REFERENDUMS REGULATIONS 1998

The Regulations rely on a small set of recurrent concepts that determine admissibility, chain of custody, and evidence treatment.

• Ballot-paper and postal ballot-paper. A postal ballot-paper is defined by Form 1 in Schedule 1 and a non‑postal ballot-paper by Form 2 (regs 2-3). The forms specify the question text and directions for marking YES or NO and for folding and enclosing. The postal form includes an express warning about the temporal and delivery conditions that determine inclusion in the poll (Form 1 note; reg 12(1)).

• Envelopes with certificates or declarations. Postal votes must arrive in the envelope bearing the postal vote certificate. Ballot-papers cast under section 36 of the Act must arrive in envelopes with the voter’s declaration. The Regulations treat absence of the relevant envelope as fatal to counting (reg 17).

• Timelines and cut-offs. Postal votes must be marked before 6.00 p.m. on polling day and be delivered either to a presiding officer before close of polling on polling day or to the Divisional Returning Officer by 6.00 p.m. on the Friday after polling day (reg 12(1)). Pre‑poll voting under section 25 is treated as voting for the purposes of the Regulations, with specific handling requirements where the voter votes outside their enrolment division (reg 6(1), (3)).

• Identification and discretion. Presiding officers may accept votes despite errors or omissions in roll entries where the presiding officer considers the voter is sufficiently identified (reg 5(1)). Similarly, Divisional Returning Officers must be satisfied as to signature matching, witnessing and timing when deciding whether to admit a postal vote (reg 13(4)).

• Chain of custody and sealing. Ballot-box construction standards are prescribed (reg 4). Envelopes with postal ballots or declarations are to be produced unopened and, if admitted, the ballot-paper is to be withdrawn and immediately deposited folded into a locked or sealed ballot-box (regs 14(5)(a), 15(4)(d)). Parcels of excluded or processed envelopes are sealed and endorsed with a statement of contents (regs 14(6), 15(7)).

• Scrutineer access and evidence. The Regulations provide rights for scrutineers to attend checking and sorting processes and to inspect rejected postal vote certificates (regs 13(2)(b), 14(2)(b), 14(4)(a), 15(2)(b)). They also make written explanations and statutory declarations submitted under the failure-to-vote procedure admissible as if given in evidence before the court (regs 19(8), 20(5)), with prescribed procedures for prosecuting officers to investigate declarations (reg 20(4)).

• Failure to vote procedure. Divisional Returning Officers must compile lists of electors who failed to vote and serve notices requiring explanation within 21 days. Religious belief is an expressly satisfactory explanation and is to be recorded in a register (reg 19(1)-(6)). The Regulations set the administrative steps leading to possible legal proceedings (regs 19-20).

• Deferred counting. An officer must defer counting where a received ballot-box contains fewer than 100 ballot‑papers (reg 21). Ballot-papers from small boxes are held until aggregation yields over 100 or until no more boxes are expected, at which point they are opened and counted (regs 21(1)-(4)).

These concepts structure the trade-off between inspection and secrecy, the threshold for admissibility and the allocation of discretion to electoral officers. The Regulations prioritise documentary verification and sealed handling to protect ballot secrecy and evidentiary records, while allowing officer judgement in identification and signature-satisfaction points.

The Regulations create duties and opportunities for distinct groups. The primary duty-bearers and affected parties are:

• Electors. All enrolled electors who vote at referendums are affected by the form and timing rules. Postal electors must sign and have their postal vote certificate witnessed, mark the ballot before 6.00 p.m. on polling day and ensure delivery to an authorised addressee within the prescribed windows or their vote will be excluded (reg 12(1), Form 1). Electors who vote under section 25 (pre-poll) and section 36 (declaration votes) are subject to special envelope procedures and to verification of declarations (regs 6, 15). Electors who fail to vote can be served notices and may face legal proceedings unless they provide an explanation within 21 days; religious beliefs may be accepted and recorded (reg 19).

