Recycling and Waste Reduction (Export—Waste Glass) Rules 2020

The instrument organizes its controls around a small set of recurring legal concepts. Understanding these is necessary to interpret obligations and compliance steps.

• Regulated waste glass: The instrument prescribes “waste glass” as regulated waste material for the Act (s5(1)). “Waste glass” is defined by activity‑based descriptions: discarded, rejected, left over, surplus or a by‑product of industrial, commercial, domestic or other activity (s5(2)). Two narrow exclusions remove personal/domestic use exports and certain temporary import/export situations from regulation (s5(3)).
• Waste glass specifications: Exporters must nominate a waste glass specification for the material they intend to export (s7(2)). A “listed waste glass specification” is an industry specification that is listed on the Department’s website and can be updated from time to time (s4). If the nominated specification is not a listed one, the application must include a copy of the specification and information demonstrating processing to meet it (s7(3)). The Minister must consider whether non‑listed specifications meet the objects of the Act when granting licences or exemptions (s8(f), s16(2)(b)).
• Export licence and export declaration: The rules make export conditional on holding a waste glass export licence covering the material, the licence being in force and unsuspended, and an export declaration being provided for each consignment with export within 30 days of the declaration (s6(2)(a)-(c), note to s6). The Act defines “export declaration” and “export licence”; this instrument prescribes how those concepts apply to waste glass exports.
• Commercial relationships and due diligence: A recurring requirement is that the licence holder have a “commercial relationship” with the importer and, where not the supplier, with the supplier of the regulated waste glass (s9(2)(b), s9(3)). The Minister must have regard to evidence of commercial relationships at grant stage (s8(a), (d)-(e)). These provisions embed a commercial traceability expectation into licensing.
• Processing to specification and documentary proof: The licence condition requires that each consignment comply with the nominated specification prior to export (s9(2)(a)). If a nominated specification is non‑listed, the applicant must demonstrate processing to comply before export (s7(3)(b)). The application and licensing process is therefore focused on prior processing and demonstrable conformity.
• Consignment photography as evidence: For each consignment the licence holder must take a photograph that clearly shows the waste glass with sufficient resolution, brightness and contrast, and that is time and date stamped (s9(4)). The photograph is an explicitly required record and must be retained for at least five years (s18(2)(a)(iii), s18(3)). The instrument thus converts a simple visual record into a prescribed evidentiary element.
• Exemptions and trade samples: Exemptions can be sought, with particular rules for “trade samples” exported solely for market testing. Applicants for trade sample exemptions must nominate a specification and the Minister must consider capability to comply and appropriateness of the specification for the intended use abroad (ss15-16).
• Records, retention and integrity: Licence holders must retain export declarations, supporting evidence, photographs and any relevant documents that show compliance for five years, in English and auditable form, and must not alter or deface records during the retention period apart from ordinary practice notations (ss18-19). If records are in another language, an English translation must be obtained and retained (s18(5)).
• Ministerial discretion and administrative checks: The Minister’s decision making is constrained by specified matters the Minister must have regard to at grant, renewal and variation stages (s8, s16, s20). The Minister may impose further conditions under the Act and may give directions to licence holders if specified matters warrant that (s9 note, s14). The instrument also prescribes specific grounds for suspension and revocation tied to failure to respond to requests for additional or corrected information under s60(2) of the Act (ss11-12).

Those concepts convert the export event into a sequence of administrative steps: nominate specification, hold a licence covering the material, process to specification, create documentary and photographic evidence, lodge an export declaration, export within 30 days, and retain records. The Department’s website list of “listed waste glass specifications” is an external, administratively maintained reference point that influences the paperwork required and the Minister’s assessment of compliance.

Identify the persons and entities that bear obligations, benefit from permissions, or are otherwise materially affected by the rules.

