retail Trading Hours Act.

Customs Act 1901 (Commonwealth). The “Duty Free Shops” category (regulation 7 Table, item 7) depends on Commonwealth Customs Act 1901 permissions, specifically shops that trade as inwards or outwards duty free shops under sections 96A(2) or 96B(3) of the Customs Act where permission is granted. This cross‑reference acknowledges and preserves the primacy of Commonwealth customs regulation over certain goods imported and sold duty free, while fitting such shops into the State Act’s category system.

Acts Amendment (Public Service) Act 1987 and Reprints Act 1984. Footnote 3 in the Schedule explains that references to “Permanent Head” in earlier written laws are to be read as references to the chief executive officer following the Acts Amendment (Public Service) Act 1987 s 31(1)(f). It also notes that the Reprints Act 1984 s 7(5)(a) was used to substitute the current reference. These notes explain how administrative titles used in older text are to be interpreted today and how the Regulations’ administrative references are to be applied.

Interaction dynamics and practical effects

• Imported substantive regimes. By importing what a pharmacy may sell under the Pharmacy Act 2010, and by tying duty free shops to Customs Act permissions, the Regulations avoid duplicating regulatory detail and ensure that other areas of law remain the source of substantive licensing and sale rules for those sectors. Operators in those sectors therefore must satisfy parallel statutory regimes.
• Spatial scope. The use of the Planning and Development Act 2005 to define the metropolitan area affects which premises may be subject to metropolitan-specific aspects of the Act or its enforcement. Practitioners must consult that Act’s Schedule 3 to determine geographic application.
• Administrative centralisation. The chief executive officer role, and the power to approve forms and to determine equivalence for hotel tourist shops by opinion, centralises administrative interaction with other laws in one departmental office, increasing the importance of that office’s policies and practices in multi‑statute compliance.
• Absence of express conflict resolution. The Regulations do not provide a mechanism to resolve conflicts between the Act, the Regulations and the other laws they reference. Practical resolution will therefore be exercised through inter-agency practice, departmental guidelines, and standard legal remedies under administrative law, none of which are contained in these Regulations.

In sum, the Regulations operate at the intersection of the Retail Trading Hours Act and other legislative frameworks, delegating substantive retail-sector detail to those separate acts where appropriate and using external definitions (for example, geographic) to fix operational scope.

The Regulations include an explicit compilation table and footnotes that record successive amendments and reprints from the original Gazette entry in 1988 to amendments as recent as 2017. The compilation table itemises each amending instrument by title, gazettal reference and commencement date. The Schedule and marginal notes in the Regulations also indicate deletions of earlier forms and the insertion of new regulations in later years.

Chronology and notable amendments, as recorded in the source:

• Original Regulations: Retail Trading Hours Regulations 1988, gazetted 12 August 1988, commenced 1 September 1988 (regulation 2 cross‑reference).
• Multiple early amendments in 1990 and 1991: The Regulation 7 Table was amended repeatedly in 1990 and 1991 (Gazette entries 23 March 1990, 5 October 1990, 4 January 1991, 25 October 1991).
• Further amendments through the 1990s: Amendments occurred in 1992, 1994, 1995 and 1996 (Gazette entries recorded in the compilation table), with Forms 1-4 deleted on 23 December 1994 and other adjustments to the Table in regulation 7.
• Reprint: A reprint of the Regulations as at 21 May 1999 is recorded in the compilation table.
• 1999-2004 updates: Multiple amendments in 1999, 2001 and 2004 are listed, affecting the Tables and possibly other administrative provisions (compilation table entries for 1999, 2001, 2004).
• 2007 and 2010 amendments: Gazette entries in 2007 and 2010 indicate further regulatory changes (compilation table).
• 2011 amendment: Regulation 5 was deleted as noted in the body with Gazette 8 April 2011 p. 1282.
• 2016 amendment: Regulation 11 was inserted (Gazette 13 December 2016 p. 5631‑2). The compilation table records the 2016 amending instrument, which added the express list of goods for filling stations.
• 2017 amendment: Regulation 8 was amended and Form 5 deleted (Gazette 22 December 2017 p. 5975‑6 and 22 December 2017 p. 5976). Form No. 6 was retained as the special retail shop certificate (regulation 8(2)). The Schedule was updated to reflect Form No. 6.
• The compilation table shows a lineage of at least 18 amending instruments between 1988 and 2017, with multiple reprints in 1999 and 2006 recorded.