• Presiding officers. These officers operate polling places and decide whether a person is sufficiently identified where roll details are incomplete, must refuse to issue a ballot-paper where a person refuses to answer or answer affirmatively questions required by section 31(2) of the Act (reg 5(1), 7), and must record and forward notes when they refuse to issue a ballot-paper to a person making a section 36 declaration (reg 8). They handle spoilt and discarded ballot-papers and must mark and forward them at close of polling (reg 9).

• Divisional Returning Officers. These officers are central to the regime. They must keep a locked/ sealed "Postal Ballot-box" for received postal envelopes and are responsible for checking postal vote certificates against applications, marking certified lists, placing unopened envelopes in ballot-boxes or marking them "rejected", processing and sorting postal votes, examining section 36 declaration envelopes, sealing parcels and endorsing statements of contents, and preparing lists of non-voters (regs 10, 13-16, 19). They are given wide procedural discretion, including determining the timing of checking and sorting procedures and approving persons present during those steps (regs 13(2), 14(2), 15(2)).

• Chief Electoral Officer. The Chief Electoral Officer may divide the Territory into regions for pre-poll voting and assign names to regions (reg 6(2)). The Chief Electoral Officer also approves persons who may witness checking of postal vote certificates or be present at sorting and examinations (regs 13(2)(b), 14(2)(b), 15(2)(b)). The Chief Electoral Officer may give directions on the timing and content of notices for failure-to-vote procedures (reg 19(2)).

• Scrutineers. The Regulations explicitly provide for scrutineers to attend checking, sorting and examination processes and to inspect rejected postal vote certificates. Scrutineers who assist at a referendum must make and subscribe a declaration (reg 22). They may be present to witness presiding officers’ notes for refusals to issue ballots (reg 8(2)).

• Prosecuting officers and courts. The Regulations set procedures for notices, acceptance of written explanations and statutory declarations as evidence, the prosecuting officer’s duty to inquire into statutory declarations, and the court’s treatment of varying defences and costs where an accused changes the substance of their defence at hearing (regs 19-20).

• Witnesses and authorised witnesses. Postal vote certificates must be purportedly witnessed by an authorised witness. The Divisional Returning Officer checks that the signature on the certificate purports to be witnessed by an authorised witness as part of admissibility (reg 13(4)(b)). The Oaths, Affidavits and Declarations (Consequential Amendments) Act 2010 amended reg 22 to reflect changes in oath and declaration practices (endnote 2 and list of amendments).

Less directly affected parties include organisations or agents engaged to courier ballot-boxes and the administrative staff who prepare and seal parcels and endorse statements of contents. The text places operational burdens on public electoral staff rather than on private businesses, though private couriers and postal services are implicitly necessary for timely delivery of postal votes.

The Regulations allocate specific duties to electoral officers and rights to participants in the checking and counting process. Key duties:

• Ballot and ballot-box standards. Presiding and returning officers must ensure ballot-boxes are constructed of durable material, capable of being securely fastened or sealed and have a cleft to receive ballot‑papers (reg 4). Ballot-papers must follow Forms 1 or 2 (regs 2-3, Schedule 1).

• Identification and acceptance of votes. Presiding officers must not reject a claim to vote solely because of certain roll errors if in their opinion the voter is sufficiently identified (reg 5(1)). A voter is not disqualified by name change through marriage (reg 5(2)).

• Pre-poll procedures. Where voters cast votes under section 25 outside their enrolled division, they must place the marked ballot-paper in an envelope bearing the name of the division for which they are enrolled, seal it and deposit it in the ballot‑box at the location; the officer must deliver that ballot-box to an officer conducting determination of results as soon as practicable after 6.00 p.m. on the day before polling (reg 6(3)-(4)).

