Relationships Regulations 2016

The Regulations are built around a handful of discrete legal concepts and mechanisms.

• Corresponding law, defined by cross‑reference: The Regulations operate by reference to the definition of "corresponding law" in section 33A of the Relationships Act 2008. Regulation 1 states that the objective is to prescribe laws to be corresponding laws for the purpose of paragraph (a) of that definition. The Regulations do not reproduce section 33A or expand on the broader statutory definition; they simply identify which specific laws are to be treated, for that paragraph, as corresponding laws (regulation 1; regulation 4).

• Prescription by naming: Regulation 4 lists, by name and in many cases by specific parts, statutes and codes from multiple jurisdictions. The form is an express prescription: "the following are prescribed laws" and then an itemised list (regulation 4). The list includes whole acts (for example "Civil Partnership Act 2004 of the United Kingdom" (regulation 4(e))) and specific books, divisions or chapters of other codes and statutes (for example "Book 1, Civil Code of Québec, Canada" (regulation 4(a)); "Chapter 572 Marriage, Part 1 and Chapter 572B Civil Unions, Hawaii Revised Statutes" (regulation 4(c)); "Division 3 Marriage, Family Code of the State of California" (regulation 4(j))).

• Reliance on authorising head‑power: The Regulations are made under the power in section 71 of the Relationships Act 2008 (regulation 2). The authorising provision locates the Regulations in subordinate legislation; the Regulations therefore operate to fill a gap delegated by the primary Act, not to alter the primary Act.

• Commencement and temporality: The Regulations have an express commencement date of 1 July 2016 (regulation 3). The document records the date of making as 15 June 2016 and that the Regulations will sunset 10 years after making, on 15 June 2026 (endnotes, General information and Subordinate Legislation Act 1994 reference).

• Interaction with interpretive rules: The endnotes state that provisions of the Interpretation of Legislation Act 1984 (ILA) , in particular the provisions about style changes and the status of headings, examples, punctuation and provision numbers , apply to the Statutory Rule as a whole (endnotes, Interpretation of Legislation Act 1984). That material affects how the Regulation should be read and therefore how the named laws might be located and identified in practice.

The Regulations therefore are not conceptually broad. Their substantive concept is "prescription" as applied to "corresponding law". They rely on a simple mechanism: an authoritative list inserted into subordinate legislation and linked back to the definition in the principal Act.

The Regulations directly affect the legal operation of the concept "corresponding law" under the Relationships Act 2008 by determining which named laws count under paragraph (a) of section 33A's definition. That effect will, in practice, reach a group of actors who use the Relationships Act and its "corresponding law" concept.

• Legal and government decision‑makers: Statutory office‑holders, registrars, administrative decision makers and courts that rely on the Relationships Act 2008 to determine recognition, registration or other treatment of relationships will be affected in the sense that, when the Relationships Act requires reference to a "corresponding law" for paragraph (a) of s 33A, the list in regulation 4 must be consulted and applied. The Regulations were made under section 71 of the Relationships Act 2008, which supplies the enabling power for subordinate rules that support administration of the Act (regulation 2).

• People in relationships formed under the named laws: Persons whose relationship status is governed by one of the listed instruments may be affected if the Relationships Act 2008 uses the concept of a corresponding law to determine rights, registration eligibility or recognition. The Regulations do not themselves state the particular rights or forms of recognition, but by declaring a law to be a corresponding law for the specified statutory purpose they alter the set of foreign and domestic instruments relevant to decisions under the principal Act.

• Lawyers, accountants and advisers: Practitioners advising clients on recognition of relationships under the Relationships Act will need to confirm whether a client's applicable foreign or interstate law appears on the list in regulation 4. The Regulations name specific parts of foreign statutes and Australian state/territory laws. Advice, filings and court pleadings will need to refer to the precise entries in regulation 4, rather than to broader notions of "laws of a foreign jurisdiction" or to more general comity principles.

• Public bodies and registries: Registries or administrative units tasked with processing relationship registrations or related administrative actions under the Relationships Act will need administrative procedures that consult regulation 4 and identify the named texts. The endnotes require awareness of commencement and sunset dates for the Regulations (regulation 3; endnotes).

