28 Condition report conclusive of condition at start of tenancy (1) This section applies if a condition report is or is to be taken to have been accepted under this Division by a landlord and a tenant unless the Tribunal determines otherwise in a particular case. (2) If the condition report relates to the start of a tenancy to which a tenancy agreement relates, the report is conclusive evidence of the condition of the premises and of the provision of, and the condition of, any ancillary property referred to in the condition report at the start of the tenancy. (3) If the condition report relates to the start of a continuation of a tenancy to which a tenancy agreement relates, the report is conclusive evidence of the condition of the premises and of the provision of, and the condition of, any ancillary property referred to in the condition report at the start of the continuation.
