Registration of Deeds Act 1856

The Act embodies a handful of interlocking legal and administrative concepts. Describe them precisely and point to the source provisions.

• Memorial registration as instrument to create notice and priority: The Act operates by registering a memorial that sets out particulars of an instrument (s 6; s 8). Registration gives priority in relation to other registered instruments according to date of registration (s 3). The Act makes registration the determinative act for priority allocation among competing claimants.
• Exclusion of Torrens land: The Act expressly says no memorial may be registered under this Act for land that is under the Transfer of Land Act 1893 (s 1). The consequence is that the Act applies to non‑Torrens interests; it is not a general land title system for modern Torrens parcels.
• Time limits for obtaining priority: Priority through registration depends on meeting fixed time windows (s 4). Deeds and similar instruments executed in WA must be registered within two months, instruments executed elsewhere within eight months; wills have their own deadlines depending on place of death (s 4). A suppressed will must be registered within three years after death to defeat purchasers or incumbrancers (s 5). These time rules impose an urgency cost on parties who want priority.
• Formalities and authorisation: Registration requires a memorial containing specified particulars (s 8), and the memorial must be signed either by a lawyer or by another person whose signature is attested in a manner consistent with Transfer of Land Act execution rules (s 6). A claimant’s affidavit sworn before a justice of the peace authorises registration by signature (s 7). The Act therefore ties registration to evidentiary and attestation formalities.
• Registrar as administrator and indexer: The Authority maintains the office and the Registrar is charged with numbering memorials, issuing receipts specifying day and time, endorsing certificates on memorials, registering memorials in registry books and indexes kept open for inspection (ss 2, 9, 10). That places administrative decision‑making and time stamping squarely with the Registrar and their assistants (s 2A).
• Discharge and update procedure for mortgages and judgments: A verified certificate, signed by the mortgagee or plaintiff (or authorised representative) and attested by at least two credible witnesses, showing full payment will trigger an entry on the memorial and a registered certificate of satisfaction (s 11; s 12). That is the statutory path to record a discharge.
• Custody and originals: The Act allows deposit of instruments and wills for safe custody (s 13). Wills deposited are to be sealed and kept until death, then delivered to the executor named or as ordered by the Supreme Court (s 13). Where an enrolled original instrument is lost, a certified copy issued by the Registrar on an affidavit is conclusive evidence in court (s 15).
• Registration as notice and evidentiary effect: Registered memorials are deemed to be notice of all facts and particulars stated in them, with effect on contracts entered into after the Act’s passing (s 16). This is an explicit notice doctrine keyed to the content of the memorial.
• Judicial supervision: The Supreme Court can order cancellation of false or fraudulent registrations and can order rectification of imperfect registrations caused by non‑wilful mistake or omission, with broader powers to substitute signatories where necessary (ss 19-20). The judiciary is the corrective mechanism for registration errors and fraud.
• Regulatory and fee framework: The Governor (and formerly Commissioner of Titles) may make regulations on medium of documents and fees (s 22). Section 22AA enables regulations to set fees beyond cost recovery and to include an amount that is a tax; section 22AB sets an expiry procedure for 22AA, with postponements recorded in the compilation notes to 2029.

These concepts create a registration regime that is documentary, time‑sensitive, registrar‑centric and subject to judicial remedy and regulatory detail. The Act interposes administrative steps between private instruments and public notice, and prescribes specific forms and evidentiary adjuncts as the means of converting a private instrument into a registered public record.

State who bears costs, who makes decisions, and who changes behaviour under the Act, with section references.