• Researchers and media: For anyone analysing the statutory landscape of relationship recognition, the Regulations provide a fixed list of statutory references that must be checked. The list includes overseas laws in Canada, the Netherlands, United States states, New Zealand, South Africa, United Kingdom and parts of various Australian states and territories (regulation 4).

Actors not directly listed , such as private businesses, employers or third‑party service providers , may be indirectly affected if determinations under the Relationships Act in individual cases change rights or obligations relevant to them. However, the Regulations do not themselves set out any operational duties, obligations or entitlements beyond altering the statutory catalogue used under s 33A para (a) of the Relationships Act; the Regulations therefore act as an enabling tool whose downstream effects depend on how the principal Act applies the concept of "corresponding law".

The Regulations are primarily prescriptive in form and do not themselves create detailed duties, rights or obligations. Their key legal operation is to declare which laws are "prescribed laws" for the purpose of paragraph (a) of the definition of "corresponding law" in section 33A of the Relationships Act 2008 (regulation 4). The immediate legal consequence is therefore definitional: the Relationships Act must treat the listed instruments as corresponding laws in the relevant context.

What the Regulations do not do is equally important and must be stated. They do not set out procedural requirements, registers, forms, penalties, enforcement mechanisms, or administrative processes. They do not say that any legal consequence follows automatically from a relationship being one regulated by a prescribed law; they provide only the material that the Relationships Act uses in its own operative sections. Consequently, the Regulations create no stand‑alone statutory duty to act, notify or register. Any duties or rights that arise once a law is treated as a corresponding law derive from the Relationships Act itself, not from these Regulations.

For practical compliance and action, the Regulations impose an obligation of attention. Decision makers applying the Relationships Act must consult regulation 4 and use the exact items listed when addressing the meaning of "corresponding law" for s 33A para (a). That is a legal duty of statutory interpretation and application: when the principal Act calls for identification of a corresponding law as defined, a prescribed list exists and must be used. The Regulations do not provide any guidance about how to interpret or apply the provisions of the named overseas or interstate laws; that interpretive task remains with the bodies applying the Relationships Act and potentially with courts.

The endnotes clarify interpretive background rules and the authoritative status of the Statutory Rule's headings and style under the Interpretation of Legislation Act 1984. Those interpretive rules change how the Regulations will be read, because headings, punctuation and examples included are part of the Statutory Rule (endnotes, Interpretation of Legislation Act 1984). Practitioners should therefore treat the labels used in the list and the structure of the instrument as legally operative in locating and applying the prescribed laws.

In short, the principal duty created by the Regulations is an application duty: decision makers must use the list in regulation 4 when implementing s 33A para (a) of the Relationships Act 2008. Rights or obligations that flow from a law being a corresponding law depend on how the Relationships Act treats corresponding laws; those operative effects are not restated in the Regulations themselves.

The Regulations do not create penalties or prescribe enforcement mechanisms. They are declaratory subordinate legislation that identifies a set of "prescribed laws" for the definitional purpose in section 33A of the Relationships Act 2008. The text contains no offence provisions, monetary fines, enforcement agency powers, compliance notices, or administrative penalty frameworks. The absence of penalty clauses or enforcement specifications is evident from the full text: regulation 4 is limited to a naming list, and regulations 1-3 set out objective, authorising provision and commencement. There are no subsequent regulations imposing sanctions.

This silence means two things in practice. First, any enforcement, sanction or remedial consequences that attach to the categorisation of a law as a "corresponding law" must be sought in the Relationships Act 2008 itself or in other primary or subordinate instruments referenced by the principal Act. The Regulations operate as an input to that statute; they do not themselves enforce or sanction. Second, administrative actors applying the Relationships Act will need to rely on the principal Act for procedural and enforcement tools. When a decision under the Relationships Act depends on whether a law is a corresponding law, the Regulations resolve that question by naming the applicable instruments; but the Regulations offer no separate compliance‑enforcement apparatus.

Practitioners and administrators should also note the endnote material on interpretive provisions contained in the Interpretation of Legislation Act 1984. Those provisions govern the construction and internal status of the Statutory Rule parts such as headings and punctuation. They do not create penalties either, but they are relevant if a dispute arises over the scope or meaning of the Regulations and whether a particular foreign or interstate instrument falls within a listed item.

