39 Rent in advance (1) The landlord must not require the payment of more than one rental payment period's rent under a tenancy agreement before the end of the first rental payment period of the tenancy. (2) If rent has been paid under a tenancy agreement, the landlord must not require from the tenant a further payment of rent until the end of the last rental period for which rent has been paid. (3) A landlord must not require another person to give a post-dated cheque or other post-dated negotiable instrument in payment of rent under a tenancy agreement.
