Remuneration Act 1990

The Act defines “remuneration” expansively in section 3 to include salary, allowances, expenses, fees, and any other benefit of a pecuniary nature. This is important because it means the Tribunal’s jurisdiction covers not just base pay but also superannuation contributions, motor vehicle entitlements, housing allowances, and any other financial perk. The core concept is the “Tribunal” itself, a three-member body appointed by the Governor on the nomination of the Minister. Section 5(2) contains a critical disqualification: the Minister must exclude any person whose own remuneration could be affected directly or indirectly by a determination of the Tribunal. This prevents serving judges, magistrates, or clerks from serving on the body that sets their own pay, but it also potentially excludes many senior public servants whose pay is linked to judicial salaries or who might be indirectly affected if the Tribunal’s decisions flow through to other public sector remuneration. The concept of “jurisdiction” is central: Part 3 gives the Tribunal jurisdiction over the offices listed in section 13 and allows additional jurisdiction to be conferred “by any other Act” or by the Governor by proclamation (section 14). This is a flexible and expandable category. Section 14(3) provides that if another Act vests remuneration-setting power in some other person or body, and then jurisdiction is conferred on the Tribunal under section 14, that other body’s power is “correspondingly reduced”. This means the Tribunal can effectively supersede other statutory decision-makers without those statutes being repealed. The “principle of judicial independence” is referenced in section 15 as a factor the Tribunal must have regard to where appropriate. This is a vague directive. It does not require the Tribunal to adhere to any particular methodology or benchmark; it merely obliges consideration. The Act does not require the Tribunal to have regard to economic conditions, the state of public finances, or the private-sector market for legal talent. The concept of “retroactive operation” (section 17) is permissive: the Tribunal can backdate its determination, creating financial uncertainty for affected office holders and the budget. The 2024 transitional provision restricts this for the first determination for parliamentary clerks, but not generally. The concept of “no appeal” (section 18) is absolute on its face, though it likely does not oust judicial review for jurisdictional error. Finally, the Tribunal is given the powers of a Royal Commission (section 11), including the power to summon witnesses, compel production of documents, and take evidence on oath. This is a heavy enforcement tool for what is essentially a salary-setting function.

The primary affected persons are the office holders listed in section 13: the Chief Justice, President of the Court of Appeal, puisne judges (both those appointed to the Court of Appeal and the others), President and Deputy Presidents of the Industrial Court, Senior District Court Judge and other District Court Judges, Chief Magistrate and other Magistrates, Supervising Industrial Magistrate and other Industrial Magistrates, State Coroner and Deputy State Coroners, Commissioners of the Industrial Commission, full-time Commissioners of the Planning Appeal Tribunal, and now (since 2024) the Clerk and Deputy Clerk of the Legislative Council and the Clerk and Deputy Clerk of the House of Assembly. These are not private-sector actors; they are holders of public office. Their direct private interests are affected because their pay is determined by a body they cannot appeal to. They have the right to make submissions (section 10(2)) but no right to negotiate or to challenge a determination on its merits. The Crown (the State of South Australia) is also directly affected: it is bound to pay the determined remuneration from the Consolidated Account (section 19). That means taxpayers indirectly fund whatever the Tribunal decides. The Minister for the time being is affected because the Minister may intervene in proceedings (section 10(4)), but also because a determination that is too generous may create political pressure, while a determination that is too stingy may be challenged as threatening judicial independence. The Governor is affected through the power to appoint Tribunal members and to add offices by proclamation, but that is a formal role. Tribunal members themselves are affected: their own remuneration is set by the Governor (section 7), and they must avoid any office that would be affected by their own determinations (section 6(4)(c) provides that a Tribunal member’s office becomes vacant if they are appointed to an office within the Tribunal’s jurisdiction). Future office holders in any office added by proclamation under section 14 will also be affected: the Governor can bring any public office under the Tribunal’s jurisdiction without further parliamentary scrutiny. That creates a mechanism for incremental expansion of the Tribunal’s reach. Private enterprise is largely unaffected except indirectly: higher judicial salaries may attract talent from private practice, increasing the cost of legal services; conversely, low judicial salaries might make it harder to recruit. The Act does not require the Tribunal to consider these external effects.

