Registration, Enforcement and Discharge of Local Authority Charges on Land, Regulations (Western Australia)

These regulations set the step‑by‑step process by which a CEO or local authority registers, enforces and discharges a statutory charge on land under section 372 of the Health (Miscellaneous Provisions) Act 1911. They specify how and when the authority must give notice, how a proprietor may dispute the charge to a magistrate, how registration with land registries is done and the procedure for enforcing the charge by sale.

They affect registered proprietors, local authorities, land registrars and the Local Court because they convert local‑authority expenses into a registrable, enforceable security with specific timing, notice and cost consequences for landowners.

These Regulations set out the procedural mechanism under section 372 of the Health (Miscellaneous Provisions) Act 1911 for creating, registering, enforcing and discharging a statutory charge on land in Western Australia to recover expenses incurred by the CEO or a local authority in performing works in relation to land or premises. The Regulations prescribe the sequence of steps the public authority must follow to convert an incurred cost into a registered charge, the process for a landowner to contest the charge, and the enforcement route culminating in an order for sale and sale by the Local Court where recovery by sale is sought.

Mechanically the Regulations require an initial written notice to the registered proprietor (Form A), allow a very short window to lodge a notice of dispute (three days; Reg 1(2)), and then set out two parallel registration routes. Where there is no dispute, the authority may apply to the Registrar of Titles or the Registrar of Deeds and Transfers to enter a memorandum or register a memorial (Reg 2, Reg 3). Where a dispute is raised, the authority must refer the dispute to the Magistrate in the nearest Local Court (Reg 4). If the Magistrate determines in the authority’s favour the authority obtains a certificate (Form G) which can be used to register the charge (Reg 5, Reg 6).

The Regulations govern the life cycle of the charge. A registered charge remains on the title until discharged in accordance with the Regulations (Reg 7). Payment of the amount due must be followed by the local authority issuing a memorandum of satisfaction (Form H) and, on application by the proprietor, the Registrar will record the discharge (Reg 8, Reg 9). For enforcement, the authority must publish and serve a notice of intention to apply for an order for sale (Reg 10(a)), wait three months from the later of Gazette publication and service, then apply to the Magistrate with supporting affidavits and certificates (Reg 10(d)). If an order for sale is made it must be registered (Reg 11), the sale is conducted by the bailiff under Local Court rules (Regs 12-13), and the Regulations set a detailed waterfall for application of sale proceeds (Reg 14). The sale gives the purchaser an estate subject to certain exceptions and the clerk of the Local Court is to execute conveyance or transfer (Regs 19-20). The order for sale ceases to bind registered land if no transfer is registered within twelve months (Reg 17).

The Regulations incorporate by reference the records of the Western Australian Land Information Authority for identifying registered proprietors and interested parties (Reg 1, Reg 10), require prescribed fees for registration steps (Reg 3(1)(a), Reg 11), and apply rules and procedures of the Local Court as far as practicable to hearings, evidentiary standards and sales (Reg 4(7), Reg 13).

Charge as statutory security: The Regulations implement a statutory charge under Section 372 of the Health (Miscellaneous Provisions) Act 1911, making certain costs incurred by the CEO or local authority a charge on described land (Forms A, D, G). The charge becomes an encumbrance recorded against title or by memorial for non-Transfer-of-Land holdings (Regs 2-3, 6).

Notice and short dispute window: The authority must give notice to the registered proprietor (Reg 1(1), Form A). The proprietor has three days from service to serve a written notice of dispute in Form B claiming matters such as disputing the fact, amount, liability or that the land is subject to the charge (Reg 1(2)). Failure to give the notice within three days is deemed admission of the authority’s right to register the charge (Reg 1(3)).

Registrar registration mechanics: Where no timely dispute is lodged, the authority applies to the Registrar of Titles or Registrar of Deeds and Transfers with supporting statutory declaration and certificate (Form C, Form D) and, on payment of prescribed fees, the Registrar records a memorandum or registers a memorial (Reg 2, Reg 3). The Registrar need not call in the duplicate title when entering the memorandum (Reg 3(2)). The Registrar is required to give notice of registration to the registered proprietor in Form E (Reg 3(2)).

