Reserve (Port Denison Suburban Lots 6 and 6A) Act 1980

The Act operates with a small set of legal concepts and instruments drawn from property and Crown land law as stated in the text.

• Reserve cancellation and reservation. The Act cancels an historical reserve (Reserve No. 269) by express statute (s 2) and then creates a new reservation by reserving the revested land for “Site for Temperance Institution” (s 3). The statutory reservation follows immediately on revesting and carries a declared intended disposition to a named body.

• Revesting in Her Majesty. Section 3 revests specified Torrens parcels “in Her Majesty as of Her former estate” and removes them from the operation of the Transfer of Land Act 1893. Revesting is the statutory act of returning proprietary rights to the Crown; the express removal from the Transfer of Land Act alters the statutory registration and dispositions regime that would otherwise apply under the Torrens system.

• Removal from the Transfer of Land Act 1893. By taking the parcels outside the Act that governs the Torrens title system, the statute changes the legal framework for subsequent dealings, including how title is evidenced, how dealings are registered, and which statutory remedies and protections apply. The preamble explicitly says removal is “to enable a Crown Grant” to the listed association (preamble (i)).

• Crown Grant in fee simple, in trust. The text states an intention that the revested land “shall be conveyed by way of Crown Grant in fee simple to the West Australian Temperance Alliance Incorporated, in trust for the aforesaid purpose” (s 3). A Crown Grant in fee simple is a transfer of proprietary title from the Crown; the Act contemplates the conveyance will be subject to an express trust for the temperance institution purpose.

• Reservation cancellation and disposals under the Land Act. Section 4(1) allows the association to apply under section 37 of the Land Act 1933 for cancellation of the reserve created by s 3. Section 4(2) then sets out which dispositions the association may undertake if the reserve is cancelled and places an approval hurdle on sale, exchange or mortgage (Governor in Council consent).

• Institutional continuity and vesting facts. The preamble (paragraphs (a)-(i)) records the historical chain: prior grants under 1870s Land Regulations to named trustees for a Good Templars lodge, registration under the Transfer of Land Act 1874, deaths of the named trustees, loss of duplicate certificates, absence of surviving trustee appointments, and the existence and incorporation history of the West Australian Temperance Alliance Incorporated. These facts are the factual foundation the legislature used to justify revesting and disposition.

Each of those concepts alters who holds legal title, which statutory regime governs dealings and registration, and what approvals are required for future encumbrances or dispositions, with cross‑references to other statutory regimes (the Transfer of Land Act 1893 and the Land Act 1933).

The Act identifies and directly affects a narrow set of legal persons and interests.

• The Crown. Section 3 revests the specified parcels in Her Majesty as of Her former estate; therefore the Crown becomes the owner of the parcels immediately upon revesting. The Crown, through the Minister for Lands and Governor in Council, is the controlling decision‑maker for subsequent approvals, including the intended Crown Grant and any later consent required under s 4(2).

• West Australian Temperance Alliance Incorporated. The Act specifically names the association as the intended beneficiary of a Crown Grant in fee simple to be held in trust for a temperance institution (s 3; preamble (h), (i)). The association is therefore the primary private recipient. Section 4(1) expressly permits that association to apply to the Minister for Lands under s 37 of the Land Act 1933 for cancellation of the new reserve, and s 4(2) sets out the association’s powers to deal with the land if such cancellation occurs, subject to Governor in Council consent for sale/exchange/mortgage.

• Former trustees and persons with historical interests. The Act records that earlier grants named trustees Samuel F. Moore and Henry F. Waldeck, and that those persons died long ago and no successor trustees were appointed (preamble (f)). The legislative revesting proceeds on the basis that no other proprietor has been registered since those deaths and no link can be established between the defunct Good Templars society and any surviving institution (preamble (g)). Any person asserting proprietary or equitable rights traceable to the historical grants would be affected because the statutory revesting and reserve cancellation effectively nullify the existing Torrens certificates’ private operation for these parcels.

• Department/registries and land information authority. The Act removes the parcels from the operation of the Transfer of Land Act 1893 (s 3), which changes how the Department of Lands and related registries administer the parcels. Note 2 in the compilation records that documents formerly registered in the Department of Lands and Surveys are now held by the Western Australian Land Information Authority (see Land Information Authority Act 2006 s 100). Administrative agencies therefore require records handling and conveyancing actions to implement the revesting and any later Crown Grant.

