40 Content of warrant
(1) A warrant issued under this part must—
(a) authorise any police officer to take appropriate action, with any
necessary and reasonable assistance, to evict a named person, or
a named person and everyone else on the premises, within the
period stated in the warrant; and
(b) require a police officer to give the named person not less than 2
days notice of the proposed eviction.
(2) Subsection (1) (b) does not apply if the registrar believes on
reasonable grounds that—
(a) there are exceptional circumstances; and
(b) it would be inappropriate to give the notice required by
subsection (1) (b).
(3) A regulation may prescribe what is, or is not, appropriate action to be
taken under a warrant.
