Recreational Greenways Act 2000

The Act centres on a concise vocabulary and several key legal instruments.

Greenway (s 3) , A statutory form of trail. The Act defines “greenway” to include the land set aside as a trail for specified recreational purposes (walking, cycling, horse riding, skating and similar), plus camping grounds and land with huts, hostels or facilities used in conjunction with a trail. The Act also treats parts of a trail or associated facilities as greenways (s 3, definition of greenway; s 5(4)).

Proclamation mechanism (s 5) , The Governor, on the Minister’s recommendation, makes a proclamation to declare land a greenway. The proclamation must identify the greenway, specify purposes and give it a name (s 5(1), (4)). Proclamations may contain conditions and closure periods (s 5(5)). Declarations are limited to specified land categories, including unalienated Crown land, vested land, pastoral lease land, council land, dedicated land and private land subject to an access agreement or easement (s 5(2)).

Access agreement (Part 4: ss 14-19) , A contract between a private landowner and the Minister permitting establishment of a greenway over private land. Access agreements attach to the land (s 15(1)), bind persons who have an interest in the land (s 15(2)), and are subject to native title that exists when the agreement is made (s 15(3)). They may include indemnities, waivers or acknowledgements of liability (s 16), and cannot have effect under the Act until noted by the Registrar‑General (s 18(1)-(2)). An access agreement may not be varied in a way that affects another person’s legal interest without that person’s consent (s 17(2)).

Easement (s 21(c), s 23) , The Minister may acquire land or an easement by agreement. The Act alters the operation of the Real Property Act by declaring that an easement acquired for greenway purposes entitles the Minister, as against all other persons with an interest in the land, to establish and maintain the greenway in accordance with the Act; the easement is in gross and is subject to native title existing when the easement was acquired (s 23(1)-(3)).

Public right of access and limitations (s 11) , Members of the public and visitors are entitled to access and use greenways in accordance with the Act and the proclamation (s 11(1)), except where another Act prohibits entry or where the greenway is closed (s 11(2)-(3)). Fees are generally prohibited for simple access but may be prescribed for commercial activity or use of facilities (s 11(4)-(5)). Special rules apply to greenways on pastoral lease land that is not a public access route under the Pastoral Land Management and Conservation Act 1989; notice to the lessee is required and horse travel may require lessee or Minister consent (s 11(6)).

Ministerial functions and powers (ss 20-24) , The Minister must identify suitable land and establish and maintain greenways (s 20). The Minister can inspect and survey land, fix markers, erect and maintain structures and facilities, and acquire land or easements by agreement (s 21). Entry for inspection requires the owner’s or occupier’s consent (s 21(2)). The Minister may delegate functions except the recommendation to the Governor for a proclamation and the power of delegation itself (s 24).

Authorised officers and enforcement (ss 25-29) , The Minister appoints authorised officers (s 25). Police, forest wardens and National Parks wardens are authorised officers by operation of the Act (s 26). Authorised officers may question persons, make records, require names/addresses, direct removal from a greenway, and, where conferred, exercise power of arrest for non‑compliance (s 27, s 29). There are express offences for obstructing officers, failing to comply or using abusive language (s 28).

Interaction with other statutory planning and native title frameworks (ss 4, 9, 10, 15(3), 23(3)) , The Act is stated to be additional to other Acts (s 4). The exercise of functions and public rights in relation to greenways is subject to approved management plans under other Acts (s 9(3)). Declarations and access arrangements are subject to native title existing when made (s 10; s 15(3); s 23(3)).

Regulatory and administrative scaffolding (ss 18, 19, 30-36) , Access agreements must be noted on title to operate under the Act (s 18). The District Court can enforce agreements and make interim orders (s 19). Gifts to the Minister must be used for greenway purposes unless refused (s 30). Fees collected are applied to administration (s 32). Regulations may govern detailed use, safety, impounding, vehicle prohibition, camping, structures, fees and penalties (s 36(2)).

These concepts create a regime blending land‑use instruments (access agreements and easements), ministerial administrative control (proclamations, closures, delegation), permissive public access with limited fee recovery for commercial uses, and enforcement through authorised officers and court remedies.

The Act allocates rights, obligations and discretion among several identifiable groups. Who pays, who decides and who must act are determinative.

