#### 20D Circumstances for suspending accreditation of an accredited power station (Act s 30E)
(1) For the purposes of subsection 30E(5) of the Act, the Regulator may suspend the accreditation of an accredited power station if:
(a) the power station no longer generates electricity using an eligible energy source; or
(b) the power station is in the national electricity market and no longer uses standard metering that meets the requirements set by the National Electricity Rules; or
(c) the power station is not in the national electricity market and no longer uses metering which allows the Regulator to determine the amount of electricity generated by the power station; or
(d) both:
(i) at least one certificate has been created in relation to electricity generated by the power station using eligible WCMG; and
(ii) after the creation of the certificate, one of the following is created in relation to electricity generated by the power station using waste coal mine gas:
(A) an abatement certificate under the Electricity Supply Act 1995 (NSW);
(B) a gas electricity certificate under the Electricity Act 1994 (Qld);
(C) an abatement certificate under the Electricity (Greenhouse Gas Emissions) Act 2004 (ACT); or
(e) the nominated person for the power station applies, in accordance with subregulation (2), to suspend the accreditation of the power station; or
(f) the power station has become inoperable because of the removal, in whole or in part, of the components of the electricity generation system that make up the power station; or
(g) both of the following apply:
(i) the nominated person for the power station is a registered person whose registration is suspended under section 30 or 30A of the Act;
(ii) the suspension relates to the power station.
(2) For the purposes of paragraph (1)(e), the application must:
(a) be made in a manner and form approved by the Regulator; and
(b) provide a reason for the proposed suspension; and
(c) specify the day the proposed suspension is to begin and the period of the proposed suspension, which may be indefinite; and
(d) be accompanied by a statement in writing from any other stakeholder in relation to the power station indicating that the stakeholder agrees to the making of the application.