• Exporters seeking to export waste glass: Any person or entity exporting regulated waste glass must meet the prescribed export conditions. The core obligations fall on the waste glass export licence holder: to ensure each consignment complies with the nominated specification prior to export (s9(2)(a)), to maintain commercial relationships with importers and, where relevant, suppliers (s9(2)(b), s9(3)), to take a time and date stamped photograph for each consignment (s9(4)), to lodge an export declaration for each consignment and export within 30 days of that declaration (s6(2)(c)), and to retain records for at least five years (s18).
• Suppliers and processors of waste glass: Where the licence holder is not the supplier, the licence requires a commercial relationship with the supplier (s9(3)), and the Minister must have regard to commercial relationships between applicant and supplier when deciding whether to grant a licence (s8(d)). If the licence does not include processing operations, the Minister must consider relationships with persons who will produce or prepare the waste glass for export (s8(e)). Those provisions make suppliers and processors relevant participants in licensing decisions, and potentially sources of documentary proof of processing to specification (s7(3)(b), s8(g)-(h)).
• Importers and overseas users: The Minister must consider the intended use of the regulated waste glass at the destination (s8(c), s8(i)), and the licence imposes a requirement to have a commercial relationship with the importer (s9(2)(b)). Where a licence specifies permitted destinations, holders must export only to those places (s9(5)). These provisions connect overseas buyers to Australian administrative requirements, and may require exporters to obtain contractual or documentary proof of intended use.
• Freight forwarders and agents: If a licence holder uses a freight forwarder or agent, changes in that agent must be notified to the Minister in the approved form as soon as practicable (s9(6)(b)-(7)). Freight forwarders therefore become operationally relevant and may be integrated into record keeping and notification obligations.
• Applicants for exemptions and trade sample exporters: Persons seeking an exemption, particularly for trade samples exported for market testing, must nominate a specification and be assessed on capability to comply and the appropriateness of the specification (ss15-16). Those exporters will still be subject to the Minister’s satisfaction on specified matters.
• Licence applicants and holders with Commonwealth liabilities: Section 20 allows a person to give a written payment undertaking to the Minister to satisfy certain Commonwealth liability requirements for grant, renewal or variation of a licence, subject to Ministerial acceptance after assessing the person’s financial position and related matters (s20(2)-(5)). Persons with outstanding Commonwealth liabilities may be affected by the availability and conditions of payment undertakings.
• The Minister and the Department: The Minister decides on licence grants, renewals, variations, suspensions, revocations, exemptions and payment undertaking acceptance. The instrument prescribes matters the Minister must have regard to when exercising those powers (s8, s16, s20), and the Department maintains the “listed waste glass specification” list on its website (s4). Administrative capacity and policy choices at the Department determine how the rules operate in practice.
• Other affected parties: Businesses that trade in industry specifications, technical laboratories that provide conformity evidence, auditors and legal advisers who prepare export documentation, and compliance teams maintaining the required photographic and documentary records will be affected by the operational compliance requirements (s7(3), s9(4), s18).

Exclusions narrow the affected population. Exports for personal or domestic use and certain temporary re‑exports are not regulated by this instrument (s5(3)). The instrument therefore targets commercial export operations that involve material characterised as waste glass and channels obligations to licence applicants and holders, their suppliers, importers and logistics agents.

This section lists the principal affirmative duties the instrument places on licence applicants and holders, and the principal rights and administrative options available to them and to the Minister.

Key duties on licence applicants and holders

• Nominate a waste glass specification in the licence application: Every application must nominate the waste glass specification with which the regulated waste glass will comply (s7(2)).
• Provide copies and processing information for non‑listed specifications: If the nominated specification is not a “listed waste glass specification”, the application must include a copy of the specification and information demonstrating that the regulated waste glass intended for export will be processed prior to export to comply with the specification (s7(3)(a)-(b)).
• Demonstrate commercial relationships: The licence holder must have a commercial relationship with the importer for each consignment, and if not the supplier, with the supplier (s9(2)(b), s9(3)). The Minister must have regard to evidence of commercial relationships when deciding on grant (s8(a), (d)-(e)).
• Ensure pre‑export conformity: The holder must ensure that each consignment complies with the nominated waste glass specification prior to export (s9(2)(a)). The Minister must have regard to whether the waste glass will be processed to comply with the nominated specification when deciding to grant a licence (s8(h)).
• Photograph consignments: For each consignment, the holder must take a photograph showing the regulated waste glass, with sufficient resolution, brightness and contrast, that is time and date stamped (s9(4)). The photograph is a required record (s18(2)(a)(iii)).
• Lodge export declarations and meet the time limit: For each consignment, the exporter must give an export declaration and export the consignment no later than 30 days after the declaration is given (s6(2)(c)).
• Export to specified places only: If the licence states permitted destinations, the holder must export only to those places (s9(5)).
• Notify the Minister of certain changes: The holder must notify the Minister, in the form approved by the Minister, as soon as practicable if specified changes occur, including change of supplier, change of freight forwarder or agent, or change of importer (s9(6)-(7)).
• Record keeping and integrity: The holder must make and retain export declarations, supporting evidence, photographs and any other documents relevant to demonstrating compliance for at least five years (s18(2)-(3)), ensure records are dated, accurate, legible and auditable, and keep records in English or provide a translation (s18(4)-(5)). Records must not be altered or defaced during the retention period, apart from ordinary practice notations, and change logs must be retained if notations are made (s19).
• Respond to information requests: The Act provides mechanisms for the Minister to require additional or corrected information under s60(2) of the Act, and failure to comply is a ground for suspension and revocation under this instrument (ss11-12).

