Railways (Standard Gauge) Construction Act 1961

Principal legal concepts embodied in the Act are statutory authorisation of works, geographic fixation by schedules and deposited plans, specified lateral deviation rights, and selective non‑application of another statute’s provision.

Statutory authorisation: Section 2 is the core enactment. It makes it lawful to “construct and maintain the several railways” described in the schedules, and to provide “all necessary, proper and usual works and conveniences in connection therewith.” That language is permissive and descriptive: it authorises physical works along mapped corridors and ancillary facilities, without prescribing who must or may undertake the works, how they are to be funded, or how they are to be procured (s 2).

Geographic fixation: The Act fixes routes by text and by reference to maps and deposited Crown engineering (C.E.) plans. Each Schedule contains a textual route description (for example, the First Schedule describes the line commencing at Kalgoorlie station yard, proceeding via Koolyanobbing, Southern Cross, East Northam, Toodyay and points near Midland Junction to East Perth), and the Fourth Schedule and Fifth Schedule append a locating statement: “The whole to be located as shown in red on maps marked C.E. Plans numbered 54405, 54406 and 54407 deposited pursuant to section 96 of the Public Works Act 1902” and C.E. Plan 51753 respectively. The Act therefore relies on external deposited plans under s 96 of the Public Works Act to fix the precise alignment on the ground (Fourth and Fifth Schedule notes).

Deviation corridors: Section 3 creates express deviation rights for certain parts of the First Schedule route, and does so “notwithstanding anything contained in the Public Works Act 1902.” The deviations are quantified: for the Kalgoorlie-Koolyanobbing portion, up to 10 miles on either side; for Koolyanobbing-East Northam, up to 5 miles on either side; and for the balance of the First Schedule route, 1 mile on either side. The statutory wording is an affirmative grant to deviate within defined lateral limits, and framed as an exception to the Public Works Act (s 3).

Selective non‑application: Section 4 declares that the provisions of section 11(7) of the State Transport Co‑ordination Act 1933 do not apply to construction of the railways authorised by this Act. The provision is categorical and narrow in scope: it does not repeal the State Transport Co‑ordination Act generally or other parts of it; it exempts the construction authorised here from a single enumerated provision (s 4).

Interoperability with existing railways: The Schedules repeatedly reference existing lines, gauge connections and other railway Acts. The First Schedule starts “at a point in the Kalgoorlie station yard at which connection can be made to the existing 4 feet 8½ inches gauge Commonwealth railway,” and later describes running “alongside the 3 feet 6 inches gauge railway built under Act number 55 Victoriae 12 of 1892” and “alongside The Midland Railway Company of Western Australia Limited’s railway” in specified stretches (First Schedule). The Fourth Schedule similarly describes junctions and parallels with other statutorily authorised lines. The Act therefore contemplates integration, junctions and parallels with pre‑existing statutory railway rights.

Measure of extent: The Fourth Schedule records the “Total length of railways referred to in the above Schedules about 460 miles.” That provides a scale reference for the authorised works.

Amendment and formal consolidation: The Act has been the subject of amendment and reprint. The compilation table in the Notes records the original Act (1961), the Railways (Standard Gauge) Construction Act Amendment Act 1963 (No. 64 of 1963), a reprint as at 14 March 2003, and formatting amendments by the Standardisation of Formatting Act 2010 (Notes). The schedules and section numbering reflect those legislative changes.

In sum, the Act is conceptually a route‑specific enabling statute, combining textual schedule descriptions, mapped plans, quantified deviation rights and narrow cross‑statutory exemptions, without procedural, fiscal or operational detail.

The Act’s geographic specificity identifies a discrete set of affected interests: land and rights owners whose property lies on, adjacent to, or within the declared corridors; existing railway owners and operators mentioned in the Schedules; and the State’s administrative machinery responsible for public works mapping under the Public Works Act 1902. The statutory text makes those impacts evident.

Land and occupiers along the lines: The Schedules describe routes by reference to station yards, towns, valleys and proximity to existing railways. For example, the First Schedule runs from “a point in the Kalgoorlie station yard” via Koolyanobbing, Southern Cross, East Northam, Toodyay and points north of Midland Junction to East Perth. Section 3 authorises deviations measured “on either side” of particular portions of the First Schedule , 10 miles either side for Kalgoorlie-Koolyanobbing, 5 miles either side for Koolyanobbing-East Northam, and 1 mile either side for the balance. Those deviation corridors identify the lateral band of land that may be used for railroad alignment and so affect any freehold, leasehold, mineral lease, pastoral or other interests within those bands (First Schedule; s 3).

