### 42 Adjournment because of proceedings in Family Court > > (1)  Without limiting the power of a court to grant an adjournment in relation to any proceedings before it, the court may adjourn the hearing of the application for an order under [section 40](#GS40@EN) if, before the court has made a final order to adjust interests with respect to the property of either or both partners, proceedings in relation to the property are commenced in the Family Court of Australia. > > > (2)  If the hearing of an application for an order is adjourned under [subsection (1)](#GS42@Gs1@EN) , either partner may apply to the court for the hearing of the application to proceed.