• Potential future purchasers, mortgagees and lessees. The statutory constraints in s 4(2) mean that third parties wishing to acquire, mortgage or take other proprietary interests in the land after a reserve cancellation will be bound by the requirement for Governor in Council consent and by any conditions imposed by that consent. Because the land is removed from the Transfer of Land Act 1893, the standard Torrens title protections, registration procedures and priority rules do not automatically apply until and unless any Crown Grant conveys into the Torrens system.

The Act does not create new criminal liabilities or regulatory obligations for the public beyond altering ownership and disposal pathways; its primary effect is to reassign title and set out a constrained path for future dealings.

The Act is short and prescriptive; it creates few operational duties but it establishes specific rights and decision points.

• Duty to effect statutory cancellation. Under section 2 the legislature has cancelled Reserve No. 269. The administrative act of noting and publishing that cancellation in the appropriate government records will be an executive duty borne by the relevant land administration authority, although the Act does not prescribe operational steps or timelines for that administration.

• Revesting and reservation. Section 3 imposes a statutory legal effect , the land is “revested in Her Majesty as of Her former estate” and “shall be reserved for the purpose of ‘Site for Temperance Institution’”. That language creates the Crown’s duty to treat the land as Crown land so reserved. The Act also states an “intention” that the land shall be conveyed by Crown Grant in fee simple to the West Australian Temperance Alliance Incorporated in trust. The term “intention” in the operative text is a legislative expression of purpose that directs executive action towards effecting a Crown Grant, but the Act does not set out administrative mechanics or timeframes for completing the Crown Grant.

• Right of the incorporated association to seek reserve cancellation. Section 4(1) gives the West Australian Temperance Alliance Incorporated the explicit right to apply to the Minister for Lands under section 37 of the Land Act 1933 to cancel the reserve that s 3 creates. That is a statutory right to use an administrative procedure provided by the Land Act.

• Conditional right to deal with land after reserve cancellation. Section 4(2) grants the association a conditional right to sell, exchange, mortgage, or lease the land if the reserve is cancelled. However, this right is qualified: “no sale, exchange or mortgage of the said land shall be made without the consent of the Governor in Council and subject to such conditions as he may impose.” That provision places a decisive control point with the Governor in Council over major proprietary dispositions.

• Administrative coordination duty. The preamble notes loss of duplicate certificates and absence of registered successors (preamble (f)-(g)). Those facts will impose practical duties on land administrators and the association to assemble records and evidence sufficient to support any Crown Grant, reserve cancellation, or future dealings. Note 2 draws attention to the current custodian of old land documents, the Western Australian Land Information Authority (see Land Information Authority Act 2006 s 100), which is therefore the practical repository for information and a necessary party in implementation.

• No new criminal or civil sanctions. The Act does not create offence provisions or private rights to damages against persons for past or future conduct. Its rights/duties are confined to property status changes and administrative approvals.

In sum, the Act creates a statutory pathway and a set of constrained rights for the named association and places primary decision authority with the executive (Minister for Lands and Governor in Council) for grant, cancellation and major disposals. Practical duties will fall on land registries and the association to progress any Crown Grant or Land Act application.

The Act contains no criminal offences, monetary penalties, or express enforcement mechanisms. It is a title‑management and dispositional statute rather than a regulatory or penal measure.

• Absence of sanctions. There are no sections creating offences or prescribing fines, imprisonment, remediation orders, or regulatory sanctions. The operative sections (s 1-4) deal with reserve cancellation, revesting, reservation for a specified purpose, and a saving provision for subsequent applications and disposals. No enforcement provisions are included in the text.

• Executive control as functional enforcement. Where the Act prescribes consent requirements and conditions, the Governor in Council’s exercise of consent under s 4(2) functions as the control mechanism over dispositions such as sale, exchange or mortgage. The statute therefore relies on executive decision‑making and administrative processes rather than court enforcement. In practical terms, non-compliance with the consent requirement (for example, attempting to sell or mortgage without Governor in Council consent) would deprive the transaction of legal effectiveness, but the Act does not specify remedial procedures or penalties for unauthorised transactions; remedies would be those recognised in property law and administrative law as applied by courts.

• Reliance on other statutes. For procedural and administrative enforcement, the Act cross‑refers to section 37 of the Land Act 1933 (s 4(1)). Any enforcement or review of decisions under the Land Act or of Governor in Council authorisations would be governed by the decision‑making, review and enforcement mechanisms in those statutes and by general administrative law principles. The Act itself does not specify dispute resolution, compensation or appeal rights.

• Records and proof issues. The preamble records that duplicate certificates of title have been lost (preamble (g)), which may complicate proof of title and administrative actions. However, the statute’s effect is to revest the land in the Crown irrespective of those missing duplicates. Administrative risk in implementation therefore arises from evidentiary and records gaps, not from defined statutory penalties.

