#### 166 Appointment of analyst (1) The Secretary may appoint a person to be an analyst for the purposes of this Act. (2) The Secretary must not appoint a person to be an analyst for the purposes of this Act unless the Secretary is satisfied that: (a) the person satisfies the training and qualification requirements determined under subsection (3); or (b) the person will satisfy those training and qualification requirements before the person exercises any powers as an analyst for the purposes of this Act. (3) The Secretary must determine, in writing, training and qualification requirements for analysts. (4) A determination under subsection (3) is not a legislative instrument.