Administrative rights and Ministerial options

• Right to apply for exemption: Applicants can seek an exemption under the Act, and for trade samples must nominate a specification and be assessed against prescribed matters (s15(2)-(3), s16(2)). Exemptions may be revoked if the holder contravenes conditions (s17).
• Licence renewal and variation: Licence holders may apply to renew or vary licences, subject to timing rules (renewal applications must be made no later than 30 days before expiry, s10) and the Minister’s decision making under the Act. The Minister can vary conditions either on application or on the Minister’s initiative (s9 note referencing Part 6 of Chapter 2 of the Act).
• Ministerial acceptance of payment undertakings: The Minister may accept a written payment undertaking to treat a relevant Commonwealth liability as paid for the purposes of grant, renewal or variation of a licence, subject to acceptance criteria including assessment of financial position and ability to comply (s20(2)-(5)).
• Ministerial discretion to direct and impose conditions: The licence will be subject to any conditions specified in the licence (s9 note), and the Minister may give directions to licence holders under s64 of the Act, with matters to be considered set out in s14.

Other procedural duties

• Renewal timing: Apply for renewal at least 30 days before expiry if the licence has an expiry date (s10).
• Notification of ceasing to operate: The holder must notify the Minister if the holder ceases to operate the export business that performs the export operations covered by the licence (s13).

These duties and rights create an administrative compliance framework that couples prior processing and commercial traceability to documentary and photographic proof, and that attaches Ministerial discretion to acceptance of payment undertakings and to licence conditions, directions, suspension and revocation.

The instrument delegates enforcement and penalty design to the Act, but it prescribes specific non‑compliance triggers, documentary requirements and administrative mechanisms the Minister may use to enforce compliance.

Statutory offence and civil penalty linkage

• The instrument explicitly links contravention of prescribed export conditions to offences and civil penalties by reference to the Act. The note to s6 states that contravention of one or more prescribed export conditions is an offence and a civil penalty provision (see s6 note and cross‑reference to s20 of the Act in that note). Section 9 notes that a holder may commit an offence or be liable to a civil penalty if a condition of the licence is contravened (s9 note, referencing s59 of the Act). The instrument does not itself set penalty quantum, rather it identifies contraventions that engage the Act’s enforcement regime. Administrative suspension and revocation grounds

• The instrument prescribes additional specific grounds for suspension and revocation tied to a licence holder’s failure to comply with information‑provision obligations under s60(2) of the Act. It is a ground for suspension if the holder was required to comply with subsection 60(2) and failed to do so (s11(2)). The same framing is a ground for revocation (s12(2)). The instrument references other grounds listed in the Act that also support suspension and revocation (s11 note, s12 note). Ministerial directions and considerations

• The Minister may give directions to licence holders under s64 of the Act. This instrument prescribes the matters the Minister must have regard to when deciding whether to give directions, including whether a licence condition has been contravened or is likely to be contravened, and whether the regulated waste glass covered by the licence does not, or is likely not to, comply with applicable requirements (s14). Directions are therefore an enforcement tool short of suspension or revocation. Record‑keeping as an enforcement lever

• The instrument makes documentary proof central to compliance. Licence holders must retain export declarations, evidence supporting declarations, and photographs for each consignment for at least five years (s18(2)-(3)). Records must be auditable and in English or accompanied by translations (s18(4)-(5)). Section 19 prohibits alteration or defacement of retained records during the retention period except for ordinary practice notations, and requires retention of documents showing how an original record was changed if notations are made (s19(1)-(3)). These record rules enable administrative audits and form the evidentiary basis for enforcement action. Administrative acceptance of payment undertakings

