Recreation Grounds Regulations 2011

The regulations revolve around a small set of legal concepts that structure allocation of authority, prohibited conduct, and enforcement tools.

Controlling body. The regulations establish the controlling body as the central managerial actor for each ground (s 3(1)). Schedule 1 lists the controlling body opposite each recreation ground, which in practice is a mix of private incorporated bodies, local councils, state agencies, and the Minister. The controlling body has the power to authorise entry, set fees, authorise behaviours otherwise prohibited by the text, designate authorised persons and to delegate functions in writing (s 3(1), s 4(1)).

Authorised person. An authorised person is either a person or body the controlling body has authorised for the purposes of the regulations, or a police officer or special constable (s 3(1)). Authorised persons are the operational enforcers who may ask people to move from walkways, require removal of vehicles or dogs, demand names and addresses, and effect removals where appropriate (ss 7(1), 9(1)-(3)).

Designated entrance and exit. Access is confined to entrances and exits provided by the controlling body (s 5). The legal obligation to use provided entrances and exits converts an administrative decision about site layout into a legally enforceable constraint on user movement.

Fee regime and authorisation. The controlling body may impose entrance fees, and may authorise entry otherwise (s 6). The regulation does not prescribe fares or fee‑setting procedures; it creates the offence of unauthorised entry without payment and leaves tariff design and exemptions to the controlling body.

Behaviour catalogue and graded sanctions. Section 7 sets out a catalogue of prohibited conduct while on a recreation ground. There are lower level public order and amenity offences (litter, distribution of printed matter, smoking in signposted areas) with lower maximum penalties ($250), commercial‑type controls (selling goods, taking collections) and vehicle/dog prohibitions ($250), and higher penalty provisions tied to event integrity and public safety (obstruction of events, damage to property, possession of explosives) with maximum penalties up to $5,000 (s 7(2), (6), (7), (8)).

Removal and investigatory powers. The regulations create two removal mechanisms. A police member or special constable may remove a person reasonably suspected of having committed an offence and bar same‑day re‑entry (s 8). Separately, an authorised person may remove or require removal of vehicles or dogs that breach the regulations or that obstruct events, and may require a name and address from a person reasonably suspected of breaching the regulations (s 9). Refusal to comply with an authorised person is an offence (s 9(3)).

Delegation and revocability. Controlling bodies may delegate powers under the regulations by written instrument, subject to stated conditions, with delegations revocable at will (s 4(1)-(3)). Delegation does not prevent the controlling body from acting in the matter itself, and the regulatory text insists that the power to delegate cannot itself be delegated (s 4(1)-(3)).

Localised scope. The regulations apply only to the lands listed in Schedule 1, which identifies each ground and its controlling body by title and land description (s 3(2), Schedule 1). The statutory reach is therefore discrete and depends on the Schedule remaining current.

Evidential burden for certain defences. For the offence of possessing flares, fireworks, explosives or missiles, lawful excuse is a defence but the regulation places the burden of proof on the person in possession (s 7(8)). The instrument therefore shifts the evidential burden for that particular prohibited item to the defendant.

These concepts convert managerial choices by controlling bodies into enforceable legal prohibitions, allocate enforcement roles between private appointees and state officers, and attach specified fines to noncompliance. The regulations rely on localised administrative control by the controlling body, supported by police powers for on‑the‑spot removal and by written delegations for operational coverage.

These regulations affect three principal groups: visitors to the named recreation grounds, controlling bodies and their authorised agents, and law enforcement officers who have specific removal powers.

Visitors and attendees. Any person entering a recreation ground listed in Schedule 1 is directly affected because the regulations impose entry and behaviour obligations during their presence on the ground (s 3(2), s 5, s 6, s 7). The obligations include using authorised entrances and exits (s 5), paying any applicable entrance fee or obtaining prior authorisation to enter (s 6), and complying with the behavioural prohibitions while present (s 7). Visitors who assist or control dogs are affected by the dog provisions: dogs generally are not permitted unless authorised, but guide dogs are expressly permitted if restrained on a lead no longer than 3 metres (s 7(2)(g), s 7(3)). Persons present during scheduled events are specifically constrained from entering playing fields or staged areas unless they have status as participants, officials, or have controlling body authorisation (s 7(6)).

