sec.67 CEO may disclose information to particular entities

The CEO may disclose anything that comes to the CEO’s knowledge under this Act or a Resources Safety Act to a prescribed entity if the CEO is satisfied the disclosure would assist in the performance of the prescribed entity’s functions under an Act or another law. Subsection (1) applies despite section 66 and the prescribed confidentiality provisions. In this section— prescribed confidentiality provision means— the Coal Mining Safety and Health Act 1999 , section 275A ; or the Explosives Act 1999 , section 132 ; or the Mining and Quarrying Safety and Health Act 1999 , section 255 . prescribed entity means— the chief executive of a department in which a Resource Act is administered; or the chief executive of a department or another entity responsible for administering a law of the Commonwealth or a State about safety and health; or the WHS prosecutor; or the director of public prosecutions.