• Parties creating or holding interests in non‑Torrens land: Owners, grantors, mortgagees, devisees, plaintiffs and defendants whose instruments affect land not under the Transfer of Land Act 1893 are the primary actors who must use the system if they want priority or public recording. The Act expressly excludes Torrens land (s 1), so its direct scope is non‑Torrens land.
• Purchasers and mortgagees for valuable consideration: A purchaser or mortgagee who buys in good faith and for value obtains protection against earlier unregistered instruments (s 3). That creates an incentive for buyers to search the registrar’s memorials and for vendors to ensure registration is correct where they rely on prior instruments.
• Persons who wish to assert title by will, deed or judgment: Claimants who seek to protect their interest must deliver a memorial with required particulars and, depending on circumstances, supporting affidavits or verified certificates (ss 6-8; s 11). The signature and attestation requirements (s 6) require either a lawyer or attested non‑lawyer signature, involving additional steps for self‑representing parties.
• The Registrar and the Authority: Operational responsibility lies with the Western Australian Land Information Authority and the Registrar of Deeds and Transfers (s 2). By designation, the Registrar of Titles performs the Registrar of Deeds and Transfers role (s 2). Assistant registrars (s 2A) may perform acts otherwise reserved to the Registrar. The Registrar decides on numbering, issuing receipts, indexing and entering memorials (ss 9-10).
• The Supreme Court: The Court is the decision‑maker where registrations are challenged as false or fraudulent (s 19) or where mistakes must be rectified (s 20). The Court can order cancellation, rectification and substitute signatories, and its orders bind the Registrar for recording purposes (ss 19-20).
• Executors and depositors of wills: People who deposit wills for safe custody and executors named in deposited wills are affected by the custody and release regime (s 13). Depositors may retrieve documents before death; otherwise wills remain sealed until death and the Registrar delivers them to the first named executor or as ordered by the Supreme Court (s 13).
• Those affected by fees and regulations: The Act authorises fees (s 22) and, as amended, permits fees above cost recovery and the imposition of tax‑like amounts if prescribed by regulation (s 22AA). The compilation notes show the expiry mechanism and postponements relevant to fee authorisation (s 22AB and notes).

Who pays: Primarily the persons who lodge memorials or seek Registrar services pay the applicable fees set under regulations (s 22; s 22AA). Indirect costs fall on purchasers and mortgagees who must search the registry and on parties who incur legal and attestation costs to prepare memorials and affidavits (ss 6-8, 9-10).

Who decides: The Registrar administers registration, time‑stamps and indexes memorials (ss 9-10). The Governor (or Commissioner under transitional arrangements) makes regulations covering fees and medium (s 22). The Supreme Court decides on fraud, cancellation and rectification (ss 19-20). The Authority oversees the office (s 2).

Behavioural effects: Parties dealing with non‑Torrens land will either register memorials within the statutory windows to secure priority or accept heightened risk that their interests will be void as against later good‑faith purchasers (s 3). Buyers and lenders will check the register as a due‑diligence step. Lawyers and other signatories will be used to satisfy attestation requirements (s 6). Parties seeking discharge of mortgages or judgments will lodge verified certificates attested by two credible witnesses (s 11-12).

List statutory duties, procedural rights and the administrative obligations the Act imposes, with section citations.

Duties and administrative obligations

• Duty to register memorial to obtain priority: To benefit from the priority regime a person must deliver a memorial to the Authority within the time windows specified (s 3; s 4). Failure to register within the times in s 4 generally removes the priority protection.
• Duty of the Registrar to number, receipt, endorse and register: On delivery, the Registrar must number the memorial according to order of delivery, give a receipt specifying day and time, endorse on the memorial a certificate of delivery with the name and place of abode of the deliverer and sign it, and register the memorial in succession and index it (ss 9-10). Those entries constitute the evidentiary record of registration.
• Duty to keep books, records and indexes open for inspection: The Registrar must keep registry books and indexes for reference and make them open at convenient times for inspection (s 10).
• Duty to accept deposits and provide receipts: The Registrar must accept deposited deeds and wills, issue receipts and maintain an index of deposited items (s 13).
• Duty to record satisfaction/ discharge entries: Where a verified certificate (verified oath, attested by witnesses) shows satisfaction of mortgage or judgment, the Registrar must enter a short memorandum on the memorial and register the certificate (s 11-12).
• Duty to issue certified copies for lost instruments: On a satisfactory affidavit that originals are lost or destroyed, the Registrar must issue a certified copy which is conclusive evidence in courts (s 15).