• The Minister and Crown agencies. The Minister has lead responsibility: recommending proclamations to the Governor, identifying suitable land, establishing and maintaining greenways (s 20), entering agreements and acquiring easements or land by agreement (s 21(c)), erecting facilities and installing signage (s 21(b)), delegating functions (s 24) and administering fees and penalties (s 32). The Minister may also accept gifts (s 30). The Minister’s decisions trigger obligations on others and shape practical implementation.
• Owners and occupiers of private land. Private landowners who consent to access agreements are directly affected: they may become parties to an access agreement that attaches to the land and binds successors (s 14, s 15(1)-(2)). Access agreements may include indemnities, waivers, acknowledgements or disclaimers of liability and obligations to indemnify for legal defence costs (s 16). Access agreements must be noted against title to have effect under the Act (s 18), and a current owner is a party to the agreement (s 15(1)). Owners also face restrictions where a greenway is proclaimed over their land: their rights and management functions are subject to the Minister’s functions and the public right of use in accordance with the Act (s 9(2)).
• Persons with legal interests in land (including mortgagees). Access agreements require that “all other persons with a legal interest in the land” consent before an owner may enter into an access agreement (s 14). An access agreement is binding on persons who have an interest in the land (s 15(2)), but the agreement does not, by noting, create an interest under the Real Property Act (s 18(4)), and is not discharged by power of sale or foreclosure (s 18(5)). This affects lenders, purchasers and other parties with proprietary interests.
• Councils and local government. Land vested in or under the care, control or management of a council is eligible to be declared a greenway (s 5(2)(d)). Where a greenway is declared over public land, the Minister and the Minister, agent or instrumentality of the Crown or the council or other person in whom the land is vested must have an agreement and the proclamation must conform to that agreement (s 5(3)). Councils therefore negotiate terms that bind the proclamation and may be constrained by greenway uses (s 9(1)).
• Pastoral lessees. Land held from the Crown under a pastoral lease is eligible (s 5(2)(c)), but the Act treats public land held under a pastoral lease as vested in the relevant Minister or party for certain purposes (s 3(2)(a)). Special procedural and substantive rules apply: the Minister must serve notice on pastoral lessees during consultation (s 7(2)) and where the greenway forms part of a pastoral lease but is not a public access route under the Pastoral Land Management and Conservation Act, persons must give the lessee notice before entering and cannot travel by horse without the consent of the administering Minister or the lessee (s 11(6)).
• Members of the public and commercial users. The public have an entitlement of access and use in accordance with the Act and the proclamation (s 11(1)); fees are generally not payable for access (s 11(4)), though fees may be prescribed for use of facilities or commercial/tour operator use (s 11(5), s 36(2)(m)). Users must comply with proclamations, closures and regulations; unauthorised entry/use and entering closed greenways are offences with fines and expiation fees (s 13).
• Authorised officers and enforcement personnel. The Act empowers the Minister to appoint authorised officers (s 25). Police, forest wardens and National Parks wardens are authorised officers by operation of the Act (s 26). These officers exercise powers to question, record, require names/addresses and remove persons for limited periods (s 27); they can be given arrest powers by their instrument of appointment (s 25(4), s 29). Persons interacting with authorised officers are subject to criminal liabilities for hindering, obstructing or failing to comply (s 28).
• The Consolidated Account / State finances. The Act contemplates the State paying amounts the Minister is liable to pay under indemnities or acknowledgements in access agreements from the Consolidated Account (s 16(5)). Fees collected under the Act are to be applied by the Minister in administration of the Act (s 32(1)). Thus both private indemnities and public liabilities are explicitly connected to State finances.
• Registrar‑General and title system. The Registrar‑General must make notes against titles, leases or Crown instruments before access agreements have effect under the Act and may impose requirements and fees for noting (s 18). Noting under this Act does not create an interest under the Real Property Act (s 18(4)), but also is not discharged by power of sale or foreclosure (s 18(5)), creating a particular interaction between the statutory regime and the ordinary land title system.

In short, the Act centrally affects the Minister and Crown agencies, private landowners and persons with interests in land, councils, pastoral lessees, the general public and regulated commercial users, authorised officers and the title registry. Each group faces discrete statutory consequences: acquisition or limitation of rights, consultation obligations, potential liabilities, regulatory duties and enforcement exposure.

The Act assigns specific duties to actors and confers statutory rights on others. Below are the principal duties, rights and the statutory provenance.

Ministerial duties and powers

• Duty to identify, recommend and establish greenways. The Minister’s functions are to identify suitable land and to establish and maintain greenways for the benefit of the public and visitors (s 20). The Minister recommends proclamations to the Governor (s 5(1)).
• Duty to consult and have regard to submissions. Before recommending a proclamation the Minister must publish a notice in the Gazette and newspapers (statewide and local) setting out location, purpose and any other information, invite written submissions (minimum 21 days) and have regard to submissions (s 6). The Minister must serve adjoining private owners and pastoral lessees with the notice where appropriate and have regard to their submissions (s 7).
• Power to prescribe closures and give notice. The Minister may temporarily close a greenway for maintenance, at the request of the landowner, for safety, or in an emergency (s 12(2)). Notices of closure must be published in a newspaper circulating generally throughout the State, except where an alternative route is provided or a short closure occurs (s 12(3)-(4)). Signs at entry points are required to the practicable extent (s 12(6)).
• Duties to conform proclamations to existing agreements and management plans. Where greenways are declared over public land, proclamations must conform to agreements with the person in whose care or management the land rests (s 5(3)). The Minister’s exercise of functions and public rights are subject to approved management plans under other statutes that apply to the land (s 9(3)).
• Power to make access agreements and acquire easements or land by agreement. The Minister may enter into access agreements with private landowners (s 14), and may acquire land or easements by agreement for the Act’s purposes (s 21(c)). Easements acquired for greenway purposes are easements in gross and are subject to native title (s 23).

Rights of the public

• Right of access to greenways. Members of the public and visitors are entitled to access and use a greenway in accordance with the Act and the proclamation (s 11(1)). This right is subject to prohibitions in other Acts and to closures (s 11(2)-(3)).
• Limited fee protection. The Act disallows fees or charges under the Act or any other Act for access to or use of a greenway (s 11(4)). However the Act explicitly preserves the power to prescribe fees for the use of huts/camping facilities and commercial tour or other commercial use (s 11(5); s 36(2)(m)).