The Tribunal has a duty to sit at least once each year to determine or review remuneration (section 8(2)). It must, before making a determination affecting a particular person or class, allow that person or class a reasonable opportunity to make submissions orally or in writing (section 10(2)). This is a procedural right of affected persons. They may appear personally or by counsel or other representative (section 10(3)). The Tribunal is not bound by the rules of evidence and may inform itself in any manner it thinks fit (section 10(1)), which gives it broad discretion but also means that submissions may be treated lightly. The Tribunal has a duty, where appropriate, to have regard to the principle of judicial independence (section 15). It must forward a report of its determination and the grounds for it to the Minister as soon as practicable (section 16(1)). The Minister must then cause copies to be laid before both Houses of Parliament (section 16(2)) and the determination must be published in the Gazette within seven days (section 16(3)). This creates transparency and accountability to Parliament, but it is post-decisional; there is no requirement for pre-decisional public consultation beyond submissions from affected persons. The Minister has a right to intervene in proceedings for the purpose of introducing evidence or making submissions on any question relevant to the public interest (section 10(4)). This is a significant power: the executive can inject its views directly. Theoretically, this could be used to argue for fiscal restraint, but it also creates a risk that the Tribunal becomes a forum for political bargaining. The Governor has the power to make regulations (section 20) and to add offices by proclamation (section 14). The Crown has a duty to comply with determinations (section 19). Affected persons have no right of appeal (section 18). The right to make submissions is their only formal remedy. If the Tribunal breaches procedural fairness (e.g., fails to allow submissions), judicial review may be available, but the Act’s privative clause for appeals will not necessarily oust supervisory jurisdiction. The Tribunal has the power to compel attendance and production of documents under the Royal Commissions Act 1917 (section 11). It may determine its own procedure subject to the Act (section 12). These procedural flexibilities reduce the cost of proceedings for the Tribunal but may increase uncertainty for those appearing.

The Act does not create criminal offences or pecuniary penalties for non-compliance. The enforcement mechanism is civil and administrative: a determination of the Tribunal is binding on the Crown (section 19(a)), and it provides sufficient authority for payment from the Consolidated Account (section 19(b)). If the Crown fails to pay the determined remuneration, the affected officer could seek a declaration or mandamus in the Supreme Court, but the Act provides no express remedy; the binding nature would likely be enforceable like any statutory duty. The Tribunal’s own processes are backed by the Royal Commissions Act 1917 (section 11(2)), which means that a person who fails to attend, refuses to give evidence, or produces false documents could face penalties under that Act (e.g., contempt of a Royal Commission). That Act carries fines and imprisonment. However, that enforcement is for non-cooperation with Tribunal proceedings, not for failure to comply with a determination. The Tribunal itself cannot enforce payment; that is an executive function. If a determination is invalidly made (e.g., without proper submissions), the Crown might refuse to pay on the basis that no valid determination exists. The absence of an appeal mechanism (section 18) does not prevent judicial review for jurisdictional error. If a determination is ultra vires (e.g., covers an office not properly within jurisdiction, or fails to comply with procedural requirements), it may be quashed by a court. That is a form of enforcement against the Tribunal. The Governor’s removal power over Tribunal members (section 6(3) - misconduct or neglect of duty) is a backstop enforcement against members, but it is political. The Act does not provide any penalty for the Minister or Governor if they fail to lay reports before Parliament or publish in the Gazette. Those duties are directory, not mandatory with penalties. Overall, the enforcement structure is light: the main practical enforcement is the Tribunal’s coercive powers during its own inquiries, and the general law of judicial review. This places a premium on the integrity of the Tribunal and voluntary compliance by the Crown.