Rights and remedies

• Priority rights for registered instruments: Those who register in accordance with the Act obtain priority over later registered instruments (s 3). Registered judgments, deeds and instruments take effect in relation to date of registration (s 4).
• Protection for bona fide purchasers and mortgagees: A subsequent bona fide purchaser or mortgagee for valuable consideration is protected against earlier unregistered instruments; unregistered instruments are "absolutely null and void" against such purchasers except for short rack‑rent leases (s 3).
• Right to require registration via affidavit: A person claiming an estate or interest by affidavit sworn before a justice of the peace may require registration and the affidavit‑signature on the memorial authorises registration (s 7).
• Right to judicial relief for fraud and mistakes: Petitioners may apply to the Supreme Court for cancellation of registrations alleged to be false or fraudulent (s 19). The Court may order rectification of imperfect registrations caused by mistake or omission (s 20).
• Right to safe custody and release of deposited instruments: Depositors have the right to safe custody and to recover deposited instruments; wills are kept sealed until death and then delivered to named executors or as the Supreme Court orders (s 13).
• Evidentiary rights: Certified copies issued under s 15 are conclusive evidence in court of the contents of lost instruments (s 15). The Registrar’s certificate of registration (endorsement and receipt) is evidence of registration and time (s 9).

Procedural dependencies and conditions

• Attestation and signature formalities: Memorials must be signed by a lawyer or another person with that signature attested by a person qualified to attest under the Transfer of Land Act execution rules (s 6). Affidavits and verified certificates must be sworn before a justice of the peace or equivalent as specified (s 7; s 12).
• Time limits condition priority: The substantive right to priority is conditional on complying with the time limits set out in s 4 and the special rule in s 5 regarding suppressed wills.
• Regulatory condition on fees and medium: Fees and documentary medium are set by regulation under s 22; s 22AA permits regulations to prescribe fees above cost recovery and to include tax amounts.

The Act therefore imposes a mix of procedural duties on registrants and the Registrar, and confers on registrants clear rights to priority and evidentiary protection when they follow the statutory process. Judicial rights to cancellation and rectification provide a mechanism for correcting the public record where registration is fraudulent or imperfect.

The Act does not create criminal penalties or a schedule of fines within its text for procedural non‑compliance. Enforcement and remedial mechanisms are primarily civil and administrative, focused on registry entries and judicial correction.

Enforcement mechanisms and remedies

• Judicial cancellation for fraud: The Supreme Court may receive a petition and, if satisfied a registration is false or fraudulent, may order summary cancellation of the registration; the Registrar must implement the order upon personal service (s 19). Cancellation is the principal remedy for fraudulent registrations and operates through the Court’s equitable powers.
• Rectification for non‑wilful mistakes or omissions: The Supreme Court may order correction of imperfect registrations caused by mistake or omission that were not wilful or fraudulent, and may impose terms and conditions it thinks fit (s 20). The Court may order substitution of signatures where original signatories are dead, absent or incapacitated, and the Registrar must comply (s 20). Rectification is available only where correction can occur without wrong or injury to persons lawfully claiming an interest in the subject matter.
• Registrar’s administrative obligations: The Registrar’s statutory role includes making entries of cancellation or rectification and keeping references in registry books and indexes (ss 9-12; ss 19-20). Enforcement of court orders is by the Registrar’s statutory duty to implement them.
• Evidentiary effect as control: The Act gives registered memorials presumptive public notice (s 16) and certified copies of lost instruments are conclusive evidence in court (s 15). Those evidentiary rules influence litigation strategy and administrative compliance.
• No express criminal sanctions in the Act: The text supplied does not set out fines, imprisonment or administrative penalties for making false memorials, though the Supreme Court’s power to cancel fraudulent entries is available (s 19). The compilation table references other Acts and repeals but contains no penalties in this Act itself.

Practical enforcement implications

• Civil litigation is the route for disputes: A person alleging fraud, mistake or omission must approach the Supreme Court (ss 19-20). That involves legal costs and time, and the remedy is tailored relief (cancellation or rectification) rather than statutory fines.
• Registrar cannot independently cancel for fraud: The Act prescribes that cancellation requires a Supreme Court order; the Registrar implements the order on personal service (s 19). That centralises removal of entries through the judiciary rather than administrative sanction.
• Discharge of mortgages and judgments is administrative but formal: Satisfaction is recorded by delivery of a verified certificate attested by two credible witnesses and the Registrar must enter the memorandum and register the certificate (s 11). Non‑compliance with these formalities may leave an interest on the register, implicating buyer and lender due diligence.

Fees and regulatory enforcement

• Regulations may prescribe fees: The Governor (or Commissioner's transitional regulations) may make regulations about fees (s 22). Section 22AA permits regulations to prescribe fees that exceed cost recovery and to include tax elements; section 22AB governs expiry and postponement of that section and the compilation notes record postponements to 2029. Enforcement of fee payment will be under regulation rather than via penal provisions in the Act.