Duties and rights of private landowners and parties to access agreements

• Consent duty before entry into agreement. An owner may enter into an access agreement only if all other persons with a legal interest consent (s 14).
• Attachment and binding effect. Access agreements attach to the land and the current owner is a party; they are binding on persons who subsequently have an interest in the land, subject to native title existing when the agreement was made (s 15(1)-(3)). An access agreement remains in force even if land ceases to be private land for any reason (s 15(4)).
• Noting requirement. An access agreement or variation has no force under the Act until noted by the Registrar‑General against the relevant instrument of title or similar land record; applicants must comply with Registrar‑General requirements and pay a fee determined by the Minister (s 18(1)-(3)).
• Liability and indemnity terms permitted. Access agreements may contain indemnities, waivers or acknowledgements of liability, and may require a party to indemnify another for costs defending proceedings. The Minister’s liability under such terms is payable from the Consolidated Account (s 16(1)-(5)). Parties may extend those terms to benefit non‑parties who may enforce them (s 16(3)).

Duties of authorised officers and procedural safeguards

• Appointment and identity. The Minister appoints authorised officers and must issue identity cards in ministerially approved form; appointments may be for a limited period and subject to conditions limiting where powers apply (s 25(1)-(3), (5)).
• Specific powers and constraints. Authorised officers may ask questions, record information, require names and addresses of suspects of offences, take photographs/recordings, direct persons to leave and refrain from re‑entering for up to 24 hours (s 27(1)(a)-(d)). They must produce identity or warrant cards on request (s 27(4)).
• Criminal obligations and arrest. It is an offence to hinder or obstruct authorised officers or to fail to comply with directions (s 28); authorised officers may be granted arrest powers by instrument and may arrest without warrant for specified breaches (s 29).

Court enforcement and remedies

• District Court enforcement. Parties to access agreements can apply to the District Court where a party believes another has contravened terms. The Court may order specified compliance, rectification, compensation or other appropriate relief; interim orders may be made, including ex parte, on terms the Court sees fit (s 19).

Other statutory rights and obligations

• Restrictions on conduct from greenways. It is an offence to enter private land from a greenway in possession of a firearm or while accompanied by a dog brought onto the greenway, and a person who brought a dog onto a greenway must not permit the dog to enter private land from the greenway; permission from the owner/occupier is a defence (s 31).
• Regulations and delegated rule‑making. The Governor may make regulations to regulate use and enjoyment of greenways, safety, impounding animals, vehicle prohibition, camping, structures, fees and penalties of up to $1 250 (s 36(1)-(2)(n)).

These duties and rights distribute operational control to the Minister and the public access right to users, while embedding private owners’ consent and title‑note procedures. Liability and indemnity clauses are expressly permissible but carry a fiscal consequence for the State under s 16(5). The Act therefore creates a transactional architecture: negotiation/consent (access agreements or easements), official proclamation, public access and delegated regulation and enforcement.

The Act sets out a mix of civil and criminal enforcement mechanisms. They range from administrative remedies and civil court orders for contractual non‑performance to criminal offences with monetary penalties and powers of arrest for vessel non‑compliance with officer directions.

Criminal offences, penalties and expiation

• Unauthorised entry/use and entry to closed greenways. A person who, without lawful authority, enters or uses a greenway in contravention of the Act (including the proclamation) is guilty of an offence with a maximum penalty of $1 250 and an expiation fee of $160 (s 13(1)). Entering a greenway that is closed without lawful authority is an offence with the same maximum and expiation fee (s 13(2)). The Act specifies categories of persons who have lawful authority to enter closed greenways (owner/occupier, person in whom public land is vested/care/management sits, a person authorised by those persons, and the Minister or a person authorised by the Minister) (s 13(3)).
• Trespass from greenway with firearm or dog. Entering private land from a greenway in possession of a firearm, or being accompanied by a dog that the person had brought onto the greenway, is an offence (s 31(1)), with maximum penalty $1 250 and expiation $160. Allowing a dog brought onto a greenway to enter private land is also an offence (s 31(2)), same penalties; permission of the owner or occupier is a defence (s 31(3)).
• Obstructing authorised officers and related conduct. A person who without reasonable excuse hinders or obstructs an authorised officer, fails to answer questions put by an authorised officer to the best of their knowledge, fails to comply with a requirement or direction, uses abusive, threatening or insulting language or falsely represents themselves as an authorised officer commits an offence (s 28). Maximum penalty is $5 000 with an expiation fee of $315.
• Conduct by authorised officers. An authorised officer or assistant who addresses offensive language or, without lawful authority or a reasonable belief in lawful authority, hinders or obstructs or uses or threatens force against another person commits an offence with maximum penalty $5 000 and expiation fee $315 (s 27(5)).

Enforcement powers and arrest

• Powers of authorised officers. Authorised officers may ask questions about administration of the Act, take photographic or audio/video records, require suspected offenders to state full name and usual place of residence and require evidence if the name/address is suspected to be false (s 27(1)-(2)). They may direct persons they reasonably suspect have committed an offence to leave the greenway via a specified route and not re‑enter for up to 24 hours (s 27(1)(d)). They must produce an identity card or, for police, a warrant card on request (s 27(4)). The Minister may appoint authorised officers with the power of arrest in the instrument of appointment (s 25(4)).
• Power of arrest. An authorised officer may, without warrant, arrest a person who without reasonable excuse fails to comply with a requirement or hinders an officer in exercising powers under the Act, subject to the appointment instrument conferring that power (s 29(1), (3)). Arrested persons must be taken as soon as possible to the nearest police station with continuous custody facilities (s 29(2)).
• Proceedings for offences. Proceedings may be commenced by an authorised officer or by any other person authorised in writing by the Minister (s 34(1)). A document purporting to be under the Minister’s hand is prima facie proof of authorisation until the contrary is shown (s 34(2)).

