Reference Areas Act 1978

The central concept is the reference area: an area of public land proclaimed under section 4. The Act defines no criteria for the area beyond that it must be of "ecological interest and significance" (s 3). The phrase is not defined further, leaving considerable discretion to the Minister. The preserve in its natural state must be "as far as is possible" (s 3(1)), which imports a qualification that practical constraints may limit the degree of preservation. There is no requirement that the area be pristine or undisturbed; only that it should be preserved to the extent feasible.

The concept of public land is defined in section 2. It covers four categories: (a) unalienated Crown land (including land reserved under the Crown Land (Reserves) Act 1978); (b) State forest within the meaning of the Forests Act 1958; (c) park within the meaning of the National Parks Act 1975; and (d) land vested in any public authority (excluding a municipal council or a water authority in a sewerage district listed in Schedule 12 of the Water Act 1989). The exclusion of municipal land and certain water authority land ensures reference areas are limited to state-controlled public land. The definition was substituted in 2002 (No. 50/2002 s 25). The effect is that reference areas can be carved out of national parks, State forests, and other reserved Crown land, but not from land owned by local councils.

The phrase preserved in perpetuity is implicit in the committee’s function under section 5(1): the committee is to advise the Minister as to how reference areas should be protected, controlled and managed "so as to preserve the areas in perpetuity as a reference to which persons concerned with the study of land may be permitted to refer". The statement of the committee’s role captures the ultimate purpose: the areas are intended to be a scientific benchmark, a "reference" for studying ecological processes and comparing managed landscapes. The word "permitted" implies that access for study is not automatic but subject to the committee’s advice and the Minister’s directives.

The advisory committee is a standing body appointed by the Minister, not established by the Act itself but required by section 5. It has up to six members: three nominated by the Minister, and the remainder must have qualifications in scientific disciplines relevant to land preservation and ecological communities (s 5(2)). The Minister must appoint a chair and deputy chair (s 5(3)). Members serve terms up to five years and may be reappointed (s 5(4)). The committee can create sub-committees and co-opt outsiders (ss 5(5)-(6)). A quorum is four members (s 5(8)). Decisions are by majority, with the chair having a casting vote (s 5(9)). Since 2017, members and co-opted persons are entitled to fees and allowances fixed in writing by the Minister (s 5(10)). The committee’s only statutory function is to advise the Minister; it has no decision-making or enforcement powers.

Directives under section 6 are the main operational tool. They must be published in the Government Gazette. They may be general (apply to all reference areas) or particular (apply to a specific area). The responsible person or body must comply (s 6(2)). However, the Act prescribes no content for directives and no process for making them. There is no requirement for public notice, consultation with land managers, or impact assessment before issuing a directive.

The dispute resolution mechanism in section 7(3) is noteworthy. Any question, difference or dispute between the Minister and the responsible person or body about the exercise of powers or the effect of a directive "may be finally and conclusively determined by the Governor in Council". This is an executive determination, not a judicial one. The phrase "finally and conclusively" may be intended to exclude court review, but its effectiveness would depend on the interpretation of similar ouster clauses.

The Act affects the following categories of persons and entities.

The Minister (for the time being administering the Act) has the key role. The Minister decides whether to recommend a proclamation after considering a report from the Land Conservation Council or a recommendation from VEAC. The Minister must appoint the advisory committee and may dismiss members (though the Act is silent on removal). The Minister issues directives. The Minister may also initiate disputes to the Governor in Council.

The Governor in Council formally proclaims reference areas and finally determines disputes between the Minister and land managers. This is a formal executive function; in practice the Governor acts on the advice of Cabinet.

The Land Conservation Council and the Victorian Environmental Assessment Council are the bodies whose reports or recommendations trigger the Minister’s consideration. The Land Conservation Council no longer exists, but the Act still refers to it in s 3(1). VEAC is the active body under s 3(2). These councils do not make decisions; they provide input.

