Regional Development Commissions Regulations 1994

The regulations are short and concentrated on three principal concepts: board composition, nomination procedure, and ministerial fallback power.

• Board composition (reg 2). The “appointed members” component of each commission’s board must total six persons, split into three categories. The regulation is explicit: two resident nominees (reg 2(a)), two local-government nominees (reg 2(b)), and two ministerial appointees (reg 2(c)). The regulation frames these appointed members as fulfilling “section 15(1)(b) of the Act,” indicating these persons form the appointed element of the board’s membership under the Act.

• Nomination procedure for resident members (reg 11). This sets the outreach mechanics. Nominations must be sought from the community by newspaper advertisement (reg 11(1)(a)(i)) and by direct correspondence to a specified cross-section of community organisations including employer and employee groups, education and training institutions, tourism and recreation bodies, and “other sections of the community” (reg 11(1)(a)(ii)). The minimum nomination window is 28 days from publication or dispatch (reg 11(1)(b)). If insufficient nominations arrive within that period, the Minister may nominate and appoint persons to fill the remaining vacancies (reg 11(2)).

• Nomination procedure for local government nominees (reg 12). Local governments receive direct correspondence inviting nominations (reg 12(1)(a)). They are asked to provide names of “twice as many persons who are willing and able to be candidates for appointment as there are places available” (reg 12(1)(b)), and the minimum period for response is 42 days (reg 12(1)(c)). If local governments fail to provide a list, or if sufficient nominations are not received within the period, the Minister may, after the expiry, nominate and appoint persons to fill remaining places (reg 12(2)).

• Ministerial fallback power (regs 11(2) and 12(2)). Both nomination regimes contain identical contingency clauses authorising the Minister to fill vacancies after the nomination period has expired, by appointing persons “as he or she thinks fit,” who are to be appointed “as if they were nominated” per the relevant subregulation.

• Transitional continuity (reg 13). The 2017 Amendment Regulations introduced a “commencement day” concept for transitional effect. Regulation 13 secures that a person who, immediately before that commencement day, held office as an appointed member, continues in office for the balance of their prior term, notwithstanding the 2017 amendments.

These concepts show the regulations operate as a procedural layer over the statutory scheme in the Act: they allocate the appointed-member slots among resident community nominees, local government nominees and ministerial appointees, and they set the required outreach and minimum timeframes for nominations.

Primary actors affected by these regulations are the Minister responsible for regional development commissions, the administrative agency that conducts nomination processes, regional community groups and organisations, local governments within each commission’s region, and potential appointees to the commission boards.

• The Minister and administering agency. The Minister is given decision rights: to appoint the two discretionary members (reg 2(c)) and, crucially, to exercise the fallback power to nominate and appoint persons when nomination routes fail to produce sufficient names (regs 11(2) and 12(2)). The regulations impose operational responsibilities , to place advertisements, send correspondence to community organisations and to local governments and to set and observe nomination periods (regs 11(1)(a), 11(1)(b), 12(1)(a) and 12(1)(c)). Those actions create administrative costs (placing newspaper advertisements, sending correspondence, processing nominations), which in practice will be borne by the relevant government department or agency that implements the Minister’s functions; the regulations prescribe the methods but do not allocate the funding.

• Community organisations and the general public in each region. The regulations require that nominations be sought from the community “by way of advertisements placed in newspapers circulating in the appropriate region” and by targeted direct correspondence to a “wide range of community organisations,” including employer and employee groups, education and training institutions, tourism and recreation bodies and “other sections of the community” (reg 11(1)(a)). Those bodies are expected to receive and consider calls for nominations and to decide whether to forward candidates. The rules thereby create an expectation that members of the public and representative organisations will engage with the nomination process within the 28-day window (reg 11(1)(b)).

• Local governments. Local governments within each commission’s region are asked, via direct correspondence, to provide names of twice as many candidates as there are local-government-nominated places (reg 12(1)(a)-(b)). That imposes a coordination task on local government authorities to identify and forward candidates within at least a 42-day window (reg 12(1)(c)). The regulation affects their internal decision-making processes and creates a deadline-driven administrative obligation, though the regulation does not create a formal statutory duty on local governments to reply.