Implications of the amendment pattern

• Frequent tailoring of the Table. Regulation 7’s Table of shop categories and goods has been amended often. The multiplicity of amendments suggests the government has used the Regulations as the primary instrument for adjusting which retail activities qualify as special retail shops and what goods may be sold under those categories. The ease of amendment at the regulation level allows the executive to respond to changing retail practices or policy priorities without needing primary legislation.
• Significant 2016 insertion. The insertion of regulation 11 in 2016 to prescribe a detailed list for filling stations represents a substantive expansion of the Regulations’ role in defining retail permissibility for a particular class of retail premises. That amendment created a clear, itemised statutory list that simplifies compliance and enforcement for filling stations.
• Form deletions and consolidations. The deletion of Forms 1-5 (1994 and 2017) and the retention of Form No. 6 indicates an administrative consolidation around a single certificate form for special retail shops, streamlining the procedural architecture.
• Administrative contingency. The compilation table and the dates demonstrate that the Regulations have been treated as a living instrument subject to repeated updating. Practitioners should therefore check the most recent published version and the Department’s current form approvals, as the Regulations have historically been adjusted by the executive through amending instruments.

The compilation table in the Regulations provides the necessary primary-source citations for each amendment, so practitioners can trace the evolution of individual provisions where necessary. Those changes, especially those affecting the Table in regulation 7 and the insertion of regulation 11,have direct operational effects on which retailers qualify for statutory categories and what goods may be sold in specified premises.

The Regulations’ text and accompanying Notes and compilation table contain no case law citations, no reported decisions, and no reference to litigation arising from these Regulations. The source material does not identify any judicial or administrative tribunal determinations that interpret the Regulations. Therefore, there is no litigation history provided in this instrument.

What the absence of recorded litigation in the instrument means practically

• No precedent recorded. Because the Regulations themselves do not reproduce or summarise court decisions, and because the provided text contains no cases, practitioners cannot rely on any statement of precedent within the Regulations’ text. Any judicial interpretation that has occurred must be sought in external databases, court reports or decisions and is not within the scope of the Regulations’ compilation notes.
• Potential for interpretive disputes. Although the Regulations contain detailed lists, some provisions create points for interpretation that could give rise to disputes. Examples include:
  • Category fit. Whether a retailer’s combined product range is sufficiently covered by a category in regulation 7 may be contestable, especially on edge cases where the Table expressly excludes certain products or includes only narrow subcategories.
  • Quantitative or qualitative determinations. The Pharmacy category relies on the Pharmacy Act 2010 to determine permissible goods, potentially leading to disputes about the interaction of the two statutes.
  • The hotel tourist shop category includes a subjective assessment by the chief executive officer about equivalence of hotel standards, which could be the site of administrative review litigation if an operator disputes a refusal or withdrawal of classification.
  • Filling station permitted goods list sets precise boundaries such as the 500 g cap on fresh meat; disputes could arise around the classification of particular food items.
• Administrative decisions and review. The Regulations make the chief executive officer the administrative decision-maker for form approval, certificate issuance, and opinion-based determinations (regulation 3, 6, 8 and Schedule Form No. 6). If an operator’s application for a certificate is refused, or a certificate is withdrawn or encumbered by condition, that action may be subject to administrative law remedies (judicial review, merits review where available) in external forums. Such litigation, if it exists, is not recorded in these Regulations.

Practical advice in the absence of recorded litigation

• Do not assume judicial gloss. When advising clients, do not rely on presumed judicial interpretations based on the Regulations alone. Instead, search case law databases and administrative tribunal decisions for any external rulings that touch on special retail shop status, certificate refusals, or the filling station goods list.
• Prepare administrative records. Given the chief executive officer’s central role and the lack of internal appeal mechanisms within these Regulations, businesses should maintain careful documentation of product lines, inventory lists, and any communication with the department to support future review or litigation if a classification dispute arises.
• Anticipate contestable categories. Expect disputes to arise around borderline product mixes, subjective equivalence determinations for hotel standards, and the interface between the Pharmacy Act and the Regulations.

In short, this instrument contains no litigation history in itself. The likely loci for litigation or administrative review are identifiable from the text, but any existing case law must be located outside the Regulations.

The Regulations contain several technical traps for the unwary. These are points where a business might assume compliance or a regulator might assume permissibility, but the text contains specific constraints or administrative hooks that alter the legal position. Below are concrete “gotchas” grounded in the Regulations’ wording.