Magistrate procedure for disputes: If a dispute is served, the authority must refer it to the stipendiary or resident magistrate nearest the land (Reg 4(1)-(2)). The magistrate sets a hearing date at least seven days after service of notice (Reg 4(3)). The hearing follows Local Court procedure and rules of evidence as far as they apply (Reg 4(6)-(7)). The magistrate may determine costs and, if the determination favours the authority, delivers a certificate of determination in Form G (Reg 4(5), Reg 5).

Enforcement by sale: If the person liable fails to pay after demand the authority may publish and serve a three‑month notice of intention to apply for an order for sale (Reg 10(a)). If unpaid after that period, the authority may apply to the magistrate for an order for sale, supported by affidavit verifying publication and service, a Registrar certificate that the charge is registered, and a certificate of amount owing from the authority (Reg 10(d)(i)-(iii), Form L). The magistrate may make the order immediately or require further evidence (Reg 10(e)). The order must then be registered with the appropriate Registrar and conditions of sale settled by the magistrate (Reg 11). Sales proceed under Local Court execution procedures and the Local Court’s Rules (Regs 12-13).

Registered proprietors and persons with interests in land: The immediate primary subjects are persons registered as proprietors of land which becomes subject to expenses incurred by the CEO or local authority under the Health (Miscellaneous Provisions) Act 1911. These persons receive the initial notice (Reg 1(1), Form A), are given a three‑day window to dispute (Reg 1(2), Form B) and, if they fail to pay, may have an enforceable charge registered against their land and ultimately face sale. Persons appearing in Land Information Authority records as having any estate, interest, mortgage or other security in the land are addressed by the service and Gazette publication requirements associated with an enforcement notice (Reg 10(a)). Those interest-holders may be affected by the charge, the priority regime in the proceeds waterfall (Reg 14), and the conduct of a forced sale (Regs 11-14, 19-20).

Local authorities and the CEO: Local authorities and the CEO are the only parties empowered to create and seek registration of these charges under the authority of the Act and the Regulations (Form A, Form C, Regs 2-3). They are the parties who incur initial expenses, prepare notices and certificates, execute statutory declarations, initiate Magistrates Court referrals for disputes, and bring applications for orders for sale. They also manage the administrative tasks of Gazette publication and identifying interested parties from Land Information Authority records (Reg 10(a)). They bear up-front costs and administrative effort but have statutory mechanisms to recover amounts, fees and expenses, and to recover enforcement costs from sale proceeds (Reg 8, Reg 14, Form L, Form M).

Registrar of Titles and Registrar of Deeds and Transfers: These officers must register memoranda, memorials and orders (Regs 3, 6, 11). They are required to give notice to registered proprietors after registration (Reg 3(2), Reg 6(3)(4)). They have the discretion not to require production of the duplicate certificate when entering a memorandum and, in the case of transfer after sale, may register a transfer without production of title subject to their usual powers in lost-title cases (Reg 3(2), Reg 20).

Local Court magistrates and court officers: The stipendiary or resident magistrate exercises jurisdiction to determine disputes referred by proprietors (Reg 4) and to hear and make orders for sale (Reg 10). The clerk of the Local Court has specified roles in receiving applications, preparing sale conditions, and arranging bailiff sales, and executes conveyances or transfers upon sale (Regs 10(d), 11(c), 12, 19).

Mortgagees and other encumbrancers: Mortgagees, including the Agricultural Bank and other mortgagees, are implicated by the priority structure of payments from sale proceeds (Reg 14). The Regulations require the authority to serve notice on persons who appear from Land Information Authority records to hold estates or interests, which places an identification burden on the authority and may affect multiple secured creditors.