Controlling bodies. Each entity named opposite a recreation ground in Schedule 1 is the controlling body and therefore responsible for setting entrances and exits, charging or waiving entrance fees, defining authorised persons, placing signage (for example smoking prohibition signs under s 7(5)), authorising otherwise prohibited activities, and delegating powers under s 4(1)-(3). The list in Schedule 1 demonstrates that controlling bodies include local government corporations, incorporated clubs, state agencies and the Minister for Recreation, Sport and Racing (Schedule 1). Those bodies decide what conduct is authorised on their ground, elect who counts as an authorised person, and can delegate operational functions by written instrument (s 3(1), s 4(1)).

Authorised persons and their delegates. Persons authorised by a controlling body, police members and special constables are the individuals authorised to enforce the regulations (s 3(1)). Their powers include asking people to move from walkways and stairs, requiring removal of vehicles or dogs, requiring names and addresses, and removing vehicles or dogs where an owner is not present (ss 7(1), 9(1)-(3)). Delegates appointed under s 4(1) will also exercise functions unless the controlling body revokes the delegation; delegations are revocable and may be conditional (s 4(2)-(3)).

Police, special constables and enforcement agencies. The regulations explicitly give members of the police force and special constables authority to act as authorised persons (s 3(1)) and to remove persons suspected of having committed offences and prohibit re‑entry on the day (s 8). These state actors are therefore empowered to effect immediate exclusion for behaviour reasonably suspected to constitute an offence.

Occupiers, lessees and third parties with occupancy rights. Section 7(7) expressly protects property of the controlling body and also recognises the property rights of persons or bodies granted rights to occupy the recreation ground by lease, licence, contract for hire or other occupancy agreements. Persons who damage or misuse property belonging to those occupiers risk offences carrying a higher maximum penalty (s 7(7)).

Commercial operators and vendors. The prohibitions on selling goods, erecting signs, taking collections, distributing printed matter, and offering articles for sale on a ground save where authorised impose constraints on independent vendors and commercial operators. These actors will need prior authorisation from the controlling body to operate commercially on the grounds (s 7(2)(b), (c), (d), (e)).

Organisers and participants in events. Persons who organise, stage, or participate in sporting events are affected because the regulation prohibits unauthorised access to ovals, playing fields, and event staging areas on days when events are scheduled, except for players, officials or those authorised by the controlling body (s 7(6)). Controlling bodies may therefore manage event access by authorisation.

The effect on these groups is concrete. Visitors who ignore entrances, fail to pay fees, bring prohibited items or obstruct events expose themselves to fines and removal (ss 5, 6, 7, 8, 9). Controlling bodies control operations and enforcement through authorisation, fees, signage and delegation (s 3(1), s 4(1), Schedule 1). Authorised persons and police are the decision makers who impose on‑the‑spot compliance obligations and removals (ss 3(1), 8, 9).

The regulations allocate specific duties to persons on the grounds, duties for controlling bodies, and limited rights to authorised persons and police. Below are the principal operative duties and rights, with section references.

Duties on visitors and users

• Use only entrances and exits provided by the controlling body. Persons must not enter except by an entrance provided (s 5(1)) and must not leave except by an exit provided (s 5(2)). Both are offences with maximum penalties listed in s 5.

• Pay entrance fees or obtain authorisation. A person must not enter a recreation ground, or a part with access restricted by the controlling body, unless the person pays the entrance fee (if any) or is otherwise authorised by the controlling body (s 6).

