#### 18A Proceedings for offences 18A Proceedings for offences > > (1) Proceedings for offences against this Act are to be dealt with summarily before the Local Court. > > > (2) Despite subsection (1), an offence under section 8 (2A) or 9 (3) may be prosecuted on indictment. However, Chapter 5 of the [Criminal Procedure Act 1986](/view/html/inforce/current/act-1986-209) (which relates to the summary disposal of certain indictable offences unless an election is made by the prosecution to proceed on indictment) applies to and in respect of an offence under section 8 (2A) or 9 (3). > > **s 18A:** Ins 2002 No 131, Sch 1 \[17\].
