Renmark Irrigation Trust Regulations 2024

The Regulations organise around a small set of core concepts that determine how the trust operates and how users interact with it.

Meter governance and measurement (regs 6-9)

• Ownership: The trust is the legal owner of any meter used to measure the quantity of water supplied to a serviced property, irrespective of who supplied or installed it (r 7). This vests property rights in the trust over the measurement devices.
• Reporting duty: Owners and occupiers must report known or suspected meter damage or dysfunction of trust irrigation works; failing to do so attracts a maximum penalty of $2,500 (r 6(1)).
• Interference consequences: If an owner/occupier interferes with a meter without trust authority, the trust may cut off supply and refuse restoration until a replacement or repair is completed and costs of repair/replacement and disconnection/reconnection are paid (r 6(2)).
• Testing and adjustment: A person liable for charges can request testing of a meter on payment of a fee set by the trust (r 8(1)); the trust may waive that fee (r 8(2)). The Regulations establish a 5 per cent tolerance: variances within ±5 per cent are accepted; greater errors allow the trust to serve a further notice under s 52 of the Act to adjust outstanding charges either by a measured degree of inaccuracy (if determinable) or by the trust’s assessment (r 8(3)). If the meter is found to be inaccurate by more than 5 per cent, the trust must refund the testing fee (r 8(4)).

Assessment and evidential presumptions (r 9)

• The trust may make an assessment of water quantity in specified circumstances: no meter, an unapproved meter, removal or bypass of a meter, or where the trust cannot determine the degree of inaccuracy after testing (r 9(1)).
• Such assessments are prima facie evidence of the quantity supplied, “in the absence of proof to the contrary”, unless it is shown the assessment was not made in good faith (r 9(2)). This sets an evidential burden on service recipients to rebut the trust’s assessment.

Operational control and emergency powers (rr 4-5)

• Notice: The trust must give reasonable notice of intention to restrict or suspend supply, except in emergencies where notice is not reasonably practicable (r 4(1)-(2)). Notice obligations remain subject to contract terms for supply (r 4(3)).
• Order of supply: The trust determines the sequence in which properties are irrigated (r 5). There is no statutory priority or algorithm set out beyond the trust’s determination.

Sanctions, interest and security (rr 10-12)

• Offences: Two categories of localised conduct carry maximum penalties of $2,500: failing to report damage (r 6(1)), and permitting stock in channels or depositing waste on channels/embankments (r 10(1)-(2)).
• Interest: The Regulations prescribe how interest on unpaid charges accrues for s 48 of the Act: a 3-month grace period, then 10 per cent of charges unpaid after that third month and 1 per cent at the end of each subsequent month (r 11).
• Recovery/security: The Regulations treat charges, rates or accrued interest as corresponding to a mortgage over the relevant land that ranks ahead of any other mortgage, encumbrance or charge (r 12). This is a statutory device for securing payment by attaching a trust-equivalent priority over land affected by supply or drainage (r 12(2)).

Service mechanics and fees (rr 13, Sch 1)

• Service on land must be waterproof wrapped and conspicuously fixed (r 13).
• Only one fee is expressly prescribed: $500 for an application to dissolve the trust (Sch 1).

These concepts convert operational decisions of the trust (supply order, testing, shut-offs) and remedies for non-payment (interest, mortgage-equivalent recovery) into concrete legal mechanics and evidential rules that determine billing and dispute resolution.

The Regulations allocate rights, duties and liabilities among a limited set of parties. The principal actors and the ways they are affected are set out by the Regulations.

Renmark Irrigation Trust (the trust)

• Decision-making: The trust decides the order of irrigation (r 5) and sets the fee for meter testing (r 8(1)), which it may also waive (r 8(2)). The trust is empowered to cut off supply and refuse restoration where unauthorised interference with meters occurs (r 6(2)), and to make assessments of water supplied (r 9). It holds ownership of all meters used for measurement (r 7).
• Enforcement and recovery: The trust may apply interest rates prescribed by the Regulations (r 11), serve further notices under s 52 when meters are inaccurate (r 8(3)), and rely on the statutory mortgage-equivalent recovery right over relevant land (r 12).

