Registration of Deeds Act 1957

The Act relies on a small set of interlocking administrative and legal concepts. Below, each concept is set out with its statutory basis and practical implication.

• Register and registration copy. The statutory register is the “general register of deeds” kept by the registrar-general (s 3). The term “registration copy” is defined in the dictionary and means either the original deed deposited on registration or the copy deposited on registration when the original is not lodged (dictionary, registration copy). Practically, the registration copy is the document that the registrar-general endorses with the memorandum of registration (s 4(5)) and the copy from which certified copies are issued (s 7).

• Modes of deposit. Registration may occur in three ways (s 4(1)): deposit of the original; production of the original with deposit of a verified copy (the verification must be by a person who has compared the copy to the original); or deposit of a certified copy where the original is already registered/filed in another State or Territory, with certification by the officer having custody or by satisfying the evidentiary rules of that jurisdiction (s 4(1)(a)-(c)). This creates a mechanism for interstate recognition of documentary proof via certification or statutory evidentiary effect under the other jurisdiction’s law.

• Registrability standards and registrar-general discretion. The registrar-general must refuse deposit where the deed or copy is not legible, not on paper of an approved size and standard, or will not remain easily readable if entered in the register (s 4(2)-(3)). Authentication rules for interlineations, alterations and erasures in deposited copies are prescriptive (s 4(4)). Those statutory requirements place a compliance cost on depositors and confer administrative discretion on the registrar-general.

• Priority principle. Section 4A sets the core substantive rule that, for deeds executed or made in good faith and for valuable consideration and registered under the Act, priority among deeds is determined solely by the sequence of registration. The rule is limited by two features: it is conditional on good faith and valuable consideration in the deed’s execution or making, and it is subject to inconsistency with the Commonwealth Personal Property Securities Act 2009 (s 4A note). Section 4A(2) also provides a protective rule for a bona fide purchaser for value who registers, saving priority even where the conveying party acted in bad faith so long as the beneficial taker acted in good faith and gave valuable consideration.

• Substantial compliance and rectification. Section 4B preserves registrations from being defeated by omission, misdescription or error so long as the identity of the deed is established and the Act’s requirements have been substantially complied with. That allows a measure of remedial effect where minor defects would otherwise be fatal.

• Indexing, searching and certified copies. The registrar-general must keep an index (s 5). Section 6 allows persons to search the index and examine registration copies. Section 7 obliges the registrar-general to issue a certified copy of the registration copy upon application (a fee may be charged: note to s 7 and s 8).

• Delegated instruments. Fees and approved forms are governed by instruments subject to Parliamentary oversight: the Minister’s fees determination is a disallowable instrument (s 8(2)), and approved forms are notifiable instruments (s 9(3)). This inserts delegated governance points into the otherwise short Act.

• Exclusions and inter-statutory relationships. The dictionary excludes certain documents from the Act’s “deed” definition, most notably instruments under the Land Titles Act 1925 (subject to the carve-out for short leases/subleases) and wills and documents evidencing a change of name (dictionary). The Act contains an express note that the PPS Act governs certain personal property interests and that this Act is ineffective to the extent of inconsistency (s 4A note).

These concepts show that the Act is primarily a statutory procedural register with limited substantive priority rules constrained by good faith and valuable consideration and subject to other statutory regimes.

The Act creates duties, discretions and costs that affect a discrete set of players; the text identifies the roles and who bears what responsibilities.

• Registrar-general. The registrar-general is the central administrative actor. The registrar-general must keep the register in the form the Minister directs (s 3), keep an index (s 5), permit searches and examinations (s 6), issue certified copies on application (s 7), and approve forms (s 9(1)). The registrar-general has explicit discretion to refuse unacceptable deposits (s 4(2)-(3)) and to insist on authentication of alterations or erasures (s 4(4)). The registrar-general is a gatekeeper of admissible registration material and of the practical accessibility of registration records.

