Recycling and Waste Reduction (Mandatory Product Stewardship—Mercury-added Products) Rules 2021

Definitions and international anchoring are the instrument’s organising concepts. “Mercury‑added products” is a defined term with a double structure: positive coverage (the products listed in Part 1 of Annex A to the Minamata Convention that contain mercury) and an exclusions list (rule 4). The instrument therefore imports, by reference, the Annex A list from the Minamata Convention and treats that list as authoritative “from time to time” (rule 4, definition of Minamata Convention). The definition’s exclusions are categorical and specific: products essential for civil protection and military uses; products for research, calibration or reference standards; certain items where “no feasible mercury‑free alternative for replacement is available” (with three examples: switches and relays; certain fluorescent lamps for electronic displays; measuring devices); products used in traditional or religious practices; and vaccines containing thiomersal as preservatives (rule 4).

The instrument uses the term “assembled product” but does not define it itself; instead it adopts the Convention’s meaning (rule 4). That creates a dependency: whether a mercury‑added product is incorporated into an “assembled product” will require looking to the Convention text to determine the scope of “assembled product”.

The prohibitions are framed as “absolute” within the instrument’s terms (headings to Part 2 and the operative phrasing in rules 6(1) and 7(1)). The instrument repeatedly states that the prohibitions are “for the purposes of subsection 92(1) of the Act”, thereby nesting the new rules within the enforcement and regulatory architecture of the Recycling and Waste Reduction Act 2020 (rules 6(1) and 7(1)).

Carve‑outs and cross‑reference to other regulatory instruments are central. Rule 6(2) provides that rule 6(1) “does not apply to the extent that the manufacture, import or export is prohibited under” two named regulatory instruments. Rule 6(3) exempts imports covered by an Article 6 exemption registered for Australia and in effect. Rule 7(2) similarly excludes from its incorporation prohibition any incorporation that is prohibited under the Therapeutic Goods Regulations 1990. These drafting devices create limited gaps and dependencies that must be resolved by cross‑checking the other instruments and Australia’s registered Article 6 exemptions.

The instrument also contains procedural commencement mechanics. The entire instrument’s coming into force is conditional on the Minamata Convention entering into force for Australia, and the Minister is required to make a notifiable instrument announcing that day (rule 2(1)). The instrument therefore does not operate as a stand‑alone domestic prohibition until that international condition is satisfied.

Finally, the instrument makes explicit that its text corresponds to the Minister’s statutory authority under Part 5 of Chapter 3 of the Act, and identifies the Minamata Convention as the international agreement contemplated by the Act’s enabling provision (rule 5(1)-(2)). That signals the legal chain: international obligation → statutory power → delegated rules implementing prohibitions.

The instrument’s prohibitions and definitions identify who is placed under direct legal constraints. The persons who must not do certain things are not numerically limited by the text: rule 6(1) states “a person must not” manufacture, import or export a mercury‑added product, and rule 7(1) states “a person must not” incorporate a mercury‑added product into an assembled product. Those formulations reach broadly to manufacturers, importers, exporters, assemblers, integrators and any other actors who engage in those activities in Australia (rules 6(1), 7(1)). The practical effect is that commercial producers of electrical and electronic goods, importers of finished products, exporters, distributors and supply‑chain intermediaries that bring products into or out of Australia, and firms assembling complex products that could include mercury‑added components will each be directly affected if their goods fall within the instrument’s definition.

The definition of “mercury‑added products” ties coverage to the Convention’s Annex A list (rule 4). That means businesses making or trading items listed in that Annex that contain mercury are the primary targets. The instrument also specifies exceptions that limit coverage: manufacturers or traders of products that fall within the excluded categories (civil protection and military uses; research/calibration/reference standards; the specified items where no feasible mercury‑free alternative exists; traditional or religious practice uses; vaccines containing thiomersal) are not subject to the prohibitions as to those products (rule 4). Entities that import products under an Article 6 exemption registered for Australia and currently in effect are also outside rule 6(1)’s ban to the extent of that exemption (rule 6(3)). Conversely, regulators and enforcement authorities under the Recycling and Waste Reduction Act 2020 will be the decision makers and enforcers, because the rules are made for the purposes of subsection 92(1) of that Act (rule 6(1); rule 7(1)).