Owners and occupiers of serviced properties

• Reporting duty: Owners/occupiers must report known or suspected meter damage or dysfunction of trustworks (r 6(1)); failure attracts a maximum penalty of $2,500.
• Exposure to cut-off and charges: If an owner/occupier damages, removes, repairs or interferes with a meter without authority, the trust may cut off and refuse to restore supply until meter replacement/repair and the costs of replacing/repairing and disconnection/reconnection are paid (r 6(2)).
• Meter testing and fee liability: Persons liable for water charges can request meter testing, subject to a fee set by the trust; if the meter proves inaccurate by more than 5 per cent, the trust must refund the fee (r 8).
• Burden of rebuttal: Where the trust makes an assessment because a meter is absent or unapproved, or has been bypassed, the assessment stands unless there is proof the assessment was not made in good faith (r 9(2)).

Mortgagees, encumbrancers and purchasers of relevant land

• Priority risk: The Regulations declare that any charge, rate or accrued interest corresponds to a mortgage in favour of the trust that ranks ahead of any mortgage, encumbrance or charge (r 12(1)). Mortgagees or purchasers of land in respect of which water is supplied or drained (the “relevant land”, r 12(2)) will be directly affected by the trust’s security interest.

Third parties and land users

• Livestock owners and occupiers: Persons who permit stock in channels or on embankments/works without written approval commit an offence with a maximum penalty of $2,500 (r 10(1)). Persons must not deposit rubbish or waste on channels or embankments (r 10(2)), with the same maximum penalty.
• Persons requiring notice served on land: Those serving notices under s 73(1)(d) or (2) must follow the wrapping and fixing method mandated by r 13.

Applicants for dissolution of the trust

• Financial outlay: An application for dissolution attracts a prescribed fee of $500 (Schedule 1).

The Regulations therefore directly shape the behaviour of property occupiers, the legal position of mortgagees and purchasers of relevant land, and the operational discretion and tools available to the trust. They create obligations that attach to land and occupiers, and prioritise the trust’s claims in a way that materially affects property interests where water is supplied or drainage occurs.

This section summarises the central legal duties imposed by the Regulations, and the principal rights they confer, citing provisions as the source.

Duties placed on the trust

• Give reasonable notice before restricting or suspending supply, except in emergencies where notice is not reasonably practicable (r 4(1)-(2)). This duty is subject to the contractual terms under which the trust supplies water (r 4(3)).
• Determine and administer the order of irrigation among serviced properties (r 5).
• Maintain ownership and control of meters used to measure supply (r 7).
• Test meters when requested by a person liable for charges and, where applicable, refund testing fees if a meter is inaccurate by more than 5 per cent (r 8(1), (4)).
• Serve further notice under s 52 of the Act to adjust outstanding charges where a meter is incorrect by more than 5 per cent (r 8(3)).

Duties placed on owners and occupiers

• Report knowledge or suspicion that a meter or any part of the trust irrigation system has been damaged or is not functioning properly; failure to report is an offence with a maximum penalty of $2,500 (r 6(1)).
• Not to damage, remove, repair or interfere with a meter without the trust’s authority; unauthorised interference enables the trust to cut off supply and refuse restoration until replacement/repair is made and costs are paid (r 6(2)).
• Not to permit livestock in channels or on embankments/works without the trust’s written approval, and not to deposit rubbish or waste on channels/works, each breach carrying a maximum penalty of $2,500 (r 10(1)-(2)).

Rights granted to owners, occupiers and persons liable for charges

• Request a meter test on payment of the fee specified by the trust (r 8(1)); the trust may waive the fee at its discretion (r 8(2)).
• Have charges assessed or corrected where a meter is found to be inaccurate by more than 5 per cent; the trust may serve a further notice under s 52 to adjust outstanding charges to reflect measured or assessed quantities (r 8(3)).
• Where a meter is missing, unapproved, removed or bypassed, or its inaccuracy cannot be quantified, have the trust make an assessment of quantity supplied (r 9(1)). While the trust’s assessment is presumptive, owners/occupiers may attempt to rebut it by proof that the assessment was not made in good faith (r 9(2)).