• Refusal to issue ballots and recordkeeping. The presiding officer must refuse to issue a ballot-paper to a person who refuses to answer specified questions under section 31(2) (other than the question in s 31(2)(b)) or fails to answer affirmatively (reg 7). Where a presiding officer refuses to issue a ballot under a section 36 declaration, the officer must prepare a written note of the request and reasons, sign it in the presence of scrutineers that are present and forward it to the Divisional Returning Officer at close of polling (reg 8).

• Handling spoilt and discarded ballot-papers. Presiding officers must immediately mark "spoilt" or "discarded" across the face, place them in an endorsed envelope and forward them at close of polling to the Divisional Returning Officer (reg 9).

• Postal vote checking and sorting. Divisional Returning Officers must examine postal vote certificates and applications, satisfy themselves as to signature, witness and timing, mark certified lists and place unopened envelopes in the postal ballot-box if satisfied (reg 13(3)-(4)). They must sort postal votes, allow scrutineers to inspect rejected certificates and, where admitted, withdraw the folded postal ballot-paper from the envelope and immediately deposit it in a locked or sealed ballot-box without inspecting it (reg 14(4)-(5)). Parcels of envelopes must be sealed and endorsed (regs 14(6), 15(7)).

• Examination of section 36 declarations. Divisional Returning Officers must not examine such declarations until after close of polling, must do so in the presence of attending scrutineers or approved persons, and if satisfied must mark certified lists and deposit the ballot-papers in sealed ballot-boxes, or exclude and parcel unopened envelopes where not satisfied (reg 15(2)-(7)). They must not exclude a ballot-paper solely because the presiding officer omitted to attest a declaration if the voter’s name appears on the record made by the presiding officer under section 36(4) of the Act (reg 15(8)).

• Part-counting and preservation of anonymity. Divisional Returning Officers may part-count but must ensure sufficient uncounted postal ballot-papers or ballot-papers remain in the ballot-box to prevent identity disclosure (reg 16).

• Deferred counting. An officer conducting determination must defer counting of ballot-papers in a received ballot‑box if there are fewer than 100 ballots, depositing them into a locked or sealed ballot-box until aggregation yields 100 or no more boxes will be received (reg 21).

• Failure-to-vote notices and registers. Divisional Returning Officers must prepare lists of non-voters, send notices within three months of declaration of poll subject to Chief Electoral Officer directions, require explanations within 21 days, accept religious belief as a satisfactory explanation and keep a register of persons who give religious beliefs as an explanation (reg 19(1)-(6)). They must forward explanations to the court in prosecutions (reg 19(7)).

Rights and procedural protections include:

• Scrutineer attendance and inspection. Scrutineers may attend checking, sorting and examination processes and inspect rejected postal vote certificates (regs 13(2)(b), 14(2)(b), 14(4)(a), 15(2)(b)).

• Written explanations and statutory declarations treated as evidence. The court must consider an elector’s written explanation or statutory declaration as if given in evidence, and prosecuting officers must inquire into statutory declarations where practicable (regs 19(8), 20(4)-(5)).

• Declaration by officers and scrutineers. Officers and scrutineers must make the prescribed declaration but failure to do so is not a ground to set aside a referendum (reg 22).

The Regulations place substantive procedural performance duties on electoral officers and create evidentiary treatment for communications from electors. Rights conferred are primarily oversight rights for scrutineers and the procedural protection that religious belief explanations will be accepted.

The Regulations themselves do not prescribe numerical penalties or fines. They establish the administrative preconditions and procedural steps that lead to prosecution for failing to vote and the evidentiary framework for such prosecutions.

• Administrative lead-in to enforcement. Divisional Returning Officers must compile lists of electors who failed to vote and, subject to directions from the Chief Electoral Officer, send notices to those electors within three months after the declaration of the poll requiring an explanation within 21 days (reg 19(1)-(3)). If an elector does not give an explanation within the time, or gives an explanation that the Divisional Returning Officer considers unsatisfactory, the officer must advise the elector by posted notice that legal proceedings may be commenced (reg 19(4)). The Regulation therefore structures enforcement by creating a standardised pre-prosecution administrative step. The content and timing are under the onus of Divisional Returning Officers and subject to Chief Electoral Officer directions (reg 19(2)).