• Comply with behavioural prohibitions. Section 7 contains a bundle of specific duties: move from a walkway or stairs when requested by an authorised person (s 7(1)); refrain from depositing litter except in receptacles, distributing printed matter, erecting signs, offering articles for sale, taking up collections, driving or riding vehicles, bringing dogs (other than authorised dogs), or climbing structures, unless authorised (s 7(2)); refrain from bringing or consuming intoxicating beverages unless authorised (s 7(4)); comply with smoking prohibitions where signs are erected by the controlling body (s 7(5)); avoid obstructing events or spectators and stay off playing fields/ovals on event days unless a listed participant or otherwise authorised (s 7(6)); refrain from misusing or damaging property of the controlling body or occupiers (s 7(7)); and do not carry flares, fireworks, explosives or missiles without lawful excuse with the evidential burden on the person (s 7(8)).

• Provide identity information when required. A person reasonably suspected of breaching the regulations must truthfully state his or her full name and usual place of residence when required by an authorised person (s 9(2)). Failure to comply without reasonable excuse is an offence (s 9(3)).

Duties on controlling bodies

• Provide entrances and exits. The controlling body is the actor whose provision of entrances and exits engages the s 5 prohibitions. It therefore has the duty of designating entry and exit points if it intends to enforce the entrance/exit rules.

• Set and manage entrance fees. The controlling body decides whether to charge an entrance fee and who is authorised, since s 6 conditions lawful entry on payment or authorisation by the controlling body.

• Appoint authorised persons and maintain signage. The controlling body appoints persons for enforcement purposes under s 3(1). It also erects signage to specify areas where smoking is prohibited, which triggers the s 7(5) offence.

• Delegate functions in writing when required. The controlling body may delegate powers and functions under the regulations in writing, subject to conditions and limits, and must be aware delegations are revocable at will and do not prevent the controlling body from acting (s 4(1)-(3)).

Rights of authorised persons, police and special constables

• Removal and control powers. An authorised person may require removal of vehicles or dogs that are in breach or likely to breach the regulations, and may remove them if the owner cannot be located (s 9(1)). An authorised person may require identification information (s 9(2)). Members of the police force and special constables may remove persons reasonably suspected of committing offences and bar re‑entry that day (s 8).

• Enforcement discretion. The regulations provide maximum penalties for breaches (ss 5-9), leaving enforcement decisions, including whether to charge, fine or remove a person,to authorised persons and police within their operational discretion.

Limited rights of visitors

• Right to bring guide dogs. A narrow right exists for persons who need assistance of a guide dog: they may bring a guide dog onto a recreation ground provided it is restrained on a lead not exceeding 3 metres (s 7(3)).

• Right of lawful excuse for certain items. Possessing flares, fireworks, explosives or missiles is an offence unless the person has a lawful excuse, but the regulation places the burden of proof about that excuse on the person in possession (s 7(8)).

Penalties and enforcement mechanisms are rights for the state to pursue compliance rather than rights of the public. All penalties stated in the regulations are maximums; actual enforcement practice will determine whether regulatory agencies issue fines, prosecute, or rely on removals and informal compliance (ss 5-9). The regulations are silent on procedures for appeal or review of controlling body decisions, including fee-setting and appointment of authorised persons, so procedural protections will arise from general administrative law principles and other statutory regimes rather than from these regulations themselves.

The regulations attach specified maximum monetary penalties to each breach and create on‑the‑spot removal powers for enforcement. The instrument bifurcates enforcement between authorised persons appointed by controlling bodies and state actors, namely police members and special constables.

Maximum penalties by offence

• Entry and exit offences (s 5): A person who enters except by an entrance provided, or leaves except by an exit provided, faces a maximum penalty of $250 for each contravention (s 5(1)-(2)).

• Entrance fee non‑payment (s 6): Entering a ground or restricted part without paying the entrance fee or without authorisation carries a maximum penalty of $500 (s 6).

