Recycling and Waste Reduction (Export—Waste Plastic) Rules 2021

The instrument introduces and uses several recurring legal and operational concepts. Each is defined or deployed in a way that allocates decision authority, compliance burden and technical obligations.

• Regulated waste plastic: The instrument prescribes “waste plastic” as regulated waste material for the purposes of the Act (s 5(1)). “Waste plastic” is defined to include plastic discarded, rejected or left over from activities and surplus or by‑product plastic; it also includes “processed engineered fuel” as a subcategory (s 5(2)-(3)). Certain narrow categories are expressly not prescribed (s 5(4)(a)-(c)). The definition therefore determines the scope of the licensing and export restrictions.
• Processed engineered fuel (PEF): Defined as waste plastic that is processed with other waste material and intended for use as fuel (s 5(3)). PEF is treated separately throughout the instrument, triggering specialised decision factors (s 9), licence conditions (s 11) and exemption considerations (s 19(4)), including calorific value, moisture, particle size, bulk density and testing requirements (s 9(2)(c); s 19(4)). The PEF label is therefore a technical category that changes the substantive requirements for export.
• Nominated specification and listed waste plastic specification: Applicants must nominate a waste plastic specification for each kind of plastic to be exported (s 7(2)). A “listed waste plastic specification” is a specification listed on the Department’s website (s 4). If the nominated specification is not listed, a copy must accompany the application (s 7(4)). The instrument therefore links ministerial assessment to either an established listed standard or an applicant‑supplied standard subject to ministerial scrutiny (s 8(2)(c); s 9(2)(c)).
• Waste Plastic Exports List and notifications: The Waste Plastic Exports List (published on the Department’s website) allows particular kinds or export circumstances to proceed without a waste plastic export licence provided the exporter gives a notification to the Minister in an approved manner and form (s 6(2)(b), (3), (5); s 4). The List and the notification mechanism operate as an administrative shortcut for some exports, subject to the Minister’s approval of the notification format and the Departmental list being current.
• Licence and export declaration interplay: Export of regulated waste plastic requires either a licence in force and an export declaration for each consignment (s 6(2)(a)(i)-(iii)), or a position on the Waste Plastic Exports List combined with the notification regime (s 6(2)(b)). The export declaration requirement anchors statutory compliance to consignment‑level reporting.
• Commercial relationship requirement: For each consignment the holder must have or have had a commercial relationship with the importer and, if the holder is not the supplier, with the supplier (s 10(2)(c), 10(3); s 11(2)(d), 11(3)). This embeds a contractual verification element into licence conditions.
• Record‑keeping and evidentiary documentation: The licence holder must retain export declarations, supporting evidence, time/date‑stamped photographs of the packed consignment and all documents relevant to compliance for at least five years (ss 21(2)(a)-(b), 21(3)-(5)). Records must be maintained in English or accompanied by an English translation and must not be altered during the retention period (ss 21(4)-(5), 22).
• Ministerial discretions and decision factors: The Minister has multiple discretions, approval of forms and notification manner (s 6(3)), to have regard to specified matters in licence decisions (ss 8-9), to accept payment undertakings (s 23(2)), to direct licence holders (s 17), and to suspend or revoke licences on specified grounds (ss 14-15). The instrument therefore allocates significant evaluative and procedural power to the Minister supported by statutory criteria.
• Payment undertaking mechanism: The Minister may accept a written payment undertaking that treats a relevant Commonwealth liability as paid if the undertaking meets content requirements and the Minister is satisfied about the giver’s financial position, the likely cost of export operations and the ability to comply (s 23(2)). This creates a discretionary financial assurance alternative to immediate payment.

Each of these concepts interacts: the technical specification nominated by the applicant drives the Minister’s technical assessment (s 8(2), s 9(2)); the Waste Plastic Exports List and notification mechanism channel some exports outside the licence system while still requiring Ministerial notification (s 6(2)(b)); the record‑keeping and commercial relationship requirements create ongoing compliance monitoring points (ss 10(2)(c), 11(2)(d), 21). Together, they convert export eligibility into a set of documentary, technical and contractual predicates that the Minister checks against statutory factors.

The instrument allocates obligations and decision points across several identifiable groups.