Two regulatory sectors are signalled as overlapping or pre‑existing regimes: agricultural and veterinary chemicals and therapeutic goods. Where the manufacture, import or export is prohibited under the Agricultural and Veterinary Chemicals (Administration) Regulations 1995 or the Therapeutic Goods Regulations 1990, rule 6(1) “does not apply to the extent” of that prohibition (rule 6(2)). Similarly, rule 7(2) excludes incorporation prohibition to the extent incorporation is prohibited under the Therapeutic Goods Regulations 1990. That drafting means actors regulated under those regimes need to reconcile obligations under those regulations with these Rules.

Finally, there are administrative actors effected by the instrument’s commencement mechanism: the Minister must declare the day the Minamata Convention comes into force for Australia by notifiable instrument (rule 2(1)). Until that declaration occurs, the instrument does not commence, so importers/manufacturers/exporters will need to monitor the Minister’s notice.

The instrument creates a small set of clear statutory duties and limited rights by way of exemptions.

Primary duties:

• Duty not to manufacture, import or export mercury‑added products (rule 6(1)). The duty is expressed as an absolute prohibition “a person must not” carry out those activities with respect to mercury‑added products as defined in rule 4.
• Duty not to incorporate a mercury‑added product into an assembled product (rule 7(1)). This places a direct legal barrier on assembling or integrating components that are mercury‑added into final products.

These duties are framed as operating “for the purposes of subsection 92(1) of the Act” (rule 6(1); rule 7(1)). The instrument itself does not set out the enforcement, compliance or penalty regime; it relies on the Act’s statutory machinery referenced in those clauses. Therefore the practical mobilisation of these duties (detection, notices, penalties, remedial directions) will be under the Act.

Limited rights and exemptions:

• Exclusions in the definitional provision operate as rights not to be captured by the prohibitions. The “mercury‑added products” definition expressly does not include: products essential for civil protection and military uses; products for research, calibration or reference standards; certain specified items where no feasible mercury‑free alternative for replacement is available (switches and relays; cold cathode fluorescent lamps and external electrode fluorescent lamps for electronic displays; measuring devices); products used in traditional or religious practices; and vaccines containing thiomersal as preservatives (rule 4). Businesses producing or dealing only in the excluded categories will not be caught by the prohibitions as to those products.
• Imports covered by an exemption registered for Australia under Article 6 of the Minamata Convention and in effect are explicitly excluded from rule 6(1) (rule 6(3)). That gives a legal pathway for authorised imports where international obligations permit specific exemptions to be registered domestically.

Cross‑regulatory interactions create conditional duties. Rule 6(2) states that rule 6(1) “does not apply to the extent” the conduct is prohibited under the Agricultural and Veterinary Chemicals (Administration) Regulations 1995 or the Therapeutic Goods Regulations 1990. Rule 7(2) contains a similar provision with respect to the Therapeutic Goods Regulations 1990. These clauses produce a priority rule for overlapping regulatory frameworks: where the other named instruments already prohibit the conduct, the new rules are not the operative source of prohibition for that conduct, leaving the other instruments as the controlling law for that subject matter.

Procedural duty on the Minister: the instrument requires the Minister to announce the day the Minamata Convention comes into force for Australia by notifiable instrument (rule 2(1)). That is an administrative duty which determines the instrument’s commencement date.

What the instrument does not create as a right or duty: it does not itself specify enforcement mechanisms, penalties, licensing, registration obligations, reporting requirements, or record‑keeping duties. Those matters are left to the Recycling and Waste Reduction Act 2020 and to the other referenced instruments (rules 3, 6(2), 7(2)).

The Rules themselves contain no standalone penalty or enforcement provisions. Each of the prohibitions is prefaced with the formula “for the purposes of subsection 92(1) of the Act” (rule 6(1); rule 7(1)), which anchors the prohibitions within the enforcement architecture of the Recycling and Waste Reduction Act 2020. The instrument therefore makes the conduct unlawful by reference to the Act, rather than by creating new penalty clauses inside the Rules.