Overall, enforcement operates through civil remedies, registrar actions required by court orders, evidentiary effects of registration and the regulatory fee framework. The Act supplies judicial remedies but does not set out a penal code for registration offences; other statutes may apply if conduct constitutes an offence (the compilation references other Acts but this Act itself focuses on registration, indexing and judicial correction).

The Act is explicitly tied to and shaped by other statutes and administrative instruments. Cite the relevant sections and compilation notes.

• Transfer of Land Act 1893: The Act excludes land under the Transfer of Land Act from its operation (s 1). It also ties attestation requirements for signatures on memorials to persons qualified to attest under the Transfer of Land Act (s 6). The Registrar of Titles under the Transfer of Land Act is the Registrar of Deeds and Transfers (s 2), and assistant registrars under the Transfer of Land Act are assistant registrars of deeds and transfers for this Act (s 2A). Those cross‑references make the Transfer of Land Act central to the Act’s scope, staffing and formalities.
• Land Information Authority Act 2006: The Authority named in s 2 is the Western Australian Land Information Authority established by the Land Information Authority Act 2006 (s 2). Section 22(2) preserves regulations previously made by the Commissioner of Titles and gives them the same effect as if made by the Governor under the amended s 22; compilation entries (Land Information Authority Act 2006 s 150) record changes that came into force 1 January 2007. The Authority is therefore the administrative holder of the registration office.
• Legal Profession Act 2008 and Legal Profession Uniform Law Application Act 2022: Section 6’s requirement that memorial signatures be by a lawyer or, if not, attested, has been amended by the Legal Profession Act 2008 (s 697) and the Legal Profession Uniform Law Application Act 2022 (compilation table). These amendments affect who may sign memorials and the attestation regime.
• Criminal and other statutes: The compilation table records historical amendments and repeals (e.g. Criminal Code Act 1902 references). While the Registration of Deeds Act does not itself create criminal offences, conduct such as forgery, perjury or fraud in relation to memorials may fall within other offences under criminal law; s 19 provides civil‑judicial remedies for fraudulent registrations but not criminal sanctions in this Act.
• Regulations and fee law: Section 22 empowers the Governor to make regulations on prescribed matters including fees. Section 22AA, as inserted in 2015, permits regulations to set fees above cost recovery and to include a tax component (s 22AA(1)-(2A)). Section 22AB prescribes an expiry mechanism for s 22AA subject to proclamation postponements; the compilation notes show the expiry was postponed to 31 December 2029 by proclamation (notes to s 22AB). Those provisions interact with broader administrative law and fiscal law governing the setting of fees and imposition of taxes by regulation.
• Evidence and court practice: The Act’s provision that certified copies are conclusive evidence (s 15) and that the Registrar’s endorsement is evidence of registration time and date (s 9) interacts with the rules of evidence and court procedure. The Supreme Court’s remedial role (ss 19-20) integrates registry disputes into the State’s judicial framework.

Practical tensions and dependencies

• Narrow scope vs modern Torrens system: Because the Act explicitly excludes Torrens land (s 1), many routine land transactions are governed instead by the Transfer of Land Act 1893. That reduces the Act’s practical footprint to unregistered or historical land holdings. Practitioners must check title status first; otherwise memorial lodgement is improper (s 1).
• Formalities tied to Transfer of Land legislation: The attestation and signature rules refer to persons qualified under the Transfer of Land Act (s 6). That makes compliance contingent on another statute’s execution rules and the professional landscape regulated by the Legal Profession Acts (compilation table entries).
• Regulatory fee powers vs accountability: Section 22AA permits fees above cost recovery and imposes no direct statutory cap in the Act; the compilation notes and s 22AB time limits and proclamation‑postponement provisions are relevant to legal challenges or parliamentary scrutiny of fee levels. Fees that include a tax element could raise issues under broader financial and administrative law.
• Historic notice clause: Section 16 deems registration to be notice of all facts and particulars in the memorial with reference to contracts entered into after the Act passed. That clause reflects a historical notice construct and its interaction with contemporary property law may be limited by the predominance of Torrens title and by modern conveyancing practice.