• Exporters of waste plastic: Primary regulated persons. They must hold a waste plastic export licence to export regulated waste plastic unless the waste and circumstances are listed on the Waste Plastic Exports List and a notification has been given to the Minister (s 6(2)). Licence holders face explicit operational duties, notification obligations for supplier/freight forwarder/importer changes (ss 10(5)-(6), 11(5)-(6)), record‑keeping obligations (s 21) and potential suspension or revocation grounds (ss 14-15).
• Licence applicants and holders: Applicants must nominate a waste plastic specification for each kind of plastic intended for export and show processing will be undertaken to meet that specification (s 7(2), (5)). Where a non‑listed specification is used, the applicant must provide the specification document (s 7(4)). Holders are required to ensure plastic is sorted into single polymer or resin for non‑PEF plastic (s 10(2)(a)), and to have/maintain commercial relationships with importers and suppliers (ss 10(2)(c)-(3), 11(2)(d)-(3)). Licence holders are the persons to whom directions under s 64 of the Act can be given and are subject to conditions (ss 10-11, 12(2), 17).
• Suppliers and importers: The rules require licence holders to have a commercial relationship with the importer and, if not the supplier, with the supplier (ss 10(2)(c), 10(3), 11(2)(d), 11(3)). While suppliers and importers are not directly regulated by this instrument as licence holders, their willingness to enter into commercial relationships and to accept nominated specifications is material to export eligibility and therefore affects them indirectly.
• Freight forwarders and other agents: Licence holders must notify the Minister if they change freight forwarders or other export agents (ss 10(5)(b), 11(5)(b)). Agents may therefore be required by licence holders to provide documentation necessary to satisfy export and record‑keeping obligations.
• Persons exporting trade samples for market testing: The instrument establishes an exemption pathway for “trade samples” , waste plastic exported solely for market testing and not being hazardous waste , but requires an exemption application that nominates a specification and demonstrates processing to meet it (s 18(2)-(5)). These exporters are affected by the narrower exemption criteria and by the Minister’s additional matters for consideration (s 19).
• The Department and Minister: The Minister has approval and oversight functions: approving forms and processes for notifications (s 6(3)), having regard to detailed technical and commercial matters in licence decisions (ss 8-9, 19), accepting payment undertakings (s 23(2)) and issuing directions or suspending/revoking licences on prescribed grounds (ss 14-17). The Department maintains the Waste Plastic Exports List and listed waste plastic specifications on its website (s 4), so those administrative publications directly affect which exports require licences.
• Users in the receiving jurisdiction (indirectly): The Minister must have regard to the intended use of the plastic in the place to which it is exported (ss 8(2)(a), 9(2)(a), 19(2)(c)). While not directly regulated by this instrument, the expected end use and suitability for remanufacture or combustion are part of the regulatory calculus and thus influence which exports are permitted.

Costs and practical burdens therefore fall mainly on exporters and licence applicants. They must invest in processing to meet nominated specifications (s 7(5)), sort consignments into single polymer/resin (s 10(2)(a)), package securely (s 11(2)(b)), maintain documentary evidence and photographs (s 21(2)), and comply with notification and renewal timing (s 13). The Minister and Department pay the administrative cost of maintaining lists, approving forms and assessing technical specifications (s 4, s 6(3), s 23(2)).

This instrument prescribes duties for exporters and licence holders, and confers practical and procedural rights tied to Ministerial discretion and administrative processes.