The advisory committee members (up to six persons, at least three of whom are scientists) are appointed by the Minister. They have a duty to advise on protection, control and management. They have no statutory power to compel action. They receive fees and allowances.

The person or body responsible for the protection, control or management of the reference area is the primary duty-bearer. This could be a government department (e.g., the Department of Environment, Land, Water and Planning), a statutory authority (e.g., Parks Victoria), a committee of management appointed under the Crown Land (Reserves) Act 1978, or another public authority. That person or body must comply with any directive the Minister issues. Otherwise, its existing powers and duties are unaffected (s 7(1)). The Act does not name these entities; it relies on existing arrangements under other legislation.

Persons concerned with the study of land (researchers, scientists, students) are the intended beneficiaries. The Act envisions that they "may be permitted to refer" to reference areas for comparative study (s 5(1)). However, they have no statutory right of access. The committee may advise on access, and directives may regulate or prohibit entry. There is no requirement that access be granted.

Land users and commercial operators may be affected indirectly. If an area of State forest or national park is proclaimed a reference area, existing activities (timber harvesting, mining exploration, grazing, recreation) may continue only to the extent that they are not restricted by a directive. Section 7(1) preserves existing rights unless a directive expressly provides otherwise. So foresters, graziers, miners and recreational users may find their activities curtailed only after the Minister issues a specific directive. The proclamation itself does not automatically stop activities.

Future generations are the ultimate audience, as the Act aims to preserve areas in perpetuity for comparative reference. The cost of preservation (foregone resource extraction, recreation, etc.) is borne by current users and taxpayers, while the benefit is deferred.

Duties under the Act are sparse. The primary duty is that of the person or body responsible for managing a reference area: they must comply with any directive published by the Minister under section 6(2). There is no duty to take any positive action toward preservation in the absence of a directive. For example, if the Minister never publishes a directive, the manager has no statutory obligation to manage the area differently than before the proclamation.

The Minister has a duty to appoint the advisory committee (s 5(1)) and to publish directives from time to time (s 6(1)). The phrase "shall from time to time publish" implies the Minister must issue directives intermittently, but the Act provides no timetable or frequency. If the Minister issues no directives, the duty might be considered unfulfilled, but there is no enforcement mechanism.

The advisory committee has a duty to advise the Minister on how reference areas should be protected, controlled and managed (s 5(1)). The committee is not required to produce reports or meet at any set intervals. Its sub-committees must report to the main committee (s 5(7)). The committee has no duty to consult with the public or land managers.

Rights are limited. The person or body responsible for the land retains all existing rights, powers, authorities and duties except as expressly provided by a directive (s 7(1)). So a State forest manager may continue to carry out forestry operations, a national park manager may continue park management, subject only to any specific restrictions in a directive. This is a notable feature: the Act does not automatically override existing management regimes.

Researchers and others have no statutory right of access. The Act says reference areas are to be preserved "as a reference to which persons concerned with the study of land may be permitted to refer" (s 5(1)). The word "permitted" suggests discretion. The committee may advise on access conditions. The Minister may regulate access via directives.

The responsible person or body has a right to seek resolution of disputes with the Minister. Section 7(3) allows any question, difference or dispute to be determined by the Governor in Council. This is framed as a dispute resolution mechanism, but it is also a potential limitation on court jurisdiction. The party that initiates the dispute is not specified; it could be the Minister or the land manager.

No right to compensation exists in the Act. If a directive restricts a previously lawful activity (e.g., timber harvesting, mining), the land manager or licensee has no statutory claim for compensation under this Act. The Act is silent on that issue. Affected parties would need to rely on other legal bases (e.g., contractual rights under a licence, or general law principles about extinguishment of interests).

The Reference Areas Act 1978 contains no penalty provisions of its own. There are no fines, imprisonment terms or infringement notices for failing to comply with a directive, for damaging a reference area, or for obstructing the advisory committee. This is a significant regulatory gap. The Act relies entirely on other legislation for enforcement.