1. Precision of category lists. The Table in regulation 7 frequently includes narrow inclusions and explicit exclusions. For instance, the “Domestic development shops” category (item 4) excludes free standing furniture other than shelving units, carpets and certain electrical items, while nevertheless admitting ready-to-assemble raw timber and finished timber household furniture sold in flat pack form. An operator that sells both flat pack kitchen cupboards and full-sized free-standing furniture might find only part of its product range is within the category, with the residual range not covered by the special retail shop classification. Practitioners must map every product against the exact text in Column 2 rather than relying on broad commercial descriptions.

2. “Calico or similar re‑useable shopping bags” is repeatedly included. Every category in the Table that lists goods includes calico or similar reusable shopping bags. That inclusion is explicit and should not be assumed to be a generic filler. Inclusion of such bags does not create a licence to sell other plastic or single-use bag variants unless they are otherwise within the category.

3. Pharmacy category depends on Pharmacy Act 2010. The pharmacy category does not set out an independent goods list. Instead it defers to what may be sold or provided under the Pharmacy Act 2010. Practitioners must check the Pharmacy Act for permitted sales and related restrictions; they cannot assume every product generally found in pharmacies is permitted under the Retail Trading Hours Regulations without cross-checking the Pharmacy Act.

4. Hotel tourist shop qualification includes subjective “chief executive officer” test. Item 11 allows hotels that are, in the opinion of the chief executive officer, of “an equivalent standard” to the 4 or 5 star classification approved by the Minister. That gives the chief executive officer an evaluative discretion. Operators should not assume automatic qualification on the basis of star-rating schemes alone; approval may hinge on administrative judgment.

5. Filling station food limitation. Regulation 11 item 1 permits sale of food but expressly excludes “fresh meat other than prepacked quantities not exceeding 500 g weight”. The presence of a precise weight threshold is a clear compliance boundary. Operators selling deli meat, cut-to-order product, or packaged meat over 500 g may fall outside the permitted list for filling stations and therefore may lose any Act-based statutory cover they expected.

6. Deletion of earlier forms. The Schedule records that Forms 1-5 have been deleted (Gazette references). Only Form No. 6 remains as the special retail shop certificate. Applications must therefore use the currently approved forms; reliance on an obsolete form may invalidate an application.

7. Short notification period with penalty. The 14-day notification requirement for changes in ownership, directorship or nature of business (regulation 9) is short. The penalty for failure to notify within that window is $1,000. Operators who change ownership via share transfers or similar corporate reorganisations must be careful to assess whether the “operator” change triggers the 14-day window.

8. Limited penalties but possible wider consequences. The Regulations set $1,000 penalties for two specific contraventions only. However, stepping outside the prescribed goods lists or misrepresenting a shop’s category could have broader legal consequences under the Act that are not enumerated in the Regulations. Do not treat the $1,000 figures as the full exposure without checking the Act.

9. Ambiguity on enforcement mechanisms. The Regulations do not set out how breaches will be detected, how penalties are imposed, or what review rights exist. Businesses should not assume the presence of administrative processes such as infringement notices or compliance notices; these procedural details may be contained in the Act or departmental policy rather than the Regulations themselves.

10. Prescribed service for car markets. Regulation 12 prescribes the provision of bays for displaying secondhand vehicles at a car market as a “prescribed service” under section 3 of the Act. Operators offering parts of that service could be captured by the Act even if they do not operate a full market; the wording is broad and focuses on the provision of display bays.

11. Geographic scope depends on external Act. The metropolitan area definition is imported from the Planning and Development Act 2005 Schedule 3. Do not assume metropolitan coverage without consulting that Schedule.

12. Discrepancies between commercial categorisation and regulatory lists. Retailers often categorise themselves broadly (for example, “hardware and homewares”). The Tables’ fine‑grained approach means a mismatch between commercial branding and statutory classification can lead to regulatory exposure. Each product line must be considered against the Tables.

Identifying and addressing these gotchas requires careful cross-checking against the Tables in regulation 7 and regulation 11, timely administrative compliance for forms and notifications, and attention to external statutes referenced in the Regulations.

Compliance with these Regulations is largely administrative and product-definition focused. The following step‑by‑step checklist and practical notes derive from the Regulations’ text and the Schedule and should help a business or adviser put in place the actions the instrument requires.

1. Determine applicable geographic scope

• Check whether the premises are within the “metropolitan area” by consulting the Planning and Development Act 2005 Schedule 3, because regulation 4 adopts that definition. This matters if the Act or related policy differentiates between metropolitan and non‑metropolitan premises.