Civil enforcement and contract remedies

• District Court remedies for access agreements. A party to an access agreement may apply to the District Court where the other party is alleged to have contravened the agreement (s 19(1)). The Court may order specified action to comply, rectification, compensation for loss or damage, and other appropriate orders. The District Court can make interim orders (including without notice and on conditions) to preserve rights or interests pending determination (s 19(2)-(3)).
• Noting and title consequences. An access agreement has no effect under the Act until noted by the Registrar‑General (s 18(1)). Noting does not create an interest in land nor give rights under the Real Property Act (s 18(4)), but an access agreement noted is not discharged by power of sale or foreclosure under the Real Property Act or other Acts (s 18(5)). This makes enforcement against new owners possible through contractual and statutory mechanisms rather than through proprietary title changes.

Administrative enforcement and regulation

• Regulation‑making power. The Governor may make regulations to govern practically every aspect of greenway use (s 36(1)). Regulations may prescribe penalties not exceeding $1 250 for breach of regulations (s 36(2)(n)). Regulations can, for example, prohibit firearms, restrict vehicles, regulate camping, impound animals, and prescribe fees for use of facilities and commercial operations (s 36(2)(a)-(m)).
• Fees and penalties applied to administration. Fees collected and penalties recovered are to be paid to the Minister and applied by the Minister in administering the Act (s 32(1)). The Registrar‑General fee for noting an access agreement is an exception (s 32(2); s 18(3)(c)).

Observations on enforcement design

• Criminal fines and expiation fees are modest. Monetary penalties for most breaches are capped at $1 250 with modest expiation fees ($160), while obstructing authorised officers carries a higher fine ($5 000; expiation $315) (ss 13, 28). This suggests the Act favours small pecuniary sanctions and administrative remedies over punitive sanctions.
• Delegation and private initiation of proceedings. The Minister can authorise persons in writing to commence proceedings (s 34(1)). Documents purporting to be signed by the Minister are prima facie proof of authorisation (s 34(2)), expanding avenues for enforcement beyond public prosecutors and authorised officers.
• Arrest power is controlled and conditional. The Act allows arrest without warrant for non‑compliance, but only where explicitly conferred in the appointment instrument; otherwise the power does not arise (s 25(4), s 29(3)). Arrests must be promptly brought to police custody facilities (s 29(2)).

In short, enforcement combines modest criminal sanctions and expiation options, administrative regulation, civil contractual remedies via the District Court, and empowered authorised officers with conditional arrest authority. The Act leaves practical enforcement contours to delegated regulations and ministerial instruments, intending administrative manageability and the preservation of public access.

The Act explicitly situates itself within the existing statutory framework and provides specific cross‑references and limits that shape interplay with other South Australian statutes and the title system. The primary statutory interactions are the Real Property Act 1886, Pastoral Land Management and Conservation Act 1989, Forestry Act 1950, National Parks and Wildlife Act 1972, Coast Protection Act 1972, Wilderness Protection Act 1992, and Local Government Act 1999. The Act also engages native title.

Express non‑derogation and application alongside other Acts

• The Act states that unless a contrary intention appears it is in addition to, and does not derogate from, other Acts (s 4). That formulates the Act as an overlay rather than a replacement of other statutory regimes, except where the Act contains specific overrides.

Real Property Act and title consequences

• Noting access agreements without creating an interest. An access agreement must be noted by the Registrar‑General to have force under this Act (s 18(1)-(2)). The Act explicitly provides that noting does not give rise to an interest in land and does not give rights under the Real Property Act 1886 (s 18(4)). Yet the Act also states an access agreement noted under this section is not discharged by power of sale or foreclosure under the Real Property Act or by power of sale under any other Act (s 18(5)). This creates a parallel contractual and statutory mechanism that binds successors in title but falls short of creating a property interest recognised as such under the Real Property Act. Drafting therefore reserves the title register’s formal proprietary mechanisms while achieving enforceability through statute and contract.
• Easements and modification of Real Property Act operation. Section 23 states that despite the Real Property Act, an easement acquired under s 21 for greenway purposes entitles the Minister, as against all other persons who have an interest in the land, to establish and maintain a greenway according to the Act. The easement is in gross (s 23(2)). This is an express legislative adjustment of the ordinary operation of easement law under the Real Property Act to give the Minister statutory priority for greenway purposes and to clarify the nature of the easement.

Pastoral Land Management and Conservation Act 1989

• Special rules and vesting for pastoral lease land. The Act treats public land held under a pastoral lease or licence as vested in the Minister, agent or instrumentality party to the lease for the purposes of the Act (s 3(2)(a)). Greenways over pastoral lease land are possible (s 5(2)(c)), but the Act also includes special protections: before recommending a proclamation the Minister must serve notice on the pastoral lessee (s 7(2)); and where a greenway forms part of a pastoral lease but is not a public access route within the Pastoral Land Management and Conservation Act, users must notify the lessee before entry and require consent to travel by horse (s 11(6)). These provisions create a layering: the Act’s greenway rights must be balanced with pastoral management regimes and lessee consent protocols where the Pastoral Land Act’s public access route concept does not apply.