Duties of the CEO and local authority

Give notice to the registered proprietor where expenses have been incurred and where the authority intends to register a charge (Reg 1(1), Form A). Notice may be sent by prepaid registered letter to the proprietor’s address on Land Information Authority records or, if actual address unknown, the address on the title (Reg 1(4)).
If no timely dispute is lodged, apply to the Registrar of Titles or Registrar of Deeds and Transfers for registration of the charge, accompanied by a statutory declaration verifying service and non‑response, and a certificate setting out the amount, land description and person liable (Reg 2(1)-(2), Forms C and D).
If a dispute is raised, refer the dispute to the stipendiary or resident magistrate in the Local Court nearest to the land within ten days of receipt of the notice of dispute, by lodging the prescribed Form F and annexing the relevant documents (Reg 4(1)-(2), Form F).
If the person liable fails to pay after demand, publish and serve a notice of intention to apply for order for sale in the Government Gazette and on persons who appear to hold estates or interests per Land Information Authority records; wait three months from the later of publication and service; then apply to the Magistrate with supporting affidavit, a certificate from the Registrar confirming the charge registration and a certificate of the amount owing (Reg 10(a), (c)-(d), Form J, Form K, Form L).
If an order for sale is granted, lodge an office copy of the order with the Registrar for registration and pay prescribed fees (Reg 11(a)-(b)).
Upon receipt of payment of the amount owing and associated costs, sign and deliver a memorandum of satisfaction to the payer (Reg 8, Form H) and cooperate in discharge applications lodged with the Registrar (Reg 9).

Duties of the registered proprietor and persons with interests

On being served with the notice of intention to register a charge, serve a notice of dispute within three days if they dispute the charge’s fact, amount, liability or whether the land is subject to it, using Form B and identifying grounds of dispute (Reg 1(2), Form B).
If a magistrate determines in the authority’s favour, the proprietor may be ordered to pay the amount and costs; the proprietor has the right to be heard at the Local Court hearing (Reg 4(3)-(6), Reg 5, Form G).

No separate criminal penalties: The text of these Regulations does not create criminal offences or prescribe penalties of a penal character. They are procedural regulations for registration, enforcement and discharge of charges. Enforcement is primarily through civil processes in the Local Court culminating in a sale of land under an order of the magistrate (Reg 10-14). The Regulations give specific enforcement remedies and recovery mechanisms without specifying fines or criminal sanctions.

Enforcement by sale: The principal enforcement mechanism is an order for sale made by the magistrate following prescribed notice and application steps (Reg 10(d)-(e), Form K, Form M). Once the magistrate makes an order for sale and it is registered with the relevant Registrar (Reg 11), sale is conducted by the bailiff under the Local Court procedures, with the clerk directing sale and preparing conditions settled by the magistrate (Regs 11-13). The purchaser receives a conveyance executed by the clerk and the registrar will register transfer without requiring production of the title instrument (Regs 19-20). A purchaser may obtain a warrant of possession to be put into possession by the bailiff (Reg 15).

Recovery of costs and amounts: The Regulations allow the authority to recover fees, costs and expenses necessary for registration and enforcement as part of the charge and as items to be paid from sale proceeds (Reg 8, Reg 14, Form L, Form M). The magistrate can order costs at the hearing of disputes (Reg 4(5)). The waterfall in Reg 14 places payment of the applicant’s costs and expenses first, ahead of the charge itself, which affects net recovery to the registered proprietor and other secured creditors.

Court discretion and procedural enforcement powers: The magistrate may make an order for sale without a hearing if satisfied on papers (Reg 10(e)(i)), or require further attendance and evidence (Reg 10(e)(ii)-(iii)). If a party is absent despite proof of service, the magistrate may determine in favour of the applicant (Reg 4(4)). The Local Court Rules and Local Courts Act apply insofar as possible to sale and execution steps (Reg 4(7), Reg 13).

Interaction with secured creditors: The Regulations do not remove or extinguish prior registered mortgages except as provided by the proceeds waterfall and the conveyancing provisions. Reg 14 deals with payment priorities, including a specific placement for the Agricultural Bank and other mortgages proved to the clerk’s satisfaction. The procedure includes payment to vendors’ costs and directions for payment to persons entitled to the land after encumbrances have been dealt with (Reg 14). An order for sale that has not resulted in sale does not discharge the charge or extinguish the authority’s rights, and the authority retains the right to apply for a fresh order (Reg 18).

Transfer and registration regimes: The Regulations operate alongside the Transfer of Land Act 1893 and the Registration of Deeds Act 1856. For land subject to the Torrens system (Transfer of Land Act 1893), the Registrar of Titles enters a memorandum on records to show the charge (Reg 3(1)(a), Reg 6(3)(a)). For land not under the Transfer of Land Act 1893, memorials and instruments are registered under the Registration of Deeds Act 1856 (Reg 2(2)(c), Reg 3(1)(b), Reg 6(2)(b), Reg 9(2)(b), Reg 11(b)). The Regulations specifically permit registration steps without production of the duplicate certificate or instrument of title (Reg 3(2), Reg 6(4), Reg 20), and permit the Registrar to take usual steps in lost-title cases when registering transfers after sale (Reg 20).

