#### 71 Application following failed mediation 71 Application following failed mediation > > (1) One or more affected home owners may apply to the Tribunal for an order under section 73 if— > > > > > (a) the home owners object to the increase in site fees, and > > > > > (b) an application for mediation of the objection was made in accordance with section 69, and > > > > > (c) mediation was unsuccessful. > > > (2) The application must be made on behalf of all the affected home owners (other than those who opt out of the application) by one or more of them appointed as the representative or representatives by the participating home owners. > > > (3) The application must be made within 14 days after the date on which the mediation failed. > > > (4) The application must be accompanied by a notice from the mediator stating mediation failed on the date specified by the mediator.
