Restraint of Debtors Regulations 1986

The Regulations rely on two core procedural concepts: (1) the prevention of a debtor leaving the State by either summons/warrant; and (2) the preservation of assets by restraining orders over property. These concepts are operationalised through standardised forms and procedural steps designed to protect notice and to channel funds through court or departmental hands.

Preventing a debtor’s departure. The application for a warrant (Form 1) is made to a judicial officer in the Supreme or District Court or to a magistrate/justice, and asks that a warrant be issued preventing the debtor from leaving the State; the form requires an affidavit in support and an applicant undertaking to notify the court upon payment or security being provided (Reg 3; Form 1). If a warrant issues, Form 2 requires the person executing it to take the debtor to the nearest police station, requires the officer in charge to deal with the debtor under section 12 of the Act, and sets out conditions for release including tender, security, deposit or applicant consent (Reg 4; Form 2). A summons (Form 3) must warn the debtor that failure to appear may lead to arrest and must set out how appearance can be avoided (Reg 5; Form 3). The registry copy of a served summons must be endorsed to show personal service at least seven days before the appearance date, and to record that the summons was accompanied by the application and every affidavit in support (Reg 6).

Preserving assets. The Regulations provide a prescribed application form for restraining orders under section 17 (Form 8), enabling applicants to seek orders restraining transfer or removal from the State of specified property of the debtor (Reg 11; Form 8). Courts’ orders made under various sections are to be in Form 6, with appropriate alterations (Reg 9).

Money handling and custody. The Regulations set specific, immediate cash and custody flows. Money paid by or on behalf of debtors to police is to be paid forthwith to a registrar at the nearest Magistrates Court registry (Reg 12(1)); the registrar retains money in trust or transmits it to the relevant departmental officer (Reg 12(2)); and the registrar may pay or authorise payment to the appropriate party once satisfied and on production of required documents (Reg 12(3)). When a debtor tenders money or gives security prior to appearance or after a warrant but before execution, the applicant must notify the court or police as appropriate (Reg 7). When an officer in charge releases a debtor under section 13 of the Act the officer must notify the court by Form 5 (Reg 8).

Administrative and enforcement concepts. The Regulations make execution or attempted execution subject to the fee set in the Magistrates Court (Fees) Regulations 2005 (Reg 13). They also make noncompliance with any provision of the Regulations an offence carrying a $200 penalty (Reg 14). The Schedule provides the precise language for applications, warrants, summonses, notices, returns and orders, standardising practice and reducing drafting uncertainty, but also creating conformity costs.

Collectively the Regulations impose a set of notice, service, custody, registry and money flow requirements designed to operationalise the Act’s restraint mechanisms, while centralising certain decisions with judicial officers, registrars and officers in charge of police stations.

The Regulations allocate duties and create touchpoints for several distinct actors. The principal affected parties are:

• Applicants (creditors or their agents). They must prepare applications in the prescribed forms (Form 1 for a warrant application, Form 8 for a restraining order) and attach an affidavit in support (Regs 3, 11; Schedule). If a debtor tenders or gives security before the appearance time specified in a summons, the applicant must notify the court in Form 4 (Reg 7(1); Form 4). If a debtor tenders or gives security after a warrant is issued but before it has been executed, the applicant must notify in writing the officer in charge of the police station to whom the warrant was delivered (Reg 7(2)). The applicant undertakes in Form 1 to notify the court forthwith upon payment or provision of security. Applicants thus bear procedural burdens of drafting, service and notice, and are the concentrated beneficiaries of restraint powers where the forms operate to prevent a debtor from leaving the State or transferring property (Form 1; Form 8).

• Debtors. The debtor is the subject of summonses, warrants and restraining orders. A summons must tell the debtor that failure to attend may result in arrest, and must set out how appearance may be avoided (Reg 5; Form 3). The debtor may avoid custody by tendering the claimed sum, giving security acceptable to the applicant, or depositing the amount with the court to abide the determination (Form 3; Form 2). If arrested under a warrant, the debtor must be taken to the nearest police station and dealt with under section 12 of the Act (Reg 4). The Regulations therefore impose potential loss of liberty or restraint on debtors pending disposition or security.