Land Information Authority records: The Regulations require reliance on the Western Australian Land Information Authority records for identifying registered proprietors and persons with estates or interests for service and Gazette publication purposes (Reg 1(1), Reg 10(a)). That locates the Regulations within the contemporary land information and records framework established by the Land Information Authority Act 2006.

Local Court and execution law: Procedural aspects for hearings and sales are tied to the Local Court framework. Hearings of disputes are to proceed as nearly as may be according to Local Court procedure and rules of evidence (Reg 4(6)-(7)). Sales under an order for sale are to be conducted in the same manner as sales under a warrant of execution issued by the Local Court under the Local Courts Act 1911, with Local Court Rules applied mutatis mutandis (Regs 12-13). The clerk of the Local Court and bailiff play statutory roles in sale execution and conveyancing consequent on sale (Regs 11-13, 19).

Trust and trustees law: The Regulations direct the clerk of the Court to pay proceeds to persons entitled and provide a specific note that, if a person is entitled to an estate in reversion or remainder, money may be paid into the Supreme Court under the Trustees Act 1900 (now Trustees Act 1962, see notes to Reg 14). This cross-references trustee and protective account practice for contingent or future interests.

Tax and rating priorities: Reg 14 specifies that where the order is in favour of the CEO, the amount payable under the charge is payable pari passu with land tax unpaid at the time of sale. Where the order is in favour of a local authority, unpaid rates and taxes other than land tax have a priority. This interaction affects the practical priority of public charges against private mortgages and other encumbrances and locates the charge relative to taxation and rating obligations.

Compilation and gazettal: The Regulations were originally gazetted as the Registration, Enforcement and Discharge of Local Authority Charges on Land, Regulations on 23 July 1937 (gazette reference included in compilation table). The compilation table in the Regulations lists subsequent amendments and commencement dates.

2006 amendment: The Registration, Enforcement and Discharge of Local Authority Charges on Land Amendment Regulations 2006 were gazetted on 29 December 2006 and commenced 1 January 2007 (compilation table). Multiple provisions in the Regulations carry an annotation "[Regulation X amended: Gazette 29 Dec 2006 p. 5906 and 5910]" indicating that alterations were made at that time across Regulations 1, 2, 3, 4, 5, 6, 8, 9, 10, 11, 14, 19, 20 and several Forms. The 2006 amendments modernised references, adjusted wording, and updated Forms; specific textual changes are indicated in each Regulation’s amendment note in the consolidated text.

2016/2017 amendment: The Health Regulations Amendment (Public Health) Regulations 2016 Pt. 32 were gazetted 10 January 2017 and commenced 24 January 2017, producing further amendments to the Regulations (compilation table). The Preamble indicates amendment by Gazette 10 Jan 2017 p. 302. Several Forms carry later amendment notes with the 10 Jan 2017 citation reflecting minor updates to forms or references. The compilation table records that the 2016 public health regulation amendments affected the Regulations.

Specifics visible in the consolidated text: Each Regulation in the version provided carries an amendment notation where changed, for example Regulation 1 amended Gazette 29 Dec 2006 p. 5906 and 5910; Regulation 4 amended Gazette 29 Dec 2006 p. 5910; Regulation 5 amended Gazette 29 Dec 2006 p. 5910‑11. These annotations identify which Regulations were updated and the gazette pages for the amendment, but the consolidated document does not display the original wording or track changes beyond those notes.

Notes about nomenclature changes: The notes supply updated references for authorities mentioned in older provisions, for example the Agricultural Bank is now the Rural and Industries Bank and a Trustees Act cross-reference has been updated to Trustees Act 1962 (see notes). Those notes indicate that the Regulations were conformed to current institutional names at the time of compilation.

Forms updated: The Appendix shows Forms A-M printed with amendment notes reflecting 2006 and 2017 amendments. The Forms themselves have been maintained as the operative templates for notices, applications and certificates under the Regulations.