The Act directly interacts with the Royal Commissions Act 1917 (SA). Section 11(2) makes that Act applicable to the Tribunal as if it were a Royal Commission. That confers the powers to summon witnesses, require production of documents, and examine on oath. It also imports the protections and liabilities of that Act. This is a heavy procedural framework for what is essentially an industrial-type remuneration body. The Act interacts with the Constitution in a broader sense: section 15 requires the Tribunal to have regard to the constitutional principle of judicial independence. That principle is derived from Chapter III of the Commonwealth Constitution and applies to state courts as well. The reference is vague, but it acknowledges that the remuneration of state judges must not be so manipulated as to impair the independence of the state judiciary. If the Tribunal ever made a determination that could be seen as punitive or as a tool of executive pressure, that could raise a constitutional issue. The Act itself does not create a cause of action for breach of that principle; it is merely a factor. Section 14 provides for interaction with other Acts: jurisdiction can be conferred “by any other Act”. That means the Tribunal can be given additional functions by other legislation, and when that happens, the power of any other body to determine that remuneration is correspondingly reduced (section 14(3)). For example, if an Act previously gave the Governor the power to set the salary of a statutory office holder, and a later Act or a proclamation brings that office under the Tribunal, the Governor’s power is reduced. This can create a patchwork of overlapping regimes. Section 19 provides that a determination is sufficient authority for payment from the Consolidated Account. This overrides any requirement for a separate appropriation or approval. It means that the Tribunal’s determination is effectively a spending authority - a significant fiscal power given the Minister’s ability to intervene but not to veto. The Act does not refer to the Public Sector Act 2009 (SA) or enterprise bargaining frameworks, but the offices listed in section 13 are generally outside those frameworks. The 2024 amendment bringing parliamentary clerks under the Tribunal removes them from whatever prior arrangement existed under the Parliament (Joint Services) Act 1985, as noted in the transitional provisions. The Act does not interact with industrial relations legislation because the Tribunal is not an industrial tribunal; it is a specific remuneration body with a closed list of offices. The Regulations power (section 20) is broad but unexercised in the provided text. The Act also interacts with the legislation revision and publication regime: section 2 was omitted under the Legislation Revision and Publication Act 2002, which is a standard housekeeping provision.

The Act was originally passed as No. 19 of 1990, assented and commenced on 19 April 1990. The legislative history table shows four subsequent amendments, each with specific effect on the sections. The Magistrates (Miscellaneous) Amendment Act 2013 (No. 26 of 2013) deleted paragraphs (i) through (l) from section 13. Those paragraphs are not reproduced in the current text, but they originally covered certain magistrates or related offices - the deletion presumably reflected a restructuring of the magistracy. The Statutes Amendment (Attorney-General’s Portfolio No. 3) Act 2017 (No. 70 of 2017) deleted paragraph (h) from section 13, commencing 8 July 2018. What that paragraph covered is unclear from the source, but it was another office removed from the Tribunal’s jurisdiction. The Supreme Court (Court of Appeal) Amendment Act 2019 (No. 45 of 2019) amended section 13 to add new offices: the President of the Court of Appeal (new paragraph (b)) and the puisne judges appointed to the Court of Appeal (new paragraph (ba)). The pre-existing puisne judges not on the Court of Appeal were re-labelled as paragraph (bb). This amendment commenced on 1 January 2021. It also included transitional provisions in Schedule 1, Part 2, clause 90, which gave the Governor the power to determine initial remuneration for the new Court of Appeal positions, pending the Tribunal making its own determination. That clause expressly notes that nothing prevents the Tribunal from later making determinations for those persons. The most recent amendment is the Statutes Amendment (Parliament - Executive Officer and Clerks) Act 2024 (No. 55 of 2024), which added paragraphs (t) and (u) to section 13, covering the Clerk and Deputy Clerk of the Legislative Council and the Clerk and Deputy Clerk of the House of Assembly. It commenced on 5 December 2024. This amendment also included a transitional provision (Schedule 1, clause 1) that preserves the existing remuneration set by the Speaker and President until the Tribunal makes its first determination. Critically, it prohibits the Tribunal from giving that first determination retroactive effect (contrary to the general rule in section 17). This suggests a legislative concern about backdating causing disruption. The legislative history also notes that section 2 was omitted under the Legislation Revision and Publication Act 2002 - a standard clean-up. The historical versions listed are 4 July 2013, 8 July 2018, and 1 January 2021, reflecting the points at which amendments came into force. The Act has remained structurally stable for over three decades, with only incremental changes to the list of offices. No amendment has altered the Tribunal’s powers, its composition rules, or the appeal prohibition.