• Treatment of religious belief explanations. The Regulations create an express safe harbour: a person who failed to vote may give religious beliefs as their explanation and this must be taken as satisfactory (reg 19(5)(a)-(b)). The Divisional Returning Officer must keep a register of such persons and forward explanations to court in prosecutions (regs 19(6)-(7)).

• Court procedure and evidence. The Regulations direct how courts are to treat written explanations and statutory declarations. Written explanations received by the court under reg 19 must be considered as if given in evidence before the court, whether or not the elector is present (reg 19(8)). For prosecutions, a notice must inform the defendant that they may attend court to answer charges or lodge a statutory declaration at least 7 days before the hearing; if a statutory declaration is received, the prosecuting officer must inquire into its truth where practicable and bring it to the notice of the court (reg 20(2), (4)). The court must consider the statutory declaration as if given in evidence, whether or not the defendant is present (reg 20(5)). If a defendant attends and sets up a defence materially different from the prior written explanation or declaration, and the court dismisses the complaint, the court must do so without awarding the defendant costs of defence (regs 19(9), 20(6)). The court may adjourn the hearing on the prosecuting officer’s application to allow inquiry into a declared matter (reg 20(7)).

• Exclusion of ballot-papers from counting. The Regulations provide immediate administrative sanctions for procedural defects that amount to exclusion from the determination of the poll. Postal ballot-papers not meeting the time and delivery conditions are excluded (reg 12(1)). Envelopes where the Divisional Returning Officer is not satisfied about signature, witness or timing are to be marked "rejected" and placed in the postal ballot box (reg 13(5)). Ballot-papers submitted without the requisite envelope are not to be counted (reg 17).

• Operational compliance consequences. Presiding officers must mark spoilage and discarded papers and forward them for central processing (reg 9). Divisional Returning Officers must seal parcels and endorse their contents, which creates a documented trail that would be relevant to any dispute or legal challenge (regs 14(6), 15(7)).

The Regulations therefore create a two-tier enforcement posture. First, administrative exclusion from counting functions as an immediate sanction for non-compliance with the formal requirements around postal and declaration votes. Second, the failure-to-vote provisions create a structured pathway to criminal or civil proceedings under the Act with specified procedural safeguards for written explanations and statutory declarations. The Regulations do not themselves set fines or criminal penalties; they channel disputes and non-compliance into the judicial processes created under the Act.

The Regulations sit as subordinate instruments under the Referendums Act 1998 and refer repeatedly to sections of that Act. They are procedural amplification of the Act’s voting, declaration and counting provisions. Key interactions:

• Dependence on the Referendums Act. The Regulations repeatedly reference sections of the Act, including sections 25 (pre-poll voting), 26 (postal ballot-papers), 31 (questions required to be answered), 34 (voter declaration requirements at pre-poll locations), 36 (declarations for special votes), 38 (discarded ballot-papers) and 52 (counting and part-counting) (see regs 6(1), 12, 7, 6(3), 9, 15, 16, 18). The Regulations therefore operationalise evidence and handling procedures required under those statutory provisions.

• Evidence and court procedure. The Regulations prescribe how written explanations and statutory declarations interact with court processes that are likely to be created by the Act or other laws. They make such material admissible as if given in evidence (regs 19(8), 20(5)). That interaction affects the procedural law of prosecutions for failure to vote and establishes prosecutorial duties to inquire into statutory declarations (reg 20(4)). The Regulations reference the courts’ processes but do not alter evidentiary rules beyond treating those written documents as evidence for the specific purpose of failure-to-vote prosecutions.

