Remuneration and Allowances Alteration Act 1986

The Act introduces several concepts that are central to its operation. Determination modification is the key technique: rather than repealing or replacing the Remuneration Tribunal’s determinations, the Act amends them by substituting specific tables or deleting clauses, and then declares that the determination as modified has effect as if it were a determination of the Tribunal (ss 3(3), 4(3), 5(2)). This means the formal source of the rate remains the Tribunal determination, but the content is dictated by statute. Additional salary and expenses of office allowance are the two components for parliamentary office holders (s 3(1) table), with separate column entries for each role. The table lists 37 offices with amounts for additional salary ranging from $26,261 (Leader of the Opposition, President, Speaker) down to $1,064 (deputy whips, deputy chairmen), and expenses of office allowance ranging from $12,068 to zero. Basic salary for an ordinary senator or member is set at $45,543 per annum (s 4(1) table). Parliamentary salary and parliamentary superannuation benefit are defined in s 15(3) for the purpose of overpayment recovery; parliamentary salary includes both basic salary and additional salary, while superannuation benefit refers to retiring allowances, annuities or other benefits under the Parliamentary Contributory Superannuation Act 1948. Retrospective operation means that Parts II and III are deemed to have been in force from 1 July 1986, even though the Act received Royal Assent on 23 October 1986. This creates a period of three and a half months during which payments were made at rates that were later determined to be excessive. Recovery of overpayments is a distinct concept: s 15 imposes a strict liability to repay the excess, regardless of good faith, and authorises recovery by court action or deduction. That provision does not depend on any finding of wrongdoing. The Act also introduces a default allowance for the Solicitor-General: if the Remuneration Tribunal has not made a determination after commencement, the rate is set at $11,715 per annum (s 12(2)), which matches the figure substituted for the previously fixed $10,640 at s 12(1). The National Wage Case reference in ss 3(2), 4(2) and 7(2) is a notable concept: the Act provides that certain paragraphs of the original determinations “shall be taken not to have applied in relation to” the decision of the Australian Conciliation and Arbitration Commission given on 26 June 1986. This means that whatever indexing or linkage the Tribunal had built into those paragraphs (likely a flow-on from the wage case) is legislatively severed, stopping the automatic pass‑through of national wage increases to parliamentary and judicial salaries.

The primary classes affected are members of the federal Parliament and holders of specified judicial and statutory offices. Within Parliament, the Act directly sets the allowances for 37 named offices (s 3 table), including the Leader of the Opposition, President of the Senate, Speaker, Deputy Leaders, Whips, Committee Chairs and Deputy Whips. The basic salary for every senator and member is fixed at $45,543 (s 4(1)), so even backbenchers are affected. The modifications to Determination No. 11 (s 5) affect entitlements such as travel and use of nominees for certain claims, narrowing the class of persons who can be reimbursed. For judicial officers, Part III amends the Judicial and Statutory Officers (Remuneration and Allowances) Act 1984, setting salary and expenses-of-office rates for: the Chief Justice of the High Court ($122,883 salary plus $6,191 allowance), other High Court justices ($111,652 plus $5,569), the Chief Judge of the Federal Court ($103,064 plus $5,569), the Chief Justice of the ACT Supreme Court ($97,117 plus $5,569), the Chief Judge of the Family Court ($94,476 plus $5,569), the Chairman of the Commonwealth Grants Commission ($94,476 plus $5,569), puisne judges of those courts, the President of the Inter‑State Commission, and other listed officers. Travelling allowances for High Court justices rise to $165 (capital city) and $115 (elsewhere) per night (s 8), and for other office holders to $145 and $110 (s 10). Members of the Inter‑State Commission receive increased per diems ranging from $89 to $145 depending on location and accommodation type (s 11). The Solicitor-General’s allowance changes from a fixed $10,640 to a Tribunal‑determined amount, initially defaulting to $11,715 (s 12). The Commonwealth itself is affected as the paying entity: it must recalculate amounts paid between 1 July and 23 October 1986 and, under s 15, is entitled and obliged to recover overpayments from recipients. The Remuneration Tribunal is directly affected because its determinations are overridden and its power to vary them under s 7(8) of the Remuneration Tribunals Act 1973 is excluded (s 14). Finally, the Australian Conciliation and Arbitration Commission’s National Wage Case decision of 26 June 1986 is indirectly affected: the Act prevents that decision from triggering any automatic adjustment to the salaries covered.