Trust remedies and enforcement rights

• Cut off and refuse to restore water supply where unauthorised interference with a meter occurs, and require payment for replacement/repair and the costs of cutting off and restoring supply before reconnection (r 6(2)).
• Serve a further notice under s 52 to adjust outstanding charges where a meter is inaccurate by more than 5 per cent (r 8(3)).
• Apply interest to unpaid charges at the prescribed rates and apply the three-month prescribed period (r 11).
• Treat unpaid charges, rates and accrued interest as corresponding to a mortgage in the trust’s favour over the relevant land that ranks ahead of any other mortgage, encumbrance or charge (r 12(1)-(2)).

Procedural duties for service of notices

• When serving a notice on the land under s 73(1)(d) or (2), the acting person must seal the notice in a reasonably waterproof clear wrapper and fix it to a conspicuous part of the land, including by fixing it to a post and then placing that post conspicuously in the ground (r 13).

Fees and administrative costs

• The Regulations prescribe a $500 application fee for an application for dissolution of the trust (Schedule 1).

These duties and rights create a structure where the trust holds primary operational and enforcement authority over measurement, billing adjustment, suspension of supply and security over land, while owners and occupiers bear reporting obligations, exposure to disconnection and payment liabilities, and a constrained evidential route to challenge the trust’s assessments.

The Regulations provide a mixture of criminal penalties, administrative remedies and property-based enforcement mechanisms. The source provisions specify the applicable penalties and the conditions triggering enforcement.

Monetary penalties

• Failure to report known or suspected damage to a meter or failure of trust-provided irrigation works is an offence with a maximum penalty of $2,500 (r 6(1)). The obligation to report is placed on the owner or occupier of a serviced property.
• Permitting stock in channels or on embankments or other works without the trust’s written approval carries a maximum penalty of $2,500 (r 10(1)).
• Depositing rubbish or other waste material in a channel or on an embankment or other works forming part of the trust’s irrigation system also attracts a maximum penalty of $2,500 (r 10(2)).

Administrative enforcement powers vested in the trust

• Interference with meters: Where a meter has been damaged, removed, repaired or otherwise interfered with by an owner/occupier without the trust’s authority, the trust may cut off the water supply and refuse to restore it until another meter is installed or the existing meter repaired and until the trust has been paid the costs of replacement/repair and the costs relating to cutting off and restoring supply (r 6(2)). The Regulation expressly states this is in addition to any other penalty provided under the Act, so it operates alongside other Act-based enforcement mechanisms.
• Meter testing and billing adjustments: The trust may test meters at its own initiative or on request. If a meter is found inaccurate by more than 5 per cent, the trust may serve a further notice under s 52 to adjust outstanding charges (r 8(3)). The ability to serve such a notice is confined to charges that remain outstanding at the time.

Interest and late payment mechanics

• The Regulations prescribe the interest mechanics for s 48 of the Act. The prescribed period is three months after the date charges became payable; the prescribed rate is 10 per cent of charges unpaid after the third month and 1 per cent of the charges unpaid at the expiration of each subsequent month (r 11(1)-(2)). These figures function as automatic financial penalties for late payment and a mechanism for the trust to recover carrying costs on unpaid sums.

Property-based recovery mechanism

• The Regulations provide that any charge, rate or accrued interest corresponds to a mortgage in favour of the trust over the relevant land that ranks ahead of any mortgage, encumbrance or charge (r 12(1)). The definition of relevant land is tied to land in respect of which water is supplied or delivered, or is drained (r 12(2)). This clause creates a statutory security interest that the trust may rely upon to recover unpaid charges by attaching to the land and taking priority over pre-existing registered or equitable interests described as mortgages, encumbrances or charges.

Procedural enforcement

• Service on land: For particular notice types under s 73(1)(d) or (2), the Regulations impose a specific method for service on the land: seal the notice in a reasonably waterproof clear wrapper and fix it to a conspicuous part of the land, including by fixing it to a post and then placing the post into the ground conspicuously (r 13). This procedure is an administrative step that, if correctly followed, supports the validity of the notice under the Act.

Limitations and operation

• Many enforcement measures are subject to the parent Act. For example, r 8 refers to the trust’s ability to serve further notices under s 52 of the Act, and r 13 refers specifically to notices under s 73. The Regulations therefore operate within the Act’s enforcement architecture, specifying how the trust exercises those statutory powers in practice.