• Oaths, affidavits and declarations reform. Endnotes record that regulation 22 was amended by the Oaths, Affidavits and Declarations (Consequential Amendments) Act 2010 (endnote 2). That indicates that the declaration form (Form 3) and the rule requiring a declaration from officers and scrutineers have been adjusted to align with broader reforms to Oaths and Declarations law. The Regulations therefore must be read in light of subsequent statutory changes to who can witness and the form of declarations.

• Northern Territory Electoral Regulations 1995. Regulation 19(10) carves out duplication of procedure where polling day for a referendum coincides with polling day for a Legislative Assembly election. In that case, a Divisional Returning Officer need not comply with reg 19 where he or she has complied with reg 30 of the Northern Territory Electoral Regulations 1995. This cross-reference reduces duplication of notices and acknowledges operational overlap when referendums and elections are simultaneous.

• Administrative law and discretion. Several provisions give decision-making latitude to presiding officers and Divisional Returning Officers (for example, reg 5(1) allows the presiding officer to determine identity; reg 13(2) allows checking "at any time the Divisional Returning Officer considers practicable"). That discretion will interact with standard administrative law principles governing lawful, reasonable and procedurally fair exercise of powers. The Regulations set procedure to reduce arbitrary exclusion, for example by requiring that rejected envelopes be marked and scrutineers given access, and by requiring written reasons and scrutineer signatures where a ballot is refused under a section 36 declaration (reg 8).

• Criminal and procedural law beyond the Regulations. The Regulations do not define offences or penalties; those are located in the Referendums Act or other Northern Territory legislation. The Regulations’ role is to establish the evidentiary chain that determines whether a given vote is counted or whether prosecution for failure to vote proceeds to court.

In practice, compliance requires operators to understand both these Regulations and the referenced provisions of the Act and related electoral regulations. The Regulations act as procedural complements to statutory duties and to general rules of court and administrative law.

The Regulations were made as the Referendums Regulations 1998 (SL No. 35, 1998), notified and commenced on 3 September 1998 (Endnotes, list of legislation). The published endnotes show formal amendments and consequential changes:

• Regulation 12 was amended by the Statute Law Revision Act (No. 2) 2003 (Act No. 44, 2003), s 6, which appears in the list of amendments (Endnotes, List of Amendments). The text now specifies the temporal conditions for postal ballot inclusion and the use of the postal vote certificate’s date and time in the absence of evidence to the contrary (reg 12(1)-(2)). The endnote identifies r 12 as subject to that 2003 amendment.

• Regulation 22 was amended by the Oaths, Affidavits and Declarations (Consequential Amendments) Act 2010 (Act No. 40, 2010), s 202 (Endnotes). That statutory amendment took effect 1 March 2011, aligning declarations by officers and scrutineers with contemporary oath and declaration rules. The relevant note in the endnotes identifies the amendment date and the enabling Act (Endnotes 2). The Regulations’ Schedule 1 Form 3 and the requirement to make and subscribe such a declaration were therefore updated to reflect the legislative changes.

• General amendments of a formal nature were made by the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) to rr 1 and 19 and Schedule 1, according to the endnotes (Endnotes 3). These are described as formal alterations and not detailed further in the printed reprint.

The Endnotes list the enabling Acts and dates but do not provide detailed amendment texts within the document supplied. The Schedule and forms show the updated form of the postal ballot-paper (Form 1), ballot-paper (Form 2) and declaration (Form 3). The endnotes do not report any repeals or expiry. The legislative history points to modest, targeted amendments: to postal vote handling and to the form and legal basis of required declarations. The 2018 Interpretation Legislation Amendment Act made formal amendments to reflect modern drafting conventions. No other substantive rewrites or repeals are recorded in the endnotes supplied with this text.