Because the instrument omits its own enforcement text, the following legal facts flow directly from the instrument’s wording:

• The Rules make specified conduct unlawful within the statutory scheme established by the Act (rules 6 and 7).
• Enforcement powers, offences, civil penalties, injunctive remedies, compliance notices and other regulatory tools are not provided in the Rules themselves and must be sought in the Recycling and Waste Reduction Act 2020 and any regulations or instruments made under it, or in the other instruments that the Rules reference where they cover the same conduct (rules 3; 6(2); 7(2)).

Practical implications for enforcement planning and compliance work:

• An enforcer seeking to penalise an unlawful manufacture, import, export or incorporation will need to rely on the Act’s enforcement provisions rather than the Rules. The Rules supply the substantive elements of the prohibited conduct (being a “mercury‑added product” as defined and the specified acts), but the Act supplies the sanctioning machinery.
• The instrument’s cross‑references to the Agricultural and Veterinary Chemicals (Administration) Regulations 1995 and the Therapeutic Goods Regulations 1990 create potential duplications or overlaps in enforcement responsibility. Where those other instruments already prohibit a given act, the Rules “do not apply to the extent” of that prohibition (rule 6(2); rule 7(2)). An enforcement authority will therefore need to choose the controlling instrument for any specific fact pattern and be able to show the legal basis of penalty authority in the Act or the other instrument.
• The instrument’s commencement condition matters for enforcement timing. The prohibitions only operate after the instrument has commenced, which happens on the later of registration and the day the Minamata Convention comes into force for Australia (rule 2(1)). The Minister must publish a notifiable instrument to mark that day. Enforcement actions premised on the Rules prior to commencement would lack legal foundation in these Rules.

Because the instrument does not state particular enforcement procedures or quantums of penalty, a practitioner must consult the Recycling and Waste Reduction Act 2020 (and the other named regulations) to identify exact breach consequences, available remedies, time limits, review rights and enforcement powers. The Rules, by themselves, establish substantive prohibitions but leave the deterrent and remedial architecture to the enabling Act and to any other applicable instruments.

The Rules are drafted to operate within a network of international and domestic instruments. They explicitly import and rely on the Minamata Convention on Mercury: “Minamata Convention means the Minamata Convention on Mercury done at Minamata on 10 October 2013, as in force for Australia from time to time” and “assembled product has the same meaning as in the Minamata Convention” (rule 4). The Rules therefore require users to consult the Convention text (and Australia’s registered Article 6 exemptions under it) to determine scope, definitions and any international exceptions that have been domesticated.

The instrument states its constitutional and statutory pedigree: it is made for the purposes of Part 5 of Chapter 3 of the Recycling and Waste Reduction Act 2020 and in accordance with paragraph 94(1)(c) of the Act; the Minamata Convention is identified as the agreement referred to in that paragraph (rule 5(1)-(2)). That ties the Rules’ authority to the Act’s delegated‑law power and confirms the intended legal route for domestic implementation of the Convention obligations.

Direct cross‑references to domestic regulatory instruments shape operational overlaps:

• Rule 6(2) says the absolute prohibition on manufacture, import and export “does not apply to the extent that the manufacture, import or export is prohibited under” the Agricultural and Veterinary Chemicals (Administration) Regulations 1995 or the Therapeutic Goods Regulations 1990. In other words, for acts that are already prohibited under those other instruments, the Rules do not purport to be the source of prohibition. That creates a prioritisation or non‑duplication rule which will require comparing the scope of each instrument when the same product or activity could fall within both regimes.
• Rule 7(2) states that the prohibition on incorporation “does not apply to the extent that the incorporation is prohibited under the Therapeutic Goods Regulations 1990.” Again, where the Therapeutic Goods Regulations control, these Rules defer.

The instrument also interacts with the Minamata Convention’s Article 6 exemption mechanism. Rule 6(3) exempts the import of mercury‑added products that are covered by an exemption registered for Australia under Article 6 of the Convention and which is in effect. That is a direct domestic recognition of an international exception: if Australia has registered an Article 6 exemption that covers particular imports, those imports remain lawful despite the domestic prohibition. Practical compliance therefore requires checking whether Australia has any active Article 6 exemptions and their scope.

Procedural intersections matter for timing and administration. The instrument’s commencement depends on the Minamata Convention coming into force for Australia; the Minister must announce the date by notifiable instrument (rule 2(1)). Until that event is declared, the Rules have not commenced. That sequencing creates an interaction between international treaty status, ministerial administrative acts and domestic application of the prohibitions.