• Judicial officers, magistrates and justices. These are the decision makers who receive Form 1 applications, issue warrants in the form of Form 2 and sign orders in the form of Form 6 and revocations in Form 7 (Regs 3-4, 9-10; Schedule). The courts receive notice from police on release (Form 5) and from applicants (Form 4), and may be asked to hear claims at the summons hearing even where jurisdiction would not otherwise lie, with both parties’ consent (Form 3). Judicial officers control whether a detained debtor is released or kept in custody, and they revoke or vary release orders (Form 7; Reg 10).

• Police officers and officers in charge of police stations. The warrant requires police executing it to take the debtor to the nearest police station and to serve the debtor with the warrant and, where relevant, copies of the application and supporting affidavits (Reg 4; Form 2). The officer in charge must cause the debtor to be dealt with under section 12 and, if the debtor is released under section 13, must notify the court by Form 5 (Reg 4, 8). Police must pay money received to a registrar forthwith (Reg 12(1)). Execution or attempted execution of a warrant carries the fee specified in the Magistrates Court (Fees) Regulations 2005 (Reg 13). Police therefore carry execution and notification duties and the immediate custody burden.

• Registrars and the court registry. Registrars receive money paid by police and must either retain it in a trust account or transmit it to the departmental officer principally assisting the Minister in administering the Act (Reg 12(2)). Registrars may, upon production of required documents and being satisfied, pay or authorise payment of the money to the appropriate party (Reg 12(3)). Registrars also receive the endorsed copy of the summons (Reg 6). The registry therefore acts as a custodian of funds and documentary evidence.

• The department principally assisting the Minister in the administration of the Act. While not prescribed in detail, Reg 12(2) contemplates that funds may be transmitted to the relevant officer of that department, creating an administrative pathway between court registries and the executive administration.

• Courts in which proceedings might be brought. Form 8 permits the applicant to choose a court where proceedings have been commenced or a court in which proceedings might be commenced (Reg 11; Form 8). Thus Supreme, District and Magistrates courts are implicated.

Secondary affected parties include respondents to proceedings whose property might be restrained and legal representatives who must prepare prescribed documents. The Regulations create specific, actionable duties for applicants, police, registrars and courts and assign costs and procedural obligations to those parties. The concentrated party that stands to gain directly from restraint is the applicant; the immediate burden of custody and compliance is concentrated on the debtor and on police and registrars as administrative actors.

The Regulations convert statutory sections into discrete duties, rights and prescribed procedural steps. Key duties and conditional rights follow from the text.

Applicant duties

• Use prescribed forms for applications and attach affidavits: Applications for warrants must be in Form 1 (Reg 3; Form 1) and applications for restraining orders in Form 8 (Reg 11; Form 8). Applicants must supply affidavits in support as required by the forms and the Act. Form 1 requires the applicant to undertake to notify the court forthwith upon payment or provision of security for the claim.

• Notify courts and police on tender or security: If the debtor tenders or gives security before the appearance time specified in the summons, the applicant must give notice to the court in the form of Form 4 (Reg 7(1); Form 4). If a debtor tenders or gives security for the amount specified in an unexecuted warrant, the applicant must give written notice to the officer in charge of the police station to whom the warrant was delivered (Reg 7(2)).

• Pay the fee for execution or attempted execution: The fee is fixed by reference to the Magistrates Court (Fees) Regulations 2005 Schedule 1 Division 3 item 3(b) (Reg 13).

Police duties and debtor rights on arrest

• Execution and custody: Where a warrant issues under section 6, the warrant must require that the person executing it take the debtor forthwith to the nearest police station (Reg 4; Form 2). The warrant also requires the officer in charge of the police station to cause the debtor to be dealt with in accordance with section 12 of the Act (Reg 4).