• Minister. The Minister has the power to determine fees for services under the Act (s 8(1)). That power places the financial burden of the register on those who use it, but subject to Parliamentary oversight because fee determinations are disallowable instruments (s 8(2)). The Minister also directs the form of the register (s 3).

• Persons lodging deeds and interested third parties. Any person may register a deed under s 4(1). Persons who wish to search, obtain certified copies, or rely on priority of registration will be affected. Those who place deeds on the register must meet the registrar-general’s standards: legibility, paper size/standard and authentication requirements for corrections (s 4(2)-(4)). Persons claiming priority under s 4A must establish that the deed was executed or made in good faith and for valuable consideration.

• Persons dealing with personal property. The Act contains a direct statutory interaction with the Commonwealth Personal Property Securities Act 2009 (PPS Act): to the extent the Act is inconsistent with the PPS Act, the PPS Act prevails (s 4A note). Persons whose interests are governed by the PPS Act must therefore treat this register as subordinate for those interests.

• State or Territory officers and interstate registries. The Act recognises documents already registered in another State or Territory if an appropriate certified copy is deposited or if the law of that jurisdiction treats the copy as evidence of contents (s 4(1)(c)). Officers of other jurisdictions who certify custody therefore indirectly participate in enabling registration in the ACT.

• Parties to land transactions and those relying on land instruments. The dictionary excludes many instruments that are properly the subject of land title registration under the Land Titles Act 1925 (dictionary). Practitioners who operate in Torrens-system land conveyancing should note whether a particular instrument is excluded from this Act and must instead be lodged under the land titles legislation.

• Persons subject to criminal penalty provisions. Although the Act itself does not create express offences for most failures, the note to s 4 directs attention to the Criminal Code, part 3.4, for false or misleading statements, information or documents. Those who make false statements in connection with registration risk criminal liability under the Criminal Code.

• Public and private sector users of information. The Act permits public searches of the index and examination of registration copies (s 6). This affects journalists, researchers, banks, purchasers and other users who will rely on the register to check priority and to obtain certified copies (s 7).

Who pays. The Act contemplates that users will pay for services: fees for registration and certified copies may be determined by the Minister (s 8 and note to s 7). The republished law contains a republication note stating the penalty unit values at that date; fee values and the cost of transactions will therefore depend on the Minister’s disallowable fee instruments (preamble note on penalties and s 8(2)). Who decides. Operational decisions, acceptance or refusal of deposits, approval of forms, issuance of certified copies, and daily administration, are taken by the registrar-general, while fees are set by the Minister.

The Act is short and administrative; its duties and rights are correspondingly procedural. The following lists the main statutory duties, discretions and rights and their practical operation.

Duties and powers of the registrar-general

• Maintain the register in the form directed by the Minister (s 3). The Act gives the registrar-general positive obligations to keep records in a Ministerially approved form.
• Keep an index of registered deeds (s 5).
• Allow inspection and searching of the index and registration copies (s 6).
• Issue certified copies of registration copies on receipt of a specified application (s 7). The registrar-general must issue the certified copy once an application specifies the particular deed; a fee may be charged (note, s 7).
• Approve and require the use of forms for prescribed purposes (s 9). Approved forms are mandatory for the specified purposes (s 9(2)).
• Refuse to accept deposited originals or copies that fail the statutory quality/legibility/paper standards (s 4(2)-(3)).

Duties of depositors

• Present the deed in an approved form and on approved paper and ensure legibility (s 4(2)). If lodging a copy, the copy must be verified as a true copy by someone who compared it with the original (s 4(1)(b)).
• If lodging a copy of a deed already registered in another jurisdiction, deposit the copy certified as a true copy by the officer with custody, or a copy that the other jurisdiction treats as evidence (s 4(1)(c)).
• Comply with authentication requirements for interlineations, alterations and erasures in copies: initial authentication for alterations and initials/signature for rewritten erasures in the margin (s 4(4)).
• Request, if desired, that the registrar-general endorse the memorandum of registration on an additional copy (s 4(5)(b)).