The source text does not record any litigation under or about the Remuneration Act 1990. The Act itself contains a privative clause in section 18: “A determination of the Tribunal is not subject to appeal.” This would prevent any merits-based appeal to a court or tribunal. However, it does not expressly exclude judicial review for jurisdictional error or denial of procedural fairness. In Australian law, privative clauses are construed narrowly, and the High Court has repeatedly held that Parliament cannot oust the supervisory jurisdiction of the Supreme Court for jurisdictional error, unless the clause is extremely clear and constitutionally valid. Given that the Act is a state law, the state Supreme Court would retain jurisdiction to review decisions that were made without jurisdiction, in breach of procedural fairness, or otherwise in excess of power. No such challenges appear in the supplied material, but that does not mean none have occurred. The Act has been in operation for over 30 years and covers a sensitive area (judicial and senior public salaries), so it is plausible that affected persons have sought judicial review. However, the source provides no case names, so it would be inappropriate to invent any. The lack of recorded litigation in the source may indicate that determinations have been broadly accepted, or that the informal pressure of submissions and the Minister’s intervention has been sufficient to avoid disputes. The Act’s processes are deliberately non-adversarial: the Tribunal is not bound by the rules of evidence, it hears submissions informally, and its determinations are not reviewable on appeal. This reduces the likelihood of litigation but also removes a check on arbitrary decisions. The transitional provision for the 2024 amendment (barring backdating for the first clerks’ determination) suggests that the legislature anticipated potential disputes about retrospectivity. If a future determination were made without allowing submissions, or if the Tribunal exceeded its jurisdiction (e.g., by determining remuneration for an office not validly added to its list), that would be ground for judicial review. The absence of reported cases in the source does not preclude such challenges; it simply means they are not part of the provided material.

The most significant hidden trap is the retrospective operation power in section 17. The Tribunal can fix a date for a determination that is antecedent to the date of the determination or even to the commencement of the Act. That means an office holder might not know their final pay for a past period until after the determination is made, creating tax uncertainty and personal financial planning problems. For clerks, the 2024 transitional provision prevents this for the first determination, but only for them. For judges and magistrates, the possibility of backdating remains. Another gotcha is that determinations are not subject to appeal (section 18). If an affected person believes the Tribunal made an error, their only formal recourse is to make submissions before the determination. After that, they cannot challenge the merits. The only hope is judicial review for jurisdictional error, which is costly and narrow. The Minister’s intervention right (section 10(4)) is a gotcha for affected persons: the executive can put its views directly to the Tribunal, potentially tipping the scales towards austerity or towards generosity, depending on the Minister’s political interests. There is no requirement for the Minister to disclose any private communications with the Tribunal outside the hearing, because the Tribunal determines its own procedure (section 12). A related gotcha is the ability of the Governor to add offices by proclamation (section 14(1)(b)) without parliamentary scrutiny. That means new public offices can be brought under the Tribunal’s jurisdiction by executive action alone. The people holding those offices may not expect their pay to be set by a tribunal rather than by their minister or department. Section 5(4) states that the validity of a determination is not affected by an irregularity in the nomination or appointment of a Tribunal member. So even if the Minister failed to properly exclude a conflicted person, the determination stands. This weakens the conflict-of-interest safeguard in section 5(2). Another gotcha is the breadth of the disqualification in section 5(2): it excludes anyone whose own remuneration could be affected directly or indirectly. “Indirectly” is very broad. It could disqualify, for example, a lawyer whose practice earns a significant portion of its income from representing government clients, if higher judicial salaries might lead to higher government legal fees. This could make it hard to find qualified independent members. The Tribunal’s power under section 11 and the Royal Commissions Act is another gotcha: witnesses can be compelled to attend and produce documents. If an affected person refuses to cooperate, they could face contempt proceedings. Finally, the Act does not require the Tribunal to consider ability to pay or economic conditions. The only mandatory factor is judicial independence (section 15). That creates a risk that determinations become disconnected from fiscal reality, and the Crown is bound to pay (section 19). There is no safety valve for the government to refuse to implement a determination. The only check is the political one: if the Tribunal makes an unpopular decision, the government could amend the Act to remove offices from jurisdiction, but that takes time and parliamentary approval.