Practitioners seeking to rely on or challenge dispositions affected by this Act will therefore need to consider general equitable and property remedies, mechanisms and relief available outside this Act, and the administrative law avenues for reviewing Governor in Council or Ministerial decisions, since the Act does not provide bespoke enforcement provisions.

The Act explicitly cross‑references and alters the operation of multiple other statutes and legal regimes, creating direct interactions that practitioners must note.

• Transfer of Land Act 1893. Section 3 expressly removes the specified parcels from the operation of the Transfer of Land Act 1893. That is a direct statutory displacement of the Torrens registration regime for those parcels. Removing land from the Transfer of Land Act affects registration, indefeasibility, priority rules, and procedural mechanisms for dealings that the Torrens system normally supplies. The preamble (i) states this removal is “to enable a Crown Grant” to the named association; the Act therefore changes the statutory regime so that the Crown can create a new proprietary interest by Crown Grant rather than by operation within the existing registered title framework.

• Land Act 1933, section 37. Section 4(1) authorises the West Australian Temperance Alliance Incorporated to apply to the Minister for Lands pursuant to section 37 of the Land Act 1933 for cancellation of any reserve made under section 3. The Land Act’s section 37 is therefore the procedural vehicle by which the new reserve can be cancelled, and any such cancellation will be governed by the Land Act’s substantive and procedural rules. The Act delegates to that existing Land Act mechanism rather than creating a new statutory cancellation route.

• Public Works Act 1902 (historical interaction). The preamble records that part of Port Denison Suburban Lot 6, amounting to 994 m2, was resumed on 15 September 1972 pursuant to the Public Works Act 1902 (preamble (e)). That historical resumption is part of the factual background but is not directly operative in this Act’s current dispositional scheme, beyond identifying the “unresumed portion” that is being revested by s 3.

• Transfer of Land Act 1874 (historical). The preamble also recounts prior registrations under the Transfer of Land Act 1874 (preamble (d), (e)), which explain why the Torrens certificates existed and why duplicates may have been lost. These are historical facts rather than current operative law, but they explain the reason for statutory intervention.

• Associations Incorporation Act 1895 (historical/informational). The preamble records the incorporation of the West Australian Temperance Alliance Incorporated under the Associations Incorporation Act 1895 and its subsequent name changes (preamble (h)). That identifies the legal capacity and corporate identity of the beneficiary association; the Act relies on those facts in naming the beneficiary for the intended Crown Grant.

• Land Information Authority Act 2006 s 100 (record custody). The compilation note (note 2) records that documents formerly registered in the Department of Lands and Surveys are now held by the Western Australian Land Information Authority (see Land Information Authority Act 2006 s 100). That interplays with practical record retrieval and evidentiary steps needed to give effect to s 3’s revesting and any subsequent Crown Grant.

• Governor in Council powers and executive decision‑making. Section 4(2) requires Governor in Council consent for sale, exchange or mortgage after a reserve cancellation, and permits conditions to be imposed. That embeds an executive approval overlay into future dealings, linking the Act to the constitutional and administrative law framework governing Governor in Council decisions.

Overall, the Act alters the operation of the Torrens system for these parcels and routes subsequent cancellation and disposal through the Land Act machinery and Governor in Council approvals. Practitioners must therefore navigate multiple statutory regimes when progressing grants, cancellations or disposals.

The Act’s compilation table and notes record its legislative provenance and amendment status as contained in the source.

• Original enactment. The Reserve (Port Denison Suburban Lots 6 and 6a) Act 1980 was enacted as Act No. 69 of 1980, assented to on 26 November 1980, with commencement on the same date (Compilation table). The Act as supplied contains no recorded amendments to the substantive provisions, and the compilation table lists only the original Act.

• No subsequent amendments recorded in the compilation. The compilation table in the provided text lists only the short title, number and year, assent date and commencement date for the 1980 Act. There are no entries indicating later amending Acts or later insertions into the Act text shown. Therefore, based on this source, the Act remains in its original 1980 form.

• Notes about record custody added later. The compilation notes include a separate, later‑framed observation (note 2) that documents formerly registered in the Department of Lands and Surveys are now being held by the Western Australian Land Information Authority, with reference to the Land Information Authority Act 2006 s 100. That note does not amend the operative text of the 1980 Act, but it does affect practical implementation because the custodian of historical records has changed since 1980. The presence of that note in the Act compilation indicates an administrative development subsequent to the Act’s passage, but not an amendment to the Act’s substantive provisions.