• Potential appointees. Individuals who seek appointment are affected by the required nomination pathways, the minimum windows for application, and the possibility that in some circumstances the Minister will bypass the nomination route and directly nominate appointees after the nomination period expires (regs 11(2) and 12(2)). Those appointees may be community-nominated, local-government-nominated, or ministerial appointees, depending on which category they come under (reg 2).

• Existing appointed members at the time of the 2017 amendments. Regulation 13 explicitly affects individuals who held office immediately before the 2017 commencement day, by preserving their continuation for the balance of their original term (reg 13(2)-(3)). That removes immediate displacement risk from the 2017 regulatory change for those incumbents.

The regulations do not address other stakeholders such as commissioners who are members ex officio, staff, contractors, or third parties interacting with commissions. They are narrowly targeted at the nomination and appointment routes for the six appointed board members.

The regulations create procedural duties for the nominating processes and confer appointment powers on the Minister. They do not, in themselves, confer substantive governance rights or private entitlements beyond the potential to be nominated or appointed.

Duties and procedural requirements

• Seek community nominations by specified methods. Regulation 11(1)(a) requires nominations for the resident-member places to be sought from the community by newspaper advertisements “circulating in the appropriate region” and by direct correspondence to a broad set of community organisations (reg 11(1)(a)(i)-(ii)). The regulation also requires a minimum nomination period of not less than 28 days, to be noted on the advertisement or correspondence (reg 11(1)(b)). Those are procedural duties on the body conducting the nomination, which in practice will be the Minister’s office or an administrative department.

• Seek local government nominations by direct correspondence and specify a quota. Regulation 12(1)(a) requires direct correspondence to local governments in the region. Regulation 12(1)(b) obliges that correspondence to request names of “twice as many persons who are willing and able to be candidates for appointment as there are places available to local government nominees on the board in that region.” The minimum response period is 42 days (reg 12(1)(c)). These are procedural obligations and a quantitative expectation on local governments to supply a list containing double the number of openings.

• Minister’s contingency appointment power. Regulations 11(2) and 12(2) both give the Minister a post-expiry power to “nominate for appointment to the board as members such persons as he or she thinks fit, in sufficient numbers to fill the remaining places available,” and to have those persons appointed “as if they were nominated in accordance with” the applicable subregulation. This confers a substantive executive power to make appointments when nomination channels do not deliver sufficient candidates within the prescribed period.

Rights and implications for candidates and nominators

• No statutory private right to appointment. The regulations define nomination methods and give the Minister appointment authority. They do not create a private legal right to appointment or a binding obligation on the Minister to appoint nominated individuals; the Minister retains discretion, most explicitly in relation to the two ministerial appointments (reg 2(c)) and in the fallback mechanism (regs 11(2), 12(2)).

• Local governments’ expectation to propose twice as many candidates. Local governments are requested (not compelled by express language in these regulations) to provide twice as many names as there are local-government-nominated places (reg 12(1)(b)). The wording is prescriptive as to the content of the correspondence, but the regulation contains no sanction for non-provision other than the Minister’s fallback power (reg 12(2)).

• Continuity for incumbents affected by the 2017 amendments. Regulation 13 affords incumbents who held office immediately prior to the 2017 commencement day the right to continue for the balance of their original term (reg 13(2)-(3)). That is an affirmatively protective transitional right.

Not specified in the regulations

• Eligibility criteria, vetting, conflict-of-interest rules, remuneration, terms of office other than the savings in reg 13, or procedures for removal are not addressed in these regulations. Those matters are therefore either governed by the underlying Act (which the regulations reference but which is not reproduced here) or by other instruments. The regulations are limited to nomination mechanics and the numerical split of appointed membership.