Finally, the Rules do not create or displace enforcement provisions in the Act or the other named instruments; they rely on them. Consequently, a compliance or enforcement assessment requires consulting:

• the Recycling and Waste Reduction Act 2020 for enforcement and penalty mechanics (rules 3, 6(1), 7(1)); and
• the Agricultural and Veterinary Chemicals (Administration) Regulations 1995 and the Therapeutic Goods Regulations 1990 where overlap exists (rules 6(2), 7(2)).

In sum, the Rules operate as a substantive overlay that imports international lists and exemptions, but they are functionally and procedurally tightly connected to existing domestic regulatory texts and the Minamata Convention.

The instrument contains a commencement schedule with an embedded note stating that the table “relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument” (rule 2, Commencement table and note). The instrument, as presented, shows the original commencement mechanism: the whole instrument commences on the later of the day after registration and the day the Minamata Convention comes into force for Australia; the Minister must announce that day by notifiable instrument (rule 2(1)). The text includes a parenthetical entry in the table indicating 7 March 2022 as a date in Column 3, but rule 2(2) warns that any information in column 3 is not part of the instrument. That structure indicates the instrument’s original drafting logic and the fact that the instrument’s formal commencement depends on the Convention’s status.

Beyond the original commencement provision and the note about the table, the instrument contains no in‑text amendments, schedules of amendment, sunset clauses, or power to vary/modify its scope by regulation. Rule 5 identifies the Minamata Convention as “the agreement referred to in paragraph 94(1)(c) of the Act” (rule 5(2)), but does not itself amend any other instruments. The three specific cross‑references to other domestic instruments (Agricultural and Veterinary Chemicals (Administration) Regulations 1995; Therapeutic Goods Regulations 1990) and the Article 6 exemption mechanism are embedded as permanent features of the text rather than temporary transitional provisions.

The instrument’s definition of Minamata Convention is expressed as “as in force for Australia from time to time” (rule 4), which provides an ongoing mechanism for the instrument to reflect future changes in the Convention’s substantive content (for instance, if Annex A were amended at an international level and accepted for Australia). That phrase is not an amendment to the Rules themselves, but it allows the Rules’ substantive scope to move with the Convention without domestic amendment. Practically, any alteration to the Convention that changes Annex A’s content would change what products are “mercury‑added products” under the Rules, because the Rules adopt the Annex A list “as in force for Australia from time to time” (rule 4).

The instrument does not include a schedule of prior instruments repealed, nor does it record prior versions, transitional provisions, or savings. It is framed as a discrete delegated instrument made under the Act and is silent in the text on any subsequent amendment history. To discover changes since the instrument’s original making, a practitioner will need to consult the formal Federal Register of Legislation for any amendments or repeals beyond the original text.

The instrument contains no recorded litigation history. The text itself does not mention any judicial decisions, references to cases, or forms of dispute resolution that have been invoked under the Rules. It does not establish any adjudicative processes within its own terms; enforcement and legal challenge procedures must instead be pursued under the Recycling and Waste Reduction Act 2020 or under the judicial review and statutory appeal mechanisms applicable to delegated legislation and administrative decisions in Australia.

Because the instrument imports the Minamata Convention and refers to other regulatory instruments (Agricultural and Veterinary Chemicals (Administration) Regulations 1995; Therapeutic Goods Regulations 1990), litigation that touches on the scope or validity of the Rules could, in principle, raise issues about: the correct interpretation of “mercury‑added products” as drawn from Annex A of the Convention; whether a product falls within one of the statutory exclusions in rule 4; whether a particular import is covered by an Article 6 exemption registered for Australia; or the relationship between these Rules and the other domestic instruments the Rules reference. However, none of those possibilities are reflected in the instrument text as past or pending litigation.

For practical client work, absence of litigation in the instrument means there is no textual guide within the Rules about how courts or tribunals have interpreted the definitions, carve‑outs or cross‑reference clauses. Any legal advice on contested points will therefore need to proceed from the instrument’s text and the controlling provisions of the Recycling and Waste Reduction Act 2020 and may require fresh judicial or administrative review if disputes arise.

The instrument is compact, but several drafting features create legal and practical traps that users should note.