Finally, the Regulations' sunset under the Subordinate Legislation Act 1994 (endnotes) affects enforcement only indirectly. After sunset, the list as contained in these Regulations will cease to have legal effect. Any enforcement or consequence based on whether an instrument is a "corresponding law" will then depend on whether the principal Act or other subordinate instruments supply an alternative list or mechanism. The Regulations themselves do not provide for transitional enforcement arrangements in the event of sunset.

The Regulations are explicitly cross‑linked to several other statutory instruments and interpretive statutes. The primary statutory relationship is with the Relationships Act 2008. The Regulations state they are made under section 71 of that Act (regulation 2), and they are drafted to supply the content required by paragraph (a) of the definition of "corresponding law" in section 33A of the principal Act (regulation 1; regulation 4). Accordingly, the Regulations operate only as a subordinate instrument to be read in conjunction with the Relationships Act.

The endnotes make clear that the Interpretation of Legislation Act 1984 (ILA) governs elements of style and interpretation that apply to the Regulations. The endnotes list the operative interpretive effects of the ILA, including that headings, examples, diagrams, notes, punctuation and provision numbers included in a Statutory Rule form part of the Statutory Rule (endnotes, Interpretation of Legislation Act 1984). That interaction matters because it limits and clarifies how the names and parts of the laws in regulation 4 are to be read. Practitioners should treat the list entries and their labels as part of the statutory text.

The Regulations also operate in the broader subordinate legislation system governed by the Subordinate Legislation Act 1994. The endnotes specify that the Regulations will sunset 10 years after the day of making on 15 June 2026 and explicitly reference section 5 of the Subordinate Legislation Act 1994 for that operation (endnotes, General information). That cross‑reference means the Regulations' continued legal force is conditioned by the sunset rules in the Subordinate Legislation Act.

There is also implicit interaction with the domestic and foreign laws that the Regulations name. Regulation 4 supplies a list which includes laws from multiple jurisdictions, including particular parts of those jurisdictions' codes and statutes. The Regulations do not purport to alter those foreign or interstate laws; they simply nominate them for the limited purpose in s 33A para (a). Consequently, any substantive application of the content of those instruments , for example, determining whether a relationship established under one of those instruments satisfies a statutory test in the Relationships Act , will require interpretive work across jurisdictions: retrieving the appropriate text or part as named in regulation 4 and interpreting it in light of the applicable statutory provision.

Finally, because the Regulations do not specify whether the named laws are to be taken as at a particular date or as including subsequent amendments, the temporal interaction between the Regulations and the named laws is unresolved within the text. The Regulations do not expressly state that a named law is to be taken "as in force" at a particular time or "as amended", nor do they provide transitional rules. That gap means practitioners must pay close attention to the Relationships Act and general principles of statutory interpretation , and to any applicable interpretive provisions in the ILA , when deciding how to treat later amendments to a named foreign or interstate law.

The Regulations present a straightforward amendment history: none. The published table of amendments and the separate endnotes explicitly state that there are no amendments made to the Relationships Regulations 2016 by statutory rules, subordinate instruments or Acts (endnotes, Table of Amendments). The text also records that there are no amendments not in operation at the date of publication (endnotes, Amendments Not in Operation).

The filing and version metadata identify the instrument as Version No. 001 and state the version was current as at 1 July 2016. The Regulations were made on 15 June 2016 by the Administrator acting as the Governor's deputy with Executive Council advice under section 71 of the Relationships Act 2008, and came into operation on 1 July 2016 (endnotes, General information; regulation 3). The endnotes also flag statutory procedural matters such as style changes authorised under ILA s 54A and the effect of amendments to section 36 of the ILA on headings, punctuation and the like (endnotes, Interpretation of Legislation Act 1984).

Because the instrument itself was made in 2016 and the endnotes assert no subsequent amendments, the original list of prescribed laws in regulation 4 remains as made. The endnotes also warn that explanatory details are not included and there were "No entries at date of publication" in the explanatory details section (endnotes, Explanatory details).