The regulations contain no express offences, penalties, or enforcement mechanisms. They prescribe nomination mechanisms, minimum timeframes and the Minister’s powers to fill vacancies, but they do not attach fines, criminal sanctions, administrative penalties or enforcement processes to compliance or non‑compliance within the text provided.

• No penalties in the text. There is no provision creating an offence for failing to advertise, failing to correspond, failing to meet the minimum nomination periods, or for local governments failing to provide the requested candidate lists. Nor do the regulations specify remedial or reviewable decisions, internal review processes, or external appeal rights arising from the Minister’s nominations or appointments.

• Practical enforcement realities. Because the regulations place operational duties on the nomination process (advertisements, correspondence, minimum periods), compliance in practice will be enforced by administrative practice and by the Minister’s own procedural controls rather than by criminal or civil penalty clauses contained in these regulations. The Minister’s fallback appointment power (regs 11(2) and 12(2)) functions as an enforcement or corrective mechanism in the event of insufficient nominations: it allows vacancies to be filled without further reliance on the prescribed nomination routes.

• Remedies outside the regulations. The absence of regulatory penalties does not mean there are no legal avenues to challenge appointments: judicial review of administrative decisions may be available under general public law principles, but such remedies and their applicability are not set out in these regulations. The regulations make clear who nominates and who appoints (reg 2) and how nomination calls must be conducted (regs 11-12), but they do not create an internal enforcement or penalty regime.

• Transitional safeguard, not punitive mechanism. Regulation 13 is a savings provision preserving incumbents’ terms after the 2017 amendments; it is a continuity rule rather than an enforcement or penalty mechanism (reg 13(2)-(3)).

In short, enforcement of these rules will be administrative: ensuring advertisements and correspondence are placed and that minimum timeframes are observed. Where these steps are not taken, the only express statutory consequence in this instrument is the Minister’s ability to make direct appointments once the nomination period has expired.

The regulations are subordinate legislation made under the Regional Development Commissions Act 1993 and expressly reference two provisions of that Act. The regulatory text must be read as an implementing instrument within the Act’s broader statutory framework.

• Implementing Act references. Regulation 2 explicitly operates “for the purposes of section 15(1)(b) of the Act,” and regulation 11 carries the heading “(section 16).” That indicates these regulations are designed to give effect to the appointed-member provisions in the Act. The regulations therefore do not stand alone; they are functionally dependent on the Act for the broader grant of power to establish commissions, to constitute boards, and to appoint or remove members. The regulations do not replicate the Act’s wider governance rules (for example, eligibility, terms of appointment, remuneration, quorum, or removal), which likely appear in the Act or other instruments.

• Subordinate instrument structure. As regulations, they are subordinate to the Act, meaning they can only operate within the scope of delegated power conferred by the Act. The regulations define nomination methods and timeframes but leave other governance matters to the parent Act. The compilation table shows amendments over time (1997, 2017, 2021), which indicates the parent Act’s enabling power has been used periodically to revise appointment procedures (Compilation table).

• Interaction with administrative law. The regulations create administrative processes managed by the Minister. Decisions by the Minister under regs 11(2) or 12(2) to nominate and appoint persons after a nomination period expires are administrative acts. They may be subject to general public law remedies (procedural fairness, reasonableness, legality) even though those remedies are not specified in the regulations. The regulations do not limit access to judicial review or specify privative clauses.

• Relationship with local government law. Regulation 12 engages local governments by seeking nominations from them. The regulation does not purport to modify or create statutory duties for local governments under local government legislation; it simply prescribes that the Minister will correspond and request lists of candidates. The absence of a sanction for non-compliance means the instrument relies on voluntary cooperation from local governments, with the Minister’s fallback power as the operational remedy.

• Transitional and amendment interactions. Regulation 13 is a transitional savings provision tied to the Regional Development Commissions Amendment Regulations 2017 (reg 13(1)-(3)). The compilation table chronicles the amendments and commencement dates for those amending instruments (Compilation table). The Other notes entry records that the 1997 Amendment’s r 3(2) is a transitional provision that is of no further effect. Those entries show how the regulations have been updated over time, and that transitional continuity has been handled by express savings clauses.