• For grant, renewal or variation decisions where relevant Commonwealth liabilities might otherwise bar action, s20 permits the Minister to accept a written payment undertaking that is then treated as payment of the liability for the decision. Acceptance is discretionary and subject to assessment of the person’s financial position and capacity to meet the undertaking (s20(2)-(3)). The Minister can also determine the order in which payments are applied if multiple liabilities or multiple undertakings exist (s20(3)). Variations to undertakings require Ministerial agreement and cannot reduce the unpaid portion of liabilities (s20(4)-(5)). This mechanism provides a conditional administrative alternative to outright refusal where a person has outstanding Commonwealth liabilities. Practical enforcement risks and implementation features

• The instrument ties suspension and revocation to failure to comply with information requests under s60(2) of the Act (ss11-12). The Minister’s acceptance of payment undertakings is discretionary and requires assessment of financial capacity (s20(2)(c)). Photographic requirements (s9(4)) and the subjective standard “sufficient resolution, brightness and contrast” create potential evidentiary challenges on audit. The instrument places considerable weight on documentary compliance as the trigger for enforcement, rather than on on‑site inspection powers. The Act contains the specific powers and penalties, and the instrument links its contraventions to those provisions.

In short, enforcement is primarily administrative and documentary: the Department and Minister act by evaluating applications, evidence and records, issuing directions, and using suspension and revocation powers anchored in failures to provide required information, and contraventions are connected to the Act’s offence and civil penalty architecture.

This instrument is made under the Recycling and Waste Reduction Act 2020 (s3), and it cross‑references several provisions of that Act for decision making, enforcement and administrative procedure. It also contains one direct cross‑reference to another Commonwealth Act.

Direct statutory dependencies and cross‑references

• The instrument’s core regulatory effect is to prescribe waste glass as regulated waste material under the Act (s5(1)), and to define export conditions for regulated waste glass for the purposes of section 18 of the Act (s6(1)). Numerous provisions in this instrument are expressly made for the purposes of particular paragraphs and subsections of the Act, thereby implementing the Act’s framework. Examples:
  • Section 7 is made for the purposes of paragraphs 172(1)(c) and (d) of the Act, prescribing application information and supporting documents for licence applications (s7(1)).
  • Section 8 prescribes matters the Minister must have regard to for the purposes of paragraph 34(2)(f) of the Act when deciding to grant a licence (s8).
  • Section 9 prescribes licence conditions for the purposes of paragraph 35(1)(b) of the Act (s9(1)).
  • Section 10 prescribes renewal timing for the purposes of paragraph 38(4)(a) of the Act (s10).
  • Sections 11 and 12 prescribe grounds for suspension and revocation for the purposes of paragraphs 46(1)(i) and 54(1)(i) respectively (ss11-12).
  • Section 18 is made for the purposes of section 142 of the Act regarding record keeping (s18(1)).
  • Section 20 prescribes circumstances for treating a relevant Commonwealth liability as paid for the purposes of section 181 of the Act (s20(1)).
• The instrument therefore operates as delegated or subordinate legislation implementing the Act’s framework. The Act supplies the underlying offence, penalty, procedural and evidentiary regimes.

Reference to the Commerce (Trade Descriptions) Act 1905

• The instrument excludes from regulation waste glass that is imported on a temporary basis and re‑exported in the same covering and with the same trade description as when imported. The instrument explicitly links the phrase “trade description” to the Commerce (Trade Descriptions) Act 1905 (s5(3)(b)). That cross‑reference identifies a pre‑existing statutory conceptual meaning for “same trade description” in the temporary import/re‑export exclusion.

Administrative interaction with Departmental instruments

• The instrument refers to a “listed waste glass specification” as a waste glass specification listed on the Department’s website and subject to change “from time to time” (s4). This creates an interaction between the statutory rules and a Departmental administrative list. The content of that list affects whether an applicant must supply a copy of a specification and evidence of processing (s7(3)) and whether the Minister must assess a nominated specification against the objects of the Act (s8(f), s16(2)(a)(ii)). That design places substantive relevance on non‑legislative administrative material maintained by the Department.

