What it does
These Regulations operationalise a small set of technical rules and administrative amounts tied to the Residential Building Work Contracts and Dispute Resolution Act 2016 (the Act). They do four discrete things.
First, they establish commencement mechanics. Regulation 2 provides that the Regulations commence on the same day as the Act. Regulation 3 defines the shorthand term Act to mean the Residential Building Work Contracts and Dispute Resolution Act 2016 for all cross-references in the Regulations.
Second, they narrow and expand the definition of what counts as a residential building for the Act’s purposes. Regulation 4 identifies two classes of buildings that are expressly not residential buildings for the purposes of section 5(2)(i) of the Act: (a) buildings comprising three or more separate places of residence situated directly one above the other, and (b) buildings designed to house more than 12 persons who are not members of the same family. Regulation 5 specifies three things that are taken to be part of a residential building under section 5(4)(b) of the Act: solar panels, satellite dishes, and rooftop wind turbines.
Third, the Regulations set two monetary parameters. Regulation 6 fixes the “set amount” used in paragraph (a) of the definition of set amount in section 41(1) of the Act at $50,000. Regulation 7 prescribes the adjudication application fee, for the purposes of section 62(4)(e) of the Act, as 208 fee units, inclusive of GST. The text records that regulation 7 was amended by No. 39 of 2018, s. 72, applied 17 December 2018.
Fourth, the Regulations prescribe which contraventions of the Act may be dealt with by infringement notice and assign the penalty amount applicable to each such prescribed offence. Regulation 8 declares that offences against the Act provisions listed in column 2 of Schedule 1 are prescribed offences for the purposes of section 80 of the Act, and that the penalty specified in column 4 of Schedule 1 applies if the offence is committed by a body corporate and the column 5 figure applies if the offence is committed by an individual. Schedule 1 then lists 19 items pairing Act sections (with a brief description) and numeric penalties for bodies corporate and individuals. The Schedule carries an amendment note showing it was amended by No. 39 of 2018, s. 73, applied 17 December 2018. The Regulations were notified in the Gazette on 2 November 2016.