• Deletions and scope. The document records that regulations 3-10 were deleted (immediately after reg 2 in the text). The content of those deleted provisions is not supplied here. Deletions indicate a narrowing or restructuring of the regulatory scheme at the time of amendment (see note after reg 2). Any interaction with other laws will therefore be affected by whatever substantive content those deleted provisions formerly contained; that content cannot be stated from this text.

The regulations include a clear amendment timeline in the compilation table and inline amendment notes. The key dates and changes recorded in this instrument are:

• Original enactment. The Regional Development Commissions Regulations 1994 were published 1 March 1994 (Compilation table: Regional Development Commissions Regulations 1994 , 1 Mar 1994 p. 779‑82) and commenced on that date.

• 1997 amendments. The Regional Development Commissions Amendment Regulations 1997 were published 29 April 1997 (Compilation table), and insertion and deletion notes mark changes: regulation 2 was inserted and regulations 3-10 were deleted on that date (inline note after reg 2 and “3-10. Deleted” entry). The 1997 amendment also included a transitional provision r 3(2), which the Other notes states is “of no further effect.”

• Reprint. A reprint occurred as at 8 December 2006 that included the 1997 amendments (Compilation table: Reprint 1).

• 2017 amendments. The Regional Development Commissions Amendment Regulations 2017 are recorded as published 29 August 2017, with r 1 and r 2 commencing 29 August 2017 and the remainder commencing 30 August 2017 (Compilation table). Regulation 2 was noted as amended in the inline note and regulation 13 (the savings provision) was inserted by the 2017 amendments (reg 13 inserted: Gazette 29 Aug 2017 p. 4595). The savings provision defines “commencement day” and preserves the office terms of appointed members who were in office immediately prior to that day (reg 13(1)-(3)).

• 2021 amendment instrument. The Compilation table records the Regional Development Commissions Amendment Regulations 2021 as State Law 2021/172, published 8 October 2021 and commencing 8-9 October 2021 depending on clauses (Compilation table). The inline amendment note shows regulation 11 was amended by SL 2021/172 r. 4 (reg 11 amended: Gazette 29 Apr 1997 p. 2140; SL 2021/172 r. 4). The 2021 instrument therefore updated reg 11; the text presented reflects those amendments.

• Deleted provisions. The inline notation “3-10. Deleted: Gazette 29 Apr 1997 p. 2140.” shows that a block of intermediate regulations were removed by the 1997 amendments. The Other notes itemises that the 1997 r 3(2) transitional provision is “of no further effect.” The current text therefore reflects a compacted regulatory instrument post‑1997 with later amendments layering in 2017 and 2021 changes.

The amendment history in the compilation table provides the dates and formal citations of the amending instruments and commencement mechanics. The regulations’ current substantive mechanics (reg 2, regs 11-13) are therefore the product of that amendment sequence.

The provided text does not record any litigation or cases. There are no cases, decisions or judicial interpretations cited within these regulations. The instrument itself contains no notes or annotations about judicial review, appeals, or litigation outcomes. The “Notes” and “Other notes” sections list compilation and transitional items, but not court decisions.

Because the regulations operate as subordinate legislation specifying nomination procedures and ministerial appointment powers, disputes arising from their application could in theory lead to administrative law litigation (for example alleging failure to follow the nomination process or asserting procedural unfairness in appointments), but there is no litigation recorded here. Any judicial treatment, case law, or tribunal decisions that interpret these provisions are not included in this compilation and would need to be located through case-law research outside this text.

The absence of litigation history in the instrument should be treated as silence about judicial engagement, not as evidence that no disputes have occurred. The regulations do not include any internal dispute-resolution or appeal mechanism specific to nomination or appointment decisions.