Rights conferred by registration

• Priority according to registration sequence. For deeds affecting land, estate or interest in land or other property, deeds registered in good faith and for valuable consideration have priority according to registration order only (s 4A(1)). The registered holder who is a bona fide purchaser for value retains priority even if the conveyancer acted in bad faith (s 4A(2)).
• Right to search and inspect registration copies and the index (s 6).
• Right to obtain certified copies from the registrar-general (s 7).

Protective and remedial provisions

• Substantial compliance safety net. Registration is not defeated by omission, misdescription or error if the deed’s identity is established and the Act’s requirements have been substantially complied with (s 4B). This creates a statutory cushion against technical invalidity of the registration process, reducing the risk that minor clerical errors will destroy registered priority.

Delegated instrument rights

• Right to rely on specified delegated instruments: the Minister’s fees determination (s 8) and registrar-general’s approved forms (s 9). Those instruments must be made and notified in accordance with the Legislation Act processes: fees determinations are disallowable instruments (s 8(2)), approved forms are notifiable instruments (s 9(3)).

Limitations and external constraints

• The Act yields to the PPS Act as to interests covered by that federal scheme (s 4A note). Practitioners must therefore consider parallel federal registration regimes for relevant personal property.
• The dictionary excludes instruments that are the subject of the Land Titles Act 1925 from the Act’s definition of “deed” (dictionary), which limits the Act’s application to instruments not already governed by the Torrens or land title regime.

Procedural observations that generate compliance obligations

• The registrar-general has broad gatekeeping authority over what is accepted for registration (s 4(2)-(3)). Those who instruct registration must therefore ensure front-end compliance with the registrar-general’s standards to avoid refusal and consequent delay or fees.
• Fees and required forms are not generated solely by the Act: users must consult Ministerial fee determinations and registry-approved forms because the Act requires use of approved forms where made (s 9(2)) and contemplates fees for registration and certified copies (note to s 4 and s 7, s 8).

The Act itself contains limited express sanctioning provisions, but it sits in an enforcement and liability environment shaped by other statutory regimes and administrative instruments.

Express penalties in the Act

• The Act does not set fines or imprisonment for most failures to comply with its procedural requirements within its text. There is no standalone schedule of offences and penalties in the body of the Act.

Criminal offences and references

• The Act contains an explicit note warning that making false or misleading statements, providing false or misleading information, or producing false or misleading documents may constitute an offence under the Criminal Code, part 3.4 (note to s 4). That cross-reference points depositors to Commonwealth criminal provisions that create criminal liability for dishonesty in statutory dealings.

Administrative enforcement

• Registrar-general discretion to refuse inadequate deposits (s 4(2)-(3)) is the primary administrative enforcement tool embedded in the Act. Refusal operates as a practical sanction: if a deed is refused, registration (and the benefits of registration such as priority under s 4A) will not be obtained until the defect is cured.
• Approved forms and fee determinations attach regulatory force: failure to use an approved form where one exists breaches the Act’s administrative requirements (s 9(2)), and fees for services are payable as determined by the Minister (s 8(1)). The Act does not specify sanctions for failing to pay a fee; enforcement of fee recovery or refusal to provide services are the expected administrative consequences.

Instrument oversight and parliamentary control

• Fee determinations are disallowable instruments (s 8(2)), exposing them to Legislative Assembly scrutiny and potential disallowance. Approved forms are notifiable instruments (s 9(3)), which requires notification under the Legislation Act 2001. Those procedural constraints create political and parliamentary checks on delegated instruments.

Penalties at the republication date

• The republication preamble records that, at the republication date, the value of a penalty unit for offences against this law is $150 for an individual and $750 for a corporation (see “Penalties” note in the republished law). That figure is a republication note and not a standalone penalty schedule in the Act.

Dispute resolution and court enforcement

• Priority disputes and challenges to registrability will be resolved through the courts because the Act sets out rights of priority (s 4A) and a register-based evidentiary regime (s 7). The Act provides the register and the registration copy as evidentiary foundations, but enforcement of rights, rectification of errors, and adjudication of good faith and valuable consideration are matters for judicial determination under general law. The Act itself does not establish a tribunal or a specialised enforcement process.