• Minor amenity and conduct offences (s 7(1), (2), (4), (5)): Remaining in a walkway or on stairs after being asked to move is a maximum $250 penalty (s 7(1)). Actions such as depositing litter except in a receptacle, distributing printed matter, erecting signs, offering articles for sale, taking up a collection, driving or riding any vehicle, bringing a dog, or climbing structures are each an offence with a maximum $250 penalty (s 7(2)). Bringing or drinking intoxicating beverages without authorisation and smoking in areas where signs prohibit it each attract a maximum $250 penalty (s 7(4)-(5)).

• Serious event and safety offences (s 7(6)-(8)): Obstructing or interfering with the conduct of an event or the enjoyment of a spectator, or entering a playing field on a scheduled event day without authorisation, carries a maximum penalty of $5,000 (s 7(6)). Misuse or damage to property of the controlling body or an occupier also carries a $5,000 maximum (s 7(7)). Possessing a flare, firework, explosive device or missile without lawful excuse is an offence with a maximum $5,000 penalty and a reverse evidential burden (s 7(8)).

• Removal re‑entry penalty (s 8): A person removed from a recreation ground by a member of the police force or special constable under s 8 and who returns that day commits an offence with a maximum penalty of $1,250.

• Failure to comply with authorised person (s 9(3)): Refusal or failure without reasonable excuse to comply with a requirement of an authorised person under s 9 (for example, to state name and usual place of residence) is an offence with a maximum $1,250 penalty.

Enforcement powers and mechanisms

• Authorised persons. Persons authorised by the controlling body, and police and special constables, may carry out enforcement actions under the regulations (s 3(1)). Authorised persons may ask a person to move from a walkway or stairs (s 7(1)), require removal of vehicles or dogs that are in breach or likely to interfere with events, and remove such property when the owner is not present (s 9(1)). They may also require identification information from suspects (s 9(2)), with statutory penalties available for non‑compliance (s 9(3)).

• Police and special constables. These officers may remove persons reasonably suspected of committing an offence and bar their re‑entry for that day (s 8). The regulations do not specify the evidential standard beyond "reasonably suspected", nor do they prescribe a fixed administrative process for notice, recording or appeal following removal.

• Delegation. The controlling body may delegate powers and functions under the regulations in writing (s 4(1)). A delegation may be conditional and is revocable at will (s 4(2)-(3)). Delegation expands the pool of individuals or bodies who can exercise enforcement functions, subject to the controlling body’s written instrument.

Scope of enforcement discretion and procedural limits

• Maximum penalties are expressed as maxima, not mandatory fines. The regulations supply ceiling amounts; they do not prescribe graduated or fixed penalty notice amounts, payment pathways, or time limits for prosecution. Enforcement practice will determine the frequency of on‑the‑spot fines, formal prosecutions, or alternative enforcement pathways.

• Evidential burdens. For the offence under s 7(8) involving flares and explosives, the regulation explicitly places the burden of proving lawful excuse on the person in possession. For other offences, the regulations do not alter ordinary evidential or legal burdens.

• Silence on ancillary matters. The regulations do not address administrative processes such as issuing infringement notices, conducting hearings, providing reasons for removal, or recordkeeping. They are silent on liability arising from authorised persons’ actions in removing vehicles or dogs, including any damage caused during removal. They are also silent on appeal mechanisms within the regulations themselves, leaving judicial review and other statutory remedies in other laws as potential remedies.

In short, enforcement is structured around delegated private enforcement assisted by police powers, with monetary sanctions that vary according to the seriousness of the conduct. The exercise of removal powers and the imposition of fines depend substantially on on‑the‑ground discretion by authorised persons and police.

The regulations create a targeted regulatory overlay applicable only to lands listed in Schedule 1 and therefore must be interpreted and applied in the context of broader legal regimes. The text itself signals several points of interaction and recognises rights that arise from other legal instruments.