Gaps and non‑specified interfaces

• The instrument does not expressly reference other Commonwealth regulatory regimes that might apply to particular shipments, such as customs, biosecurity, hazardous materials controls, or foreign customs regulations. The Act defines “export declaration” and related export‑licence machinery but the instrument does not explicitly set out how the export declaration under the Act interacts with customs export documentation or other export control regimes. Practically, exporters will operate within multiple statutory regimes, but this instrument governs only the waste glass export licence and documentary and record‑keeping obligations it prescribes. Ministerial discretion and procedural checks under the Act

• The instrument repeatedly points back to the Minister’s decision making under the Act, and opens the Minister to consider “any other matter that the Minister considers relevant” where the Act allows (s8 note). The Minister’s acceptance of payment undertakings is likewise an administrative discretion exercised under criteria that the instrument prescribes only in part (s20(2)-(3)). Consequently, the instrument’s operation depends on the Act’s procedural safeguards and review avenues, and on how the Department administers the listed specification and information requests in practice.

In sum, this instrument functions as a sector‑specific layer within the Act’s export control architecture and links to one discrete external statute for the meaning of “trade description”. The Department’s website list and the Act’s broader administrative and penalty regimes are the principal external legal interactions.

This instrument was made by the Minister for the Environment, Sussan Ley, on 16 December 2020, and commenced in full on 1 January 2021 (see commencement table at s2). The instrument contains an explicit commencement table that states “The whole of this instrument” commenced 1 January 2021 (s2(1)). A note accompanying the commencement table states that the table relates only to the provisions as originally made and will not be updated to reflect later amendments of the instrument (s2 note). The instrument otherwise contains no in‑text amendments, schedules or later amendment dates.

Administrative amendment mechanisms and living lists

• Although the instrument itself shows no post‑making amendments, it creates at least two mechanisms for administrative change without amending the instrument by statute:

  • The “listed waste glass specification” is defined as a waste glass specification that is listed on the Department’s website “as existing from time to time” (s4). The Department can therefore update which specifications are “listed” administratively by altering the website content, and that change affects applicant documentary obligations and Ministerial considerations under ss7 and 8.
  • The Minister has express powers under the Act to vary conditions of licences either on application or on the Minister’s initiative, where Part 6 of Chapter 2 of the Act applies (s9 note). Licence‑level changes can thus occur administratively under the Act without amendment to this instrument. No amendment record in this instrument

• The instrument’s text contains no schedule of amendments, no later commencement entries, and no marked insertions or deletions. The only historical information recorded in the instrument is the date it was made and the commencement date (s1-s3). Where further amendments have been made, they are not reflected in the text provided. The instrument’s own note signals that the commencement table will not be updated to reflect later amendments (s2 note), and the instrument contains no internal amendment history section. Practical implication for practitioners

• Because key operational material is maintained outside the text (the Department’s website list of listed waste glass specifications) and because the instrument cross‑refers to the Act for many operational questions, practitioners should check:

  • the Department’s current listing of waste glass specifications on its website before applying for a licence or relying on a listed specification; and
  • any subsequent legislative instruments, regulations or amendments to the Recycling and Waste Reduction Act 2020 that affect licensing procedures, penalties, or decision rights.

• The instrument’s present text stands as originally made; any later changes would appear as separate amending instruments or as changes on the Department’s administrative website. The instrument itself makes no provision for retrospective amendment or transitional arrangements beyond its commencement.

The instrument as provided contains no references to litigation, cases, or tribunal decisions. It does not cite any judicial or administrative determinations, nor does it list contested statutory interpretations or precedent. The only legal references in the text are to the Recycling and Waste Reduction Act 2020 and to the Commerce (Trade Descriptions) Act 1905 for the meaning of “trade description” in the temporary import/re‑export exclusion (s5(3)(b)). Because the instrument is subordinate legislation implementing policy objectives, disputes arising from its application would arise under the Act, and any litigation would depend on facts such as compliance with licence conditions, sufficiency of records, and the Minister’s exercise of discretion.