Interaction with Commonwealth regimes

• The Act expressly defers to the Personal Property Securities Act 2009 (PPS Act) where inconsistent (s 4A note). For interests within the PPS Act’s scope, enforcement and priority will be determined according to that federal scheme, and disputes may be litigated under the PPS Act regime.

Practical enforcement consequences

• In practice, enforcement will be a mixture of administrative refusal (registrar-general declining lodgment, refusing certified copy, or requiring correction), fee enforcement through delegated instruments, criminal prosecution for false statements under the Criminal Code, and court resolution of substantive disputes about priority, good faith, identity and rectification consistent with s 4A and s 4B.

The Act has explicit cross-references and implied interactions with a number of other statutory regimes and legislative instruments. Those interactions matter for practitioners because they constrain the Act’s reach and determine which registration regime controls particular interests.

Personal Property Securities Act 2009 (Cwlth)

• The Act contains an express note that the Personal Property Securities Act 2009 (PPS Act) regulates certain interests in personal property and that this Act has no effect to the extent of inconsistency with the PPS Act (s 4A note). Practically, that means the statutory priority regime in s 4A cannot displace federal PPS priority where the PPS Act applies. Parties with personal property interests should therefore check registration under the PPS Register rather than rely on the ACT deeds register where the PPS Act has primacy.

Criminal Code (Cwlth)

• The Act refers depositors to the Criminal Code, part 3.4, for offences relating to false or misleading statements, information or documents (note to s 4). The Criminal Code thus supplies criminal sanctions for dishonest conduct connected to registration. Practitioners should be aware that provision of materially false certification or forged documents may give rise to Commonwealth criminal liability.

Land Titles Act 1925 (historical reference)

• The dictionary excludes from “deed” instruments that are in accordance with the provisions of the Land Titles Act 1925 and purport to transfer or otherwise deal with or affect an estate or interest in land under that Act, except that a lease or sublease for a term not exceeding three years is not excluded (dictionary, paragraph (b)). This means many land title instruments are outside the remit of the Act and must be handled under the statutory Torrens-style land title procedures. Practitioners must determine whether a conveyancing instrument is governed by the land titles scheme or by this deeds register.

Legislation Act 2001

• The Act relies on definitions and procedural requirements contained in the Legislation Act 2001 (see s 2 notes and the dictionary note). The Legislation Act governs how disallowable and notifiable instruments are made and published and supplies definitions for terms such as “Minister”, “person”, and “registrar-general”. Section 8(2) and s 9(3) rely on the Legislation Act for parliamentary scrutiny and notification processes.

Interstate registration and recognition

• Section 4(1)(c) recognises deeds which have already been registered, filed or deposited with an officer of a State or Territory if a copy certified by the officer having custody is deposited, or if the copy is by virtue of that jurisdiction’s law evidence of the deed’s contents. This creates a statutory recognition mechanism that allows interstate documentary evidence to be used to obtain registration in the Territory, subject to certification and evidentiary rules of the originating jurisdiction.

Common law doctrines and equity

• The Act does not displace general principles of equity and contract, but it modifies the evidential and priority environment for deeds. Questions of good faith, valuable consideration, and identity of the deed (s 4A(1), s 4B) will be resolved against the backdrop of common law and equitable doctrines. The Act supplies a procedural record but does not purport to be a full code for all disputes relating to property interests.

Other ACT statutes

• The Act’s endnotes show a history of consequential amendments tied to other ACT statutes (Registrar-General (Consequential Provisions) Act 1993, Land Titles (Consequential Amendments) Act 1995, Powers of Attorney Act 2006, etc.). Those acts adjusted definitions and administrative mechanics that affect how this Act is administered within the Territory’s broader statutory framework.

Regulatory instruments

• Fees and forms are governed by delegated instruments (s 8, s 9). Those instruments are made under the Legislation Act’s processes and can alter the operational cost and administrative burden on users without primary legislation changes. Since fees are disallowable instruments and forms are notifiable instruments, they are subject to parliamentary oversight but can change more readily than the Act.