Forestry Act 1950 and National Parks and Wildlife Act 1972

• Authorised officers and management plans. Forest wardens and National Parks wardens are authorised officers for greenway purposes (s 3(1) definitions; s 26(1)-(2)), though their powers are geographically limited to reserves where they exercise powers under their home Acts unless appointed specially under the Recreational Greenways Act (s 26(2)). The Act also conditions Ministerial performance of functions and public rights on approved management plans under the Coast Protection Act 1972, adopted plans under the National Parks and Wildlife Act 1972 and the Wilderness Protection Act 1992 where they apply (s 9(3)). Thus existing reserve management planning frameworks continue to constrain greenway operation.

Local Government Act 1999 and councils

• Councils as land managers. Land vested in, or under the care, control or management of, a council is eligible for greenway proclamation (s 5(2)(d)). Where greenways are declared over public land the proclamation must conform to agreements with the person in whom the land is vested or who has care or management, which will often be a council (s 5(3)). Therefore intergovernmental agreements with councils determine many practical operating arrangements.

Native title

• Subject to existing native title. The Act makes multiple references that decrees are subject to native title existing over the land when the proclamation, easement or access agreement is made (s 10; s 15(3); s 23(3)). The Act does not set out a scheme for future native title claims or compulsion where native title arises later; it simply preserves existing native title rights at the time of the instrument.

Management plans and other Acts

• Managerial hierarchy. The Act provides that Ministerial functions and public rights to use a greenway are subject to approved management plans under other statutes (s 9(3)). This means a greenway proclaimed over land that is subject to an approved coastal, park or wilderness plan will be operated in a manner consistent with that plan, constraining some ministerial discretion.

Regulations and their interaction

• Regulations may supplement or limit user conduct and fees. Section 36 authorises regulations governing the use and enjoyment of greenways, permitting animals, safety, impounding animals, vehicle prohibitions, prohibition on firearms, camping, erection of structures, fees for facilities and commercial use and penalties not exceeding $1 250 (s 36(2)). Regulations will therefore be the practical instrument for detailed cross‑statutory coordination and limits.

Other interactions and procedural consequences

• Noting versus proprietary change. The Act intentionally keeps access agreements outside the Real Property Act’s scheme while ensuring they continue to bind successors (s 18(4)-(5), s 15(2)). Mortgagees, purchasers and foreclosure processes thus interact with access agreements in a more contractual/statutory way than through title reclassification.
• District Court enforcement operating alongside criminal sanctions. The Act separates civil contractual enforcement (District Court orders against contractually bound parties, s 19) from criminal offences for unauthorised use (s 13) and obstructing authorised officers (s 28). Parties can therefore pursue both remedies in different forums.

Taken together, the Act is framed to coexist with, and in specific cases to override or qualify, existing property and land management regimes. The Act both defers to existing management plans and native title where they exist, and establishes statutory priority for greenway easements and access agreements in ways that are legally consequential but not characterised as transfers of proprietary title under the Real Property Act.

The Act’s textual history, as recorded in the Act’s legislative history notes, is sparse but concrete. The legislative history section in the text provides specific amendments and omissions.

• Original enactment. The Recreational Greenways Act 2000 (No 61 of 2000) received assent on 27 July 2000 and commenced on 16 November 2000 (Gazette 16.11.2000 p3196). The Act’s long title and initial provisions established the greenways regime (Legislative history).
• 2006 amendments. The Statutes Amendment (New Rules of Civil Procedure) Act 2006 (No 17 of 2006) amended provisions of the Recreational Greenways Act. The legislative history notes that s 19(3) was amended by s 204 of the 2006 Act and that various textual clean‑ups were made under the Legislation Revision and Publication Act 2002 with effect on 4 September 2006 (Legislative history). The text lists certain provisions as omitted or varied under the Legislation Revision and Publication Act 2002 on 4.9.2006 (for example, s 2 omitted), and records s 19(3) amended by 17/2006 s 204 with the same commencement date noted in the schedule to that amending Act.
• 2025 entry. The legislative history records the Biodiversity Act 2025 (No 29 of 2025), assented 26 June 2025, with Schedule 5 (clauses 91 to 94) uncommenced as relevant to this Act (Legislative history). The entry states those clauses are uncommenced; no text in the principal Act shown in the supplied version incorporates those amendments.
• Legislation Revision and Publication Act 2002 adjustments. The Act’s long title and other textual elements were amended under the Legislation Revision and Publication Act 2002 with effect 4 September 2006 (Legislative history, “Long title amended under Legislation Revision and Publication Act 2002”).
• Principal Act table. The legislative history includes a tabulated record where new entries appear in bold, showing the principal Act (2000 No 61) and the 2006 amendment (No 17), and the 2025 Biodiversity Act entry as noted above. The table lists which provisions were varied or omitted and gives commencement dates.