The supplied text contains no reported case law, judicial decisions or litigation outcomes arising under these Regulations. The document’s endnotes and schedule of legislation list only enabling Acts and amendments. There are no cases named or judicial interpretations referenced in the Regulations or endnotes provided. The Regulations do, however, anticipate court involvement in prosecutions for failure to vote (regs 19-20) and create documentary and evidentiary procedures that a court will apply, for example by treating written explanations and statutory declarations as evidence (regs 19(8), 20(5)). Any litigation history would therefore arise under the Referendums Act 1998 or in proceedings initiated under the failure-to-vote pathway, but no such cases or outcomes are recorded in the document provided.

For practitioners, that absence means two things. First, the text provides the primary source of procedural obligations and evidentiary rules; you cannot rely on judicial gloss from the Regulations themselves. Second, operational uncertainties tied to discretionary provisions (for example, the presiding officer’s discretion to accept a voter despite roll errors under reg 5(1), or the Divisional Returning Officer’s satisfaction about signatures under reg 13(4)) are likely to be resolved in courts if contested. The Regulations specify how evidence is to be collected and forwarded to courts but do not supply precedents for resolving disputes about the exercise of discretion. Where legal questions arise as to the interpretation or application of these Regulations, practitioners will need to proceed on the basis of statutory text and established principles of administrative and electoral law, noting that the Regulations supply a tightly documented chain of custody intended to reduce factual disputes.

The Regulations contain multiple provisions where procedural non-compliance leads to exclusion of votes or to potential legal consequences. Common pitfalls to watch for:

• Strict envelope requirement for postal and section 36 votes. A postal ballot-paper is not to be counted unless received in the envelope bearing the postal vote certificate and marked as required (reg 12(1), reg 17(a)). Similarly, ballot-papers under section 36 are not to be counted if received otherwise than in the envelope bearing the declaration (reg 17(b)). Practically, that means if an elector slips a postal ballot into a generic envelope or the certificate is detached or missing, the vote will be excluded.

• Tight timing rules for postal votes. Postal ballot-papers must be marked before 6.00 p.m. on polling day and either given to a presiding officer before close of polling or received by the Divisional Returning Officer before 6.00 p.m. on the Friday following polling day (reg 12(1)). The postal vote certificate’s date and time are taken as conclusive absent contrary evidence (reg 12(2)). Late marking or late receipt is fatal to counting.

• Subjective satisfaction of signatures and witnessing. Admissibility of postal votes depends on a Divisional Returning Officer being satisfied that the signature on the postal vote certificate is the same as on the application and that it appears to be witnessed by an authorised witness (reg 13(4)(a)-(b)). These are subjective assessments that can result in arbitrary exclusion if not consistently applied. There is a scrutineer presence safeguard but no prescriptive verification method.

• Pre-poll region handling. Votes cast at pre-poll locations outside a voter’s division must be placed in an envelope bearing the division name and sealed (reg 6(3)). Failure to do so risks misallocation or exclusion. The Chief Electoral Officer’s discretion to define regions may create variation in practice that voters and administrators must track (reg 6(2)).

• Presiding officer discretion and recordkeeping. A presiding officer may refuse to issue a ballot-paper to someone who refuses to answer or fails to answer affirmatively certain questions (reg 7). Where a ballot-paper is refused for a section 36 declaration, the presiding officer must make a written note, sign it in the presence of scrutineers and forward it. Failure to follow this process will affect the documentary trail and expose decisions to challenge (reg 8).

• Deferred counting threshold. Counting of ballot-papers in any ballot-box containing fewer than 100 is to be deferred and aggregated (reg 21). Administrators must track how many ballot-boxes have been received at the counting location to know when the threshold is met. If misunderstanding occurs, ballots might be opened prematurely or held unnecessarily, affecting timeliness.

• Part-counting and anonymity requirements. When part-counting, enough uncounted ballot-papers must remain in the ballot-box to avoid disclosing identities (reg 16(2)). Failure to observe this could result in inadvertent breach of ballot secrecy or legal challenge.