In summary, the Act is situated in a web of statutory and administrative instruments. For many practical transactions the ACT deeds register will be only one of several registers or regimes that practitioners must consult, particularly the PPS Register for personal property interests and the Torrens land title system for estate and interests governed by the Land Titles Act 1925.

The republished Act includes an amendment history and legislative history in the endnotes. The key mechanical and structural amendments, with dates and their effect as recorded in the republished law, are listed below. The purpose here is to map how the Act’s present form came to be.

Origins and conversion to an ACT Act

• Originally enacted as the Commonwealth Registration of Deeds Ordinance 1957 A1957-13, notified and commenced 21 November 1957 (legislation history). The ordinance was converted into an ACT enactment on self-government day, 11 May 1989, by operation of the Australian Capital Territory (Self-Government) Act 1988 (Cwlth), s 34(4).

Notable amendments while an ordinance

• Several amendments were made between 1966 and 1985 (Ord1966-19; Ord1977-49; Ord1978-25; Ord1980-14; Ord1982-79; Ord1983-40; Ord1985-22). The 1985 Ordinance inserted s 4A (Priority according to registration) and s 4B (Mistakes in registration) (see amendment history: s 4A ins Ord1985-22; s 4B ins Ord1985-22).

Post-conversion amendments and consequential provisions

• Registrar-General (Consequential Provisions) Act 1993 A1993-64 sch 1 (notified 6 September 1993, sch 1 commenced 1 October 1993) made consequential amendments including to s 3 and dictionary definitions (legislation history and amendment history).
• Land Titles (Consequential Amendments) Act 1995 A1995-54 sch pt 1 (sch pt 1 commenced 20 June 1996) amended the dictionary and interactions with land title legislation.
• Births, Deaths and Marriages Registration (Consequential Provisions) Act 1997 A1997-113 (sch commenced 24 June 1998) made consequential changes.
• Legislation (Consequential Amendments) Act 2001 A2001-44 pt 327 introduced structural amendments, including substitution and relocation of some definitions and the insertion of statutory provision-making mechanisms (s 8, s 9) as shown in amendment history.

Substantive and structural modernisation

• Registration of Deeds Amendment Act 2003 A2003-39 (commenced 9 September 2003) made revisions to the body of the Act (see amendment history stating A2003-39 s 4).
• Powers of Attorney Act 2006 A2006-50 sch 2 pt 2.4 (commenced 30 May 2007) caused consequential changes to terminology and references (amendment history s 3 and dictionary relocations).
• Statute Law Amendment Act 2007 A2007-3 (sch 3 pt 3.86) included a number of editorial and relocation amendments and inserted s 2A (Notes) in 2007 (amendment history notes s 2A ins A2007-3 amdt 3.453 and dictionary relocation entries).
• Personal Property Securities Act 2010 A2010-15 (sch 3 pt 3.3) amended s 4A in 2010 to insert a note on the PPS Act’s primacy (s 4A am A2010-15 amdt 3.3).
• Red Tape Reduction Legislation Amendment Act 2014 A2014-47 (pt 12) and Red Tape Reduction Legislation Amendment Act 2016 A2016-18 (sch 3 pt 3.39) implemented amendments in 2014 and 2016 intended to reduce regulatory burdens; the 2016 changes came into force 27 April 2016 (legislation history).

Relocation of definitions and editorial changes

• Definitions originally in s 2 were relocated to the dictionary in the 2007 amendments (amendment history shows defs reloc to dict A2007-3 amdt 3.452; dict ins A2007-3 amdt 3.455). Over time the dictionary definition of “deed” was amended multiple times (A1993-64 sch 1; A1995-54 sch pt 1; A1997-113 sch; A2003-39 s 4), and other housekeeping changes were made.

Instrument-making and delegated powers

• The Act’s modern form contains explicit powers for the Minister to determine fees (s 8, inserted Ord1983-40 and later substituted A2001-44) and for the registrar-general to approve forms (s 9, ins A2001-44), reflecting a move to delegated administration for operational detail.

