161 Dispute resolution and appeals to take place under this Act (1) Subject to this Part, Part 14 of this Act applies to and in relation to a lease that was in force immediately before the commencement day as if a reference in Part 14 to a tenancy agreement were a reference to a lease and a reference in that Part to a tenant or a landlord were a reference to a lessee or a lessor respectively. (2) If after the commencement day a matter relating to the reimbursement of a security deposit in relation to a lease is referred to the Commissioner under section 39(6) of the Tenancy Act, the matter is to be dealt with by the Commissioner as if it were an application under section 126 of this Act, except that the Commissioner may only make an order of the kind specified in section 39(8) of the Tenancy Act. (3) Subject to this Part: (a) Part 15 of this Act applies to an order, determination, decision or variation made by the Commissioner under the Tenancy Act before or after the commencement day as if a reference to a tenant or a landlord were a reference to a lessee or a lessor respectively; and (b) Part III of the Tenancy Act does not apply in relation to the order, determination, decision or variation.