The text of the Regulations and accompanying Appendix that you provided contains no citations to court cases, judicial decisions, or a litigation history. It specifies the Local Court (magistrate) as the forum to determine disputes under the Regulations (Reg 4) and as the court to make orders for sale (Reg 10), but it does not record any decisions or precedents.

What the source does show about dispute resolution: The Regulations channel disputes about fact, amount, liability or whether land is subject to the charge to the stipendiary or resident magistrate in the Local Court nearest the land (Reg 4). The magistrate conducts hearings according to Local Court procedure and may determine costs and issue a certificate of determination if the dispute is resolved in the authority’s favour (Reg 4(5), Reg 5). The magistrate also adjudicates applications for orders for sale and may do so on papers without hearing the applicant or may require further evidence (Reg 10(e)).

Implication for practitioners: Because the Regulations provide a structured Magisterial-level process, case law arising under these Regulations would likely appear in Local Court decisions or in appeals from the Local Court (if any such appeals occurred), addressing issues such as the sufficiency of notice, the three‑day dispute rule, evidence standards, the magistrate’s discretion to make orders without hearing, the application of the proceeds waterfall and interactions with mortgages. However, the Regulations as provided do not list or summarise such decisions.

Research note: To assemble an authoritative litigation history or to identify appellate guidance on the Regulations’ operation, a practitioner should search Local Court and higher court databases for cases citing section 372 of the Health (Miscellaneous Provisions) Act 1911 or these Regulations, and check whether any reported decisions have considered the procedural strictures such as the three‑day dispute requirement, the sufficiency of service by registered post, the registrar’s registration powers without production of title, or the proceeds priority scheme in Reg 14.

Very short dispute timeframe: The registered proprietor has only three days from service of the initial notice to serve a written notice of dispute in Form B (Reg 1(2)). Failure to serve that notice within the three days is deemed an admission that the authority has the right to register the charge (Reg 1(3)). Practitioners and proprietors must be alert to this compressed timetable; postal delays, misaddressing, or miscalculation of the three‑day period can foreclose dispute rights under these Regulations.

Service by registered post suffices: Service upon the registered proprietor is sufficient if the notice is sent by prepaid registered letter to the proprietor’s known address or, if actual address unknown, to the address on the title (Reg 1(4)). This means that non-delivery, absence, or failure to read mail does not necessarily prevent the notice being effective, and courts will treat registered post service as valid for starting the three‑day clock.

Deeming rule creates risk of unintended admission: Reg 1(3) deems admission upon failure to dispute within three days. That is a strict procedural deeming rule that converts inaction into a procedural concession, not a factual finding. Parties should document any dispute within the three‑day window.

Magistrate may make order without hearing applicant: For an order for sale the magistrate may make the order forthwith without hearing the applicant (Reg 10(e)(i)). While in practice the magistrate will be shown the affidavit and supporting materials, the provision permits ex parte orders on application papers that meet the statutory requirements. Conversely, if the registered proprietor fails to appear at a scheduled hearing after proof of service, the magistrate may determine in favour of the authority without further hearing (Reg 4(4)(a)). Those powers place procedural emphasis on effective service and attendance.

Publication and wide service obligations before sale: Before applying for an order for sale, the authority must publish the notice once in the Government Gazette and serve it upon every person who appears from Land Information Authority records to have any estate or interest or mortgage or other security (Reg 10(a)). The authority therefore bears an evidential burden to identify relevant interest-holders using official records and must file affidavit proof of the publication and service when applying (Reg 10(d)(i)). Errors in identifying interested parties can complicate subsequent enforcement and title issues.

Registrar may register without duplicate title: The Registrar of Titles or Registrar of Deeds and Transfers is not required to call in the duplicate certificate when entering memoranda (Reg 3(2), Reg 6(4)). This expedites registration but also means the registrars rely on statutory application documents rather than original title instruments. In practice this can simplify registration but may raise title-searching and practical conveyancing considerations.