Potential sources and types of litigation that could arise, subject to the Act and procedural review rights

• Judicial review of administrative decisions: Applicants or licence holders aggrieved by Ministerial decisions to refuse, vary, suspend or revoke a licence, or to refuse an exemption or to accept or decline a payment undertaking, may seek judicial review in the Federal Court or the Federal Circuit and Family Court on grounds such as jurisdictional error, failure to observe procedural fairness, or unreasonable exercise of discretion. The instrument prescribes matters the Minister must have regard to in making decisions (for example s8), and failure to consider those mandatory matters could be the basis for review.
• Civil penalty and criminal proceedings under the Act: The instrument links certain contraventions to offence and civil penalty provisions under the Act (s6 note, s9 note referencing s59 of the Act). Enforcement action by the regulator could result in civil penalty proceedings or criminal charges where the Act so provides. Disputes may arise over whether documentary or photographic evidence met the specified standard, whether a consignment complied with the nominated specification, or whether export timing requirements were met.
• Evidentiary disputes about records and photographs: Because the instrument turns photographs and retained records into required evidence (s9(4), s18), litigation could raise questions about the sufficiency of photographic evidence, authenticity and integrity of records where alteration is alleged, or adequacy of translations of non‑English documents (ss18(4)-(5), s19).
• Contractual and commercial disputes: The Minister is required to have regard to commercial relationships with importers and suppliers (s8). Litigation could arise in the commercial sphere about whether a commercial relationship satisfies the instrument’s expectations when administrative decisions hinge on that factor.
• No named cases in the instrument: The instrument itself names no cases and records no litigation. Any reported decisions interpreting these rules or the relevant provisions of the Act will post‑date the instrument and must be sought in judicial databases, tribunal records and adjudicative reports.

Practical note for practitioners

• Because the instrument provides a framework for administrative decisions under the Act, and because many enforcement triggers depend on documentary evidence, any litigation is likely to focus on administrative law principles, standards of proof for documentary compliance, and the procedural fairness of Ministerial determinations. Practitioners should review the Act’s review and appeal provisions, the Administrative Decisions (Judicial Review) Act 1977 where applicable, and keep detailed contemporaneous records that respond to the instrument’s evidentiary requirements in case a decision is litigated. The instrument does not itself provide litigation history.

This instrument contains a number of provisions whose practical effect may be counter‑intuitive or that create operational and evidentiary hazards for exporters, licence applicants and their commercial partners. Below are discrete points to watch.

Export declaration timing and the 30‑day rule

• Each consignment requires an export declaration and must be exported not later than 30 days after the export declaration is given (s6(2)(c)). The timeframe is relatively short. Failure to export within 30 days after giving the export declaration would, by the instrument’s terms, mean a contravention of the prescribed export condition and could attract offence or civil penalty consequences under the Act (s6 note). Practitioners must coordinate customs, carrier bookings and export licensing to ensure the declaration and physical export align.

Photograph requirement: subjective standards and evidentiary risk

• The licence condition requires a photograph of each consignment that “has sufficient resolution, brightness and contrast to show the regulated waste glass clearly” and is time and date stamped (s9(4)). The phrasing leaves significant subjectivity as to what is “sufficient”. On audit, regulators may challenge photographs as inadequate. Photographs are required records and must be retained for five years (s18(2)(a)(iii), s18(3)), so establishing an internal standard and imaging protocol that demonstrably meets the requirement is necessary.

Commercial relationship requirement and supply chain traceability

• Licence holders must have a commercial relationship with the importer and, where not the supplier, with the supplier (s9(2)(b), s9(3)). The Minister must have regard to evidence of commercial relationships when deciding to grant a licence (s8(a), (d)). The instrument does not define “commercial relationship”, so applicants should document contracts, purchase orders, supply agreements, letters of intent and transactional records to show the relationship exists and is commercial in nature. Where the licence does not include processing, evidence of arrangements with parties who produce or prepare the regulated waste glass must be available (s8(e)).

Non‑listed specifications and extra evidence

• If a nominated specification is not on the Department’s listed specifications, the application must include a copy of the specification and information demonstrating that the regulated waste glass will be processed to comply with it prior to export (s7(3)). The Minister must consider whether such a nominated specification meets the objects of the Act (s8(f)). Using a non‑listed specification therefore adds application complexity and invites closer ministerial scrutiny.

Limit on destinations in licences

• Licences may specify the place to which regulated waste glass may be exported, and if so the holder must export only to that place (s9(5)). Using a licence that limits destinations requires logistics coordination and may require additional licence variations to change destination markets. Failure to follow specified destinations is a contravention of a licence condition.

Record language, translations and retention period

• Records must be in English, dated, accurate, legible and auditable, and retained for at least five years from the date made or received (s18(3)-(5)). If records are not in English, an English translation must be obtained and retained (s18(5)). Practically, if importers or foreign suppliers provide documentation in another language, the exporter must procure certified translations and retain both originals and translations to demonstrate compliance on audit.