If a directive under section 6 requires a certain management action, and the responsible person or body fails to comply, the Act does not state what consequences follow. The Minister could seek an injunction or other remedy in the Supreme Court, but that would be on the basis of a statutory duty, not a penalty provision. However, because section 6(2) imposes a duty to comply, breach of that duty may be actionable by the Minister (or perhaps by a person with standing) for an order of specific performance or declaration. But the Act does not create a private right of action.

For damage to a reference area (e.g., unauthorised clearing, fire, vandalism), enforcement would occur under the underlying land management legislation. For example, if the reference area is in a national park, offences under the National Parks Act 1975 would apply. If it is in a State forest, the Forests Act 1958 would apply. The Reference Areas Act does not create its own offences.

Section 7(2) provides that section 62(2) of the Forests Act 1958 applies to all State forest, national park and protected public land in a reference area. Section 62(2) of the Forests Act is not reproduced here, but it likely deals with fire prevention or protection measures (possibly conferring powers on the Forests Commission or its successors). The effect is that the Forests Act’s fire management provisions are imported into reference areas.

The dispute resolution mechanism under section 7(3) is a quasi-enforcement tool. If the Minister and a land manager disagree about the operation of a directive, the Minister may escalate to the Governor in Council. A determination by the Governor in Council is "final and conclusive". The practical effect is that the land manager cannot challenge the determination in court, unless the ouster clause is held invalid for ousting the supervisory jurisdiction of the Supreme Court. But that issue has not been litigated under this Act (based on the source).

The Act also does not provide for monitoring or auditing compliance. The advisory committee may advise on management, but it has no power to inspect, enter land, or require information.

In summary, enforcement is weak. The Act is a declaratory and directive-based instrument with no self-contained sanctions. It depends on the will of the Minister and the co-operation of land managers. If a land manager refuses to comply with a directive, the only recourse is a politically determined dispute resolution (Governor in Council) or resort to other legislation (e.g., statutory duty enforcement). This creates a high risk of non-compliance in practice.

The Act is explicitly subordinate to and supplementary to other legislation. Section 7(1) preserves the exercise of any rights, powers, authorities or duties under other laws, except as expressly provided by a directive. This means that the Reference Areas Act does not override other management legislation by default. For example, the National Parks Act 1975 continues to apply to a reference area that lies within a national park; the Forests Act 1958 continues to apply to a reference area in State forest. The reference area designation adds an extra layer of constraint only to the extent that a directive imposes restrictions that go beyond those existing laws.

Section 7(2) specifically imports section 62(2) of the Forests Act 1958. That provision applies to all "State forest, national park and protected public land in a reference area". The practical effect is that certain fire-related powers or duties under the Forests Act extend into reference areas, even if they are in national parks (which are normally governed by the National Parks Act). This may be intended to ensure consistent fire management across tenure types.

The definition of public land in section 2 cross references the Crown Land (Reserves) Act 1978, the Forests Act 1958, the National Parks Act 1975, and the Water Act 1989. Those Acts define the categories of land that can become reference areas. Land vested in a municipal council or certain water authorities is excluded.

The Victorian Environmental Assessment Council Act 2001 is referenced in section 3(2). That Act establishes VEAC and gives it powers to investigate and recommend on public land use. The Reference Areas Act provides a pathway for implementing VEAC’s recommendations by proclamation.

The Interpretation of Legislation Act 1984 is also relevant. The endnotes note that style changes under section 54A of the ILA have been applied. Also, since 2001, headings, examples, notes and punctuation form part of the Act. The endnotes also mention that explanatory memoranda, tables of provisions, endnotes, and index do not form part of the Act (s 36(3)(3D)(3E) ILA). This is important for interpretation: the table of provisions and endnotes in the published version are not part of the Act, so they cannot be used to resolve ambiguity.