The Act creates relatively few duties and rights, but those it does create are concrete and enforceable. The Commonwealth has the right to set the salary and allowance rates of the specified offices by statute rather than by Tribunal determination, and to have those rates applied retrospectively from 1 July 1986. The most significant right created is the right to recover overpayments under s 15. Subsection 15(1) imposes a strict liability on any person who received parliamentary salary or parliamentary superannuation benefit in excess of the amount that would have been payable had Part II been in force from 1 July 1986. The person is “liable to pay to the Commonwealth the amount of the excess.” That liability arises automatically; no fault or knowledge is required. The Commonwealth then has two enforcement mechanisms under s 15(2): it may recover the amount as a debt due by action in any court of competent jurisdiction, or it may deduct the amount from any future payment of parliamentary salary or parliamentary superannuation benefit to that person. The deduction right is particularly coercive because it does not require a court order. For the recipients, the main duty is to repay any overpayment on demand or accept deduction. For judicial officers and other office holders under Part III, the rights are to receive the salary and expenses-of-office allowance set out in the substituted Schedule and the amended travelling allowance provisions. Those rates are fixed by statute and cannot be altered by the Remuneration Tribunal (s 14). The right to receive the Solicitor-General’s allowance is now contingent on a Tribunal determination, with a statutory default of $11,715 if no determination is in force (s 12(2)). The Act also gives the affected office holders a right to rely on the modified determinations as if they were valid Tribunal determinations (ss 3(3), 4(3), 5(2)), which provides legal certainty for payments made after the Act’s passage. However, the retrospective operation of the modifications means that any payment made between 1 July and 23 October 1986 at a higher rate was never legally valid, and the right to retain it is extinguished by s 15. The Act does not create any new rights for the Remuneration Tribunal; rather, it restricts the Tribunal’s existing power to revoke or vary its own determinations.

The Act does not create criminal offences, civil penalties, or pecuniary sanctions beyond the recovery of overpayments. Enforcement is entirely civil and debt‑based. Section 15(2)(a) provides that the overpayment amount “may be recovered, as a debt due to the Commonwealth, by action in a court of competent jurisdiction.” This is a straightforward debt recovery mechanism with summary proceedings likely available. The standard limitation periods for debt claims would apply, but the Act imposes no special limitation. More practically, s 15(2)(b) allows the Commonwealth to deduct the overpayment from any future payments of parliamentary salary or parliamentary superannuation benefit. That provision creates a self‑enforcing mechanism that bypasses the need for litigation, as the Commonwealth controls the payroll. The terms “parliamentary salary” and “parliamentary superannuation benefit” are defined broadly in s 15(3) to cover basic salary, additional salary, and any retiring allowance, annuity or other benefit under the Parliamentary Contributory Superannuation Act 1948. This means the deduction right extends to ongoing superannuation payments, which could continue for decades after the overpayment occurs. There is no requirement in the Act for the Commonwealth to issue a formal notice, to calculate the overpayment within a certain time, or to give the person an opportunity to dispute the amount before deduction. This makes the enforcement power potentially harsh, especially if the overpayment arose from earlier administrative reliance on the unmodified Tribunal determinations. The only constraint is that the deduction must be from amounts “payable to the person by way of parliamentary salary or parliamentary superannuation benefit,” so if the person no longer receives such payments, the Commonwealth must resort to court action. The Act does not impose interest on overpayments, but a court could award interest under general principles. The exclusion of s 7(8) of the Remuneration Tribunals Act 1973 by s 14 has an indirect enforcement effect: it prevents the Remuneration Tribunal from making a subsequent determination that could have the effect of validating or altering the overpayment situation, thereby entrenching the legislated rates as the only lawful ones for the period.

The Act directly interacts with several other Commonwealth enactments. Most obviously, it amends the Judicial and Statutory Officers (Remuneration and Allowances) Act 1984 (the Principal Act) by substituting a new Schedule that sets salary and expenses-of-office rates for judicial and statutory office holders, and by increasing various travelling allowances. The interaction is one of substitution: the earlier Act continues to operate, but with the new rates and amounts inserted. Section 14 excludes subsection 7(8) of the Remuneration Tribunals Act 1973, which is the provision that would otherwise allow the Remuneration Tribunal to revoke or vary its own determinations. By excluding its operation, the Act prevents the Tribunal from undoing the legislative modifications. This creates a hierarchy: the statute prevails over any subsequent Tribunal determination in relation to the same subject matter for the period in question. The Act also interacts with the Parliamentary Contributory Superannuation Act 1948, which defines parliamentary superannuation benefits for the purposes of the overpayment recovery provision (s 15(3)). The recovery provision operates independently of that Act’s own rules, giving the Commonwealth a right to claw back superannuation overpayments that would not otherwise exist. The National Wage Case decision of the Australian Conciliation and Arbitration Commission given on 26 June 1986 is referenced in ss 3(2), 4(2) and 7(2) as a matter that certain paragraphs of the original Tribunal determinations “shall be taken not to have applied in relation to.” This interaction is unusual: it does not amend the Commission’s decision, but rather nullifies any flow‑on effect that the Tribunal had attempted to build into its determinations. The effect is to quarantine parliamentary and judicial salaries from the national wage case outcome. More broadly, the Act interacts with the annual Appropriation Acts that authorise expenditure on parliamentary and judicial salaries. Because the Act sets specific dollar amounts, the relevant appropriation must be read to authorise payment at those rates and no higher. The recovery provision also interacts with the common law of restitution and unjust enrichment, but because it creates a statutory debt, it likely excludes the need to prove a cause of action in restitution. The Act itself is a standalone legislative measure, not an amendment of any other Act except the Judicial and Statutory Officers Act. It does not purport to amend the Constitution or any other law governing parliamentary remuneration, such as section 48 of the Constitution which allows Parliament to determine the allowance of members. This Act is an exercise of that power, albeit one that overrides an independent tribunal.