Key duties

• Licence prerequisite or notification: Exporters must either hold a waste plastic export licence in force and not suspended and provide an export declaration for each consignment, or rely on the Waste Plastic Exports List plus a Ministerially approved notification (s 6(2)(a)-(b), s 6(3)-(4)). This is the primary duty establishing export permissibility.
• Application content and processing evidence: Applicants must nominate a waste plastic specification for each kind of plastic to be exported and demonstrate the plastic will be processed prior to export to meet that specification. If the specification is not a listed one, a copy must accompany the application (s 7(2), (4)-(5)).
• Compliance with nominated specification: Licence holders must ensure each consignment complies with the nominated specification prior to export (ss 10(2)(b), 11(2)(a)). For non‑PEF plastic, additional sorting into single polymer or resin is required (s 10(2)(a)).
• Commercial relationships: Holders must have or have had a commercial relationship with the importer of the plastic and, if the holder is not the supplier, with the supplier at the time of export (ss 10(2)(c)-(3), 11(2)(d)-(3)).
• Packaging and environmental risk steps for PEF: For processed engineered fuel, holders must ensure secure packaging and take all reasonable steps to ensure combustion is carried out in a way that minimises risks to the environment and human health (s 11(2)(b)-(c)).
• Notifications of changes: Holders must notify the Minister, in an approved form, of changes in supplier, freight forwarder/agent or importer as soon as practicable (ss 10(5)-(6), 11(5)-(6)).
• Records creation and retention: Licence holders must create and retain specified records for at least five years, including export declarations, supporting evidence, and time/date‑stamped photographs of the consignment as packed for export (ss 21(2)-(5), 21(3)). Records must be in English or accompanied by a translation and must be accurate, legible and auditable (s 21(4)-(5)).
• Non‑alteration of records: Records must not be altered or defaced during the retention period, subject to ordinary practice notations; where notations are made, the person must retain documents that show how the original record was changed (s 22).

Rights and procedural points

• Right to apply for licence renewal and timing: Licence holders can apply to renew a licence; applications for renewal must be lodged no later than 30 days before the expiry date (s 13). Licences may be in force until expiry or until a specified event (s 13 note).
• Right to have a nominated specification stated in the licence: If a waste plastic specification applies, the licence must state that specification, which is the nominated specification (s 12(1)-(2)). This locks the specification into the licence as a clear requirement.
• Right to have applications assessed against prescribed matters: The Minister must have regard to prescribed technical and commercial matters when deciding whether to grant licences or exemptions (ss 8-9, 19). Applicants can anticipate the issues the Minister will consider and prepare evidence accordingly.
• Right to vary licences or conditions: Conditions and other aspects of a licence may be varied either on application by the licence holder or by the Minister on the Minister’s own initiative, under the Act’s Part 6 (note at s 10(1) and s 11(1)).
• Right to give a payment undertaking alternative: A person whose Commonwealth liability is relevant to licence grant or renewal may give a written payment undertaking which, if accepted by the Minister after consideration of specified matters, is taken to have paid the liability (s 23(2)-(3)). The undertaking may be varied by agreement but cannot reduce unpaid liabilities (s 23(4)-(5)).

Ministerial powers and constraints

• Ministerial approval of forms and notification manner: The Minister may approve the manner and forms for notifications (s 6(3)). Different forms may be approved for different kinds or for multiple kinds in a single form (s 6(5)). This creates administrative flexibility but also centralises procedural control with the Minister.
• Grounds for suspension or revocation: Failure to comply with a requirement to provide additional or corrected information under subsection 60(2) of the Act is a specific ground for suspension (s 14(2)) and revocation (s 15(2)). The instrument points to statutory suspension and revocation mechanisms in the Act and adds this specific data‑provision ground.
• Direction powers: The Minister may give directions to licence holders under s 64 of the Act and must have regard to specific matters when considering such directions (s 17).

The duties are operational and documentary; the rights are largely procedural and tied to administrative processes. Licence holders must organise processing, sorting, packing and record systems to satisfy the technical specification and evidentiary duties (s 7(5), s 10(2)(a)-(b), s 11(2)(a)-(c), s 21). The Minister has explicit assessment criteria and administrative discretions which set the framework in which duties are evaluated (ss 8-9, 19, 23).

The instrument references the Act’s enforcement architecture while prescribing additional procedural grounds and evidentiary obligations that tie into enforcement action.

Offences and civil penalties

• Contravention of prescribed export conditions is an offence and a civil penalty provision under the Act (s 6 Note 2). The instrument reiterates that failure to meet the conditions in s 6(2) constitutes both criminal and civil penalty exposures.
• Licence condition contraventions can be offences or civil penalty provisions (s 10 Note 2; s 11 Note 2 reference). The instrument makes clear that breaches of the duties set out in the conditions for both ordinary waste plastic and processed engineered fuel are enforceable under the Act (see ss 10(1) note and 11(1) note).