The Regulations are subject to the automatic sunset provision in the Subordinate Legislation Act 1994: the document records that the Statutory Rule will sunset 10 years after making, on 15 June 2026 (endnotes, General information and Subordinate Legislation Act 1994 reference). The sunset is a legislative mechanism that will remove the Regulations from force unless a replacement or extension is enacted before that date. No amendments or replacement regulations are recorded in this instrument as at the publication date.

In short, the Regulations have a simple amendment history: they were made on 15 June 2016, commenced 1 July 2016, have not been amended, and are slated to sunset on 15 June 2026 under the Subordinate Legislation Act 1994.

The Regulations do not record any litigation history. The published text contains no references to cases, judicial decisions, appeals, or legal challenges involving the Regulations themselves. The endnotes and table of provisions provide versioning, making and commencement details but do not indicate that the Regulations have been the subject of judicial review, declaratory proceedings, or contested administrative decisions.

Because the Regulations are primarily a naming instrument that prescribes laws to be treated as corresponding laws under a definition in the Relationships Act 2008, litigation that might engage them would likely arise only in the context of a dispute under the principal Act in which the question whether a particular foreign or interstate law counts as a corresponding law becomes material. The Regulations contain no provisions establishing jurisdiction, procedures, or remedies specific to the Statutory Rule. Accordingly, any litigation touching the Regulations would almost certainly be by way of challenge or interpretation tied to substantive outcomes under the Relationships Act.

The absence of recorded litigation in the instrument and its endnotes means that, as at the date of publication, there is no internal statement of case law or judicial construction to guide how courts have approached the Regulation's list or its interaction with s 33A of the Relationships Act. Practitioners should therefore treat the Regulations as a statutory listing that requires application in context, and seek judicial guidance from cases under the Relationships Act where appropriate. The Regulations themselves contain no litigation annotations, reported decisions or commentary.

The Regulations are short and appear simple, but they contain several features that can lead to practical pitfalls if not read carefully.

• Narrow, specific naming: Regulation 4 prescribes particular instruments and, in several instances, specific parts of those instruments. For example, it prescribes "Book 1, Civil Code of Québec, Canada" (regulation 4(a)) and "Chapter 572 Marriage, Part 1 and Chapter 572B Civil Unions, Hawaii Revised Statutes" (regulation 4(c)). A practitioner who assumes that "the Civil Code of Québec" or "Hawaii law" generally is prescribed would risk error. The Regulation names specified parts and acts; compliance requires matching the named item precisely.

• No express temporal qualification: The Regulations do not state whether the named laws are to be read as at a particular date or as including later amendments. The instrument prescribes laws by name without saying "as in force on 1 July 2016" or "as amended from time to time". Users should not assume the temporal scope. The instrument is silent on whether future amendments to the named foreign or interstate laws are captured; this absence creates legal uncertainty that must be resolved by reference to the Relationships Act and interpretive statutes.

• Limited substantive content: The Regulations do not themselves explain the consequences of the prescribed status. The document provides no guidance on what recognition, registration or entitlements follow from the Relationships Act treating a named law as a corresponding law. Lawyers and administrators must therefore perform further statutory reading of the Relationships Act to determine practical outcomes. Relying on the Regulations alone to assert rights or to advise clients will be incomplete.

• Interpretation rules apply: The endnotes emphasise that style changes and interpretive rules from the Interpretation of Legislation Act 1984 apply. This means headings, punctuation and examples included in the Statutory Rule are part of the instrument (endnotes, Interpretation of Legislation Act 1984). Small differences in how a named law is captioned or punctuated in the Regulation may therefore be legally material in construing what the Regulation prescribes.

• Sunset risk: The Regulations will sunset on 15 June 2026 unless renewed or replaced (endnotes). Any reliance on the list in regulation 4 should take into account that the statutory basis will cease to have effect after that date unless a new instrument is made. Stakeholders should avoid assuming permanence.

• Geographical spread and heterogeneity: The list includes laws from multiple jurisdictions with different legal structures. For example, some items are whole acts from common law jurisdictions, others are specific parts of codes from civil law jurisdictions, and some items are state or territorial statutes within Australia. Translating those differences into practical application under the Relationships Act can be complex because the Regulations do not harmonise or explain differences. The Regulation names what counts rather than how to reconcile competing legal concepts across jurisdictional regimes.