• Scrutineer rights are limited to inspection in certain stages. While scrutineers may attend and inspect rejected certificates (regs 13(2)(b), 14(2)(b), 14(4)(a), 15(2)(b)), they are not permitted to open envelopes containing admissible votes; the Divisional Returning Officer must withdraw the folded ballot-paper and deposit it in a sealed ballot-box without inspection (reg 14(5)(a), 15(4)(d)). Misunderstanding this boundary may cause confrontation or procedural error.

• Failure-to-vote administrative steps. Notices must be sent within 3 months after the declaration of the poll, but the content and timing are subject to Chief Electoral Officer directions (reg 19(2)). Failure to follow the precise sequence could render a subsequent prosecution procedurally vulnerable or may give rise to discretionary refusal to prosecute.

• Evidence consequences if elector changes defence. If an elector provides a written explanation or statutory declaration and then later attends court and advances a materially different defence, a court that dismisses the prosecution must do so without awarding costs to the elector (regs 19(9), 20(6)). This is a tactical risk for defendants who might prefer to assert a different factual case orally at trial.

• Form compliance. The Forms in Schedule 1 specify exact directions (for example, the postal ballot-paper warns the elector not to mark until the authorised witness has seen the ballot-paper unmarked). Ignoring or mis-advising electors about these steps can lead to excluded votes (Form 1).

• Declaration form omission is not a ground to set aside a referendum. Although officers and scrutineers must make and subscribe the declaration under reg 22(1), reg 22(2) expressly states that omission is not a ground for setting aside a referendum. This protects overall poll validity but may reduce personal accountability in some procedural disputes.

Practitioners and administrators should incorporate these rules into checklists, training, and quality controls so that routine errors do not produce systemic exclusion of votes or procedural vulnerabilities that create grounds for challenge.

Practical compliance requires administrative process design, staff training and recordkeeping aligned to the Regulations’ procedural prescriptions. Below is an operational checklist structured by actor and phase.

For electors (postal and pre-poll):

• Postal voters must complete the postal vote certificate in accordance with the application and ensure it is witnessed by an authorised witness. Electors should mark the postal ballot-paper before 6.00 p.m. on polling day and either deliver it to a presiding officer before close of polling or ensure it is received by the Divisional Returning Officer by 6.00 p.m. on the Friday following polling day (reg 12(1), Form 1). The postal vote certificate’s date and time will be taken as evidence of when the vote was marked in the absence of contrary proof (reg 12(2)).
• Pre-poll voters casting votes outside their division must fold the ballot-paper, place it in an envelope bearing the name of their division, seal the envelope and deposit it in the ballot-box at the location after complying with the statutory identification requirements (reg 6(3)). Ensure you understand the region assigned by the Chief Electoral Officer if regional pre-poll arrangements apply (reg 6(2)).

For presiding officers:

• Carry and use ballot-boxes meeting the construction requirements (durable, capable of secure fastening or sealing, with a cleft) (reg 4). Ensure spoilt and discarded ballot-papers are clearly marked "spoilt" or "discarded", placed in endorsed envelopes and forwarded to the Divisional Returning Officer at close of polling (reg 9).
• Apply reg 5(1) flexibly to accept voters with minor roll errors if, in your opinion, identification is sufficient, and do not disqualify married voters solely because their surname changed (reg 5).
• If refusing to issue a ballot under section 36, make a written note of the request and reasons, sign it in the presence of any scrutineers present and forward at close of poll to the Divisional Returning Officer (reg 8).

For Divisional Returning Officers:

• Maintain a locked or sealed "Postal Ballot-box" and place all envelopes containing postal ballot-papers received and not excluded under reg 12 into it until the determination of the results (reg 10).
• Check postal vote certificates and applications at a practicable time and in the presence of another officer or an approved person (reg 13(2)). Confirm the signature matches the application and that the certificate purports to be witnessed by an authorised witness, and that the vote was marked before 6.00 p.m. on polling day. If satisfied, mark the certified list and place the unopened envelope in the postal ballot-box; if not, mark the envelope "rejected" and place it in the postal ballot-box (reg 13(3)-(5)).
• Sort postal votes after 6.00 p.m. on the Friday following polling day at a practicable time with scrutineers or approved persons present. Produce unopened envelopes received by the deadline and allow scrutineer inspection of rejected certificates (reg 14(2)-(4)). Withdraw admitted folded postal ballot-papers without inspecting them and deposit them immediately in a locked or sealed ballot-box; place the emptied envelope in a parcel and seal and endorse parcels (reg 14(5)-(6)).
• Examine section 36 declaration envelopes only after close of polling, in the presence of attending scrutineers or approved persons. If satisfied as to signature, attestation and entitlement, mark the certified list and withdraw and deposit the folded ballot-paper immediately into a sealed ballot-box; if not satisfied, exclude the ballot-paper without opening the envelope and place the unopened envelopes in a parcel and seal with an endorsed statement (reg 15(2)-(7)). Do not exclude simply because a presiding officer omitted to attest if the voter's name appears on the presiding officer’s record under section 36(4) of the Act (reg 15(8)).
• When part-counting, ensure enough uncounted ballot-papers remain in the ballot-box to prevent identity disclosure (reg 16(2)).
• Implement the deferred counting rule: do not count ballots from a ballot-box with fewer than 100 ballots; place them in a locked or sealed ballot-box and delay opening until the count of aggregated boxes exceeds 100 or no further boxes are expected (reg 21).

For the Chief Electoral Officer and administrators:

• If conducting pre-poll voting, divide the Territory into regions as appropriate and assign names to regions; communicate those regions clearly to polling staff and electors (reg 6(2)).
• Provide guidance on who qualifies as an authorised witness for postal vote certificates and on signature verification standards to reduce subjectivity in Divisional Returning Officers’ decisions (reg 13(4)(b)).
• Issue directions on the timing and form of notices to electors who fail to vote, ensuring notices are posted within three months after the declaration of the poll and give electors 21 days to respond (reg 19(2)-(3)). Ensure systems for recording and forwarding explanations to courts are in place (regs 19(7)-(8)).

For scrutineers and observers:

• Attend the checking, sorting and examination processes where possible and inspect rejected postal vote certificates; be aware that you may not open envelopes that contain admissible votes and must accept the procedure by which the Divisional Returning Officer withdraws and deposits folded ballot-papers without inspection (regs 13(2)(b), 14(2)(b), 14(4)(a), 14(5)(a)).
• Make and subscribe the prescribed declaration before an adult witness (reg 22(1), Form 3), but understand that omission to do so will not be grounds to set aside a referendum (reg 22(2)).

Recordkeeping and audit trail:

• Maintain parcels sealed and endorsed with statements of contents for rejected and processed envelopes (regs 14(6), 15(7)).
• Keep a register of persons who cite religious beliefs as an explanation for failing to vote (reg 19(6)).
• Forward written explanations and statutory declarations received under the failure-to-vote procedure to the court as required (reg 19(7)).

Training and quality control:

• Train staff in identification decisions under reg 5(1), signature matching under reg 13(4), and the strict timelines in reg 12. Provide checklists to presiding officers and Divisional Returning Officers for every stage: receipt, documentation, sealing, marking certified lists, parcel endorsement and forwarding.
• Test transport and security arrangements for sealed ballot-boxes to ensure delivery to determining officers by the prescribed times (reg 6(4), reg 10).

Legal preparation:

• Ensure prosecuting officers are aware of the obligation to inquire into statutory declarations where practicable and to present these to the court (reg 20(4)).
• Develop standard notice templates that comply with the content requirements in reg 20 and reg 19, including informing defendants of the right to lodge a statutory declaration at least 7 days before hearing (reg 20(2)).

Following these steps will align administration and electorate behaviour to the documentary, timing and evidentiary requirements in the Regulations, reduce the risk of excluded votes, and create a defensible audit trail should disputes or prosecutions for failure to vote arise.