1. Importation by reference to the Minamata Convention

• The Rules define “mercury‑added products” by reference to Part 1 of Annex A to the Minamata Convention and say the Convention is “as in force for Australia from time to time” (rule 4). That means the set of covered products can change without an amendment to the Rules, depending on changes to the Convention and whether Australia accepts them. Users cannot treat the list as static; they must monitor the Convention’s current status for Australia.

2. Definition excludes, rather than permits, specific categories

• The definition lists exclusions under the heading “mercury‑added products means ... but does not include:” and then a list (rule 4). That drafting requires careful item‑by‑item analysis: if a product falls into one of the excluded categories, the prohibitions do not apply to that product. The exclusions include items where “no feasible mercury‑free alternative for replacement is available” with three exemplars. Determining “no feasible mercury‑free alternative” is a factual and possibly technical question that the Rules do not define; practitioners will need evidence and possibly expert input to conclude whether a product quality meets that exclusion.

3. The odd interaction clause in rule 6(2)

• Rule 6(2) states the manufacture/import/export prohibition “does not apply to the extent that the manufacture, import or export is prohibited under” the Agricultural and Veterinary Chemicals (Administration) Regulations 1995 or the Therapeutic Goods Regulations 1990. That phrasing does not say the other instruments permit conduct; it says the new prohibition does not apply where the other instruments already prohibit the activity. The practical effect is one of deference and non‑duplication, but it also means that businesses regulated under those other instruments must be attentive to which instrument is the operative source of prohibition and enforcement in their circumstance. That drafting is potentially confusing and merits careful mapping between the instruments.

4. Incorporation prohibition depends on the Convention’s definition of “assembled product”

• Rule 7(1) prohibits incorporating a mercury‑added product into an assembled product, but rule 4 explicitly adopts the Convention’s definition of “assembled product”. Any dispute about whether a particular combination constitutes an “assembled product” will require consulting the Convention text. The instrument does not provide domestic gloss on that term.

5. Article 6 exemptions are a narrow import pathway

• Rule 6(3) exempts imports that are “covered by an exemption that is registered for Australia under Article 6 of the Minamata Convention and in effect.” The exemption must be (a) registered for Australia and (b) in effect. There is no domestic procedure in the Rules for registration or for criteria; those are matters of the Convention’s Article 6 mechanism and Australia’s administrative practice. Importers who plan to rely on this exemption must locate evidence of a registered Article 6 exemption and confirm it remains in effect.

6. No penalties or compliance procedure set out in the Rules

• The instrument supplies no penalty quantums, compliance notice mechanisms or administrative processes. Enforcement must be alleged under the Recycling and Waste Reduction Act 2020. That means practitioners and regulated entities should not look to these Rules for procedural clarity on enforcement, notices, review periods, or remedies.

7. Commencement depends on Ministerial announcement and treaty status

• The entire instrument does not commence until the Minamata Convention comes into force for Australia and the Minister announces the date by notifiable instrument (rule 2(1)). A regulated entity cannot assume the Rules are in force until the notifiable instrument exists. The commencement table includes a note that information in column 3 is not part of the instrument (rule 2(2)); practitioners should therefore rely on the official notifiable instrument rather than any editorial table notes.

8. Overlap with sectoral regulation

• Where chemicals, veterinary or therapeutic product regimes apply, those regimes may be the operative prohibitions or may create separate compliance obligations. Firms operating across sectors must reconcile requirements under the other named instruments rather than treating the Rules as the only source of law (rules 6(2), 7(2)).

9. No domestic definition of “mercury‑added products” list within the Rules

• Because the list is external to the instrument, identifying whether a product is covered requires consulting Annex A of the Convention. That is a multi‑step compliance task for supply‑chain actors.

These “gotchas” are structural consequences of the Rules’ heavy reliance on external texts and on the enabling Act. They create practical tasks: identifying whether a product falls within Annex A; assembling evidence that a product falls within one of the exclusions; verifying the existence and scope of any Article 6 exemption; and confirming the commencement date via the Minister’s notifiable instrument.

The Rules impose narrow but absolute‑worded prohibitions; compliance is therefore a function of accurate product classification, awareness of exceptions and timely tracking of commencement status. The following steps map directly to the instrument’s text and identify concrete tasks that businesses and advisers should perform. None of these steps invent new legal obligations; they follow from the instrument’s content.