Operational consequences of the amendment record

• The Act has had targeted amendments rather than wholesale reworking. The recorded amendments are precise and limited (s 19(3) amendment in 2006, and textual revisions under revision legislation). The presence of later uncommenced amendments in the Biodiversity Act 2025 indicates further legislative interaction may be intended but not in force in the version supplied.
• Uncommenced provisions. The legislative history explicitly notes that amendments of the listed version that are uncommenced are not incorporated into the text. The 2025 entries in the schedule were uncommenced at the time the legislative history was prepared; practitioners should check the current South Australian legislation register and Gazette to confirm commencement for any 2025 or later amendments.

Practical note for users

• Always check contemporaneous statute versions. The Act’s legislative history indicates that amendments and revisionary alterations have occurred. For current advice or transactional work, one must verify the operative text on the South Australian legislation website or the Gazette and confirm whether any listed but uncommenced amendments (for example in 2025) have since commenced.

The supplied legislative history is the sole source for recorded amendments in the text provided. It does not list case law or interpretive controversies, only specific amending Acts and revision actions. For authoritative amendment status, consult the Government Gazette and the consolidated statute database.

The Act text supplied does not name or summarise any judicial decisions. The legislative text includes no reported case law or judicial interpretation, and the legislative history supplied concerns statutory amendments rather than court decisions.

What the Act records and what it does not

• No cases are mentioned in the Act. Unlike some statutes that incorporate case law or provide illustrative judicial guidance, this Act contains none.
• The Act provides court access for enforcement of access agreements (District Court jurisdiction, s 19) but records no litigation outcomes or appellate treatments.
• The Act does not include transitional provisions summarising litigation or precedent.

Implications for practitioners

• Absence of named cases in the Act text does not mean there is no litigation history. The Act predates 2026, and it may have been the subject of litigation in South Australian courts or elsewhere. The supplied text simply does not contain any annotated case references.
• Recommended research steps. For authoritative analysis of how courts have interpreted or applied particular provisions (for example, the effect of noting access agreements under s 18, the meaning of “subject to native title” in s 10, the scope of easements in gross under s 23, or the limits on authorised officers’ powers under ss 27-29), practitioners should search:
  • South Australian District Court and Supreme Court databases for proceedings mentioning the Recreational Greenways Act 2000.
  • AustLII and commercial legal research services for judgments, including interlocutory orders under s 19.
  • Administrative tribunal decisions if any administrative reviews or challenges were brought against Ministerial proclamations or closures.
• Prudential approach. In areas where the Act intersects with property rights, native title and management plans under other Acts (s 9(3), s 10, s 15(3), s 23(3)), case law is likely the primary source of detailed interpretive guidance. That may include disputes over the effect of noting on title, the enforceability of indemnity clauses in access agreements, the boundaries of authorised officers’ powers, or the allocation of liability where public use is permitted.

Concluding note

• Because the Act text itself contains no litigation summary, any litigation history must be assembled from external sources. The Act, however, establishes mechanisms that are litigation‑relevant: District Court enforcement (s 19), obligations to note agreements (s 18), and interaction with other statutory regimes (ss 4, 9, 10, 23) that create fertile ground for disputes. Practitioners should therefore treat the absence of cases in the text as a prompt to conduct targeted case law research before relying on contested provisions.

The Act contains several provisions that may produce counter‑intuitive legal outcomes or practical risks if overlooked. These are concrete operational pitfalls grounded in the text.

Noting requirement: an access agreement has no force until noted (s 18(1)-(2))

• Practical effect. Parties may sign an access agreement but it will not have any force or effect under the Act until the Registrar‑General has made the required note on the instrument of title (or equivalent land record for unregistered land or Crown lease) (s 18(2)). The application must be in a form approved by the Registrar‑General, comply with any Registrar‑General requirements and be accompanied by a ministerially determined fee after consultation with the Registrar‑General (s 18(3)). Failure to note risks that the access agreement does not achieve the statutory attachment and the protective features of the Act.
• Operational risk. A signed but unnoted access agreement can expose both the Minister and the private owner to disputes about enforceability and create uncertainty for third‑party purchasers or lenders.

Access agreement attaches and binds but is not a proprietary interest under the Real Property Act (s 15(1), s 18(4)-(5))

• Unusual hybrid effect. Noting does not create an interest under the Real Property Act (s 18(4)), but an access agreement is binding on persons with an interest and is not discharged by power of sale or foreclosure under the Real Property Act (s 15(2), s 18(5)). This means successors in title are bound contractually/statutorily despite the access agreement not being a registered proprietary interest in the ordinary sense.
• Implications for lenders and purchasers. Mortgagees may not see a conventional recorded proprietary encumbrance but are still subject to an operative access agreement once it is noted and therefore face contractual liabilities and limitations. This can complicate financing and conveyancing unless flagged and accommodated.

Ministerial consent and landowner limits (s 21(2), s 14)

• Entry for inspection requires consent. The Minister may inspect or survey land to determine suitability for a greenway but only with the consent of owner or occupier (s 21(1)(a), s 21(2)). This means informal or unilateral entry by the Minister for surveying private land is constrained.
• Full legal interest consent required. An owner may enter into an access agreement only if all other persons with legal interests consent (s 14). Chain of title complexities can therefore stall access agreements until all interest holders consent.

Easements in gross and statutory priority (s 23)

• Easement character and limits. Easements acquired are easements in gross; they do not benefit a dominant tenement (s 23(2)). Section 23(1) gives the Minister statutory entitlement, “as against all other persons who have an interest in the land,” to establish and maintain a greenway in accordance with the Act. While this is declaratory, it may create unusual priority relationships not typically expected under the Real Property Act.
• Native title carryover. Easements are subject to native title existing at acquisition time (s 23(3)), which may limit the Minister’s intended use if native title was extant.

