3Operation of Part

#### 3 Operation of Part (1) This Part has effect in spite of: (a) anything in any Determination of the Remuneration Tribunal made on or before 1 June 1990; or (b) any provision of an Act, being a provision providing for the remuneration or allowances of the holder of an office to be determined by the Remuneration Tribunal (including section 21 of the Workplace Relations Act 1996); or (c) any provision in the Judicial and Statutory Officers (Remuneration and Allowances) Act 1984 that is inconsistent with this Part. (2) Where, after 1 June 1990, the Remuneration Tribunal has made, or makes, a Determination that is inconsistent with a provision of this Act: (a) subject to subsection (3), the Determination operates according to its terms in spite of the provision of this Act; and (b) the provision of this Act ceases to operate. (3) A Determination referred to in subsection (2) that purports to take effect from a day earlier than 1 June 1990 takes effect on 1 June 1990. (4) Where a resolution disapproving of a Determination referred to in subsection (2) is passed as mentioned in subsection 7(8) of the Remuneration Tribunal Act 1973, the provision of the Act overridden by the Determination operates with effect from the day on which the resolution is passed.
