58A Dispensing with notice or lapse of time
> > (1) Any notice or lapse of time prescribed by section 57 (not being notice or lapse of time relating to default in the payment, in accordance with the terms of the mortgage or charge, of any principal, interest, annuity, rent-charge or other money) may, by agreement expressed in the mortgage or charge, be dispensed with, and in such case section 58 shall operate as if no notice or lapse of time were thereby required.

> > (2) This section does not apply to covenant charges but applies to mortgages and charges made before or after the commencement of the [Real Property (Amendment) Act 1976](/view/pdf/asmade/act-1976-96) and, to the extent to which an agreement dispensing with notice or lapse of time expressed in such a mortgage or charge is not authorised by subsection (1), the agreement has no force or effect.