• Service of documents: The executing officer must serve the debtor with a copy of the warrant and, where the warrant was issued under section 6 or 7, a copy of the application on which the warrant was issued and any further affidavit in support (Form 2).

• Conditions for release set out in the warrant: The warrant must set out conditions on which the debtor may be released, which are enumerated in Form 2. The debtor is entitled to be released if he tenders the claimed amount in a form acceptable to the applicant, gives security to the applicant’s satisfaction, pays to the officer in charge for deposit with the court the claimed amount to abide the determination, the applicant consents in writing to release, or a court directs release (Reg 4; Form 2).

Registrar duties and funds rights

• Immediate custody of money: Money received by a police officer must be paid forthwith to a registrar at the nearest Magistrates Court registry (Reg 12(1)).

• Trust retention or transmission: The registrar must retain that money in a trust account or transmit it to the relevant officer of the department principally assisting the Minister in the administration of the Act (Reg 12(2)).

• Disbursement upon satisfaction: The registrar, upon production of necessary documents and orders and being satisfied that payment is proper, may pay or authorise the departmental officer to pay the money to the appropriate party (Reg 12(3)).

Court duties and powers

• Endorsement on registry copy of summons: The copy of a summons lodged in the registry must be endorsed to the effect that it was personally served at least seven days before the date of appearance and that it was accompanied by a copy of the application and every affidavit in support (Reg 6).

• Forms for orders and revocations: Orders under sections 14, 16, 18, 19, 20 or 22 may be in Form 6, and revoked orders may be in Form 7 (Regs 9-10; Forms 6-7).

Debtor rights and procedural protections

• Avoiding attendance: The summons (Form 3) lists three methods by which the debtor is not required to appear: tendering the specified amount to the applicant in an acceptable form, giving security to the satisfaction of the applicant, or depositing the amount with the court to abide the determination. The summons must advise the debtor that failure to attend may result in a warrant (Reg 5; Form 3).

• Court may hear the claim with consent: The summons advises that at the hearing the court may, with the debtor’s and applicant’s consent, hear and determine the claim even if it otherwise lacks jurisdiction, or decline to hear it or make an order for costs (Form 3). This provides a procedural right for parties to resolve the claim at the summons hearing by consent.

Penalties and administrative duties

• Offence for noncompliance: A person who contravenes or fails to comply with any of the Regulations commits an offence punishable by $200 (Reg 14). This is a general compliance penalty intended to secure adherence to the procedural requirements.

The Regulations thus distribute duties across applicants, police, registrars and courts while explicitly preserving certain debtor choices to avoid custody. Rights to be freed from detention are tied to tender, security, deposit, applicant consent or court direction as established in the warrant and the summons (Form 2, Form 3). The combination of standard forms and specified notice obligations is designed to reduce dispute about the steps taken and to create a traceable paper trail for enforcement and release decisions.

Enforcement under the Regulations is primarily procedural and administrative rather than penal in the criminal sense. The Regulations contain a single expressly stated offence provision and otherwise establish enforcement through court and police powers under the Act.

Statutory offence and penalty

• The Regulations make contravention of any regulation an offence punishable by a monetary penalty of $200 (Reg 14). The wording is broad: "A person who contravenes or fails to comply with any of these regulations, commits an offence. Penalty: $200." The provision attaches a relatively modest fixed financial sanction to noncompliance with form, notice and registry requirements, rather than prescribing imprisonment or larger fines.

Policing and custody enforcement

• Warrants and arrest are enforced by police under the Act as operationalised by the Regulations. A warrant issued in accordance with section 6 must be in the form of Form 2 and must require the person executing the warrant to take the debtor to the nearest police station and to serve the debtor with a copy of the warrant and relevant documents (Reg 4; Form 2). The officer in charge of the police station then has the duty to cause the debtor to be dealt with in accordance with section 12 of the Act (Reg 4). The Regulations therefore place the active enforcement of restraint powers in the hands of police, who are required to lodge detainees, serve documents and notify courts upon release (Reg 8; Form 5).