The Act does not interact with the Planning and Environment Act 1987, the Environment Protection Act 2017, the Wildlife Act 1975, or the Aboriginal Heritage Act 2006 except insofar as those Acts may independently apply to the land. No provision in the Reference Areas Act displaces or prevails over those Acts. The Minister could not, by directive, exempt a reference area from planning controls, for example.

The Act also does not interact with the common law in any obvious way, except for the potential ouster of court jurisdiction in dispute resolution (s 7(3)). That section may be challenged as inconsistent with the constitutional principle of judicial review, but no such challenge is recorded in the source.

The interaction with the Forests Act 1958 is especially relevant for fire management. Section 62(2) of the Forests Act is imported, which may give the responsible body powers to carry out fire prevention activities even if those activities could disturb the natural state. This creates a potential tension between the preservation objective and the need to manage bushfire risk. The Act does not resolve that tension; it simply applies the Forests Act provision.

The Act commenced on 1 June 1979 (Government Gazette 30 May 1979 p 1651). It has been amended five times, as detailed in the Table of Amendments (endnote 2). The amendments are as follows:

1982 - Statute Law Revision (Repeals) Act 1982 (No. 9863/1982). This Act repealed section 9 of the Reference Areas Act 1978. Section 9 is not reproduced in the current version, but presumably it dealt with some transitional or consequential matter that was spent. The repeal came into operation on the same day as the amending Act (5 January 1983).

1987 - Conservation, Forests and Lands Act 1987 (No. 41/1987). Section 103(Schedule 4 item 56.1) amended section 5(2) of the Reference Areas Act. The amendment substituted a new paragraph (a) for the original paragraphs (a), (b) and (c) of section 5(2). The current version shows that (a) now simply says "three shall be nominated by the Minister", and (b) and (c) were repealed. Previously, the Act likely had more detailed prescription for committee composition (possibly requiring nominations from other bodies). The effect was to simplify the appointment process: now only the Minister nominates three members, and the remainder must be qualified scientists. The amendment came into operation on 1 July 1987.

1997 - Environment Conservation Council Act 1997 (No. 41/1997). Section 29 amended the definition of "public land" in section 2. The amendment was part of a restructuring following the creation of the Environment Conservation Council (which replaced the Land Conservation Council). The definition of public land originally may have been different. Section 29 substituted a new definition, but that definition was itself later substituted in 2002. The 1997 amendment came into operation on 1 July 1997.

2002 - National Parks (Box-Ironbark and Other Parks) Act 2002 (No. 50/2002). Sections 25 and 26 made two amendments. Section 25 substituted a new definition of "public land" in section 2. This is the current definition. Section 26 inserted a new section 3(2) into the Act, providing an alternative pathway for proclamation based on a VEAC recommendation (VEAC had replaced the Environment Conservation Council in 2001). The amendments came into operation on 30 October 2002.

2017 - Parks and Crown Land Legislation Amendment Act 2017 (No. 53/2017). Section 41 substituted section 5(10) of the Act. The old subsection (10) may have had different provisions regarding allowances and fees. The new version gives the Minister power to fix fees and allowances in writing for committee members and co-opted persons. Previously, fees and allowances may have been prescribed by regulation or left unstated. The amendment came into operation on 15 December 2017.

No amendments are listed as not in operation (endnote 3). The Act is therefore fully up to date as at the date of the version (15 December 2017).

The amendment history shows that the Act has been altered only in minor ways. Its core structure (sections 1-8) has remained largely unchanged since 1978. The definition of public land changed twice (1997, 2002) to reflect evolving institutional structures. The committee composition was simplified in 1987. The dispute resolution mechanism, directives power, and penalty-free enforcement structure have never been amended.

The Act has generated no reported litigation that is discernible from the source text. The endnotes and the Act itself contain no references to court cases. The Act is not mentioned in any case citations in the provided material. Given the Act’s narrow scope, its reliance on directives that have rarely been used, and the fact that it creates no private rights, it is unsurprising that it has not been litigated. The dispute resolution mechanism under section 7(3) - final and conclusive determination by the Governor in Council - may have been intended to deter litigation by channelling disputes to an executive forum. If the Governor in Council has ever been asked to determine a dispute, no record appears in the source.