Checklist for local authorities/CEO initiating a charge

Identify and document expenses: Maintain a clear record of the expense incurred and the statutory authority under section 372 of the Health (Miscellaneous Provisions) Act 1911 that grounds the charge. Prepare the certificate of amount and land description in Form D and any internal statutory declaration required for Form C (Reg 2(2), Forms C and D).
Search Land Information Authority records: Verify who appears as the registered proprietor and who appears to have any estate, interest, mortgage or other security in the land using Western Australian Land Information Authority records (Reg 1(1), Reg 10(a)). Record the searches and results as evidence for later filings.
Serve initial notice correctly and retain proof: Serve the Form A notice of intention to register the charge on the registered proprietor by prepaid registered letter to the registered address or title address as prescribed (Reg 1(4), Form A). Keep proof of posting/registered mail and the date of service to set the timing for the three‑day dispute clock.
Monitor for a notice of dispute within three days: If a notice of dispute in Form B is received within three days, prepare to refer the matter to the magistrate within ten days of receipt (Reg 4(1), Form B). If no dispute is received within three days, proceed to apply to the Registrar for registration.
Lodge registration application if no dispute: Prepare Form C and attach the statutory declaration verifying service and non-response, and the Form D certificate setting out the amount, land and person liable. If the land is outside the Transfer of Land Act jurisdiction, prepare a memorial of the certificate for registration under the Registration of Deeds Act 1856 (Reg 2(1)-(2), Forms C and D).
Pay prescribed Registrar fees and ensure Registrar notice is posted: On filing with the Registrar of Titles or Registrar of Deeds and Transfers pay the prescribed fee and obtain evidence of registration. The Registrar will send notice in Form E to the proprietor (Reg 3(1)-(2), Form E).
If disputed, refer to magistrate and prepare hearing materials: If the proprietor serves a timely Form B, refer the dispute to the stipendiary or resident magistrate nearest the land within ten days by lodging Form F and annexures including copies of Form A and Form B (Reg 4(1)-(2), Form F). Prepare to present the authority’s materials, evidence and witnesses accordingly.

Registration, Enforcement and Discharge of Local Authority Charges on Land, Regulations

Regulations relating to the registration, enforcement and discharge under Section 372 of the Act, of charges upon land of expenses incurred by local authorities.

[Preamble amended: Gazette 10 Jan 2017 p. 302.]

1. Notice to registered proprietor

(1) Where the CEO or a local authority has incurred expenses in doing any act, matter or thing upon or in relation to any land or premises, which by the provisions of the Act are declared to be a charge upon such land or premises, and in accordance with Section 372 of the Act the CEO or the local authority desires to register such charge against such land or premises, the CEO or the local authority, as the case may be, shall serve upon the person who appears by the records of the Western Australian Land Information Authority established by the Land Information Authority Act 2006 section 5 to be the registered proprietor of such land or premises a notice in writing in accordance with Form A in the Appendix to these regulations.

(2) If the person upon whom notice is served as provided for in paragraph (1) hereof disputes the fact or the amount of the charge claimed or that the land or premises proposed to be charged is or are subject to the charge claimed or that he is liable to pay the amount of the expenses claimed, such person may within three days after the service upon him of the notice aforesaid, serve upon the CEO or the local authority, as the case may be, at his or its office notice in writing in accordance with Form B in the Appendix to these regulations setting forth the nature of the dispute, and requiring that such dispute shall be referred to a magistrate for determination in accordance with these regulations.

(3) If a person after being served by the CEO or a local authority with a notice as provided for in paragraph (1) hereof fails within the time prescribed to serve the CEO or the local authority with a notice as provided for in paragraph (2) hereof such person shall be deemed to admit the right of the CEO or the local authority to the charge claimed in his or its said notice.

(4) For the purpose of paragraph (1) of this regulation, service upon the registered proprietor of the land or premises shall be sufficient if the notice is sent to him by prepaid registered letter addressed to the address of such registered proprietor, if known, or, where his actual address is not known, addressed to his address appearing on the certificate or other instrument of title of the said land.

[Regulation 1 amended: Gazette 29 Dec 2006 p. 5906 and 5910.]

2. Application for registration at charge

(1) Where the CEO or a local authority has served notice under paragraph (1) of the next preceding regulation upon the registered proprietor of the land or premises described in the notice, and such registered proprietor has failed within the prescribed time to serve upon the CEO or the local authority, as the case may be, notice of dispute as provided for in paragraph (2) of the said next preceding regulation, the CEO or the local authority may at any time thereafter make application in writing in accordance with Form C in the Appendix to these regulations to the Registrar of Titles or the Registrar of Deeds and Transfers, as the case may require, for registration of the charge claimed against the land of such registered proprietor.

