#### 124 Offence—failure to return identity card (1) A person contravenes this subsection if: (a) the person has been issued with an identity card under subsection 123(1); and (b) the person ceases to be a person referred to in paragraph 123(1)(a), (b) or (c); and (c) the person does not, within 14 days after so ceasing, return the person’s identity card to the Secretary. (2) Subsection (1) does not apply: (a) to an authorised officer whose authorisation has been suspended; or (b) if the identity card was lost or destroyed. > Note: A defendant bears an evidential burden in relation to the matter in this subsection (see subsection 13.3(3) of the Criminal Code). (3) A person commits an offence of strict liability if the person contravenes subsection (1). Penalty: 1 penalty unit.