In short, enforcement combines criminal fines for particular conduct, administrative shut-off powers tied to meter interference, automatic interest charges on late payments, and a statutory mortgage-equivalent priority to secure unpaid charges against the land receiving supply or drainage.

The Regulations are subsidiary legislation made under the Renmark Irrigation Trust Act 2009 and repeatedly cross‑refer to that Act for substantive powers and remedies. Their effect must be read in conjunction with the parent Act in areas the Regulations expressly amend, clarify or operationalise.

Direct references to the Act

• The Interpretation provision defines “Act” as the Renmark Irrigation Trust Act 2009 (r 3), anchoring the Regulations to that statute.
• Several provisions expressly invoke sections of the Act:
  • r 8(3) refers to the trust’s power to serve a further notice under s 52 of the Act to adjust outstanding charges following meter testing;
  • r 11 is framed “for the purposes of section 48(2) of the Act” and “for the purposes of section 48(3) of the Act”, prescribing rates and the prescribed period for interest on unpaid charges;
  • r 12 is framed “for the purposes of section 53(1) of the Act” and prescribes that unpaid charges correspond to a priority mortgage over relevant land;
  • r 13 prescribes the procedure where a notice is to be served on land under s 73(1)(d) or (2) of the Act.

Operationalising Act powers and remedies

• The Regulations supply numerical and procedural specifics that the Act either leaves to subordinate legislation or does not specify:
  • Interest mechanics: The Act’s s 48 provides the power to charge interest; r 11 sets the exact percentages and the three-month delay.
  • Recovery security: The Act’s s 53(1) contemplates recovery rights; r 12 prescribes that these rights correspond to a mortgage that ranks ahead of other charges and defines the relevant land.
  • Meter-testing remedies: The Act’s s 52 gives the trust power to issue notices adjusting charges; r 8 prescribes when and how that power is to be used following tests and sets a 5 per cent threshold.
  • Notice service: The Act’s s 73 contemplates service on land; r 13 prescribes the wrapping and fixing requirements for that mode of service.

Interaction with property and insolvency rights

• The Regulations state that charges correspond to a mortgage that ranks ahead of any mortgage, encumbrance or charge (r 12(1)). That provision establishes a statutory priority in favour of the trust vis-à-vis other interests described in that language. The text does not detail how that priority interacts with the registration regime for land titles or insolvency law; the Regulations impose the form of priority but leave their interaction with land registration systems to be determined in practice under the Act and other relevant property law processes.

Interaction with contractual terms

• The obligation to give reasonable notice before suspension or restriction of supply is explicitly made subject to the terms and conditions on which the trust supplies water (r 4(3)). Where supply is governed by contract, the contract terms will modify or displace the Regulation’s notice duty to the extent the contract provides otherwise.

Limited cross-reference to other statutes

• The Regulations do not reference other statutes by name beyond the Renmark Irrigation Trust Act 2009. As a subordinate instrument, their operation will coexist with general criminal procedure, land law and procedural rules that govern enforcement actions, registration of charges and service of process. The Regulations set methods and priorities that the trust will use within that legal framework, but they do not, for example, pre-empt registration requirements, nor do they include express transitional arrangements for dealings registered under other regimes.

Repeal and replacement effect

• The Regulations repeal the Renmark Irrigation Trust Regulations 2009 (Schedule 2). This means the 2024 instrument supersedes the earlier subordinate instrument, replacing any previous regulatory rates, fees, procedures or penalties that were set by the 2009 Regulations.

In short, these Regulations operate as implementing detail for multiple powers in the Renmark Irrigation Trust Act 2009: they set numerical values, procedural steps and evidentiary presumptions that the Act either authorised or left to subordinate legislation to specify. Their practical intersection with property registration, insolvency, and other statutory regimes depends on the application of the parent Act and general legal processes, as the Regulations themselves do not purport to resolve those cross‑regime questions beyond prescribing the trust’s priority and procedures.

The Regulations are a single, self-contained instrument with a short legislative history recorded in the instrument. The text provides the following points.