Court supervision and release

• Courts receive endorsed summonses and are the primary decision makers on orders for release, continued detention, revocation and restraining orders. Orders under sections 14, 16, 18, 19, 20 or 22 may be in Form 6 (Reg 9). Where a court has issued an order releasing a debtor that is later revoked, the revocation is to be in the form of Form 7 and the officer in charge of the police station is to hold the debtor in custody until the debtor can be taken before the court again (Reg 10; Form 7). This creates a judicially supervised enforcement mechanism: courts issue the key detention and release directions, and police implement them.

Money handling and registry enforcement

• Money paid by or on behalf of a debtor is to be paid by police forthwith to a registrar who must retain it in trust or transmit it to the relevant departmental officer (Reg 12). The registrar may disburse money only upon production of required documents and being satisfied that payment is proper (Reg 12(3)). This creates a custodial money trail intended to ensure that funds are handled under court registry or departmental oversight, reducing the risk of misapplication.

Administrative fee enforcement

• The Regulations fix the fee for execution or attempted execution of a warrant by cross reference to the Magistrates Court (Fees) Regulations 2005 Schedule 1 Division 3 item 3(b) (Reg 13). Charging an execution fee assigns a direct administrative cost to warrant activity and creates an enforcement point through fee collection.

Practical enforcement picture

• Enforcement is carried out through a mix of police action (executing warrants, custody, service and notification), court authority over orders and registrars' control over funds. The only express criminal sanction is the $200 penalty for breaching the Regulations, indicating that the drafters intended the Regulations mainly as procedural prescription rather than to expand criminal liability. A failure by an applicant or officer to comply with notice and endorsement obligations may attract the modest penalty, but the principal enforcement consequences are operational: detention, release conditions, registry handling of money, and judicial orders including revocation and restraining orders.

The Regulations are expressly framed as subordinate to the Restraint of Debtors Act 1984 and operate in conjunction with a small number of other legal instruments referred to in the text. The interaction is procedural and administrative.

Reference to the parent Act

• The Regulations repeatedly refer to sections of the Restraint of Debtors Act 1984, using the defined term "section" to mean a section of the Act (Reg 2A). Many of the Regulations' forms and duties cross‑reference the Act: applications for warrants are made under sections 5 and 7 (Form 1; Reg 3), warrants issued under section 6 must follow Form 2 (Reg 4; Form 2), summonses are issued under section 6 and follow Form 3 (Reg 5; Form 3), restraining orders are under section 17 and use Form 8 (Reg 11; Form 8), and the officer in charge of a police station releases a debtor under section 13 and must notify the court (Reg 8). The Regulations therefore function as a procedural layer that gives effect to specific Act powers.

Interaction with Magistrates Court fees rules

• Execution or attempted execution of a warrant attracts the fee set in the Magistrates Court (Fees) Regulations 2005 Schedule 1 Division 3 item 3(b) (Reg 13). This is the only explicit cross-reference to another statutory instrument with substantive financial effect in the Regulations. The fee reference means costs of enforcement are connected to existing Magistrates Court fee structures and subject to their amendment.

Registry, trust accounts and executive administration

• Reg 12(2) permits the registrar to retain money in a trust account or transmit it to the relevant officer of the department principally assisting the Minister in the administration of the Act. The provision therefore interfaces court registry financial administration with departmental administration. The identity and powers of the "relevant officer" are not set out here; the Regulations make a procedural linkage rather than specifying the operational role of the department beyond transmission or receipt of funds.

Courts and jurisdictional interaction

• Form 1 contemplates filing in the Supreme or District Court or before a magistrate/justice, giving applicants the option of the appropriate court. Form 8 allows an application for a restraining order either in the court where proceedings in respect of the alleged debt have been commenced or in any court in which proceedings might be commenced (Reg 11; Form 8). Form 3 explicitly notifies a debtor that, with the parties' consent, the court may hear and determine the claim at the summons hearing even where it otherwise lacks jurisdiction (Form 3). These provisions allow procedural interaction between the Restraint of Debtors framework and normal civil jurisdiction rules by permitting voluntary submission or transfer of issues for resolution at the summons stage.