Administrative enforcement mechanisms

• Suspension and revocation: The instrument prescribes that failure to comply with a request under subsection 60(2) of the Act (to provide additional or corrected information in relation to an application) is a ground for suspension (s 14(2)) and for revocation (s 15(2)) of a waste plastic export licence. These are additional, instrument‑specific grounds supplementing the general grounds in the Act noted in the instrument (s 14 note, s 15 note).
• Directions: The Minister may give directions to holders of waste plastic export licences under s 64 of the Act. The instrument prescribes matters the Minister must have regard to before issuing a direction, such as whether a licence condition has been or is likely to be contravened, and whether applicable requirements are being or are likely to be complied with (s 17). Directions are an intermediate enforcement tool to secure compliance before suspension or revocation.
• Evidence production power: Licence holders may be required to produce evidence of compliance (ss 10 and 11 notes referencing s 143 of the Act). This enables the Minister or Department to inspect documentary proof underlying claims in export declarations or licence applications.

Record‑keeping and integrity enforcement

• Specific record obligations: The instrument requires preservation of certain records for at least five years and prohibits alteration or defacement during that period, except for ordinary practice notations which must be supported by documentation showing how the original record was changed (ss 21(3)-(5), 22). These requirements create a clear evidentiary trail and make tampering or late back‑dating detectable.
• False or misleading information: The instrument expressly notes that providing false or misleading information or documents may constitute an offence under the Act (sections 146 and 147) and potentially offences under the Criminal Code (sections 137.1 and 137.2), as referenced in the instrument’s notes (s 6(3) note). The instrument therefore anchors its documentary duties to existing statutory offences that penalise dishonest representations.

Financial enforcement and undertakings

• Payment undertaking mechanism: Under s 23, the Minister may accept a written payment undertaking to treat a relevant Commonwealth liability as paid for the purposes of certain Act provisions (s 23(2)). The Minister must consider the giver’s financial position and the likely cost of export operations before accepting. The instrument also allows the Minister to determine the order in which payments reduce multiple liabilities (s 23(3)) and forbids varying an undertaking so as to reduce an unpaid liability (s 23(5)). This creates a discretionary substitute for immediate payment but also an enforcement tool: failure to meet an accepted undertaking would leave the person liable and potentially expose them to enforcement action under the Act and the terms of the undertaking.

Operational enforcement modalities

• Inspection and auditability: The content requirements for photos and documentary evidence (s 21(2)(a)(iii), s 21(2)(b)) establish an inspectionable package for each consignment that the Department can use to verify compliance.
• Grounds for action linked to application history: The Minister must have regard to whether applicants have applied for, held or been refused export permits for hazardous waste or have had export licences revoked (ss 8(2)(e)-(f), 9(2)(d)-(e)). This allows prior compliance history to inform licensing decisions and subsequent enforcement priorities.

What the instrument does not do in enforcement terms

• It does not specify penalty quantum, enforcement procedure specifics or prosecution thresholds; instead, it references the Act for offences, civil penalty provisions and the general enforcement architecture (s 6 note; ss 10, 11 notes). Therefore, precise penalty outcomes and prosecutorial approach remain governed by the Act and other applicable legislation.

Overall, enforcement under the instrument relies on documentary obligations, ministerial direction and suspension/revocation powers, and existing statutory offences for dishonest conduct. Record retention, photo evidence and the declared content of export declarations supply the Department with the factual basis for enforcement action (s 21).

The instrument is explicitly constructed to operate within an existing legislative and treaty architecture. Its provisions cross‑reference, incorporate and exclude matters governed by other Commonwealth laws and international instruments.

Direct statutory links

• Recycling and Waste Reduction Act 2020: The instrument is made under the Act and repeatedly references specific Act provisions as the source of legal force for the rules it prescribes. Examples include prescribing waste plastic as regulated waste material for subsection 17(1) (s 5(1)), prescribing export conditions for the purposes of section 18 of the Act (s 6(1)), and defining what must be included in licence applications for the purposes of paragraphs 172(1)(c) and (d) (s 7(1)). The instrument therefore functions as an operative subordinate instrument implementing the Act’s regulatory framework.
• Hazardous Waste (Regulation of Exports and Imports) Act 1989: The instrument refers to “export permit” and “hazardous waste” as those expressions are defined in the Hazardous Waste Act (s 4). It also excludes from the definition of regulated waste plastic hazardous waste that is the subject of a Ministerial order or arrangement under Part 3 of that Act (s 5(4)(c)). Exports of hazardous waste thus remain governed by the Hazardous Waste Act process when an order or arrangement applies.
• Commerce (Trade Descriptions) Act 1905: The instrument excludes plastic imported on a temporary basis and re‑exported in the same covering and with the same trade description (within the meaning of the Commerce Act) (s 5(4)(b)). This ties customs and trade description law into the export treatment of temporary imports.
• Criminal Code and the Act’s offence provisions: The instrument notes that false or misleading information may constitute offences under the Act (ss 146-147) and under the Criminal Code (ss 137.1-137.2) (s 6(3) note). This links documentary duties and representations to existing criminal liability frameworks.