Alteration rules and change logs

• A retained record must not be altered or defaced during the retention period, except for notations made in accordance with ordinary practice (s19(1)-(2)). If notations are made, documents that show how the original record was changed must themselves be retained (s19(3)). This requires version control and an auditable change management system. Failure to preserve original records and change logs could be treated as evidence‑tampering by enforcement agencies, or at least undermine a defence.

Suspension and revocation tied to information requests

• The instrument specifically makes failure to comply with a s60(2) request for additional or corrected information a ground for suspension and revocation (ss11(2), 12(2)). Practically, applicants and holders must respond promptly and fully to information requests to avoid automatic administrative consequences.

Trade sample limitation

• “Trade sample” is narrowly defined as waste glass exported solely for market testing (s15(3)). Exemptions tied to trade samples require nomination of a specification and Ministerial assessment of capability to comply and appropriateness of the specification (s16(2)). Attempting to rely on the trade sample exemption for more than narrowly defined market testing may expose exporters to enforcement.

Ministerial discretion on payment undertakings

• Section 20 allows the Minister to accept a written payment undertaking in lieu of payment of relevant Commonwealth liabilities when deciding on grant, renewal or variation. Acceptance is discretionary, and the Minister may consider the person’s financial position, the likely cost of export operations, and other factors (s20(2)(c)). Payment undertakings do not automatically confer rights; they require Ministerial acceptance and may be conditioned.

Listed specification maintained administratively

• The “listed waste glass specification” is maintained on the Department’s website and may change; reliance on that status requires checking the Department’s list at the time of application (s4). A specification that is listed today may be removed or amended later, with practical implications for future applications.

Notification timing: “as soon as practicable”

• Notifications of changes required under s9(6) must be given “as soon as practicable” (s9(7)). The phrase is context dependent and imprecise, potentially creating compliance uncertainty regarding the acceptable window to report changes.

No quantified penalty figures in the instrument

• The instrument links contraventions to offences and civil penalties under the Act but does not state penalty amounts (s6 note, s9 note). Practitioners must consult the Act for the quantum and nature of sanctions.

Operational note

• The combination of documentary proof, photographic evidence, short export timing, and broad Ministerial regard obligations creates administrative complexity. Transparent contractual and documentary arrangements with suppliers, processors and freight providers, robust imaging standards, a records management system with version control and translations, and rapid processes for responding to information requests are practical necessities to minimise the operational risk created by the instrument’s requirements.

This section sets out practical compliance steps mapped to the instrument’s provisions. The sequence follows a typical export transaction lifecycle and addresses application, pre‑export processing, export event, record keeping and responses to administrative actions.

Pre‑application due diligence and planning

• Determine whether the material qualifies as regulated waste glass: Check if the glass meets the activity‑based definition in s5(2). If the material is being exported for personal or domestic use or is a temporary import re‑exported with the same covering and trade description under the Commerce (Trade Descriptions) Act 1905, confirm whether the s5(3) exclusions apply.
• Identify the applicable specification: Decide whether to nominate a listed waste glass specification or a specification that is not listed. If relying on a listed specification, confirm listing on the Department’s website at the time of application (s4, s7(2)). If the nominated specification is not listed, prepare a copy and document the processing steps that will be taken prior to export to ensure conformity with the specification, because s7(3) requires both the specification and information demonstrating processing to comply.
• Contractual arrangements with importers and suppliers: Because the licence requires and the Minister must have regard to commercial relationships, put in place clear contractual documentation with importers and suppliers. Maintain commercial contracts, purchase orders, letters of intent, invoices and correspondence that evidence the commercial relationship and intended use overseas (s8(a), s8(d)-(e), s9(2)(b), s9(3)).

Application stage

• Prepare the licence application: Include the nominated waste glass specification (s7(2)), and if non‑listed, attach the specification copy and processing information demonstrating how the material will be processed to meet the specification (s7(3)). Include any other documents required by the Act and by the instrument, for example evidence of commercial relationships and processing capacity (s8).
• Evidence of processing and equipment: Be ready to show the equipment or machinery that will be used to process the regulated waste glass (s8(b)), and emphasise the intended use of the material at destination (s8(c)). Where the licence would not cover production or preparation, provide evidence of commercial relationships with those who will carry out that processing (s8(e)).