Police powers and general policing law

• The Regulations place execution duties on police officers and require persons executing warrants to take debtors to the nearest police station and serve relevant documents (Reg 4; Form 2). The role of police under these Regulations sits alongside, and must be exercised consistently with, the wider powers and obligations of police under general criminal and custodial law, although those wider frameworks are not reproduced or altered by these Regulations.

Administrative law and appeals

• The Regulations do not create express appeal routes or procedural judicial review mechanics. Judicial decisions under the Act and implemented by these Regulations will therefore be subject to the ordinary avenues for appeal and review that apply to the courts and to administrative decision-making, but the Regulations themselves do not alter appellate jurisdiction.

In short, the Regulations operate as a procedural adjunct to the Restraint of Debtors Act 1984 and cross over into existing Magistrates Court fee regimes and the administrative interfaces between court registries and the Department assisting the Minister. They assume the existence of the Act’s substantive restraints and the broader bodies of police, court and financial administration law in which those procedural rules will sit.

The Regulations include a recorded amendment history in the compilation table and show targeted amendments to insert or update specific provisions. The amendment history as presented in the Notes is the primary source for tracing the Regulations’ changes.

Key amendments and reprints

• Original gazettal and commencement: The Restraint of Debtors Regulations 1986 were gazetted on 4 July 1986 at pages 2286-2290 and commenced 11 July 1986 (see r. 2 and Gazette 11 Jul 1986 p. 2333). This is the original instrument establishing the forms and procedures.

• Amendment 1998: Restraint of Debtors Amendment Regulations 1998 were gazetted on 28 August 1998 at pages 4756-4757 and commenced on 28 September 1998 (see r. 2 and Gazette 28 Aug 1998 p. 4754). The compilation table notes this amendment, though the Regulations as presented here do not identify the textual changes effected in that 1998 instrument beyond inclusion in the reprint.

• Reprint: A reprint of the Regulations as at 12 December 2003 is recorded, which includes the amendments listed above up to that date.

• Amendment 2005: Restraint of Debtors Amendment Regulations 2005 were gazetted on 28 April 2005 at pages 1766-1767 and commenced 1 May 2005 (see r. 2 and Gazette 31 Dec 2004 p. 7128). The Regulations document that Regulation 2A was inserted (see Reg 2A: "Term used in these regulations" defining "section") and that other parts were amended as recorded in the text notes. Several regulations show the annotation "[Regulation X amended: Gazette 28 Apr 2005 p. 1766]" indicating specific changes implemented at that time, notably Regs 2A, 8 and 9.

• Amendment 2007: Restraint of Debtors Amendment Regulations 2007 were gazetted on 31 July 2007 at pages 3803-3804. The commencement entries show r. 1 and 2 commenced 31 July 2007; the remaining regulations commenced 1 August 2007. The text contains annotations "[Regulation X amended: Gazette 31 Jul 2007 p. 3803‑4]" at Regs 12 and 13 and under Forms 4 and 5 reflecting these amendments. Reg 12 was amended to clarify the duty to transmit money to the departmental officer and the registrar's role in payments, with the amendment noted in the printed regulation.

What the annotations show

• The insertion of Reg 2A in 2005 provides a defined term "section" for the Regulations, clarifying internal cross‑references to sections of the Act. This is an internal drafting refinement to reduce ambiguity in cross‑references.

• The 2007 amendments, which adjust money-handling duties, and the specific amendments to Forms 4 and 5 in 2007 (Gazette 31 Jul 2007 p. 3804) indicate an administrative update to the procedure for notice and return on release and for transmission and disbursement of funds.

What the compilation table does not show

• The compilation table lists the instruments, gazettal pages and commencement dates. It does not, by itself, summarise the policy reasons for the amendments or the detailed text changes effected by each amending regulation. Where the Regulations annotate particular provisions as amended, those annotations are the direct evidence of the parts altered.