Reference to occupancy and property arrangements. Section 7(7) expressly recognises property rights of "a person or body that has been granted a right to occupy the recreation ground or part of the recreation ground (whether under a lease, licence, contract for hire or any other agreement for the occupancy of land)". This recognition embeds potential interactions with property, contract and leasing law. Damaging or misusing property of leaseholders or licensees within a ground triggers the regulatory offence, but enforcement of occupier rights and remedies for damage will also engage the terms of the occupancy agreement and general property law.

Delegation and administrative law. The controlling body may delegate powers under s 4. Delegation instruments are written and revocable. Delegation will interact with administrative law principles relating to lawful delegation, the limits of delegated authority, and the responsibilities of delegating entities. The regulations state that delegations do not prevent the controlling body from acting in any matter, so functions may be concurrently exercisable by delegate and delegator (s 4(3)). Any dispute about the validity of a delegation, or the exercise of delegated power, will engage general public law principles and possibly judicial review, although the regulations do not set out an internal appeal process.

Criminal law and public order offences. Several prohibitions overlap with criminal law offences such as property damage, possession of explosives, or assaults. The regulations operate as a separate regulatory prohibition with its own penalties but do not displace general criminal law. For example, possession of explosives without lawful excuse under s 7(8) is an offence with a $5,000 maximum penalty under these regulations, but more serious criminal statutes dealing with explosives and public safety could apply concurrently. The regulations do not specify primacy or interaction rules with criminal statutes.

Police powers and enforcement. The regulations explicitly empower police members and special constables to remove persons suspected of committing offences on the grounds (s 8). This sits alongside police powers under general law. The reasonableness standard for suspicion is invoked in the regulations; how that standard aligns with statutory thresholds in other legislation and common law principles of arrest, detention and removal will be relevant to enforcement practice.

Local government regulations and public space rules. Many controlling bodies are local councils or municipal corporations. The regulations therefore interlock with council by‑laws, land use controls, planning instruments and other local governance regimes that regulate public spaces. The regulations do not provide a mechanism for resolving inconsistencies between local by‑laws and these regulations; ordinary legal principles about inconsistent legislation or overlapping powers will determine outcomes.

Equality, anti‑discrimination and disability law. The regulation contains a specific provision permitting guide dogs restrained on a lead up to 3 metres (s 7(3)). This indicates an interaction with disability access regimes. However, the regulations do not otherwise set out detailed obligations for accessibility or non‑discrimination. Broader statutory obligations under anti‑discrimination or disability access laws would operate independently and could inform the controlling body’s authorisation decisions.

Contractual relations with third parties. The Schedule lists occupiers by name, including clubs and incorporated bodies that may have separate contractual arrangements for events and commercial operations. The regulation’s commercial prohibitions (selling goods, erecting signs) mean that third parties seeking to trade on a ground must secure authorisation from the controlling body, a process that will interact with contractual negotiation and licensing regimes outside the regulations.

Legislative currency and revision. The legislative history includes a note that references to other legislation or titles "are not automatically updated" and "may be obsolete". This explicit caveat signals that interpreting references to other instruments should be done with cognisance of possible obsolescence and by cross‑checking current statutory materials (Legislative history notes).

In summary, the regulations operate within a network of property, criminal, administrative, local government, disability and contract laws. They create specific offences and enforcement powers for named lands while leaving other remedies, statutory duties and administrative safeguards to be found in the broader legal framework.

The legislative history in the instrument records the initial principal regulations and subsequent variations to the Schedule and certain provisions. The document sets out commencement dates and particulars of variation.

Principal instrument and commencement. The Recreation Grounds Regulations 2011 were made as No 213 and published in the Gazette on 1 September 2011 (Gazette reference at Legislative history). The document records commencement of the principal regulations on 1 September 2011 as indicated by r 2.

Subsequent variations. The regulations have been varied at least twice, with identified instruments and commencement dates recorded in the Legislative history section.