Compliance with this Act falls into several categories. For the Crown (i.e., the executive, including Treasury and the Attorney-General’s Department), the key obligation is to pay the remuneration as determined by the Tribunal from the Consolidated Account. No separate appropriation is needed: a determination itself is sufficient authority (section 19(b)). The government should monitor the Tribunal’s meeting schedule (at least once a year under section 8(2)) and ensure that any determinations are gazetted within seven days (section 16(3)). The Minister should prepare to exercise the right to intervene in proceedings (section 10(4)) if the public interest requires it. That may involve preparing evidence and submissions on economic conditions, budgetary constraints, or recruitment and retention issues. The Minister must also cause the Tribunal’s report to be laid before both Houses of Parliament as soon as practicable (section 16(2)). For offices that are added by proclamation under section 14, the government must ensure that the proclamation is properly made and published, and that any conflicting powers in other Acts (section 14(3)) are identified and adjusted. For the Tribunal itself, compliance means: convening at least one sitting per year (section 8(2)); giving affected persons a reasonable opportunity to make submissions (section 10(2)); having regard to judicial independence where appropriate (section 15); forwarding a report with grounds to the Minister (section 16(1)); and publishing the determination in the Gazette within seven days (section 16(3)). The Tribunal must be properly constituted of two or three members (section 9(1)) and decisions must have at least two members concurring (section 9(2)). Members must disclose any conflicts and must not be appointed if their own remuneration could be affected (section 5(2)). If a member is later appointed to an office within the Tribunal’s jurisdiction, their office becomes vacant (section 6(4)(c)). For affected office holders (judges, magistrates, coroners, commissioners, clerks, and any others added), compliance means being aware of the Tribunal’s processes and exercising the right to make submissions. They should monitor the Gazette and the Tribunal’s reports. They should keep records of their current remuneration and any changes. If a determination is retrospective (section 17), they may need to seek tax advice. They cannot appeal, so they should make the best case they can at the submission stage. For clerks, they should note the special transitional provisions restricting backdating. For any person contemplating an appointment to the Tribunal, they must ensure they are not disqualified under section 5(2). The Governor and the Minister must comply with the appointment process: the Minister must nominate, and must exclude conflicted persons; the Governor appoints. The Governor may remove a member for misconduct or neglect (section 6(3)), so the Minister should monitor any potential grounds. The Governor also sets the remuneration of Tribunal members (section 7), which is a separate function not delegated to the Tribunal. That power should be exercised transparently to avoid undermining the Tribunal’s independence. Regulations under section 20 may be made if needed, but none are in the source. Overall, the compliance burden is low on a day-to-day basis, but the potential for unexpected determinations with retrospective effect, or for jurisdictional expansion by proclamation, means that all affected parties should stay informed of Tribunal activities and any amendments to the Act.