Practical effect of amendments

• The recorded amendments indicate iterative refinement in the Regulations’ administrative mechanisms , for example, clarifying the registrar’s role in handling funds and the insertion of a defined term. The cross‑reference to the Magistrates Court (Fees) Regulations 2005 (in Reg 13) post‑dates those fee rules and ties execution fees to the wider Magistrates Court fee framework as it may be reissued or updated.

The compilation table and the annotations in the text are the authoritative record within the Regulations of their amendment history. The Regulations’ structure and the Schedule forms reflect these amendments and the ongoing administrative relationship between courts, police and the department assisting the Minister.

The Restraint of Debtors Regulations 1986 themselves contain no reported litigation history, and the Regulations’ Schedule and notes do not cite any cases. The text lists only statutory instruments, amendment dates and reprint information. Accordingly, within the material provided:

• There are no cases named in the Regulations or the Schedule to indicate judicial interpretation or appellate consideration of these procedural provisions.

• The compilation table and notes record amendments and reprints but do not include citations to judicial decisions or published reasons that construe particular regulatory clauses or the forms (Notes, Compilation table).

What the absence of litigation citations implies for practitioners

• Practitioners should not infer settled judicial doctrine from the Regulations themselves. Where the Regulations cross‑refer to sections of the Restraint of Debtors Act 1984, the substantive and interpretive questions about the scope of detention, the Act’s compatibility with other legal rights, or the scope of restraining orders will depend on case law under the Act and related statutory and common law frameworks. That case law is not reproduced in these Regulations.

• Because Form 3 explicitly contemplates a court hearing and determining the claim by the parties’ consent "whether it otherwise has jurisdiction or not" (Form 3), potential jurisdictional and procedural disputes may arise and have in other contexts been the subject of litigation. No such decisions are recorded here.

Recommended practitioner approach given the lack of litigation history in the Regulations

• Treat the Regulations as procedural rules that must be complied with in form and timing. Where questions about the Act’s substantive powers arise, practitioners should research case law under the Restraint of Debtors Act 1984 and related jurisprudence on arrest for civil debt, judicial oversight, and custody to determine the current positions of courts. The Regulations provide forms and prescribed steps; their legal effect in contested situations will depend on judicial interpretation of the Act and how courts apply the Regulations in practice.

• Where unfamiliar or potentially contentious uses of restraint are contemplated, consider seeking judicial guidance in the relevant court, or arrange for interlocutory directions, because the Regulations themselves do not provide precedent or guidance arising from litigation.

In sum, the available text of the Regulations records no litigation history; practitioners must therefore consult external case law and judicial decisions concerning the Act to understand how courts have interpreted or applied these procedural rules in contested matters.

The Regulations standardise procedure but also contain several specific technical requirements and potential procedural traps that can have real consequences if overlooked. The following are concrete "gotchas" grounded in the text.

Service and endorsement timing

• Personal service and minimum notice period: The copy of a summons lodged in the registry must be endorsed to show that the summons was served personally on the debtor on a specified date being not less than seven days before the day he is summoned to appear (Reg 6(a)). Failure to ensure personal service at least seven days before the hearing date, or failure to lodge an endorsed copy evidencing that service, could undermine the procedural validity of any warrant issued subsequently and expose the applicant to difficulties at the hearing.

• Accompanying documents requirement: The endorsed summons must also record that it was accompanied by a copy of the application upon which the summons was issued and every affidavit in support (Reg 6(b)). If supporting affidavits or the application are not served with the summons, the endorsement will be defective and may be relied on by the debtor.

Warrant execution and service by police

• Duty to take debtor to nearest police station and to serve copies: A warrant (Form 2) requires the person executing it to take the debtor to the nearest police station and to serve the debtor with a copy of the warrant and, where the warrant was issued under section 6 or 7, a copy of the application and any further affidavit in support (Reg 4; Form 2). If the executing officer fails to serve the supporting documents, the debtor may not have been fully informed of the basis for detention, potentially giving rise to procedural challenge and complaints.