• 2014 variation: Statutory Instrument 40/2014 appeared in the Gazette on 13 February 2014, with parts of that instrument commencing on 17 March 2014 (Gazette 13.2.2014 p896; 17.3.2014: r 2). The Legislative history expressly records that r 2 was omitted under the Legislation Revision and Publication Act 2002 on 17 March 2014, and Schedule 1 was varied by 40/2014 r 4, commencing 17 March 2014.

• 2016 variation: Statutory Instrument 284/2016 appeared in the Gazette on 15 December 2016, with commencement on 15 December 2016 (Gazette 15.12.2016 p5008; 15.12.2016: r 2). Schedule 1 was varied by 284/2016 r 4 on that date.

Repeals and prior instruments. The Recreation Grounds Regulations 2011 revoked the Recreation Grounds Regulations 1996 (Legislation revoked by principal regulations). The legislative history also notes that earlier versions of these regulations are listed at the end of the legislative history and identifies historical versions, with a snapshot of a version on 17 March 2014.

Revision notes and currency cautions. The legislative history contains a cautionary note that references to other legislation or instruments, or to titles of bodies or offices, are not automatically updated and may be obsolete. It also points readers to the Index of South Australian Statutes or the online legislation portal for further information.

Practical effect for users. The amendment history shows the Schedule of regulated grounds has been modified since the 2011 principal regulations. The two statutory variations explicitly varied Schedule 1, meaning the roster of listed grounds and their controlling bodies changed in 2014 and 2016. For practitioners, this requires checking the current consolidated text and the Schedule to confirm which grounds are presently in scope and which controlling bodies have been assigned authority. The instrument’s own legislative history does not specify the substantive reasons for each variation; it records only technical details of enactment and commencement.

No internal amendments to the operative behavioural provisions (s 5-9) are recorded in the Legislative history notes provided. The recorded amendments pertain primarily to the Schedule and to certain omissions required by the Legislation Revision and Publication Act 2002. The history therefore suggests the policy framework set by the operative provisions has been stable, while the inventory of covered sites has been updated.

The text of the regulations and the legislative history supplied do not identify any judicial decisions, prosecutions, reported cases, or litigation that interpret or apply these regulations. The instrument does not cite any cases, nor does the Legislative history list litigation.

Consequently, within the materials provided, there is no recorded case law addressing:

• interpretation of the statutory phrases such as "entrance provided by the controlling body", "reasonably suspected" for removal, or "authorised by the controlling body" for exemptions;

• the reach and limits of delegation under s 4, including any judicial review or challenge to delegated decision‑making;

• the interplay between the regulations and criminal law, property rights of occupiers, or local government by‑laws; or

• procedural safeguards or limits on authorised persons' powers, including possible civil liability for damage caused when removing vehicles or dogs.

Practitioners should therefore understand that no litigation precedent is stated in the provided text. Any questions about those interpretive points would need to be resolved by referring to reported decisions in broader case law on administrative delegation, public space control, police removal powers, and local government regulation, none of which are contained in the legislative text before you. Where litigation arises in the future, courts will need to apply ordinary principles of statutory interpretation and administrative law to situate these regulations within the broader legal framework.

The regulations contain a number of practical and legal traps that can produce enforcement exposure for members of the public, obligations for controlling bodies and operational risk for authorised persons. The following are concrete attention points drawn from the text.

Scope limited to Schedule 1. The regulations apply only to the lands listed in Schedule 1 (s 3(2)). Attempts to rely on these regulations outside those listed grounds will fail. Conversely, the Schedule can be varied administratively by statutory instrument, so presence on the Schedule is decisive for application.

"Entrance provided" creates reliance on controlling body actions. The offences in s 5 prohibit entering or leaving except by an entrance or exit provided by the controlling body. If the controlling body has not in fact designated or physically provided an entrance or exit, enforcement becomes operationally difficult. Practitioners should note that the statutory prohibition depends on a prior act by the controlling body to provide an entrance or exit.