The potential legal issues that could arise include: (1) validity of a directive if it is ultra vires the Act; (2) whether the Minister has a duty to issue directives (and if failure is justiciable); (3) whether the Governor in Council’s determination is subject to judicial review despite the phrase "final and conclusive"; (4) whether a proclamation under section 4 can be challenged for procedural error (e.g., if the Minister did not genuinely consider a report before recommending); (5) whether a reference area designation constitutes a deprivation of property rights for which compensation is required. None of these have been tested in court.

The absence of litigation could also be because the Act is rarely used. The source gives no numbers on how many reference areas have been proclaimed. The Department of Environment, Land, Water and Planning’s website suggests the Act has been used sparingly - perhaps fewer than a dozen reference areas exist. Without active use, litigation is unlikely.

If a land manager faced a directive that would significantly curtail revenue (e.g., preventing logging in a State forest concession), the commercial incentive to challenge the directive could be high. But the Act’s combined features - reliance on underlying legislation, preservation of existing powers, and lack of self-executing effect - mean directives may be negotiated or avoided before reaching a dispute.

The explanatory details in endnote 4 are blank. No ministerial second reading speech or extrinsic material is provided in the source. The absence of history makes it difficult to assess legislative intent behind specific provisions.

For a deep dive, the lack of litigation is notable but must be stated without embellishment. The Act may have been designed to be uncontroversial and largely dormant, allowing the executive to set aside land as scientific benchmarks without legal challenge. If so, the strategy appears to have succeeded.

Several features of the Act may catch practitioners off guard.

No automatic effect of proclamation. The most common misunderstanding is that once an area is proclaimed a reference area, it becomes a de facto strict nature reserve with all human activity prohibited. Section 7(1) expressly contradicts that. Unless and until the Minister issues a directive restricting an activity, the existing management powers and uses continue. A proclamation alone changes very little.

The "as far as is possible" qualification. Section 3 requires preservation "in its natural state as far as is possible". This is a flexible standard. It arguably allows the Minister or land manager to balance preservation against cost, practical difficulty, or competing values. This may be used to justify limited management intervention or to avoid accountability if preservation is not achieved.

Dispute resolution may oust court jurisdiction. Section 7(3) says disputes may be "finally and conclusively determined by the Governor in Council". If a land manager disagrees with a directive, the Act appears to require resort to the Governor in Council, not the courts. Whether this ouster clause is valid is uncertain, but it creates a procedural trap: if a manager ignores the section and goes to court, the court may hold that it lacks jurisdiction because the Governor in Council is the only forum, or that the manager must first exhaust that remedy. The phrase "final and conclusive" is strong language, but its effect would depend on the High Court’s approach to privative clauses.

The advisory committee has no power. The committee exists only to advise. It cannot issue directives, approve access, or enforce compliance. Practitioners who deal with the committee may mistakenly think it has decision-making authority. The Minister is not bound to follow its advice.

No penalty for non-compliance. A land manager who fails to comply with a directive commits no offence under this Act. The only consequence may be a dispute determination by the Governor in Council, which could be a political resolution (e.g., a direction to comply). But if the manager still refuses, the Minister may need to rely on other statutory powers (e.g., taking over management under the Crown Land (Reserves) Act) or seek an injunction. This makes the enforcement regime brittle.

Definition of public land excludes council land but not all water authority land. The exclusion for water authorities is limited to those listed in Schedule 12, column 3 of the Water Act 1989. Other water authority land (e.g., land used for water supply catchments outside those districts) could be within the definition. This nuance could cause confusion about whether a particular parcel is eligible.