(2) Such application shall be accompanied by —

(a) A statutory declaration by the clerk to the CEO or the clerk or secretary of the local authority verifying a copy of the notice served by the CEO or the local authority as aforesaid, and of the service of such notice upon the person to whom such notice was directed, and of the failure of such person to serve upon the CEO or the local authority a notice of dispute as aforesaid within the time prescribed by paragraph (2) of Regulation 1 of these regulations;

(b) a certificate under the hand of such clerk to the CEO or such clerk or secretary of the local authority in accordance with Form D in the Appendix to these regulations stating the amount of the charged claim, the land and premises subject to such charge, and the person liable to pay the amount of such charge; and

(c) in case the land and premises to be charged are not under the Transfer of Land Act 1893, a memorial of the certificate referred to in subparagraph (b) of this paragraph for registration under the Registration of Deeds Act 1856.

[Regulation 2 amended: Gazette 29 Dec 2006 p. 5906 and 5910.]

3. Registration of charge

(1) Upon receipt from the CEO or the local authority of an application to register a charge made in accordance with Regulation 2 of these regulations, the following provisions shall apply —

(a) Where the land charged is under the Transfer of Land Act 1893, the Registrar of Titles shall, subject to payment of any prescribed fee, enter upon the records under his control relating to the land charged such memorandum or other record as shall be necessary to place on record the fact that the said land is charged as aforesaid; and

(b) Where the land charged is not under either the Transfer of Land Act 1893, the Registrar of Deeds and Transfers shall, subject to payment of the prescribed fee, register in the Register of Deeds the memorial of the certificate referred to in subparagraph (c) of paragraph (2) of Regulation 2 of these regulations.

(2) It shall not be necessary for the Registrar of Titles or the Registrar of Deeds and Transfers to call in the duplicate certificate or other instrument of title of the land charged when entering the Memorandum or record or registering the memorial as aforesaid; but when such memorandum or record has been entered or such memorial has been registered, the Registrar of Titles or the Registrar of Deeds and Transfers, as the case may require, shall cause notice of such entry or registration to be sent to the person whose name appears in the records as the registered proprietor of the land charged at his address appearing in such records. Such notice shall be in accordance with Form E in the Appendix to these regulations.

[Regulation 3 amended: Gazette 29 Dec 2006 p. 5906 and 5910.]

4. Notice of dispute

(1) Where the CEO or a local authority has served notice under paragraph (1) of Regulation 1 of these regulations upon the registered proprietor of the land or premises described in the notice, and such registered proprietor serves upon the CEO or the local authority notice of dispute within the time prescribed by and in accordance with paragraph (2) of Regulation 1 of these regulations, the CEO or the local authority, as the case may be, shall within ten days after the receipt of such notice of dispute, refer such dispute for determination by the stipendiary or resident magistrate exercising jurisdiction in the Local Court held nearest to the place where the land or premises sought to be charged is situated.

(2) Reference of a dispute to a magistrate as provided for in paragraph 1 of this regulation shall be made by the CEO or the local authority, as the case may be, leaving with the magistrate at his chambers notice in writing in accordance with Form F in the Appendix to these regulations, together with copies of the notice served upon the registered proprietor of the land or premises as aforesaid and of the notice of dispute served by such registered proprietor as aforesaid.

(3) Upon receipt of the notice and documents mentioned in paragraph (2) of this regulation, the magistrate shall appoint a day and time for the hearing of the parties in relation to the dispute, and shall cause notice of such day and time to be sent to such parties. Such day and time shall not be less than seven days after the date of service of notice thereof upon the parties as aforesaid.

(4) If either party neglect to appear personally or by counsel or solicitor on the date and at the time for hearing, and proof is made to the satisfaction of the magistrate that the said parties were duly served with notice of such hearing, the magistrate may —

(a) where the registered proprietor of the land or premises fails to appear, determine the dispute in favour of the CEO or local authority without any further hearing;

(b) where the CEO or the local authority, as the case may be, fails to appear, hear and determine the dispute, or adjourn the hearing of the same to some other date.

(5) On the hearing and determination of the dispute the magistrate may make such order as to costs to be paid by either party to the other party as he may think just.
