#### 74 What are the Commonwealth’s intellectual property rights in a product stewardship logo The Commonwealth’s intellectual property rights in a product stewardship logo are: (a) if the product stewardship logo is an artistic work—the Commonwealth’s right under the Copyright Act 1968 to do an act comprised in the copyright of the artistic work; and (b) if the product stewardship logo is a trade mark—the rights held by the Commonwealth as the registered owner of the trade mark under the Trade Marks Act 1995.
