#### 16J Excess not payable 16J Excess not payable > > (1) This section applies where, in respect of a lease, the Secretary would, but for this section, be required to pay out an amount of money and that amount of money is in excess of the amount of money held on deposit by the Secretary in respect of the lease. > > > (2) The Secretary— > > > > > (a) must refuse to pay out the money, and > > > > > (b) must treat applications for payment out of the money as having been withdrawn, and > > > > > (c) must inform the applicants accordingly. > > > (3) This section has effect despite any other provision of this Part. > > **s 16J:** Ins 2005 No 90, Sch 1 \[22\].
