What it does
Mechanically, the Regional Development Act 2004 establishes a statutory framework for the New South Wales Minister to provide direct financial assistance targeted to regional New South Wales, it creates and governs a dedicated Regional Development Trust Fund to hold and pay out that assistance, and it sets out governance, reporting and procedural obligations for administration. The Act gives the Minister authority to make grants, subsidies, loans, payroll tax rebates and other assistance consistent with the Act’s object, and it creates an advisory structure and transparency obligations to support oversight of those decisions.
Key mechanical features in the text are these. The object clause sets out the statutory purposes in s 3, which expressly link targeted economic and employment growth in regions with the principles of ecologically sustainable development, place-based solutions, support for Aboriginal communities and enterprises, and cooperation across levels of government. The Minister may grant financial assistance on application or on the Minister’s own initiative, subject to an application form approved by the Secretary and any additional documentation the Secretary requires, s 5(1)-(2). The Act lists the forms of assistance the Minister may provide in s 6, and allows the Minister to impose conditions and securities on grants, including performance targets, investment obligations, repayment triggers and interest, s 7. Payroll tax rebates are a defined form of assistance under s 8 and are conditional on payroll tax having been paid for the relevant year, and on group members having paid payroll tax where applicable, s 8(4)-(5).
The Act establishes the Regional Development Trust Fund in the Special Deposits Account and sets out sources of money to go into the Fund, permitted outgoings, and investment powers available under the Government Sector Finance Act 2018, s 11. The Act requires a governance framework and an investment strategy to be prepared and published, and mandates periodic review of the investment strategy at least once every two years, s 11A. It also requires an annual report for the Fund, to be published on the Department’s website, including specific items such as payments from the Fund and the Minister’s actions in relation to advice from the Regional Development Advisory Council, s 11B. The Minister must establish a Regional Development Advisory Council and must consider its advice when exercising the Minister’s functions, s 12.