In short, the Act is embedded in a legislative ecosystem: the Transfer of Land Act drives scope and formalities, the Land Information Authority Act supplies administrative structure, and regulations (including fee instruments) complete operational detail. Practitioners must consider these linked instruments when advising on or executing registrations under this Act.

• Section 22AA was inserted in 2015 (No. 11 of 2015 s 6), with an expiry mechanism in s 22AB added at the same time (No. 11 of 2015 s 6).
• The compilation notes record two postponements of the expiry of s 22AA by proclamation: to 31 December 2024 by Land Legislation (Postponement of Expiry) Proclamation 2018 (Gazette 21 Dec 2018 p. 4845-6), and to 31 December 2029 by the Land Legislation (Postponement of Expiry) Proclamation 2024 cl. 3 (SL 2024/43). Those notifications are recorded in the notes to s 22AB.

Reprints and consolidation points

• Reprint approved 16 Mar 1976 includes amendments to that point.
• Reprint 2 as at 9 Apr 2004; Reprint 3 as at 7 Nov 2014 are recorded in the compilation table.
• Various amendments cross‑referenced in the text reflect incremental modernisation and administrative realignment with the Land Information Authority and legal profession regulation.

In short, the Act has longstanding origins (1856) and has been adapted over time to align with modern administrative structures (Land Information Authority, Registrar of Titles), legal profession regulation and a regulatory fee power introduced in 2015. The compilation table furnishes dates and amending instruments for each significant change.

The supplied instrument does not list judicial decisions or reported litigation interpreting the Act. The Act itself prescribes judicial functions (s 19 and s 20), but the compilation and notes contain no case references. What follows is a statement of the statutory litigation pathways and the observable absence of reported cases in the provided material.

Statutory litigation pathways

• Fraud and cancellation: Section 19 creates a direct route to the Supreme Court for any person seeking relief against a registration alleged to be false or fraudulent. The Court can order cancellation summarily if satisfied of the allegation; the Registrar implements such orders upon personal service (s 19).
• Rectification and substitute signatories: Section 20 permits the Supreme Court to rectify imperfect registrations where mistakes or omissions were not wilful or fraudulent, and to order substitutions of persons required to sign where originals are dead, absent or incapacitated. The Registrar must make references to the Court’s order in the registry (s 20).
• Admissibility of certified copies: Section 15 states that certified copies issued by the Registrar under an affidavit for a lost instrument are to be received in any court of justice in the State as conclusive evidence of contents once the court is satisfied of loss and the Registrar’s signature.

Absence of reported cases in the source

• The Act as provided does not name any reported cases, nor does the compilation table supply a litigation history. The Court’s powers are set out, but there are no appended judicial authorities interpreting those powers in the supplied text. The compilation table and notes are legislative and administrative; they do not summarise case law.

Practical implications for practitioners

• Expect litigation under the Act to proceed in the Supreme Court where parties dispute the truth of registrations, fraud allegations or the need for rectification (ss 19-20). Relief is discretionary, and the Court may impose terms and substitute parties as necessary.
• Because the Act confers conclusive evidentiary force to certified copies (s 15), contested proceedings involving lost instruments will typically involve preliminary judicial determinations about adequacy of proof of loss and the Registrar’s certification before the copy is treated as conclusive.
• If practitioners require precedential guidance on how courts have applied ss 19-20, they will need to consult case law databases and the Supreme Court’s reported judgments outside the text of the Act. The Act itself does not supply a litigation history.

In short, the Act provides clear judicial mechanisms but the supplied compilation does not include any reported judicial decisions under it. Any case law development must be located by independent research in court records and law reports.

Practical traps, statutory pitfalls and items that commonly cause non‑compliance or unintended consequences, with direct references to the text.