International instrument reference

• Basel Convention: The instrument imports the phrase “almost free from contamination and other types of wastes” by reference to Annex II to the Basel Convention, as amended and in force for Australia (s 8(3)). The instrument therefore incorporates an international standard into the Minister’s assessment criteria for contaminant thresholds in non‑listed specifications.

Administrative and regulatory interfaces

• Departmental website lists and specifications: The instrument depends on administrative publications on the Department’s website , the Waste Plastic Exports List and listed waste plastic specifications , and treats those publications as operative references “as existing from time to time” (s 4). This creates a dynamic link between the instrument and Departmental administrative materials, which are not part of the instrument but control eligibility and specification recognition.
• Export permits for hazardous waste and export licences under the Act: The Minister must have regard to an applicant’s history of applying for or holding export permits for hazardous waste or having export licences revoked under the Act (ss 8(2)(e)-(f), 9(2)(d)-(e)). This interface allows cross‑checking between different Commonwealth export regulatory regimes when assessing risk and compliance history.
• Evidence production and audit powers under the Act: The instrument signals that licence holders may be required to produce evidence of compliance and refers to s 143 of the Act (ss 10, 11 notes). The Act’s inspection and information powers therefore operate alongside the instrument’s documentary duties.

What the instrument does not displace

• The instrument does not repeal or modify the substantive provisions of other Acts; it operates within their frameworks. For example, hazardous waste exclusions remain dependent on the Hazardous Waste Act procedures (s 5(4)(c)), and false representation offences remain governed by the Act and the Criminal Code as referenced (s 6(3) note).

Practical implications of the interactions

• Applicants and licence holders must manage compliance not only with the instrument but with related Commonwealth provisions, treaty obligations (as reflected in the Basel Convention reference) and departmental administrative lists (s 4). Where an export potentially straddles hazardous waste rules, temporary import/export rules, or has international law implications, applicants must account for multiple, overlapping regulatory tracks.
• Administrative expectations (forms, lists, approval of notification methods) are central to operational compliance and can change without instrument amendment because the instrument expressly allows website lists and approvals “as existing from time to time” (s 4, s 6(3)-(5)). This requires licence holders to track Departmental publications.

The instrument contains a commencement table and an internal note about the table, but does not itself record any later amendments within the text provided.

• Date made and commencement: The instrument was made by the Minister for the Environment (Sussan Ley) and dated 24 May 2021 at the head of the instrument. The formal commencement clause provides that the whole instrument commenced on 1 July 2021 (s 2 and the commencement table).
• Authority for making: The instrument states it is made under the Recycling and Waste Reduction Act 2020 (s 3). That identifies the parent Act under which these rules were created.
• Notes about the commencement table: The instrument includes a Note that the commencement table relates only to the instrument as originally made and will not be amended in the instrument text to record later amendments (s 2(2)). This means later amendments would be recorded elsewhere (for example, in legislative amendment instruments or consolidated electronic versions), not in the original text.
• Dynamic references to external materials: Several defined terms refer to departmental publications “as existing from time to time” (s 4). Those dynamic administrative materials can be updated without the instrument itself being amended (for example the Waste Plastic Exports List and listed waste plastic specifications appearing on the Department’s website). The instrument’s reliance on those materials produces functional change without instrument amendment when the Department updates its lists.
• No internal amendment schedule included: The provided text contains no amending provisions or schedules that change individual sections or record prior alterations; it contains only the original provisions and a statement that the commencement table will not be amended to reflect later changes (s 2(2)).