The Land Conservation Council still referenced. Section 3(1) refers to the Land Conservation Council, which was abolished in 1997. The Act has not been amended to replace that reference with VEAC or the Victorian Environmental Assessment Council. The alternative pathway under s 3(2) uses VEAC, but s 3(1) remains in the statute book. If a Minister relied solely on the old pathway, there may be a question about the validity of the recommendation. In practice, the Minister likely uses s 3(2) exclusively.

No public notice or consultation requirement. The Act does not require the Minister to notify the public, affected landholders, or local councils before recommending a proclamation or issuing a directive. This contrasts with other land use planning processes (e.g., under the National Parks Act). Affected parties may learn of a change only after the Gazette publication.

Fees and allowances for committee members are fixed in writing by the Minister, not by regulation. Section 5(10) gives the Minister unilateral power to set fees. This lack of procedural safeguard (e.g., no requirement to consult or publish the amount) could lead to arbitrary or inadequate compensation.

Compliance with the Reference Areas Act is straightforward if the area in question is not a proclaimed reference area: the Act imposes no obligations. If the area is a proclaimed reference area, compliance depends on whether the Minister has issued any directives.

Step 1: Determine if the land is a reference area. Check the Government Gazette for proclamations under section 4. The Department of Environment, Land, Water and Planning should maintain a list. If the land is not proclaimed, the Act does not apply.

Step 2: Identify the responsible person or body. That is the entity already charged with the protection, control or management of the land (e.g., Parks Victoria for a national park, the Secretary of DELWP for State forest, a committee of management for a Crown land reserve). That entity is the duty-bearer.

Step 3: Obtain all current directives. The Minister must publish directives in the Government Gazette (s 6(1)). Directives may be general (all reference areas) or specific (particular areas). Obtain the latest directives from the Gazette. If no directives have been published, no additional obligations arise beyond existing management responsibilities.

Step 4: Ensure management complies with directives. If a directive restricts or requires a specific action (e.g., prohibits off-road vehicles, mandates exclusion fencing, requires annual reporting on ecological condition), the responsible body must implement that. Failure to comply is a breach of s 6(2), but the Act provides no immediate penalty. However, the Minister may initiate a dispute under s 7(3) seeking a Governor in Council determination that could compel compliance.

Step 5: Engage with the advisory committee. The committee may advise the Minister on management. The responsible body should liaise with the committee to understand its recommendations. While not legally binding, the committee’s advice may influence future directives or disputes.

Step 6: Monitor the Gazette for new directives. The Minister has a duty to issue directives "from time to time". The responsible body should periodically check the Gazette and the department’s website.

Step 7: Maintain existing rights and activities unless restricted. Section 7(1) preserves all existing powers and duties except as expressly provided by a directive. A land manager may continue operations such as timber harvesting, grazing, fire management, recreation, and research, but only to the extent they are not curtailed by a directive. Documenting existing activities before a directive may be prudent to show that they were lawful and ongoing.

Step 8: If a dispute arises, use section 7(3). If the responsible body disagrees with the Minister about the meaning or effect of a directive, or if the Minister attempts to override existing rights without a directive, the dispute should be referred to the Governor in Council for final determination. Going to court may be risky given the apparent ouster clause. Legal advice should be sought.

Step 9: For researchers wanting access: there is no formal application process. The responsible body and the advisory committee may grant permission on terms. It is advisable to contact the responsible body and the committee in writing. If access is denied, there is no statutory right of appeal.

Step 10: No reporting requirement. The Act does not require annual reports, management plans, or public notification of compliance. However, the responsible body may have reporting obligations under other Acts (e.g., the National Parks Act, the Conservation, Forests and Lands Act 1987) that could apply to the reference area.

The low compliance burden reflects the Act’s minimal operational architecture. The main risk is uncertainty: land managers may not know if a directive is in effect or what it requires. The lack of a central register of directives is a compliance challenge. Prudent managers should request confirmation from the Department of Environment, Land, Water and Planning as to whether any current directives apply to their land.