Summary timeline (selected)

• 1957: Original enactment as Commonwealth ordinance.
• 1966-1985: Series of ordinance amendments.
• 1989: Conversion to ACT Act on self-government day.
• 1993-2003: Consequential and substantive amendments following administrative reform and transfer of registry functions.
• 2007: Definitions moved to dictionary; introduction of s 2A notes.
• 2010: Explicit note about PPS Act in s 4A.
• 2014-2016: Red tape reduction amendments affecting procedural aspects of registration.

The amendment history in the republished law records changes at a section and schedule level (see endnote 4). Practitioners should consult the legislative history and the compilation on the ACT legislation register to confirm the current text and any uncommenced or subsequent amendments.

The republished Act and its endnotes do not list any cases decided under the Act, and the text does not cite judicial decisions. The Act itself names only one external statutory instrument for conflict resolution, the Personal Property Securities Act 2009 (s 4A note), and references the Criminal Code for possible criminal liability (note to s 4). The legislation history and amendment history in the endnotes list amending acts and ordinances but not case law.

What the republished material shows for practitioners:

• No cases are cited or reported in the Act’s republished annotations. The republished law therefore does not summarise any judicial interpretation of s 4, s 4A or s 4B.
• Because the Act establishes priority rules (s 4A) and a register, litigation is likely to arise in the following factual contexts (the Act does not name cases):
  • Disputes about whether a registered deed was executed or made in good faith and for valuable consideration so as to attract the priority rule in s 4A(1).
  • Challenges to priority where the conveying party acted in bad faith but the registrant purports to be a bona fide purchaser for value (s 4A(2)).
  • Proceedings seeking rectification where an omission, misdescription or error was alleged to defeat registration, and the question is whether s 4B’s substantial compliance threshold is met.
  • Challenges to the registrar-general’s refusal to accept a deposit because of alleged non-compliance with s 4(2)-(4).

Suggested research steps for practitioners

• Because the republished Act does not include litigation history, practitioners should conduct an independent case law search (ACT courts, Federal courts where appropriate, and relevant superior courts) for decisions involving the Registration of Deeds Act 1957, especially judgments addressing s 4A and s 4B, registrar-general discretion, or the evidential effect of registration copies.
• Check reported cases that interpret conflicts between the PPS Act and state/territory registration schemes where personal property security questions arise, since s 4A expressly defers to the PPS Act to the extent of inconsistency.

In short, the republished law contains no internal litigation history. Practitioners must rely on external legal research to identify any case law that interprets the Act’s registration, priority, identity and substantial compliance provisions.

The Act contains several features that can trip up transactional practice if not attended to. The following practical risks and traps are taken directly from the statutory text and the republished notes.

Registrar-general discretion and evidentiary requirements

• The registrar-general may refuse to accept a deposit if, in the registrar-general’s opinion, the deed or copy is not legible, not on paper of an approved size and standard, or will not remain easily readable if bound in the register (s 4(2)-(3)). Practitioners should not assume that a document which would be acceptable elsewhere will be accepted in the ACT registry. Ensure compliance with registry guidance on paper size and standard and with any approved forms (s 9).

Authentication of corrections and erasures

• Copies containing interlineations, alterations or erasures cannot be deposited unless the person verifying or certifying the copy authenticates alterations by initialling them, and in the case of erasures the words or figures that appear on the erasure must be rewritten and initialled or signed in the margin by the verifier (s 4(4)). Failure to meet this narrow procedural requirement can lead to refusal of deposit.

Interstate copies and certification

• Section 4(1)(c) allows registration where the original has been lodged in another State or Territory, but only if the deposited copy is certified as a true copy by the officer with custody or is, under that jurisdiction’s law, evidence of contents in that jurisdiction. Different States and Territories have different certification regimes; do not assume uniformity. Verify the form of certification required by the other jurisdiction before lodging.