• Do not attempt to register Torrens land under this Act: Section 1 expressly forbids registration in respect of any land under the operation of the Transfer of Land Act 1893. Checking title status must be the first step. Registering a memorial for Torrens land is outside the Act’s scope and will not create statutory priority.
• Strict time windows determine priority: Failure to comply with the windows in s 4 (two months for deeds executed in WA, eight months for deeds executed elsewhere; varying periods for wills) can destroy your claim to priority. The statute phrases unregistered instruments as "absolutely null and void" against subsequent bona fide purchasers or mortgagees (s 3). Plan for tight deadlines.
• A suppressed will requires registration within 3 years: If a will has been concealed or suppressed, it will not defeat a purchaser unless it is registered within three years after the devisor’s death (s 5). Reliance on a late discovery of a will is risky without registration within that period.
• Memorial content is detailed and must be accurate: Section 8 requires the memorial to set out dates, nature and object of instruments, all parties and witnesses' names and "especially particularise" the lands by proper and ordinary names of districts, towns or places. Incomplete or imprecise descriptions can defeat the purpose of registration.
• Attestation and signature formalities are mandatory: A memorial must be signed by a lawyer or by another person whose signature is attested in the manner required by the Transfer of Land Act (s 6). Non‑compliant attestations may jeopardise the memorial’s acceptance or create grounds for later rectification proceedings.
• Registrars time‑stamp and their certificate is evidence: The Registrar’s receipt and the endorsement on the memorial are evidence of registration and time (s 9). Failure to secure and retain the Registrar’s receipt may weaken proof of registration time in disputes.
• Discharges of mortgages and judgments require a verified certificate with two credible witnesses: Section 11 prescribes a particular form of verified certificate, attested by at least two credible witnesses, to record satisfaction. Informal letters or single‑witness affidavits will not meet the statutory prescription.
• Certified copies of lost instruments are conclusive only after judicial satisfaction: While s 15 says certified copies are to be received in Court as conclusive evidence, courts require proof that the original is lost, destroyed, or fully effaced and that the Registrar’s certificate is genuine. Do not assume automatic admissibility.
• Rectification is not a substitute for proper process where wilful conduct exists: Section 20 permits rectification for non‑wilful mistakes or omissions, but not where wilful or fraudulent conduct is present. If a party has acted wilfully or fraudulently, the Court’s rectification power may not be available and further relief may be sought under s 19 for cancellation.
• Regulation‑set fees may exceed cost recovery and include tax components: Section 22AA, as inserted in 2015 and subject to postponements recorded in the notes, permits fees prescribed by regulation that exceed cost recovery and that may include an amount that is a tax (s 22AA(1)-(2A)). When budgeting for registration costs, assume that fees may be above simple cost‑recovery levels; check current regulations.
• The Act’s notice provision is historically framed: Section 16 deems registration notice of all facts and particulars in the memorial "with reference to all contracts entered into after the passing of this Act." That clause is of historical provenance and its practical coverage may be narrow, particularly given that the Torrens system now governs most land. Nonetheless, the clause can influence disputes over notice where the Act applies.
• Administrative reliance on other statutes: Several requirements refer to qualifications and procedures in the Transfer of Land Act and to the legal profession legislation (s 6; compilation table). Ensure you cross‑check those statutes to meet attestation, execution and signature rules.
• Registrar’s action depends on Court orders for cancellation: The Registrar cannot unilaterally cancel a fraudulent registration; s 19 requires a Supreme Court order before cancellation. Parties seeking immediate administrative relief must approach the Court.

Each "gotcha" follows directly from a statutory requirement in the Act. Practitioners should document compliance with particularised memorial content (s 8), retain Registrar receipts (s 9), observe time frames (s 4, s 5), and prepare verified certificates in the precise form required for discharges (s 11-12). Also check current regulations for fees and procedural detail under s 22 and the latest postponement status of s 22AA in the compilation notes.

Operational steps and practical checklist for a practitioner who needs to register an instrument under the Act, grounded in the statutory text. These steps assume the matter concerns land not under the Transfer of Land Act (confirm as step 1).

1. Confirm scope: check title system

   • Verify the land is not under the Transfer of Land Act 1893 (s 1). If the land is Torrens‑title, this Act does not apply and you must use the Transfer of Land regime.

2. Prepare the instrument and supporting evidence

   • Ensure the underlying deed, will, conveyance, judgment or instrument is final and properly executed.
   • For wills, note the special time windows and deposit rules (s 4 and s 13; s 5 for suppressed wills).

3. Draft the memorial to statutory particulars (s 6; s 8)

   • Include:
     • Date of the instrument.
     • Particular nature and object of the instrument.
     • Names (and additions when known) of all parties and witnesses.
     • Full and particularised description of the lands, using the proper and ordinary names of districts, towns or places where the land is situated.
     • Pecuniary or other consideration (except where registering a will).
   • If multiple writings perfect the same conveyance or security, include them in one memorial and particularise lands once (s 8, proviso).