The regulations are concise but contain several practical features and silences that can produce unforeseen outcomes or implementation challenges:

• Mandatory methods with no alternative channels. Regulation 11(1)(a) requires that nominations for resident members be sought by newspaper advertisements and by direct correspondence to a wide range of community organisations (reg 11(1)(a)(i)-(ii)). The prescription of these specific channels may under‑reach modern outreach expectations if the administering agency relies solely on traditional newspapers and correspondence; the regulation does not require additional methods such as electronic publication, social media or public notices beyond what is specified. The regulation does not mandate that additional outreach be undertaken, nor does it explicitly require proof of circulation or reach of the advertisements.

• Minimum periods but no enforcement mechanism. The regulations set minimum nomination periods , 28 days for community nominations (reg 11(1)(b)) and 42 days for local government nominations (reg 12(1)(c)). There is no penalty or automatic consequence for failing to observe those minimum periods, though a failure could be open to administrative challenge. The absence of an express validation mechanism (for example, a power to extend periods or to re-run a call) means that failure to observe timeframe requirements could create procedural uncertainty.

• Local government quota expectation. Regulation 12(1)(b) asks local governments to provide names of “twice as many persons” as there are local government nominee places. That is a quantitative expectation which presumes local governments can identify and agree on a pool of candidates. There is no mechanism in these regulations to resolve disputes among local governments or to oblige individual councils to participate. If one or several local governments do not supply lists, the fallback is ministerial appointment after the period expires (reg 12(2)), which may produce appointments not endorsed by local councils.

• Ministerial fallback power after expiry. Both regs 11(2) and 12(2) permit the Minister to nominate and appoint persons “as he or she thinks fit” after the nomination period expires, where insufficient nominations have been received. That clause is broad and grants the Minister substantive discretion to fill vacancies. The regulation also stipulates that those appointees are to be treated “as if they were nominated in accordance” with the applicable nomination subregulation, creating an appearance of parity between ministerial appointments made under the fallback and nominations delivered through the advertised or local government channels, even though the latter were unsuccessful.

• No eligibility, vetting or conflict rules in these regulations. The regulations do not supply eligibility criteria, criminal history rules, conflict-of-interest requirements, disclosure obligations, or vetting processes. Those matters may exist in the Act or separate instruments, but the regulations themselves are silent. Implementing agencies must therefore be careful to consult the parent Act and other relevant instruments to ensure compliance on eligibility and integrity checks.

• Savings provision scope. Regulation 13 preserves incumbents’ terms for the balance of prior appointments following the 2017 amendments (reg 13(2)-(3)). That is narrow: it only applies to persons who “immediately before commencement day, held office as an appointed member.” New appointees after that date are governed by the amended scheme. The regulation therefore creates transitional protection for a defined group; practitioners should check incumbent statuses and term expiries to apply the savings correctly.

• Deleted provisions not in this text. Regulations 3-10 were deleted (note after reg 2). The substance of those deleted regulations is not available here. If a practitioner relies on older practice, they must verify whether any operational obligations that previously existed were removed.

• No supervisory reporting or transparency obligations. The regulations do not require public publication of the names of nominees, the shortlisting process, the Minister’s reasons for appointment, or records of adverts and correspondence. That absence may reduce transparency around appointments unless other instruments or departmental policies require disclosure.

These features concentrate operational discretion in the Minister and in the administering agency while placing procedural expectations on community organisations and local governments. The practical effects will depend on how strictly the Minister and the agency adhere to the prescribed methods and minimum periods, and on the existence of parallel rules in the Act.

For an agency implementing the nomination and appointment process under these regulations, the following concrete compliance checklist is grounded in the regulatory text. The checklist assumes the Minister and an administrative unit will coordinate the steps and keep contemporaneous records.

1. Confirm statutory foundation. Ensure the nomination and appointment exercise is conducted under the Regional Development Commissions Act 1993, and that these regulations (regs 2, 11-13) apply to the particular commission. Regulation 2 explicitly refers to s 15(1)(b) of the Act and regs 11 and 12 to s 16.

2. Establish timeline and responsible officers. Appoint an officer or team to run the nomination campaign and to be accountable for meeting minimum periods and for recordkeeping. Document the start and end dates for each nomination period.