Exclusion of Land Titles Act instruments

• The dictionary excludes instruments within the Land Titles Act 1925 (dictionary para (b)) from the Act’s definition of “deed”, subject to the carve-out for leases or subleases not exceeding three years. That means an instrument that would otherwise be registered under the Torrens system must be handled there. Mis-lodging a Torrens instrument in the deeds register can cause delay and uncertainty.

Priority limited to good faith and valuable consideration

• The priority rule is not automatic. Section 4A(1) gives priority according to sequence of registration only for deeds executed or made in good faith and for valuable consideration. Gratuitous transfers or transfers where good faith by the registrant cannot be shown may not enjoy the statutory priority. Where the conveying party acted in bad faith, a registrant still can have priority if they beneficially took in good faith for value (s 4A(2)), but proof of those elements may be contested in litigation.

Substantial compliance is not a cure-all

• Section 4B saves registrations from defeat by omission, misdescription or error if identity is established and requirements “substantially complied with”. That phrase is fact-sensitive and will not be a substitute for compliance in material respects. Do not rely on s 4B as a planning tool to excuse careless preparation.

Fees and forms can change administratively

• Fees are determined by Ministerial instrument and are disallowable; approved forms are notifiable instruments (s 8(2); s 9(3)). This means fee levels and mandatory forms can change without primary legislation, and registrants must check current instruments. A practitioner relying on an old fee scale or obsolete form risks refusal or unexpected charges.

Criminal exposure for false statements

• The Act’s note directs attention to Criminal Code, pt 3.4. Intentionally false certification, forged signatures, or knowingly misleading submissions may give rise to Commonwealth criminal offences. Do not treat the registry as a clinical administrative process immune from criminal liability.

Limited remedial machinery in the Act

• The Act itself does not provide an administrative appeal mechanism for registrar-general refusals, nor does it set out an internal rectification process beyond the endorsement and certification mechanics in s 4(5) and s 7. Challenges to registry decisions may require court proceedings; this can increase costs and delay.

Interaction with PPS Act and overlapping registers

• For personal property, the PPS Act may override the Act’s priority scheme (s 4A note). Practitioners must check whether an interest must be registered under the PPS Act rather than the ACT deeds registry, and be aware of the consequences for priority, enforcement and insolvency.

Evidential weight of registration copy

• A registration copy is the official copy for issuance of certified copies (s 7). However, the Act does not create a Torrens-style indefeasibility guarantee: priority depends on the statutory tests in s 4A and good faith/value elements. Do not assume registration is conclusive title; the Act provides priority protection against other deeds registered under the Act, subject to statutory qualifications.

Buried dependency on other legislation and delegated instruments

• Definitions of core terms are supplied or cross-referenced to the Legislation Act 2001 and other statutes (s 2 notes and dictionary). This inserts interpretative complexity: check the Legislation Act definitions and the current delegated instruments for operational detail (forms and fees).

In short, the main “gotchas” arise from the registrar-general’s gatekeeping power, the formal authentication rules for copies, the conditional nature of the priority rule, the Act’s subordinated relationship to the PPS Act, and the delegated instrument-based apparatus for fees and forms.

Below is a practical, source-grounded compliance checklist for lawyers, conveyancers and registry users who intend to register a deed or obtain certified copies under the Act.

1. Verify the instrument falls within the Act

• Check the dictionary definition of “deed” to ensure the instrument is not excluded, especially where it might be an instrument under the Land Titles Act 1925 (dictionary, para (b)). If the instrument is a Torrens-type conveyancing instrument, it should be lodged under the land titles system, not this Act.

2. Choose the correct mode of registration (s 4(1))

• If you have the original, either deposit the original with the registrar-general (s 4(1)(a)) or produce the original and deposit a verified copy (s 4(1)(b)). If the original is already registered/filed in another State or Territory, deposit a copy that is certified by the officer having custody or a copy that, by the law of the originating jurisdiction, is evidence of the deed’s contents (s 4(1)(c)). Confirm the certifier’s identity and the required form of certification in the other jurisdiction.