Release conditions contained in the warrant

• Warrant must set out conditions for release: Reg 4 requires the warrant to set out the conditions of release; Form 2 lists various grounds on which the debtor shall be forthwith released, including tender to the applicant, security to the applicant’s satisfaction, deposit with the court, written consent by the applicant, or a court direction (Reg 4; Form 2). An applicant that does not make clear the acceptable forms of tender or security may find the debtor tendering an offer the applicant wrongly rejects, with attendant delay and potentially costs.

Registry handling of money

• Immediate transmission to registry: Money received by police must be paid forthwith to a registrar at the nearest Magistrates Court (Reg 12(1)). If police hold funds at the station beyond that point, they may be failing a clear regulatory duty.

• Registrar control and documentation: The registrar may pay or authorise payment only upon production of "such documents and orders as may be required" and being satisfied that payment is proper (Reg 12(3)). Applicants and debtors should anticipate documentary proof and potentially court orders to trigger disbursement; informal or incomplete documentation will not be sufficient.

Applicant notice obligations

• Mandatory notifications on tender or security: If the debtor tenders or gives security before appearance, the applicant must notify the court in Form 4 (Reg 7(1)). If the debtor tenders or gives security for the amount in an unexecuted warrant, the applicant must notify the officer in charge of the police station to which the warrant was delivered (Reg 7(2)). Failure to give these notices can leave police holding a warrant that ought to be rendered unnecessary, or court records incomplete.

Summons hearing jurisdictional caveat

• Consent to hearing and jurisdictional waiver: Form 3 advises that the court may, with the consent of the debtor and applicant, hear and determine the claim whether it otherwise has jurisdiction or not. That is a significant procedural instrument that can result in parties consenting to have a claim heard in a court that may otherwise lack jurisdiction. Practitioners must ensure the parties’ consent is informed and recorded, particularly where jurisdictional issues could have longer term consequences for enforcement or appeal.

Fee reference trap

• Cross‑reference to external fee rules: Reg 13 sets the execution or attempted execution fee by reference to the Magistrates Court (Fees) Regulations 2005 Schedule 1 Division 3 item 3(b). Practitioners must consult that separate instrument to know the fee amount. Relying solely on Reg 13 without checking the current Magistrates Court fee regulations risks underpayment or oversights.

Form deletion and accuracy

• Forms require deletion of irrelevant options: Several forms (e.g., Form 1, Form 4, Form 5, Form 8) instruct the drafter to delete options that are not applicable. Failure to delete or to tailor forms appropriately may create ambiguity or administrative irregularity.

Registrar’s dual pathways

• Trust account or transmission to department: Reg 12(2) allows registrars to either retain funds in trust or transmit them to the relevant departmental officer. The Regulations do not specify criteria for choosing one pathway over the other. Practitioners should make early enquiries about local registry practice to avoid delays or misrouting of funds.

Penalty modesty and compliance expectations

• Low monetary penalty: The penalty for breaching the Regulations is $200 (Reg 14). The penalty level may understate the practical consequences of noncompliance, which include detention, inability to obtain funds, or wasted court time. Do not treat the $200 as the sole sanction; procedural defects can have consequential costs.

In short, strict adherence to the forms, timing for personal service, endorsement requirements, mandatory notices by applicants, immediate transmission of funds to the registrar and careful handling of the surrender or provision of security are all operationally critical. Overlooking any of these points can convert what should be a routine enforcement step into contested litigation or administrative delay.

Compliance is a matter of process discipline: use the prescribed forms, meet the timing and service requirements, observe the money‑handling path, and document notices. Below is a practical, stepwise compliance checklist drawn from the Regulations.

1. Decide the correct court and complete the appropriate application form

• For a warrant to prevent a debtor leaving the State, complete Form 1 and attach the supporting affidavit as required by the Act (Reg 3; Form 1). Ensure the correct box is selected for the judicial officer to which the application is addressed (Supreme/District Court or magistrate/justice) and that the applicant undertakes to notify the court on payment or security as required by Form 1.