1. Confirm commencement status

• Do not assume the Rules are in force. The instrument only commences on the later of the day after registration and the day the Minamata Convention comes into force for Australia, and the Minister must announce that day by notifiable instrument (rule 2(1)). Check the Federal Register of Legislation and the Minister’s notifiable instruments for the commencement declaration.

2. Determine whether the product is a “mercury‑added product”

• The Rules define the term by reference to Part 1 of Annex A to the Minamata Convention (rule 4). To determine coverage, obtain the current Annex A text as in force for Australia and verify whether the product type appears on the list and whether the product actually contains mercury. Because the Rules import the Annex “as in force for Australia from time to time”, repeat this verification periodically.

3. Check the definitional exclusions

• If the product is listed in Annex A, test whether it falls into any of the exclusions in rule 4: essential civil protection and military uses; research, calibration, or reference standards; the specified items where no feasible mercury‑free alternative is available (switches and relays; cold cathode/external electrode fluorescent lamps for electronic displays; measuring devices); products used in traditional or religious practices; vaccines containing thiomersal as preservatives. For the “no feasible mercury‑free alternative” category, gather technical evidence and expert statements that document the absence of feasible alternatives, because the phrase introduces a factual inquiry that the Rules do not define.

4. If importing, check Article 6 exemptions

• Before importing, verify whether Australia has an Article 6 exemption that covers the import and whether that exemption is registered and in effect, as imports covered by such an exemption are excluded from the import prohibition (rule 6(3)). Obtain documentary proof of the exemption and retain records demonstrating the exemption’s scope and current status.

5. Map overlap with other regulatory regimes

• Identify whether the product and the activity are subject to the Agricultural and Veterinary Chemicals (Administration) Regulations 1995 or the Therapeutic Goods Regulations 1990. Where those instruments prohibit the conduct, the Rules “do not apply to the extent” of that prohibition (rule 6(2); rule 7(2)), and where the Therapeutic Goods Regulations apply to incorporation, rule 7(2) is relevant. Consult regulatory compliance frameworks for those instruments to ensure there are no other duties, approvals or prohibitions that affect operations.

6. For assemblers and integrators, verify component provenance

• To comply with rule 7(1), which prohibits incorporating a mercury‑added product into an assembled product, establish supplier controls and component traceability. Because “assembled product” is defined by the Minamata Convention, check the Convention to determine whether your product structure meets that definition. Maintain procurement records that allow you to show components do not contain mercury or are excluded under rule 4.

7. Maintain evidence and contemporaneous due diligence

• Although the Rules do not specify record‑keeping, retaining documentary evidence is the practical means of proving compliance: supplier declarations, technical specifications (showing absence of mercury), import/export documentation, and copies of any Article 6 exemption relied upon. For items where the “no feasible mercury‑free alternative” exclusion is invoked, preserve expert reports or supplier attestations.

8. Monitor regulatory and treaty developments

• Because the Rules adopt the Convention’s lists “as in force for Australia from time to time” (rule 4) and rely on Article 6 exemptions, maintain a schedule to monitor the Minamata Convention’s status for Australia and any registered exemptions. Also monitor any amendments to the Agricultural and Veterinary Chemicals (Administration) Regulations 1995 and the Therapeutic Goods Regulations 1990 that may affect overlap or exclusion application.

9. Seek sectoral regulatory advice where overlap exists

• Where products fall within areas regulated by the Therapeutic Goods Regulations 1990 or the Agricultural and Veterinary Chemicals (Administration) Regulations 1995, obtain advice on the interplay of those regimes with these Rules, since the Rules defer to those instruments in certain respects (rule 6(2); rule 7(2)).

10. Prepare for enforcement under the Act

• Because the Rules anchor prohibitions to subsection 92(1) of the Recycling and Waste Reduction Act 2020 (rule 6(1); rule 7(1)), ensure any compliance program aligns with the Act’s enforcement model. Confirm the enforcement, penalty and review processes in the Act so that internal processes for incident response, voluntary disclosure, and remediation can be aligned to the remedies and notices that the Act permits.

These steps are strictly derivative of the instrument’s text. They will help regulated entities to demonstrate an evidence‑based, documented approach to compliance and reduce legal uncertainty in the event of regulatory queries or enforcement action.