Public right vs. other statutory prohibitions and closures (s 11(2)-(3), s 12)

• Access is qualified. The statutory entitlement in s 11(1) is subject to other Acts that may prohibit entry and to closure periods (s 11(2)-(3)). Users cannot assume unlimited access; closures for maintenance, safety or emergency are permitted and may be implemented with post‑closure notice in some instances (s 12(2)-(4)).
• Pastoral lease complications. Where a greenway is on pastoral lease land and is not a public access route under the Pastoral Land Management Act, users must give the lessee notice before entering and need consent to ride horses (s 11(6)). That can limit the recreational uses the greenway appears to permit.

Indemnities and state fiscal exposure (s 16)

• Access agreements may contain indemnities. The Minister may enter agreements including indemnities and waivers; where the Minister is liable under an indemnity the amount is payable from the Consolidated Account (s 16(1), (5)).
• Fiscal risk. Allowing access agreements to include indemnities (s 16) shifts potential cost to the State rather than leaving it entirely private. Agreement negotiators must consider that the Commonwealth’s or State’s balance sheet, rather than a private insurer, may be the backstop for claims.

Authorised officer powers and evidentiary framing (ss 25-29, s 34)

• Broad practitioner powers with limited procedural safeguards in the Act. Authorised officers can require names, direct persons to leave for up to 24 hours and may be conferred power of arrest (s 27(1)(c)-(d), s 25(4), s 29). The Act lacks in‑text detailed procedural safeguards for questioning and records beyond identity production on request (s 27(4)) and the general defence of unintentional conduct (s 33). Practitioners should plan for compliance protocols and evidential preservation when authorised officers act.
• Third‑party commencement of proceedings. Proceedings for offences may be commenced by any person authorised in writing by the Minister (s 34(1)), with the Minister’s purported authorisation being prima facie evidence (s 34(2)). This delegation can create enforcement actions by non‑public prosecutors, raising the risk of uneven enforcement if ministerial authorisation is not carefully controlled.

Regulations may alter practical entitlements and penalties (s 36)

• Broad regulatory reach. The Governor may make regulations on use, safety, animals, impounding, vehicles, camping, structures, fees and prescribe penalties up to $1 250 (s 36(2)). Practical operational rules and fee regimes for commercial use will therefore be determined by regulation rather than primary text.
• Risk of shifting obligations. Stakeholders should track subordinate legislation since it may implement significant constraints (for example, prohibiting certain vehicles or requiring permits for commercial tour operators) that materially alter how a greenway works.

Native title caveats (s 10, s 15(3), s 23(3))

• Only protects existing native title at instrument time. Declarations and access arrangements are subject to native title existing when the instrument is made (s 10, s 15(3), s 23(3)). The Act does not specify a scheme for subsequent native title claims or extinguishment, leaving legal uncertainty if native title arises later or if claims proceed. Due diligence on native title is therefore essential.

Registrar‑General fee and procedural friction (s 18(3)(c), s 32(2))

• Noting requires an application fee determined by the Minister after consultation with the Registrar‑General (s 18(3)(c)). While fees collected under the Act are generally applied to administration (s 32(1)), Registrar‑General fees are excluded (s 32(2)), implying a separate funding stream and potential transactional cost.

These are the primary “gotchas” likely to surprise parties who rely on plain reading of the greenway concept rather than the detailed statutory mechanics. Practical parties should approach access agreements and proclamations with care: ensure noting on title, secure consents from all interest holders, account for native title and pastoral lease constraints, be mindful of indemnity terms, and track regulations and ministerial instruments that operationally define the regime.

Compliance under the Act is transactional and administrative: it requires attention to procedural steps, documentation, consultation obligations and regulation-driven detail. Below is a pragmatic compliance checklist for principal actors: the Minister/agency, private landowners, councils and authorised officers.

For the Minister and administering agencies

1. Preliminary assessment and consultation

   • Identify suitable land consistent with statutory categories (s 5(2)); review whether the land is unalienated Crown land, vested land, pastoral lease, council land, dedicated land or private land eligible under an access agreement or easement.
   • Check applicable management plans under the Coast Protection Act, National Parks and Wildlife Act or Wilderness Protection Act that may constrain use (s 9(3)).
   • Check for existing native title over the land; the Act makes proclamations and access agreements subject to native title existing at the time (s 10, s 15(3), s 23(3)).

2. Consultation and notice

   • Prepare a Gazette notice and newspaper notices (statewide and local where the greenway is proposed) that specify location, purpose(s) and other material information and provide at least 21 days for written submissions (s 6(1)(a)). Ensure service on adjoining private landowners and pastoral lessees where relevant (s 7).

3. Agreements and acquisitions

   • Where private land is involved, secure consent of all persons with legal interest before entering an access agreement (s 14).
   • If an easement or land purchase is required, acquire by agreement (s 21(c)). Ensure any access agreement or easement is drafted to conform with the terms required for any contemplated proclamation (s 5(3), s 5(6)).
   • Carefully structure indemnity clauses. If the Minister accepts indemnities that could create payment liabilities, ensure adequate budgetary processes given s 16(5) states amounts payable under such terms are payable from the Consolidated Account.