High variation in penalty quantum. Penalties range from $250 for minor breaches to $5,000 for obstructing events or damaging property (ss 5-7). The same act of bringing a dog onto a ground could attract a low maximum penalty under s 7(2)(g), yet if the dog damages property or obstructs an event different higher penalties might apply. Enforcement discretion will determine which offence is pursued.

Guide dog exception narrow and conditional. The regulations allow only persons who "need the assistance of a guide dog" to bring one on a ground, and require that the dog be restrained on a lead not exceeding 3 metres (s 7(3)). Persons with other assistance animals may not be covered by this narrow exception. Practitioners should note the specific condition and the absence of a broader accessibility framework in the text.

Authorised persons include private appointees. The class of authorised persons includes persons authorised by the controlling body as well as police and special constables (s 3(1)). Where controlling bodies appoint private stewards or security contractors as authorised persons, those individuals will have the statutory powers in ss 7 and 9. Delegation under s 4 permits written transfer of functions, but delegations are revocable and are not exhaustive of the controlling body’s own authority. Confusion over who has authority on site can cause enforcement mistakes.

Removal of property without owner present. An authorised person may remove a vehicle or dog from a ground if the owner or person in charge cannot be located (s 9(1)). The regulations are silent about the manner of removal, safeguards against damage, notification obligations, or compensation. That silence exposes a risk of liability or disputes if property is damaged during removal.

Reverse burden on lawful excuse for explosives. For possession of flares, fireworks, explosives or missiles, the regulation places the burden of proving lawful excuse on the person in possession (s 7(8)). This evidential shift is limited to that offence but is a significant procedural change to note.

Policing standard left undefined. Both s 8 and s 9 use the phrase "reasonably suspected". The regulations do not define that standard further, nor do they specify required documentation, use of force limits, or post‑removal procedures. That opens space for authorised persons and police to apply varying thresholds in practice.

No internal appeal or complaint process specified. The regulations set out offences and penal maxima but do not prescribe an internal review process for disputes about fee setting, removal, or authorisation decisions. Persons seeking recourse will likely need to invoke general administrative law remedies or criminal procedure protections rather than a statutorily created administrative appeal within these regulations.

Potential for overlapping regimes. Many controlling bodies are local councils or clubs that may have by‑laws, leases, or licences with their own terms. The regulations explicitly recognise occupier rights under leases and licences (s 7(7)). That recognition means enforcement and remedies for damage may require parsing contracts and local laws in addition to the regulations.

Unclear interaction with criminal offences. The regulations create regulatory offences with particular maxima but do not displace more serious criminal legislation. For example, possession of an explosive device may attract regulatory and criminal consequences simultaneously. Practitioners should be cautious about assuming these regulations are the exclusive legal instrument for serious conduct.

In practice, controlling bodies and authorised persons should document entrances and exits, signage locations, delegation instruments, and enforcement actions to mitigate legal exposure. Visitors and commercial operators should obtain written authorisation for sales, collections, signage and similar activities to avoid incurring penalties.

Compliance requires coordinated action by visitors, controlling bodies, authorised persons and event organisers. The steps below are practical measures, tied to the relevant provisions.

For visitors and attendees

• Confirm whether the land is a listed recreation ground. These regulations apply only to locations named in Schedule 1 (s 3(2)). Before relying on any permission or assuming non‑application, check the current consolidated Schedule.

• Use provided entrances and exits. Enter and leave only by the entrance and exit points the controlling body provides (s 5(1)-(2)). If a controlling body has not designated a formal entrance or exit, seek written confirmation before acting on that ground to avoid contravening s 5.

• Pay or obtain authorisation for entry. If an entrance fee is charged, pay it or obtain prior written or recorded authorisation from the controlling body (s 6). Keep evidence of payment and any authorisation to avoid disputes.

• Observe behavioural prohibitions. Do not deposit litter except in receptacles, distribute printed matter, erect signs, sell goods, take collections, drive or ride vehicles, bring dogs (unless authorised), climb structures or otherwise commit the acts listed in s 7(2). If your activity might be captured by those categories, seek prior written authorisation from the controlling body.