3. Resident-member nominations (reg 11):

   • Prepare and place an advertisement in newspapers “circulating in the appropriate region” (reg 11(1)(a)(i)). Record the publication date and a copy of the published advertisement.
   • Identify a wide range of community organisations to be contacted by direct correspondence, including at least employer and employee groups, education and training institutions, tourism and recreation bodies and other community sections (reg 11(1)(a)(ii)). Maintain a contact list and copies of correspondence sent.
   • State the nomination period on the advertisement and in all correspondence, ensuring a period of not less than 28 days from date of advertisement or dispatch (reg 11(1)(b)). Use a clear closing date and time.
   • Set up a formal process for receiving and recording nominations, including date-stamping submissions and maintaining a register of nominations received.

4. Local-government nominations (reg 12):

   • Send direct correspondence to all local governments in the region requesting names of candidates (reg 12(1)(a)). Keep copies of all letters/emails and the date sent.
   • In the correspondence, request that local governments provide the names of twice as many persons who are willing and able to be candidates as there are local-government nominated places on the board (reg 12(1)(b)). Specify the number of places and the expected list size.
   • Provide a nomination period of not less than 42 days and note that period in the correspondence (reg 12(1)(c)). Record replies and their dates.

5. Vetting and eligibility checks. Although the regulations do not set out eligibility or vetting requirements, ensure that the agency follows applicable provisions in the Act and any other relevant instruments governing eligibility, conflicts of interest, security or probity checks. Document vetting procedures and outcomes for each nominee.

6. Processing nominations. Evaluate nominations against any statutory eligibility criteria, and prepare a short-list or recommendation for the Minister where appropriate. Maintain records of the selection process, scoring or assessment criteria used (even if not required by the regulations), and reasons for recommendations.

7. Ministerial appointments and fallback (regs 2, 11(2), 12(2)):

   • If sufficient nominations are received within the period, follow the Act’s appointment procedures for appointing nominees. If insufficient nominations are received within the minimum period, be prepared to exercise the Minister’s fallback power after the expiry of the period to nominate and appoint persons “as he or she thinks fit” to fill remaining places (regs 11(2) and 12(2)). Document the decision-making process and rationale for any such direct nominations.
   • For the two discretionary ministerial appointees under reg 2(c), record how candidates were identified and why they were chosen.

8. Transitional incumbents (reg 13). For appointments that straddle the 2017 commencement day, verify whether any incumbent held office “immediately before commencement day” and ensure they continue in office for the balance of their term as set out in reg 13(2)-(3). Keep records of appointment dates and term expiries to apply the savings correctly.

9. Recordkeeping and transparency. Keep a clear audit trail: copies of advertisements, correspondence lists, candidate submissions, dates received, vetting checks, shortlists, ministerial appointments, instruments of appointment, and records of communications with local governments and community organisations. Even where the regulations do not mandate publication, consider publishing basic information on the commission’s website to demonstrate procedural compliance.

10. Practical outreach considerations. Although reg 11 specifies newspaper advertisements and direct correspondence, consider supplementary outreach consistent with the regulation’s aims (for example, electronic notices and outreach to broader networks) while contemporaneously retaining the required newspaper advertisement and correspondence to meet the formal requirements in regs 11(1)(a)(i)-(ii).

11. Legal review. Before final appointments are made, obtain legal clearance that the process complied with the minimum periods, the advertised methods, and any Act-based eligibility and procedural requirements. Ensure instruments of appointment reference the relevant Act and the regulation under which the appointment is made.

12. Post-appointment matters. Update commission records and public registers as required under the Act or other instruments. For transparency, prepare a file note describing the nomination process and the Minister’s appointment decisions, and retain for audit and potential review.

Following this checklist will align administrative practice with the procedural prescriptions in regs 2, 11, 12 and the transitional rule in reg 13. Because these regulations are narrowly focused, agencies must also check the parent Act and other relevant instruments for requirements not addressed here, such as terms of office, remuneration, conflicts rules, and removal processes.