3. Meet paper, legibility and form requirements (s 4(2), s 9)

• Ensure the deed or the copy is legibly written and on paper of a size and standard approved by the registrar-general. Consult the registry’s guidance or approved forms and use the approved form if one exists (s 9(2)). Using the correct approved form is mandatory where the registrar-general has approved a form.

4. Handle interlineations, alterations and erasures correctly (s 4(4))

• For copies with interlineations or alterations, ensure that the verifying person initials the alterations. For erasures, rewrite the words or figures and have the verifier sign or initial the margin next to the rewritten text. Failure to follow these steps is a ground for refusal.

5. Verify copies properly when producing a copy (s 4(1)(b))

• The person verifying the copy must have compared it with the original and must state that it is a true copy. Ensure the verifier’s statement follows registry guidance and is properly signed.

6. Prepare for registrar-general scrutiny and potential refusal (s 4(2)-(3))

• Expect the registrar-general to exercise discretion about readability and format; take remedial steps (e.g. retyping, reformatting, producing a fresh copy) before lodging rather than relying on post-lodgment correction. If you anticipate borderline issues, contact the registry in advance.

7. Request endorsement and retain proof of registration (s 4(5))

• On registration, the registrar-general endorses the registration copy with a memorandum recording the date and time (s 4(5)). If you produced the original but did not deposit it, ask the registrar-general to endorse the memorandum on the original. If you deposited a copy under s 4(1)(c), you may request endorsement on a further verified copy and produce it for endorsement (s 4(5)(b)). Maintain a copy of the endorsed registration copy as evidence.

8. Pay fees as determined and confirm current fee schedules (s 8)

• Fees are set by Ministerial determination (s 8(1)) and are disallowable instruments (s 8(2)). Before lodging, obtain the current fee schedule from the registry to budget and ensure payment arrangements are in place.

9. Use approved forms where required (s 9)

• If the registrar-general has approved a form for a particular application or purpose, you must use that approved form (s 9(2)). Approved forms are notifiable instruments (s 9(3)), so check for current versions.

10. Search the index and existing registrations before lodging (s 5, s 6)

• Use the index (s 5) and the right to search and examine registration copies (s 6) to identify prior registered deeds and to assess priority risks. Confirm whether any competing interests exist and whether the PPS Act affects the priority of personal property interests (s 4A note).

11. For interests in personal property, check PPS Act requirements (s 4A note)

• If the interest relates to personal property covered by the PPS Act, register under the PPS Register as appropriate. The PPS Act prevails if inconsistent with the Act (s 4A note). Do not rely on the ACT register to provide priority or security in matters governed by the PPS Act.

12. Aim to document good faith and valuable consideration

• Section 4A conditions priority on good faith and valuable consideration. Retain documentary evidence (purchase contracts, consideration records, correspondence) that supports an assertion of good faith and valuable consideration should priority be contested.

13. Be cautious about reliance on s 4B

• While s 4B saves registrations from technical mistakes if identity is established and there has been substantial compliance, do not assume s 4B will cure material defects. Correct material errors before lodging where possible.

14. Keep originals and certified documentation safe

• Where an original is produced but not deposited, ensure you keep the original safe; the registrar-general may endorse the original with the registration memorandum under s 4(5)(a). Where a certified copy is deposited under s 4(1)(c), retain copies of the certificate and the certifying officer’s particulars.

15. Be aware of criminal liability and accuracy obligations

• Do not make false or misleading statements or produce false documents; the Act cross-refers to the Criminal Code, part 3.4, for offences in this area (note to s 4). Ensure all verifications, certifications and declarations are factually accurate.

16. Prepare for court remediation where necessary

• The Act does not create an internal dispute resolution mechanism for many registry disputes. If priority or registration is contested, be prepared to commence court proceedings to seek rectification, declarations of priority or relief. Retain documentary evidence supporting registration, verification, good faith and consideration.

By following these steps, lodge parties and their advisers can align practice with the statutory requirements in ss 3-9, reduce the risk of refusal, and preserve the evidentiary and priority protections the Act provides.