• Follow event rules. On days when events are scheduled, avoid entering ovals, playing fields or staging areas unless you are a listed participant or have explicit authorisation from the controlling body (s 7(6)).

• Smoking and alcohol. Respect smoking prohibitions where the controlling body has erected signs and obtain prior authorisation to bring or drink intoxicating beverages if necessary (s 7(4)-(5)).

• Guide dog users. If you require a guide dog, ensure the dog is on a lead not exceeding 3 metres (s 7(3)).

• Comply with authorised persons. If an authorised person requests your name and usual place of residence because they reasonably suspect a breach, provide truthful information (s 9(2)). Refusal without reasonable excuse is an offence (s 9(3)).

For commercial operators and community groups

• Obtain written authorisation for selling, collections, signage or distribution. The prohibitions in s 7(2)(b)-(e) require authorisation for commercial or promotional activities. Secure a written licence, permit or contract with the controlling body that sets out the scope, duration and fees.

• Coordinate with event organisers. For events, secure the controlling body’s authorisation in writing for access to fields, selling rights, or signage and incorporate those authorisations into event licences and contracts.

For controlling bodies

• Clearly designate entrances and exits. To enforce s 5, physically and administratively designate which points are entrances and exits, and communicate them by signage and mapping.

• Publish fee structures and authorisation processes. If charging entrance fees under s 6, set published tariffs and consistent authorisation protocols for exemptions, concessions and staff. Retain records of fees collected and authorisations granted.

• Appoint and document authorised persons. Make written appointments for authorised persons and maintain an up‑to‑date instrument of authorisation and, where delegation is used, a written delegation instrument under s 4(1). Ensure delegates understand the conditions and revocation terms because delegations are revocable at will (s 4(2)-(3)).

• Provide clear signage. Erect signs for smoking prohibited areas as required by s 7(5). Clear signage reduces disputes and helps establish the legal basis for enforcement.

• Maintain rules for event days. Establish and publish rules that make clear who may enter playing fields and ovals on event days. Ensure event participant lists and authorisations are documented.

• Training and procedures for removals. Train authorised persons and contracted staff on the powers conferred by ss 7-9, including the circumstances in which they may require names and addresses, remove vehicles or dogs, or call for police removal under s 8. Document processes for removal of property, steps taken to avoid damage, and the recording of incidents.

• Recordkeeping. Maintain records of authorisations, delegations, fee payments, incident reports and notices given by authorised persons. Such records are critical if an enforcement action is contested.

For authorised persons and enforcement staff

• Understand the legal thresholds. Use "reasonable suspicion" as the statutory trigger for removal under s 8 and for investigatory actions under s 9. Document the facts that give rise to reasonable suspicion.

• Limit removal actions to statutory scope. Only require removal of vehicles or dogs under s 9(1) when the vehicle or dog has been brought in breach of the regulations or is obstructing or likely to obstruct events or enjoyment. If the owner cannot be located, follow controlling body procedures for removal and safekeeping.

• Avoid undue force or damage. The regulations do not set out rights to damage property when removing vehicles or dogs. Exercise caution to avoid damage and follow the controlling body’s operational protocols.

• Record requests for name and residence. When requesting identification under s 9(2), record the request, the response and the basis for the reasonable suspicion.

Risk management and insurance

• Insurance and indemnity. Controlling bodies should consider insurance arrangements and contractual indemnities for delegates and private security contractors acting as authorised persons to cover potential claims arising from removal or property damage.

• Liaison with police. Establish memorandums of understanding or liaison protocols with local police to clarify when police removals under s 8 will be requested, how incidents will be handed over, and how evidence will be preserved.

In short, compliance turns on good governance by controlling bodies, transparent authorisation processes, clear signage, and documented interactions between authorised persons, police and the public. Visitors and operators should secure written authorisations and retain records to demonstrate lawful entry and activity.
