What it does
This Act is an amending and commencement instrument for the Registration to Work with Vulnerable People Act 2013 and its Regulations. It does four discrete things, as shown in the text you supplied.
- Short title: s 1 names the instrument the Registration to Work with Vulnerable People Amendment Act 2015.
- Commencement: s 2 sets staged start dates. Except where otherwise provided, the Act commences on the day it receives Royal Assent. Two parts have delayed commencement dates: Part 4 (amendments to the Regulations) commences on 1 December 2015, and Part 3 (further amendments to the Principal Act) commences on 1 April 2016. The remainder begins on Royal Assent.
- Incorporation of amendments into the authorised (consolidated) texts: a large number of sections (displayed as ss 3-36 and repeated later as ss 3-36 and ss 38-40, ss 42 and similar) do not set out the substantive amendment text in the Act itself. Instead, they state that "The amendments effected by this Part have been incorporated into the authorised version of the Registration to Work with Vulnerable People Act 2013" (or the authorised Regulations as the case may be). Those clauses indicate that the legal effect of the amendments is to be read in the consolidated, authorised version of the Principal Act or Regulations.
- Preservation of regulatory amendment power: s 43 expressly provides that the amendment by this Act of any regulations does not bar their subsequent amendment or repeal by regulation.
Mechanically, therefore, the Act does not create new standalone obligations, offences, or regulatory detail within its own text beyond commencement mechanics, the incorporation notices, and s 43. Its operative effect is to alter the content of the authorised versions of the Principal Act and the Principal Regulations. Practitioners must therefore consult the authorised/consolidated versions of the Registration to Work with Vulnerable People Act 2013 and of the Registration to Work with Vulnerable People Regulations 2014 to see the precise legal rules now in force. The Act identifies the Principal Act (s 37) and Principal Regulations (s 41) for this purpose.