For legal research and compliance purposes, users should note this instrument contains forward references to Departmental lists and the Act. To determine whether the instrument has been amended since the provided text, practitioners must consult consolidated legislative databases or the parent Act’s legislative history. The instrument itself instructs readers that updates to the administrative lists occur “from time to time” (s 4), and that the commencement table will not be edited within the instrument to reflect subsequent amendments (s 2(2)).

The instrument’s text does not record any judicial decisions, references to cases, or litigation outcomes. It does reference external legal instruments and provisions that may themselves have been the subject of litigation, but no cases are named or cited in the instrument.

• No cases named: The instrument makes reference to the Basel Convention, the Hazardous Waste (Regulation of Exports and Imports) Act 1989, the Commerce (Trade Descriptions) Act 1905 and the Criminal Code in the context of definitions, exclusions and offences (ss 4, 5(4)(b), 6(3) note, 8(3)). However, the instrument itself contains no case citations or litigation summaries.
• Implementation litigation not recorded: Because the instrument is a subordinate legislative instrument setting out rules, litigation arising from its application would be recorded in court or tribunal decisions and would not appear in the instrument text. The instrument therefore provides no direct litigation history in the text supplied.
• Where litigation would arise: Potential areas that could generate litigation include disputes over the Minister’s exercise of discretion (for example, in accepting payment undertakings (s 23) or in deciding whether to grant a licence on prescribed matters (ss 8-9)), challenges to a licence suspension or revocation on the prescribed grounds (ss 14-15), or prosecutions or civil penalty proceedings for contraventions of export conditions and record‑keeping obligations (s 6 note; ss 10 and 11 notes; ss 21-22). Any such litigation will be recorded in judicial or tribunal databases, not in the instrument.
• Research note: Practitioners seeking case law should search relevant administrative, civil and criminal decisions concerning the Recycling and Waste Reduction Act 2020, the Hazardous Waste Act and any decisions addressing the Department’s use of its lists and specification publications. The instrument itself provides the statutory hooks and decision factors that would be the subject of judicial review or internal merits review, but provides no outcome history.

In short, the instrument does not contain a litigation history. Any judicial engagement with these rules will need to be located through external case law searches focused on the Minister’s decision‑making under ss 8-9, 14-15, 17 and the enforcement provisions referenced in the Act.

The instrument contains multiple technical, documentary and timing requirements that carry operational risk if overlooked. The following are the most material practical pitfalls, with section pointers.

