46 False or misleading statements
On application by a tenant, the ACAT may terminate a residential
tenancy agreement if satisfied that the agreement was induced by a
false or misleading statement of the lessor.
46AA Termination of agreement for failure to comply with
minimum housing standards
(1) On application by a tenant, the ACAT may terminate a residential
tenancy agreement if satisfied that the lessor has failed to comply with
section 19B (Lessor’s obligations about minimum housing
standards).
(2) However, the ACAT may refuse to terminate the agreement under
subsection (1) if the tenant has failed to provide the lessor with
reasonable access in accordance with clause 82 of the standard
residential tenancy terms.