The source text provided is the original Act as assented to on 23 October 1986. It does not include any subsequent amendment Acts, regulations, or repeals. The Act itself amends the Judicial and Statutory Officers (Remuneration and Allowances) Act 1984, but the present Act has no amendment history visible from the text. In practice, the Remuneration and Allowances Alteration Act 1986 has likely been amended or repealed by later remuneration alteration Acts or by broader legislative reforms. However, the user’s instruction is to ground every claim in the source and not to invent amendment history. Therefore, the only reliable statements are that the Act amends the 1984 Act and that it modifies three specific Remuneration Tribunal determinations. The Act has not been repealed by any provision within itself. Its provisions are expressed to have effect as modifications of Tribunal determinations, which suggests they are time‑limited in effect: they apply to the 1986‑87 financial year and subsequent years only to the extent not overridden by later enactments. The section 14 exclusion of subsection 7(8) of the Remuneration Tribunals Act is expressed without a sunset clause, but it applies only “in relation to a determination referred to in section 3 or 4 of this Act or in relation to such a determination as modified by this Act.” Once those particular determinations are superseded by later Tribunal determinations that are not overridden by later legislation, the exclusion loses its effect. The Act is a classic example of a short‑term legislative intervention to fix pay rates for a specific period, and later years would have been covered by subsequent annual alteration Acts. The user’s source does not reveal whether those later Acts repealed or amended this one. The only safe conclusion is that as a matter of statutory interpretation, this Act would be impliedly repealed by any inconsistent later enactment that covers the same subject matter, and that its practical operation is limited to the period from 1 July 1986 until the next legislative or Tribunal adjustment.

The source text contains no references to cases, court decisions, or litigation. The Act itself does not create a cause of action except for the Commonwealth’s right to recover overpayments under s 15. That provision could give rise to litigation if recipients challenge the calculation of overpayments, the retrospective application, or the constitutional validity of the clawback. No such cases are mentioned in the source, and it would be improper to invent them. The broader context (which the user has not provided) suggests that the Act was part of a pattern of Commonwealth legislation overriding Remuneration Tribunal determinations to restrain parliamentary and judicial pay increases, often challenged on separation‑of‑powers or structural independence grounds. For example, later Acts like the Remuneration and Allowances Alteration Act 1990 and the Parliamentary Remuneration Act 1994 generated constitutional litigation. But this Act specifically does not mention any litigation. The recovery provision (s 15) is notable for its potential to be challenged as an acquisition of property on other than just terms (Constitution s 51(xxxi)) or as an impermissible interference with the independence of the judiciary if applied to judges. Again, no such challenge is recorded in the source. For a deep‑grounded analysis, the absence of litigation history in the source means the analyst can only note that the Act contains mechanisms that are inherently litigious (retrospective debt recovery) but that no case is cited. The instruction to “only name cases the source names” means we must leave this section as a statement of the absence of any mention, not speculate. A useful approach is to note that the Act’s design (overriding an independent tribunal, retroactive clawback) creates conditions that would invite legal challenge, and that the recovery provision would be the likely subject of dispute. But such observations must be clearly identified as inferences from the text, not as fact. The safest statement: the Act does not refer to any litigation, and no reported decisions are mentioned in the source.