• Dual nominated specifications for the 1 July 2022 transition: If an applicant intends to export a kind of regulated waste plastic (other than PEF) both before 1 July 2022 and on or after that date, the application must nominate separate specifications for the pre‑1 July 2022 and post‑1 July 2022 exports (s 7(3)). Failure to nominate both may make the application incomplete and trigger prescribed‑matter scrutiny based on which specification applies (s 8 note and s 7(3)). This is a timing‑sensitive drafting obligation in licence applications.
• “Processed prior to export” requirement: Applications must include information demonstrating the waste plastic will be processed prior to export to comply with the nominated specification (s 7(5)), and exemption applications for trade samples have the same requirement (s 18(5)). The instrument does not define the precise quality or scope of “information demonstrating” processing, leaving the Minister to evaluate sufficiency against the prescribed matters (ss 8-9, 19). Applicants should therefore prepare documentary proof of processing steps, facilities, process controls and testing regimes.
• Single polymer or single resin sorting duty for non‑PEF: Licence holders exporting non‑PEF waste plastic must ensure each consignment is sorted into single polymer or single resin prior to export (s 10(2)(a)). This imposes operational sorting and quality control obligations that can be costly and require specific supply chain arrangements.
• Commercial relationship requirement: Holders must have or have had a commercial relationship with the importer and (if not the supplier) the supplier at the time of export (ss 10(2)(c)-(3), 11(2)(d)-(3)). The instrument does not define the legal form or duration of a “commercial relationship”, and ministerial discretion could treat informal arrangements as insufficient. Exporters should ensure contractual documentation exists and is available for inspection (s 21).
• Photographic evidence technical standard: Records for each consignment must include photographs of the plastic and of the consignment once packed that have “sufficient resolution, brightness and contrast to show the plastic and consignment clearly” and that are time and date stamped (s 21(2)(a)(iii)). Poor‑quality images, missing time/date stamps or ambiguous images risk non‑compliance.
• Record language and translation obligations: Records must be in English (subject to s 21(5)), dated, accurate, legible and auditable (s 21(4)-(5)). If relevant records are in another language, the licence holder must obtain and retain an English translation; failure to do so may affect the ability to demonstrate compliance.
• Non‑alteration rules and audit trail: Records must not be altered or defaced during the five‑year retention period, with exceptions for ordinary practice notations that must be supported by documents showing how the original was changed (s 22). Back‑dated corrections or informal edits without an audit trail could be treated as breaches.
• Waste Plastic Exports List administrative reliance: The instrument permits exports without a licence for kinds and circumstances listed on the Waste Plastic Exports List, subject to a notification; the List is maintained on the Department’s website and can be updated “from time to time” (s 4, s 6(2)(b), (5)). Exporters relying on the list must monitor the Departmental website and ensure notifications comply with any Ministerially approved form and manner (s 6(3)).
• Payment undertaking conditionality: A payment undertaking will be accepted only if the Minister is satisfied as to the financial position of the giver and their ability to comply and meet costs (s 23(2)(c)). Reliance on this mechanism without prior ministerial discussion is risky.
• Processed engineered fuel distinct treatment: PEF is defined narrowly and carries distinct conditions (s 5(3); ss 9, 11). Exporters must understand whether their product falls within the PEF definition , for example, whether it is intended for use as fuel and processed with other waste material , because PEF triggers different decision criteria (calorific value, moisture, particle size) and obligations (secure packaging, combustion risk minimisation) (ss 9(2)(c), 11(2)(b)-(c)).
• Failure to respond to information requests: Failure to comply with a requirement to provide additional or corrected information under subsection 60(2) of the Act is a specific ground for suspension and revocation (ss 14(2), 15(2)). Applicants and licence holders must respond promptly to such requests.
• Timing for renewal applications: Renewal applications must be made no later than 30 days before expiry (s 13). Late renewal applications could create a gap in a licence that would prevent export (s 6(2)(a)(ii)).
• Exemption narrowness for trade samples: Trade samples must be exported “solely for the purposes of market testing” and must not be hazardous waste (s 18(2)). The Minister has prescribed matters to consider and the same processing demonstration requirement applies (s 19; s 18(3), (5)). Exporters should be careful not to overreach the trade sample exemption by exporting material that could be used or sold beyond testing.

These “gotchas” are concrete compliance traps that can be managed by precise documentation, contractual arrangements, quality control systems, and proactive engagement with Departmental publications and ministerial approvals.

This section gives a practical, section‑referenced compliance checklist for exporters, applicants and licence holders. Each step maps to instrument obligations and decision factors.

1. Determine whether your plastic is “regulated waste plastic”

   • Check the definition: plastic that is discarded, surplus or a by‑product, and whether it is processed engineered fuel (s 5(2)-(3)).
   • Confirm exclusions: personal/domestic export, temporary import re‑exported unchanged, or hazardous waste subject to a Ministerial order under the Hazardous Waste Act (s 5(4)(a)-(c)).

2. Decide whether you need a waste plastic export licence or can rely on the Waste Plastic Exports List

   • If your plastic and export circumstances are listed on the Departmental Waste Plastic Exports List, complete and lodge the Ministerially approved notification (s 6(2)(b), (3), (5)). Be aware that the instrument allows the Minister to approve different forms and manners for notifications (s 6(5)).
   • If not listed, plan to apply for and hold a licence in force whenever exporting (s 6(2)(a)(i)-(iii)).

3. Prepare a licence application that addresses all prescribed content (s 7)

   • Nominate a waste plastic specification for each kind of plastic intended for export (s 7(2)). If exporting both before and on/after 1 July 2022 (for non‑PEF), nominate two specifications as required (s 7(3)).
   • If using a non‑listed specification, include a copy with the application (s 7(4)).
   • Provide information demonstrating the plastic will be processed prior to export to comply with the nominated specification; practical materials include process flow diagrams, facility descriptions, process controls, test results and quality assurance procedures (s 7(5)).