• For a restraining order under section 17, complete Form 8 and attach the supporting affidavit (Reg 11; Form 8). Identify the property precisely and indicate whether the order sought is to restrain transfer or removal from the State.

2. Ensure service and endorsement requirements are followed

• Serve the summons personally on the debtor at least seven days before the date they are summoned to appear. The registry copy must be endorsed to show personal service on a specified date not less than seven days before appearance, and to confirm the summons was accompanied by the application and every affidavit in support (Reg 6). Keep a clear proof of personal service.

• When delivering documents to police for execution of a warrant, include a copy of the application and every affidavit in support so that police can serve them with the warrant (Reg 4; Form 2).

3. Use the prescribed forms for warrants, summonses, notices and returns

• Warrant: Use Form 2; ensure it sets out the conditions for release, names the specified court, and is executed and endorsed properly when used (Reg 4; Form 2).

• Summons: Use Form 3; ensure the place, date and time of attendance are accurately filled, and that the summons sets out the methods by which appearance may be avoided (Reg 5; Form 3).

• Notice when debtor tenders or gives security: If a debtor tenders payment before the hearing, lodge Form 4 with the court specified in the summons (Reg 7(1); Form 4). If the tender occurs after a warrant is issued but before execution, give written notice to the officer in charge of the police station to which the warrant was delivered (Reg 7(2)).

• Return on release: The officer in charge must use Form 5 to notify the court when a debtor is released from custody under section 13; ensure Form 5 is completed and transmitted promptly (Reg 8; Form 5).

4. Handle money exactly as required

• Police must pay any money received forthwith to a registrar at the nearest Magistrates Court registry (Reg 12(1)). Do not allow police to hold funds at the station for extended periods.

• Registrars must either retain money in a trust account or transmit funds to the relevant departmental officer (Reg 12(2)). Confirm the registry’s local practice on whether funds will be retained in trust or sent to the department and what documentation will be required for release.

• For disbursement of funds, the registrar will require production of the necessary documents and orders and must be satisfied it is proper to pay (Reg 12(3)). Anticipate needing certified orders and identity and entitlement documents for disbursement.

5. Pay the execution fee

• Ensure the fee for execution or attempted execution is paid in accordance with the Magistrates Court (Fees) Regulations 2005 Schedule 1 Division 3 item 3(b) (Reg 13). Check the current Magistrates Court fee instrument for the applicable amount and payment method.

6. Prepare for court hearing and consent options

• At the summons hearing, if both parties consent the court may hear and determine the claim whether it otherwise has jurisdiction or not (Form 3). Ensure any consent is informed and recorded in writing on the court file if the parties wish to resolve the underlying claim promptly.

7. Keep documentary proof and delete inapplicable options

• Several forms require deletion of inapplicable options and detailed signatures. Complete forms accurately and delete options not in point. Keep copies of all filed documents, endorsements of service, proofs of payment and notices sent to police and the court.

8. Observe notification duties promptly

• If the debtor tenders or gives security and you are the applicant, notify the court or the officer in charge as required (Reg 7). If you are the officer releasing a debtor, provide Form 5 to the court promptly (Reg 8). Timely notices prevent unnecessary further enforcement.

9. Understand the registrar’s discretionary role

• The registrar’s ability to pay money to the "appropriate party" is discretionary in being conditional on production of documents and being "satisfied" that payment is proper (Reg 12(3)). Plan for required documentation and be prepared for the registrar to ask for supporting orders or affidavits.

10. Avoid procedural breaches

• Noncompliance with any regulation attracts an offence penalty of $200 (Reg 14). Although the monetary penalty is modest, procedural breaches can invite delay, contested litigation, or reputational consequences. Strict adherence to the prescribed steps minimises such risks.

Following this checklist aligns operational practice with the explicit duties and forms in the Regulations. Additional local practices at particular registries or police stations may be relevant; practitioners should confirm local registry practice for trust account handling and any departmental protocols for transmitted funds.