• No statutory revocations or supersessions recorded here. The compilation does not indicate that any operative sections have been repealed or superseded. Section headings and operative text (s 1-4) are intact in the text provided.

Because the compilation table is the only amendment history supplied in the source, practitioners should treat the Act as enacted in 1980 in the terms shown, and consult the published statutes and any later consolidation or reprints for any amendments not captured in this compilation if further confirmation is required.

The Act text and its accompanying compilation provide no record of litigation, judicial decisions, or case law referencing the Act.

• No cases cited. The source contains no list of judicial decisions, no annotations of judicial interpretation, and no references to disputes or challenges arising under the Act. The preamble recounts historical facts and administrative notes, but does not report any court proceedings concerning revesting, title disputes, or the association’s rights.

• Practical implications of absence of reported litigation. Because the Act is specific, narrow and mainly dispositional, it may have been implemented administratively without litigation. Alternatively, disputes (if any) may not be reported in the compilation provided. The Act’s text leaves executive decisions (for example, Governor in Council consents under s 4(2) and any Ministerial action under Land Act s 37) susceptible to standard administrative law review; however, no such challenges are recorded in this source.

• Evidence and records issues noted but not litigated here. The preamble states duplicate certificates of title were lost and that no other trustees have been appointed (preamble (f)-(g)). Those facts create a factual environment that can be fertile for title disputes, but the statute resolves title by revesting in the Crown and providing an intended Crown Grant to a named incorporated body. The compilation does not show any judicial testing of those facts or of the statute’s operation.

If litigation history is material to a matter, practitioners should search court records and legal reporting services for decisions relating to the parcels, the association, or administrative actions taken under the Land Act or Governor in Council approvals. The Act compilation itself contains no litigation history.

This short Act contains a number of practical traps and implementation risks that are visible on its face.

• “Intention” language and practical effect. Section 3 states an intention that the land “shall be conveyed by way of Crown Grant in fee simple to the West Australian Temperance Alliance Incorporated, in trust for the aforesaid purpose.” The word “intention” describes the legislature’s purpose but does not specify administrative mechanics, timing, or mandatory duties owed to third parties for effecting the Crown Grant. Practitioners should not assume automatic or immediate transfer without administrative steps and Ministerial or executive acts to record and effect the Crown Grant.

• Removal from the Transfer of Land Act 1893. By removing the land from the operation of the Transfer of Land Act 1893 (s 3), the Act takes the parcels outside the Torrens registration system. That alters the default mechanisms for evidencing title, dealing with mortgages, and relying on indefeasibility. Any party who assumes the Torrens system applies (for example, when investigating priority for a mortgagee) will be mistaken unless and until a Crown Grant is made and the land is returned to the Torrens regime. This is a legal status change that affects conveyancing practice.

• Duplicates of certificates lost; record custody moved. The preamble states duplicates of the original Certificates of Title have been lost (preamble (g)). Note 2 observes that historical documents are now held by the Western Australian Land Information Authority (see Land Information Authority Act 2006 s 100). Practically, tracing title or proving chain‑of‑title facts will require contacting that authority and may require reconstructing evidentiary material. The absence of duplicates could slow or complicate any Crown Grant, s 37 application under the Land Act, or subsequent dealings.

• Governor in Council consent for significant dispositions. Even if the reserve is cancelled under the Land Act and the association acquires rights to sell, exchange or mortgage the land (s 4(2)), such major dispositions require the Governor in Council’s consent and may be subject to conditions. Practitioners should factor in the political/administrative uncertainty and conditionality of that approval for deals, valuations and financing. Conditional consent can impose constraints on marketability and bankability.

• Historical trustee deaths and lack of registered successors. The preamble records the deaths of the two named trustees and that no other trustees have been registered by transmission or otherwise (preamble (f)). That factual history is the reason the Parliament exercised its power to revest; nonetheless, any person later asserting equitable claims as a successor in interest will confront an Act that has already revested legal title in the Crown. Challenge routes would be to contest factual bases or seek relief in equity, but the Act itself resolves title.

• Reliance on external statute for later cancellation. Section 4(1) requires an application under s 37 of the Land Act 1933 for cancellation of the new reserve. Practitioners must therefore be fluent with the Land Act’s procedures and any contemporary reform of that Act. The present Act does not itself supply the mechanism for cancellation other than to permit the Land Act route; errors in invoking the Land Act process could delay intended transactions.

• Potential gap between statute and administrative practice. The Act contemplates a Crown Grant to the incorporated association. Administrative practice, statutory form, and registries’ procedural requirements will determine the manner and timing of the grant. The Act does not specify the form of the trust terms to be included in any Crown Grant; absent careful drafting at the grant stage, the scope of the trust and the association’s capacities to deal with the land later could be unclear.