4. Anticipate the Minister’s decision factors and provide supporting evidence (ss 8-9, 19)

   • For non‑PEF: provide evidence about intended use in destination, appropriateness of the nominated specification for that use, polymer/resin type, contaminant thresholds (including whether “almost free from contamination” applies per Basel Annex II), packaging and colour requirements, and physical form/remanufacture capability for exports on or after 1 July 2022 (s 8(2)(a)-(d), (3)).
   • For PEF: provide evidence of calorific value, contaminant thresholds, packaging, particle size/bulk density, moisture thresholds and testing/sampling regimes (s 9(2)(c); s 19(4) for trade samples).
   • Disclose export permit or licence history, including prior refusals or revocations, and whether any conditions of hazardous waste export permits have been or are being breached (ss 8(2)(e)-(g), 9(2)(d)-(f)).

5. Implement operational controls to meet licence conditions (ss 10-11)

   • For non‑PEF: sort consignments into single polymer or single resin prior to export; ensure pre‑export compliance with the nominated specification; secure and maintain commercial relationships with importer and supplier evidence; only export to places stated in the licence if the licence specifies a destination; notify the Minister of supplier/agent/importer changes as soon as practicable in an approved form (ss 10(2)(a)-(6)).
   • For PEF: ensure pre‑export compliance with nominated specification, securely package consignments, take all reasonable steps to ensure combustion is carried out to minimise environmental/human health risk, maintain commercial relationships and provide the same notifications (ss 11(2)(a)-(d), 11(4)-(6)).

6. Establish record‑keeping systems (ss 21-22)

   • For each consignment retain: export declaration; evidence supporting the export declaration; time/date‑stamped photographs of the plastic and the packed consignment with adequate resolution, brightness and contrast (s 21(2)(a)(i)-(iii)).
   • Retain every other document made by or coming into possession of the holder that is relevant to showing compliance with the Act for at least five years from creation or possession (s 21(2)(b), (3)).
   • Ensure records are in English or have English translations, are dated, accurate, legible and auditable (s 21(4)-(5)).
   • Do not alter or deface retained records during the retention period; if notations are made in ordinary practice, retain documents that show how the original record was changed (s 22).

7. Manage notifications, renewals and responses to information requests

   • If relying on the Waste Plastic Exports List pathway, ensure notifications follow any Ministerially approved manner/form and include required information and documents; separate notifications are not required for each consignment (s 6(3)-(4)).
   • Apply for licence renewal no later than 30 days before the expiry date (s 13).
   • Respond promptly to any requirement to provide additional or corrected information under subsection 60(2) of the Act; failure to comply is a ground for suspension or revocation (ss 14(2), 15(2)).

8. Consider financial assurance options under s 23

   • If a relevant Commonwealth liability exists, consider whether to propose a written payment undertaking to the Minister. Ensure the undertaking includes the term that liabilities will be reduced by amounts paid under the undertaking and prepare to demonstrate financial capacity, the nature and likely cost of export operations, and ability to comply (s 23(2)(a)-(c)).
   • Discuss with the Department before relying on an undertaking because acceptance is discretionary and the Minister may determine allocation order where multiple liabilities or undertakings exist (s 23(3)).

9. Prepare for audit, inspection and potential enforcement

   • Keep contracts, invoices, shipping documents, testing results and correspondence demonstrating commercial relationships and processing controls ready for production under s 143 of the Act (see notes in ss 10 and 11).
   • Use robust chain‑of‑custody records to demonstrate sorting, processing and packaging compliance.

10. Monitor Departmental publications and statutory changes

• The Waste Plastic Exports List and listed waste plastic specifications are published on the Department’s website and can change over time (s 4). Regularly monitor the Departmental website for updates to avoid relying on obsolete listings or specifications.
• Track any changes to the parent Act or related legislation that may affect the instrument’s operation.

Practical tips

• Treat the nominated specification as contractually binding: once stated in the licence it is the nominated specification for assessment and compliance (s 12(2)).
• For PEF, document combustion risk mitigation steps and whether the intended receiving facility is authorised and capable , the licence condition requires “reasonable steps” to minimise environmental or human health risk (s 11(2)(c)).
• Build photographic evidence processes into packing lines to ensure time/date stamps and consistent image quality (s 21(2)(a)(iii)).
• Maintain a designated records custodian responsible for translations if needed and for preserving an audit trail consistent with s 22.

Following these steps, with documentary evidence mapped to each prescribed matter in ss 7-11 and ss 21-23, will address the principal compliance obligations the instrument imposes.