Commencement and Gazette

• The Regulations were made in 2024 as the Renmark Irrigation Trust Regulations 2024 (r 1).
• The Regulations come into operation on the day on which they were made (r 2).
• The legislative history annex records the principal regulations as Year 2024, No 76, Gazette 1.8.2024 p2284 and notes commencement as 1.8.2024: r 2. That entry indicates the instrument’s making and immediate commencement date are both 1 August 2024.

Repeal of earlier subordinate instrument

• Schedule 2 expressly repeals the Renmark Irrigation Trust Regulations 2009. The effect is that the 2024 Regulations replace the 2009 Regulations in full.

Schedule of fees added

• Schedule 1 prescribes an application fee of $500 for an application for dissolution of the trust. This is the only fee schedule contained in the Regulations.

No other amendments recorded

• The instrument as supplied records no other amendment history, transitional provisions, savings clauses or staged commencements. It neither amends the parent Act nor lists consequential amendments to other statutes or subordinate instruments. The legislative history section is limited to the principal regulations entry and the repeal of the 2009 Regulations.

Implication for users

• Practitioners should treat these Regulations as the operative delegated rules for the trust from 1 August 2024. Any procedural, fee or enforcement practice that previously relied on the 2009 Regulations must be reviewed against the 2024 text, which sets new or confirmed procedures, rates and penalties as cited.

The text of the Regulations and its legislative history do not contain any record of litigation or judicial determinations concerning these Regulations. The schedule labeled “Legislative history” records only the making and commencement of the instrument and the repeal of the 2009 Regulations; it does not reference any cases, judicial reviews, or court decisions arising from the Regulations.

Because the Regulations are recent subordinate legislation made on 1 August 2024, there is no litigation history recorded in the instrument itself. Any court or tribunal challenges, appeals or determinations that might arise from enforcement actions under these Regulations would be external to the legislative record and are not provided in the source text.

Practitioners seeking litigation precedent or guidance on interpretation should therefore note that the Regulations supply procedural and evidential rules that may generate disputes , for example, about the meaning of “reasonable notice” (r 4), about what constitutes proof that an assessment was not made in good faith (r 9(2)), the operation of the 5 per cent testing tolerance (r 8(3)), and the practical effect of the trust’s mortgage-equivalent priority (r 12). Any authoritative judicial interpretation or dispute resolution outcome would need to be sourced from court records or subsequent legal reporting, which are not contained in this instrument.

The Regulations include several technical provisions that produce concrete legal and commercial effects which may not be obvious on casual reading. This section highlights specific risks, friction points and implementation details drawn from the text.

Meter ownership and interference

• Ownership is vested in the trust whether the meter is supplied by the trust, the owner or any other person (r 7). Practitioners and property owners should not assume that installing or paying for a meter confers ownership or control rights; the trust retains title. This affects who can lawfully repair, replace or remove a meter and who bears risk of interference.
• Unauthorised interference by an owner or occupier permits the trust to cut off supply and refuse reconnection until a meter is replaced or repaired and the cost of replacement/repair and of cutting off/restoring supply has been paid (r 6(2)). That restoration is conditional on payment, so a single act of interference can trigger immediate commercial consequences.

Reporting duty and criminal penalties

• Owners/occupiers must report known or suspected meter damage or malfunction; failure to report is an offence with a maximum $2,500 penalty (r 6(1)). This is an affirmative reporting obligation, not merely a defence to other enforcement action. Failing to notify could therefore give rise to criminal exposure independent of any dispute about billing.

Meter testing fee mechanics and refund trigger

• A person liable for charges can request a test on payment of a fee specified by the trust; the trust may waive the fee (r 8(1)-(2)). The Regulations do not prescribe the fee amount, leaving fee-setting to the trust. If the meter is inaccurate by more than 5 per cent the trust must refund the fee (r 8(4)), but the trust initially controls whether a fee applies and how large it is. That creates a potential cost barrier to initiating a meter test, with the trust able to set fee levels subject to any other limits in the Act.