4. Ensure signature and attestation formalities (s 6)

   • Have the memorial signed by a lawyer where possible.
   • If signed by a non‑lawyer, obtain attestation by a person qualified to attest execution under the Transfer of Land Act 1893 as required by s 6.
   • For affidavit‑based claims, obtain the supporting affidavit sworn before a justice of the peace that asserts the claimant’s estate or interest (s 7).

5. Prepare verified certificates for discharges if required (ss 11-12)

   • For mortgage or judgment satisfaction, prepare a verified certificate signed by the mortgagee/plaintiff or their authorised representative and attested by at least two credible witnesses (s 11).
   • Ensure the certificate contains the particulars listed in s 12 appropriate to judgments or mortgages.

6. Lodge the memorial with the Authority (s 6; s 2)

   • Deliver the memorial to the Authority’s office maintained by the Western Australian Land Information Authority (s 2).
   • Obtain a receipt from the Registrar which specifies the day and time and the assigned number for the memorial (s 9). The Registrar must endorse the memorial with the day and time of delivery and the deliverer’s name and place of abode and sign the certificate (s 9).

7. Observe statutory time limits (s 4; s 5)

   • Register within two months if instrument executed in Western Australia, eight months if executed elsewhere (s 4).
   • For wills, check the relevant two‑month or 12‑month windows depending on the devisor’s place of death (s 4).
   • If the will was suppressed, register within three years after death to affect purchasers or incumbrancers (s 5).

8. Secure indexing and copies (ss 9-10; s 13; s 15)

   • Rely on the Registrar to register the memorial in the appropriate register book and to index it alphabetically by district and parties (s 10).
   • If depositing an original for safe custody, require the Registrar to issue a receipt and to index the deposit (s 13). Ensure sealed envelopes for wills where applicable.
   • If an enrolled instrument has been lost, obtain an affidavit of loss before the justice of the peace and request a certified copy from the Registrar; note the copy is conclusive evidence in court after the court is satisfied of loss and the Registrar’s signature (s 15).

9. For disputes: approach the Supreme Court (ss 19-20)

   • If a registration appears false or fraudulent, file a petition in the Supreme Court under s 19 seeking cancellation and serve the Registrar for implementation.
   • For imperfect registrations due to non‑wilful mistakes or omissions, apply to the Supreme Court under s 20 for rectification and for orders allowing substitute signatures if the original signatory is dead, absent or incapacitated.

10. Check the regulations for procedural detail and fees (s 22; s 22AA)

    • Consult the regulations made under s 22 for the required medium, paper size, filing format and the current fee schedule. Note that s 22AA permits fees above cost recovery and possibly a tax component; review current regulations and any proclamations postponing expiry of s 22AA (notes to s 22AB).
    • Obtain and retain official receipts for fee payment.

11. Document the process and retain evidence

    • Keep copies of the memorial, affidavits, verified certificates, the Registrar’s receipt, and any endorsed memorial pages showing time of delivery.
    • Retain proofs of attestation and witness statements in case of later challenge.

12. Advise clients on limitations and due diligence

    • Warn buyers and lenders that the Act does not apply to Torrens land (s 1) and that registration under this Act is necessary to secure priority only for non‑Torrens land.
    • Recommend early registration to meet the statutory windows and minimise risk that a later bona fide purchaser will defeat their interest (s 3).

Checklist summary (practical items)

• Title type confirmed not Torrens (s 1).
• Memorial drafted with full particulars (s 8).
• Signature by lawyer or attested per Transfer of Land rules (s 6).
• Affidavits/verified certificates sworn before a justice of the peace where required (ss 7, 12).
• Lodge with Authority, obtain dated receipt/endorsement (s 9).
• Ensure entries are indexed and obtain copy of registered memorial (s 10).
• Pay applicable fees per current regulations (s 22; s 22AA).
• For discharges, lodge verified certificate attested by two credible witnesses (s 11).
• For lost originals, obtain certified copy on affidavit (s 15).
• For disputes, prepare Supreme Court petition for cancellation or rectification (ss 19-20).

Following these steps will align practice with the statutory prescriptions in the Act. Where regulatory detail is silent or has been updated, consult the current regulations made under s 22 and any relevant administrative practice directions from the Land Information Authority or the Registrar.