Operational and pre‑export compliance

• Process each consignment to nominated specification before export: The licence condition requires pre‑export compliance with the nominated specification for each consignment (s9(2)(a)). Ensure processing steps and quality control records exist and are linked to the consignment.
• Photograph each consignment: Establish an imaging protocol that produces a time and date stamped photograph for each consignment with sufficient resolution, brightness and contrast to show the regulated waste glass clearly (s9(4)). Store photographs as part of the consignment file and ensure metadata or visible timestamping demonstrates the capture date.
• Confirm importer commercial relationship and permitted destination: Ensure the commercial relationship with the importer is documented, and if the licence specifies a permitted place, verify the destination matches the licence (s9(2)(b), s9(5)).
• Coordinate logistics for the 30‑day export window: Since each export declaration must be followed by the actual export within 30 days (s6(2)(c)), integrate declaration lodgement with shipping bookings and carrier commitments to meet the timeframe.

Export declaration and export event

• Lodge the export declaration and execute the export within 30 days: Give the Minister an export declaration for each consignment and export no later than 30 days after the declaration is given (s6(2)(c)). Keep a copy of the export declaration as a retained record.
• Collect and retain supporting evidence: For each consignment retain the export declaration, evidence supporting the matters in the export declaration, and the required photograph (s18(2)(a)(i)-(iii)). Also retain any other documents relevant to demonstrating compliance with the Act (s18(2)(b)).

Record keeping and document management

• Retain records for at least five years: All records made by the holder or that come into the holder’s possession and that are relevant to compliance must be retained for at least five years starting on the day the record was made or received (s18(3)). Ensure a records management system timestamps file creation and receipt dates to demonstrate the retention clock.
• Ensure records are in English or translated: Records must be in English, dated, accurate, legible and auditable, and if they are not in English, obtain and retain an English translation (s18(4)-(5)). Use accredited translators and keep translation certificates.
• Protect record integrity and implement version control: Do not alter or deface retained records during the retention period, apart from ordinary practice notations (s19(1)-(2)). If notations or markings are made, retain documents that show how the original record was changed (s19(3)). Implement a version control and change log system that preserves originals and captures every notation, who made it, and why.

Notifications and ongoing obligations

• Notify the Minister of specified changes as soon as practicable: If there is a change in supplier, freight forwarder or agent, or a change in importer, notify the Minister in the form approved by the Minister as soon as practicable (s9(6)-(7)). Establish internal processes to detect these changes and notify the Department promptly.
• Apply for renewal in time: If the licence has an expiry date, file renewal applications at least 30 days before expiry (s10). Track licence expiry dates in contract and compliance calendars and allocate responsibility for renewal filings.

Responding to Ministerial requests and avoiding suspension

• Respond to s60(2) information requests promptly and completely: Failure to comply with a request under subsection 60(2) of the Act (for additional or corrected information) is a ground for suspension and revocation (ss11(2), 12(2)). Implement rapid response procedures for Ministerial information requests, including a legal reviewer and an evidence custodian to compile and submit information within the time requested.
• Where Commonwealth liabilities exist, consider payment undertakings: If relevant Commonwealth liabilities might otherwise affect a decision to grant, renew or vary a licence, a person can give a written payment undertaking to the Minister, which the Minister may accept subject to assessment of the person’s financial position and capacity to comply (s20(2)). Prepare financial documentation to support an application for acceptance of a payment undertaking, and anticipate possible Ministerial conditions.

Audit readiness and compliance programme

• Build an auditable compliance trail: Link photographs, export declarations and supporting evidence to consignment identifiers and make the chain of custody clear from supplier or processor through to shipment and delivery. Keep raw data files, camera metadata and originals for evidentiary robustness.
• Train personnel and contractors: Train staff and contracted freight forwarders on the photographic, documentary, translation, and notification requirements. Include licence condition compliance clauses in contracts with suppliers and logistics providers to ensure cooperation during audits.
• Maintain an administrative watch on the Department’s specifications list: Regularly check the Department’s website for the current listed waste glass specification list and any administrative updates, since listing status affects application requirements (s4, s7(3)).

• Avoid altering records, or keep change logs if notations are made (s19).
• Notify Minister of required changes as soon as practicable (s9(6)-(7)).