These “gotchas” are practical and legal frictions visible in the Act text. They affect timing, evidentiary burden, marketability, and the political/administrative discretion that governs major dispositions.

For the West Australian Temperance Alliance Incorporated, registries and any third party dealing with the parcels, compliance is primarily administrative and evidence‑based. The Act itself creates the legal status changes; parties must follow the relevant statutory procedures and executive approvals to achieve their goals.

Practical steps and compliance points, grounded in the Act:

1. Record and administrative acknowledgement of cancellation and revesting. The Department of Lands, or the current custodian (Western Australian Land Information Authority per note 2; see Land Information Authority Act 2006 s 100), must record the cancellation effected by s 2 and the revesting in the Crown under s 3. Compliance requires updating land records and ensuring the parcels are removed from the operational Torrens register to reflect removal from the Transfer of Land Act 1893 (s 3). This is an administrative duty; obtain written confirmation of registry entries and any new Crown file references.

2. Assemble evidentiary material. Preamble (g) records lost duplicates and absence of successor trustees. The association and land administrators should gather incorporation documents (preamble (h) records incorporation under the Associations Incorporation Act 1895 and name history), any surviving historic title material from the Land Information Authority, and any administrative records of resumption (Public Works Act 1902 reference in preamble (e)). These documents will be necessary to support a Crown Grant, a Land Act s 37 application, or to satisfy prospective financiers or purchasers of the land’s status.

3. Prepare for Crown Grant procedures. Section 3 expresses an intention to convey by Crown Grant in fee simple to the named association in trust. To operationalise that intention, the association should liaise with the Minister for Lands’ office to determine the statutory and administrative requirements for a Crown Grant, including drafting of trust terms and any required instruments. The Act does not prescribe formality for the Crown Grant; administrative compliance will therefore require alignment with current Crown land grant practices.

4. Use Land Act s 37 where cancellation of reserve is needed. If the association prefers the reserve cancelled to permit sale, mortgage or exchange, section 4(1) permits it to apply to the Minister for Lands under s 37 of the Land Act 1933. Compliance requires preparing an s 37 application in accordance with the Land Act’s procedural requirements, submitting supporting evidence, and engaging with any consultations or notices that the Land Act mandates. Understand timeframes for processing, public notice obligations (if any), and criteria the Minister will apply.

5. Secure Governor in Council consent for sale/exchange/mortgage. If the reserve is cancelled and the association seeks to sell, exchange or mortgage the land, s 4(2) requires Governor in Council consent and permits conditions. Practically, before negotiating a sale or arranging finance, the association should obtain a formal instrument of consent or a clear indicator from the Governor in Council. Lenders should be asked whether they will take security given the requirement for Governor in Council consent and any conditions that may attach.

6. Legal documentation and trust drafting. Any Crown Grant to the association described as “in trust for a site for temperance institution” should include carefully drafted trust terms that reflect the intended purpose. If the association later wishes to alter the purpose, the s 4(2) regime applies and Governor in Council consent may be necessary. Parties should ensure deeds, mortgage instruments, and other documents conform to the trust instrument and to any conditions imposed under Governor in Council approval.

7. Confirm registration and priority after grant. Because s 3 removed the parcels from the Transfer of Land Act 1893, the association and any third parties should confirm whether a subsequent Crown Grant will return the land to the Torrens system and, if so, ensure proper registration to establish indefeasibility and priority positions. The Land Information Authority will be the practical office for registering and for providing official copies.

8. Plan for contingencies and political discretion. Governor in Council approvals are executive acts and may be contingent on policy or conditions. Parties should build contingency time and conditions into contracts and finance arrangements to account for potential delays or conditions imposed by the Governor in Council.

9. Seek administrative review routes if needed. If the Minister or Governor in Council declines applications or imposes conditions, administrative law remedies (merits review or judicial review) may be available under the Land Act or general administrative law principles. The Act itself does not provide appeal routes; compliance strategy should include engagement with potential review mechanisms under the relevant statutes.

10. Document chain of dealings and obtain formal confirmations. Given historical loss of duplicate certificates and the initial removal from the Torrens register, ensure all dealings are accompanied by formal instruments, Ministerial authorisations, and lodged records with the Land Information Authority. Obtain clear, dated confirmations of any Crown Grant, reserve cancellation, or Governor in Council consent to avoid title uncertainty.

Following these steps, aligned with the statutory text (s 3 and s 4), will be the practical route to convert the Act’s legislative intention into enforceable proprietary arrangements and to manage risk for third parties dealing with the land.