5 per cent tolerance and adjustment of outstanding charges

• The Regulations create a binary tolerance rule: variances of up to ±5 per cent are accepted and the meter’s reading governs charges (r 8(3)(a)). If inaccuracy exceeds 5 per cent and the trust can determine the degree of inaccuracy, the trust may serve a further notice under s 52 to adjust outstanding charges (r 8(3)(b)). If the degree cannot be determined, the trust may issue a further notice based on its assessment (r 8(3)(c)). The trust’s ability to adjust is confined to “charges that remain outstanding”. The practical effect is that adjustments may not operate retrospectively against amounts already paid.

Presumptive assessments and evidential burden

• Where no meter is installed, the meter is unapproved, bypassed, removed or the degree of inaccuracy is undeterminable, the trust may assess the quantity supplied and that assessment is to be taken as the quantity supplied “in the absence of proof to the contrary” (r 9(1)-(2)). The phrase “in the absence of proof to the contrary” places the burden of rebuttal on the account holder, who must show the assessment was not made in good faith to overturn it. That evidential formulation narrows the practical avenues for disputing assessments.

Interest calculation specifics and possible misconceptions

• The Regulations prescribe 10 per cent of charges unpaid after the third month and 1 per cent of charges unpaid at the expiration of each subsequent month (r 11(1)). They also designate three months from when charges became payable as the prescribed period (r 11(2)). The Regulations do not state explicitly whether the 1 per cent monthly additions are calculated on the outstanding principal only, or on principal plus previously accrued interest; they do, however, state the sequence in which percentages apply. Practitioners should treat the wording literally and confirm calculation practices with the trust or by reference to the Act.

Mortgage-equivalent recovery priority and practical effect

• The Regulations declare unpaid charges correspond to a mortgage in favour of the trust that “ranks ahead of any mortgage, encumbrance or charge” (r 12(1)). This expresses a statutory priority over other interests in the relevant land. The text does not specify how this priority is to be registered or enforced under land-titles or registry rules, nor does it qualify the meaning of “any mortgage, encumbrance or charge”. Practitioners acting for lenders, purchasers or trustees should be alert to the potential that trust charges may disrupt financing or conveyancing for land that is supplied with water or is drained, as defined in r 12(2).

Service on land technicality

• Notices under s 73(1)(d) or (2) must be sealed in a reasonably waterproof clear wrapper and fixed conspicuously to the land, including by fixing to a post and placing that post into the ground (r 13). Failure to comply with these exact steps could render a service defective; conversely, following the procedure creates a low-cost route to effecting notice where personal service or postal methods are impractical.

Limited fee schedule

• Only one fee is prescribed in the Regulations: the $500 application fee for dissolution of the trust (Schedule 1). The trust retains discretion to set other fees (for example, meter-testing fees) and the Regulations do not constrain those amounts.

Emergency and contractual exceptions

• Notice requirements may be bypassed in an emergency where giving notice is not reasonably practicable (r 4(2)), and the obligation to give reasonable notice is subject to the trust’s supply terms and conditions (r 4(3)). Parties should therefore review supply contracts to see whether contractually agreed notice regimes differ from the Regulation’s default.

These provisions create a range of operational pitfalls: owners who assume meter ownership rights, persons who assume they can challenge trust assessments cheaply, mortgagees who assume their priority is secure, and operators who fail to observe service technicalities may all face unintended consequences if the Regulations are not followed closely.

This section provides a practical checklist drawn directly from the Regulations for trusts, owners/occupiers, prospective purchasers and advisers. Compliance steps cite the relevant provisions.

For the Renmark Irrigation Trust (administration and operations)