2. Decide whether to apply for a certificate and which one

• If the business seeks the status of a small retail shop or special retail shop under section 11(1) of the Act, prepare an application using the form approved by the chief executive officer. Regulation 6 governs small retail shop certificate applications and regulation 8(1) governs special retail shop certificate applications.
• For special retail shops, note that the certificate is Form No. 6 (regulation 8(2)). Use the currently prescribed Form No. 6 as reproduced in the Schedule or the department’s up-to-date version.

3. Map your product mix against the prescribed lists

• Carefully compare the business’s goods and services with Column 2 of the Table in regulation 7 for each candidate category. If your product mix fits wholly within a single category, note that category and include the mapping evidence in the application.
• If the business operates as a filling station, map inventory against the 28 itemised categories in regulation 11. Pay particular attention to the exclusion on fresh meat (only prepacked quantities not exceeding 500 g are permitted).
• If the business is a pharmacy, consult the Pharmacy Act 2010 to confirm permitted sales that the pharmacy status carries over into the Retail Trading Hours classification (regulation 7 Table item 3).

4. Use approved forms and submit timely

• Obtain the current approved forms from the administering department (the chief executive officer), and complete them accurately. The Regulations require the use of forms approved by the chief executive officer (regulations 6 and 8(1)).
• Ensure that Form No. 6 is correctly completed if applying for special retail shop certification, and that the application contains evidence of product categories, hotel classification (if relevant), or other qualifying details.

5. Prepare to meet ongoing administrative duties

• Record and monitor ownership, directorship and business nature changes. The operator must notify the chief executive officer within 14 days of any change (regulation 9). Establish an internal trigger and calendar process to ensure timely notification and avoid the $1,000 penalty.
• Prepare to display the certificate in a prominent, public-facing position within the retail shop as required by regulation 10. The Schedule reiterates display and notification obligations as conditions of the certificate.

6. Maintain accurate inventory and product documentation

• Keep contemporaneous inventory lists and supplier invoices that show the nature, volume and packaging of goods (for example, prepacked meat quantities for filling stations). These documents will be important to demonstrate compliance if an inspection or query arises.
• For composite stores with multiple product ranges, maintain a product category ledger that maps SKU lines to the Regulation 7 Table entries to demonstrate whether the store as configured qualifies for a single category, or whether certain product lines lie outside the prescribed lists.

7. Understand the chief executive officer’s role and engage early

• Where a shop’s qualification depends on the chief executive officer’s opinion (for example, hotel tourist shops item 11), seek pre-application engagement. Provide hotel classification evidence, amenity descriptions, and any relevant Ministerial classifications to support the CEO’s determination.
• For novel products or product categories not obviously captured by a Table entry, request written guidance or a preliminary decision from the department to reduce future risk.

8. Plan for filling station inventory design

• Filling stations should design retail offerings to fit strictly within the regulation 11 Table. Avoid introducing items that could be considered fresh meat beyond the 500 g cap, or other items clearly outside the Table, unless prepared to forego any Act-based claims.

9. Keep up to date with amendments and departmental practice

• The Regulations have been amended frequently. Practitioners should monitor the State Law Publisher, department website or Gazettes for amending regulations and revised forms. Do not rely on historic copies of forms or deleted schedules.
• Confirm with the department whether any guidance notes, administrative policies or registration procedures exist that further clarify application, inspection and enforcement practices.

10. Document compliance to prepare for disputes

• Retain copies of applications, certificates, display photographs, notification submissions and department correspondence in a compliance file. In the absence of an internal appeal mechanism set out in the Regulations, such records are the evidentiary basis for any administrative review or external legal challenge.

11. Check interlocking legislation where applicable

• If a business is a pharmacy, duty free shop, or provides other regulated services, consult the Pharmacy Act 2010, the Commonwealth Customs Act 1901 and other relevant statutes referenced in the Regulations to ensure that compliance is aligned across regimes.

12. Seek tailored advice for borderline cases

• Where a product mix straddles category borders, obtain legal advice and consider submitting a precatory application or written request for confirmation from the chief executive officer. Keep records of such requests and any departmental responses.

Following these steps will put an operator in a position to demonstrate compliance with the Regulations’ procedural and substantive prescriptions. The Regulations create relatively few direct penalties, but the operational risk of misclassification, or failing to meet the 14-day notification window and the display requirement, is real and avoidable with straightforward administrative systems.