• No penalties or procedural tools: Because the Regulations contain no enforcement provisions, users may be tempted to treat the list as procedural guidance only. It is not a procedural code; the operative mechanisms for enforcement, registration or rights remain with the Relationships Act. Failure to apply the principal Act in conjunction with these Regulations may yield procedural mistakes.

• Absent explanatory materials: The Explanatory details section contains "No entries at date of publication" (endnotes). There is therefore no accompanying official guidance in this instrument about legislative intent, transitional arrangements or administrative procedures that might assist practitioners in resolving borderline questions.

Each of these gotchas is a matter of statutory drafting and placement. The Regulations perform a focused function, and practitioners must combine them with the principal Act and interpretive statutes to reach a legally sound result.

For practitioners, administrators and advisers who must apply the Relationships Act 2008 in contexts where the status of a "corresponding law" matters, the Regulations impose a clear set of practical steps derived from their structure.

1. Start with the Relationships Act 2008: When the question of a corresponding law under section 33A paragraph (a) arises, read that statutory provision in the Relationships Act first and then consult the Regulations to identify prescribed laws. The Regulations supply the catalogue; the principal Act supplies operative effects. Regulation 1 and regulation 4 show the intended linkage.

2. Consult regulation 4 precisely: Use the exact nomenclature in regulation 4 when determining whether a foreign or interstate law is prescribed. The list is specific. For example, some entries refer to particular books, divisions, chapters or parts. Confirm that the law you intend to rely on matches the precise entry, including any part references. The list is at regulation 4(a)-(r).

3. Obtain authoritative texts of the named items: For each prescribed law you need to rely on, obtain the authoritative text as identified by the Regulation. Where the Regulation prescribes a part or division (for example "Division 3 Marriage, Family Code of the State of California" or "Chapter 572 Marriage, Part 1 and Chapter 572B Civil Unions, Hawaii Revised Statutes"), retrieve that specific part of the text. Do not rely on summary descriptions or secondary sources alone.

4. Check commencement and sunset: The Regulations commenced on 1 July 2016 (regulation 3) and the endnotes indicate they will sunset on 15 June 2026 under the Subordinate Legislation Act 1994. When applying the Regulations close to the sunset date, confirm whether the Regulations remain in force or whether they have been replaced or extended.

5. Account for interpretive provisions: The Interpretation of Legislation Act 1984 rules referenced in the endnotes affect how the Regulations are read. Treat headings, punctuation and provision identifiers as operative parts of the Statutory Rule. Where drafting ambiguity exists, consult the ILA provisions cited in the endnotes for guidance on statutory construction.

6. Do not assume automatic substantive effect: The Regulations do not set out the consequences of a law being prescribed. To advise on rights, registration, recognition or entitlements, read the Relationships Act provisions that use the "corresponding law" concept. The Regulations are material to that task but are not determinative of substantive outcomes by themselves.

7. Maintain version control: Because the Regulation lists particular foreign and interstate instruments, maintain clear records of which version or part of that law you relied on and the date. The Regulations do not specify whether subsequent amendments to a prescribed law are included; accordingly, document whether you used the text as in force on a given date.

8. Record reasoning in administrative files: When making an administrative decision that turns on whether a particular law is a corresponding law, record the cross‑checking process: cite regulation 4, identify the entry that was matched, and attach or cite the authoritative text retrieved. This will help if the classification becomes relevant in later proceedings.

9. Seek secondary guidance where the match is uncertain: If there is doubt whether a given foreign or interstate instrument falls within a named item (for example because of differences in titles, translations, or reorganisation of parts), escalate to legal counsel or seek authoritative advice from the responsible legislative or registry body before making a conclusive determination.

10. Monitor for replacement or amendment: Given that the Regulations were made in 2016 and are subject to sunset, monitor legislative publications for any updated Regulations or amendments that might alter the prescribed list. The endnotes indicate there were no amendments at date of publication, but that status can change.

These steps are procedural and organisational because the Regulations function as a classificatory instrument. Compliance therefore consists primarily of ensuring the correct statutory texts are identified and used when the Relationships Act requires reference to a corresponding law under s 33A para (a).