• Notice before restriction: Establish and document procedures to provide “reasonable notice” before restricting or suspending supply, but maintain an emergency protocol that allows immediate action where giving notice is not reasonably practicable (r 4(1)-(2)). Ensure contracts of supply are consistent with the trust’s operational practice, because r 4(3) makes the notice duty subject to contract terms.
• Order of irrigation: Maintain and publish (or otherwise communicate) the trust’s method for determining the order of irrigation, since r 5 vests that determination in the trust.
• Meter ownership records: Keep an up-to-date register of meters and record ownership as vested in the trust (r 7). Document authorisations for any third-party repairs or replacements to avoid disputes under r 6(2).
• Meter testing process: Publish the testing fee policy and the circumstances under which fees may be waived (r 8(1)-(2)). Establish a testing protocol that applies the 5 per cent tolerance rule (r 8(3)) and a refund procedure where a meter is found inaccurate by more than 5 per cent (r 8(4)). Ensure testing reports record whether the degree of inaccuracy is determinable to trigger the correct form of further notice under s 52 (r 8(3)(b)-(c)).
• Assessment and evidence: Where making quantity assessments under r 9(1), prepare contemporaneous records evidencing the methodology and calculation and ensure good faith procedures are documented, because r 9(2) makes such assessments prima facie correct unless rebutted by proof of lack of good faith.
• Enforcement and billing: Implement procedures for cutting off supply where unauthorised meter interference occurs and for calculating and invoicing the costs of replacement/repair and disconnection/reconnection, consistent with r 6(2).
• Interest and recovery: Apply the interest mechanics in r 11 when charging for late payment, and document the trust’s mortgage-equivalent recovery position under r 12. Establish internal processes for registering and enforcing the trust’s priority against relevant land, and for communicating the existence of this charge to buyers, mortgagees and other stakeholders where appropriate.
• Notice service on land: Train staff and authorised agents in the wrapping and fixing procedure in r 13 when effecting notice on land under s 73(1)(d) or (2). Retain photographic evidence showing the notice sealed in a clear waterproof wrapper and fixed conspicuously or to a post placed in the ground.

For owners and occupiers of serviced properties

• Reporting obligation: Promptly report any known or suspected damage to meters or trust irrigation works to the trust to avoid exposure to the $2,500 maximum penalty under r 6(1). Keep contemporaneous records of reports made (date, time, method, person notified).
• Do not interfere with meters: Avoid removing, repairing, or otherwise interfering with meters without the trust’s authority. If an owner needs to repair a meter, obtain written authorisation from the trust to avoid triggering disconnection and restoration costs under r 6(2).
• Request meters tests where accuracy is in doubt: If disputing a bill, request testing under r 8(1) and obtain written confirmation of the test fee and the terms for waiver or refund. If the test reveals >5 per cent inaccuracy, expect a refund of the testing fee (r 8(4)), and note that any further adjustment by the trust under s 52 will normally apply only to outstanding charges (r 8(3)).
• Maintain evidence to rebut trust assessments: If the trust makes an assessment under r 9, preserve any evidence that would allow rebuttal , for example, records of independent meters, irrigation logs, or other documentary proof of volumes supplied , because r 9(2) treats the trust’s assessment as the default unless proof shows bad faith.
• Deal with encumbrance risk when purchasing land: Before purchase, enquiry should be made about outstanding trust charges and whether any charges correspond to a mortgage-equivalent priority under r 12(1). Obtain title searches and ask the trust for a history of charges and any steps taken to enforce them.
• Avoid stock and waste offences: Do not permit stock in channels or on embankments/works without written approval and do not deposit rubbish on channels or embankments to avoid the $2,500 maximum penalties in r 10.

For mortgagees, solicitors and conveyancers

• Investigate trust charges: Treat the trust’s claim to a mortgage-equivalent priority (r 12) as a material encumbrance on relevant land. Seek evidence from the trust about existing charges and their registration status and consider contractual protection or indemnities if funding land that may be subject to trust charges.
• Confirm notice procedures: If acting to serve a notice under s 73(1)(d) or (2), follow r 13 precisely: seal the notice in a reasonably waterproof clear wrapper and fix it conspicuously or to a post placed into the ground, and retain photographic proof and a witness where practicable.

Administrative documentation and record-keeping

• Keep comprehensive records of all tests, notices, disconnections/reconnections, repair costs, fee waivers and assessments so that actions under r 6-r 9 and the interest/recovery steps under r 11-r 12 can be evidenced if contested.
• Where the trust charges interest, document precise calculation methodology and when charges became payable, to justify the application of the three-month prescribed period and subsequent percentage additions (r 11).

Fee and procedural compliance

• For dissolution applicants: Pay the prescribed $500 application fee set out in Schedule 1 and confirm any additional procedural requirements under the Act for applications for dissolution.

Following these steps aligns administrative practice with the Regulations’ clear prescriptions. Parties should also consider the interaction of these measures with contract terms and the parent Act so that operational practice is consistent across statutory and contractual obligations.