4. Proclamation drafting and conformity

   • Prepare the Governor’s proclamation containing identification, specified purpose(s) and name, and any terms and conditions on use and closures (s 5(4)-(5)). Ensure the proclamation conforms to the access agreement or easement where private land is involved (s 5(6)) and to any agreement with the public land manager (s 5(3)).

5. Registrar‑General noting and fees

   • Require parties to apply to the Registrar‑General to note access agreements or variations. Ensure the application is in the approved form, meets Registrar‑General requirements and includes the fee determined by the Minister after consultation (s 18(2)-(3)).

6. Operational management and closures

   • For temporary closures, follow s 12(2) reasons (maintenance, at owner request, safety, emergency) and notification obligations (s 12(3)-(6)). Place signage at entry points where practicable (s 12(6)).
   • Maintain records of consultation, submissions and notices to back up statutory compliance.

7. Authorised officer appointments

   • Appoint authorised officers by written instrument identifying powers and, if arrest powers are intended, include express conferral of arrest authority (s 25(1)-(4)). Issue identity cards in approved form and maintain records of appointments and identity material (s 25(5)).

For private landowners considering access agreements

1. Confirm consent and chain of title

   • Establish who has legal interests in the land; the owner may only enter into an access agreement if all other persons with legal interests consent (s 14). Obtain written consents from mortgagees, lessees, covenanted parties or other interest holders.

2. Draft and negotiate access agreement terms

   • Decide whether to include indemnities, waivers or acknowledgements. Be aware that the Minister can contractually accept indemnities and where the Minister is liable the State will pay out of the Consolidated Account (s 16(1), (5)).
   • Consider including or negotiating protections for successors, insurance provisions, maintenance obligations and dispute resolution clauses.

3. Noting and fees

   • Apply for Registrar‑General noting promptly after agreement execution; an access agreement has no force under the Act until the note is entered (s 18(1)-(2)). Prepare to pay the Registrar‑General fee determined by the Minister (s 18(3)(c)).

4. Conveyancing and lender engagement

   • Alert prospective purchasers and mortgagees to the access agreement’s binding nature despite it not being a proprietary interest under the Real Property Act (s 18(4)-(5)). Incorporate disclosure into sale documents and liaise with lenders to secure consent where required.

5. Ongoing compliance

   • Comply with the terms of the access agreement and be prepared to litigate or respond to District Court enforcement under s 19 if disputes arise. Consider insurance and risk management to address liabilities, especially where indemnities are negotiated.

For councils and other public land managers

1. Negotiate agreements before proclamations

   • If land is vested in or under the care/control/management of a council, the Minister and the relevant land manager must enter into an agreement in relation to the declaration and the proclamation must conform to it (s 5(3)). Negotiate terms on use, maintenance, closures, signage, liability and cost sharing.

2. Coordinate management plans

   • Review any applicable management plans under the Coast Protection Act, National Parks and Wildlife Act or Wilderness Protection Act (s 9(3)). Ensure greenway use is consistent with adopted plans and that proclamation terms do not conflict with statutory obligations under other Acts.

For authorised officers and enforcement staff

1. Appointment and identity

   • Ensure formal written appointment instruments are in place, specify any geographic limits or conditions and clarify whether arrest powers are conferred (s 25(1)-(4)). Carry and present identity cards/warrant cards as required (s 27(4)).

2. Exercise of powers

   • Confine questioning and directions to the purposes set out in s 27. If requiring a person to leave the greenway, ensure there are reasonable grounds and specify the route and period (up to 24 hours) as per s 27(1)(d). Obtain and preserve records (photographs, recordings) lawfully when exercised (s 27(1)(b)).

3. Procedural fairness and restraint

   • Avoid abusive language and unlawful obstruction; the Act criminalises offensive language by authorised officers and improper use of force (s 27(5)). Comply with arrest procedures, taking persons to a police station promptly if arrested (s 29).

For tour operators and commercial users

1. Fees and permits

   • Take note that fees may be prescribed by regulation for commercial use or tour operations (s 11(5); s 36(2)(m)). Verify regulatory requirements, apply for necessary permits and plan fee structures into commercial models.

2. Compliance with proclamation and closures

   • Ensure operations comply with proclamation terms and closure notices (s 5(5), s 12). Maintain insurance and safety procedures consistent with any regulatory safety standards (s 36(2)(d)).

Cross‑cutting compliance tasks

• Native title and due diligence. Before concluding agreements or acquiring easements check for native title interests existing at the time of the intended instrument (s 10, s 15(3), s 23(3)). Obtain legal advice and consult the National Native Title Tribunal and relevant registers.
• Document retention. Keep full records of notices, consultation submissions, agreements, Registrar‑General applications and approvals, signage records and closure notices to demonstrate compliance with statutory consultation and notice obligations (s 6, s 7, s 12, s 18).
• Monitor regulations. Because regulations will determine many operational details and fees (s 36(2)(m)), stakeholders should monitor subordinate legislation and gazettes for new or amended rules that affect permitted uses, safety requirements, animal controls and vehicle restrictions.

This compliance roadmap focuses on mechanics the Act prescribes: consultation and notices before proclamation, agreement and consent procedures for private land, Registrar‑General noting for access agreements, alignment with management plans and native title, appointment and training of authorised officers, and vigilance for regulations that will operationalise many day‑to‑day rules.