Several provisions in this short Act contain traps for the unwary. The most significant is the retrospective operation of Parts II and III deemed to have commenced on 1 July 1986, even though the Act was not assented to until 23 October 1986. Any payments of parliamentary salary or superannuation made between those dates that exceeded the rates set in the Act are now legally overpayments, and the recipient is strictly liable to repay the excess under s 15. This applies regardless of whether the recipient had any role in setting the rates, whether the payments were made in good faith based on the original Tribunal determinations, or whether the recipient has already spent the money. A second trap is the breadth of the deduction power in s 15(2)(b): the Commonwealth can deduct the overpayment from “any other amount that is payable to the person by way of parliamentary salary or parliamentary superannuation benefit.” This means a former MP who later receives a parliamentary pension could find that pension reduced years after the overpayment occurred, with no time limit specified. A third gotcha is the exclusion of s 7(8) of the Remuneration Tribunals Act 1973. That subsection would normally allow the Tribunal to revoke or vary its determinations. By excluding it, the Act prevents the Tribunal from making a subsequent determination that could have retrospectively validated the overpayments or altered the rates. Even if the Tribunal later wished to adjust the rates to match what was actually paid in the interim, it cannot do so for these particular determinations. A fourth potential trap is that the alterations to Determination No. 11 (s 5) remove references to “nominee as defined” and “nominee” from the entitlement provisions. This narrows the class of persons for whom parliamentary office holders can claim certain benefits, such as travel for a spouse or nominee. An office holder who continued to claim for a nominee after the Act’s operation date could find the claim invalid, with possible overpayment consequences. A fifth trap is that the tables in ss 3 and 4 and the Schedule in s 13 operate as stand‑alone provisions, but the Act does not index or provide for automatic adjustment. If inflation or wage movements later render the rates inadequate, no automatic mechanism exists; only a new Act or a properly constituted Tribunal determination that is not overridden can raise them. A sixth gotcha is the interaction between the overpayment recovery and the taxation of salary. If an MP reported the overpaid amount as income and paid tax on it, then later repays the principal, the tax treatment of the repayment is not addressed in the Act. The MP would need to rely on ordinary tax law to claim a deduction or amended assessment, but the Act imposes no obligation on the Commonwealth to facilitate that. Finally, s 12 changes the Solicitor-General’s allowance from a fixed statutory rate to a Tribunal‑determined rate, with a default of $11,715 if no determination is made. The default is exactly the same as the amount substituted for the old $10,640. If the Tribunal fails to make a determination, the allowance stays at $11,715, but if the Tribunal later makes a lower determination, the Solicitor-General takes a pay cut. That structural risk is easy to overlook.

For Commonwealth departments and agencies responsible for paying parliamentary and judicial remuneration, compliance begins with correctly identifying the applicable rates and allowances as set out in the Act. For parliamentary salaries, payroll systems must apply a basic salary of $45,543 per annum to all senators and members from 1 July 1986. For office holders covered by the table in s 3, the additional salary and expenses‑of‑office allowance columns must be paid exactly as listed, not the rates that appeared in the original Remuneration Tribunal determination. For judicial officers, the new Schedule set out in s 13 replaces the previous Schedule to the Judicial and Statutory Officers (Remuneration and Allowances) Act 1984. Payroll must be updated to reflect the column 2 salary and column 3 expenses‑of‑office allowance for each office. Travelling allowances for High Court justices (s 8), other office holders (s 10), and Inter‑State Commission members (s 11) must be paid at the increased per diem rates specified. The Solicitor-General’s allowance should be paid at $11,715 per annum unless and until the Remuneration Tribunal makes a valid determination under s 7(1) of the Principal Act as amended, in which case the Tribunal amount applies; if no such determination is in force, the default continues. The most urgent compliance task is the calculation and recovery of overpayments under s 15. The department must identify all payments of parliamentary salary (basic and additional) and parliamentary superannuation benefit made between 1 July 1986 and 23 October 1986 to any person, and compare them against the amounts that would have been payable under the Act had it been in force from 1 July. Any excess must be recorded, and the affected persons must be informed of their liability. The Act does not prescribe a specific notice period or format, but good administrative practice would involve providing a written calculation and demanding repayment. Recovery may be effected by immediate deduction from future salary or pension payments, but careful record‑keeping is essential to avoid disputes over calculation methodology. The deduction authority under s 15(2)(b) is broad, but to maintain procedural fairness, the department should give the affected person an opportunity to review the calculation before deduction. For judicial officers, the overpayment provisions apply only to parliamentary salary and superannuation, not to judicial salaries, so no recovery is required for the judicial amendments in Part III, unless a judge also holds a parliamentary office. For the Remuneration Tribunal, compliance means acknowledging that its Determinations Nos. 7, 8 and 11 of 1986 are modified and that the modified text prevails. The Tribunal should also note that s 14 excludes its power under s 7(8) of the Remuneration Tribunals Act, so it cannot make a new determination that would vary or revoke the modified versions of those specific determinations. For MPs and office holders affected by the overpayment recovery, compliance means either repaying the excess promptly or accepting deductions. Any attempt to refuse repayment or challenge the calculation should be documented, and legal advice sought, because the Commonwealth can sue and the debt is strict. Given that the Act is retrospective and the repayment obligation may be unexpected, seeking legal and accounting advice about tax consequences of the clawback is advisable.