Existing railway companies and lessees: The First Schedule expressly notes connections and proximity to existing gauge lines and names a lessee: it starts at a point where connection can be made to the “existing 4 feet 8½ inches gauge Commonwealth railway” and proceeds to “a point adjacent to Koolyanobbing Hill on the area leased to Broken Hill Pty. Co. Ltd.” It also describes running “alongside the 3 feet 6 inches gauge railway built under Act number 55 Victoriae 12 of 1892” and “alongside The Midland Railway Company of Western Australia Limited’s railway” in various sections. Those textual references mean the authorised works were designed to meet, cross, or run parallel to assets and rights established by other statutes and private leases; such owners and lessees are therefore directly implicated by the authorised works (First Schedule; Third and Fourth Schedules).

Public authorities and mapping functions: The location clauses tie the authorised lines to C.E. Plans deposited pursuant to section 96 of the Public Works Act 1902 (Fourth and Fifth Schedule notes). That procedural connection brings within scope the departments or offices that manage plan deposit, surveying and public works mapping under the Public Works Act, because the statutory authorisation depends on those deposited plans being the record of location.

Statutory actors under State transport law: Section 4 removes the application of section 11(7) of the State Transport Co‑ordination Act 1933 to the construction of these railways. Any State agencies or private parties whose powers or obligations would have been engaged by s 11(7) are therefore directly affected by the non‑application declared in s 4.

Indirectly affected parties: Though the Act does not spell out compensation, acquisition or operational mechanisms, those normal incidentals of railway construction , compulsory acquisition, easements, or temporary occupation pending works , would be material to landowners, miners, utility holders, local councils and residents within the mapped corridor, because the Act authorises physical works and ancillary conveniences “in connection therewith” (s 2).

Absent specification of the constructor or funder: The Act does not name the body that will construct, own or operate the railway. The statutory authorisation therefore affects any party that the State ultimately designates or contracts to implement the works, but the Act itself contains no express appointment or funding allocation identifying that party (s 2; whole Act).

In sum, the text identifies an affected geography and names existing railway interests and lessees; it also produces effects on public mapping processes and on any regime that would otherwise operate under the State Transport Co‑ordination Act s 11(7), which has been declared inapplicable to these works.

The Act is primarily permissive rather than prescriptive: it confers rights to construct and to deviate but contains few explicit duties. The statutory rights and the limited duties that appear in the text are set out below.

Rights conferred

• Right to construct and maintain the railways described in the Schedules, including “all necessary, proper and usual works and conveniences in connection therewith” (s 2). That is the central statutory right: lawful authority to carry out construction and to maintain the infrastructure once built.

• Right to deviate within quantified lateral limits for parts of the First Schedule route, notwithstanding the Public Works Act 1902 (s 3). Specifically, the Act allows deviation for the Kalgoorlie-Koolyanobbing portion up to 10 miles either side, for Koolyanobbing-East Northam up to 5 miles either side, and for the balance of the First Schedule route up to 1 mile either side. Those quantified margins are statutory privileges to adjust alignment.

• Right to have the works located as shown on the deposited C.E. Plans (Fourth and Fifth Schedule notes). The Act fixes location by reference to those plans, and that reference is a legal right to use the mapped alignment.

Rights removed or restricted for other laws

• Exclusion of s 11(7) of the State Transport Co‑ordination Act 1933 from applying to construction of these railways (s 4). This is a negative right from the constructor’s perspective , the constructor is insulated from whatever obligations, conditions or procedural requirements would otherwise have arisen under that specific provision.

Duties and obligations explicit in the Act

• There are no express duties of compensation, acquisition procedure, public consultation, environmental assessment, or licencing included in the Act. The only positive procedural requirement embedded in the text is the linkage to deposited C.E. Plans under the Public Works Act (Fourth and Fifth Schedule notes), which implies an obligation to locate the works as shown on those plans.

• The Act does not state who must comply, who must pay for construction, or who must enforce the obligations; it does not set out ongoing regulatory duties for operators. Therefore, the Act itself places the primary legal obligation on the State of being lawful to construct and maintain , it authorises activity rather than prescribing licencing or control mechanisms (s 2).

Implications of “necessary, proper and usual works and conveniences”

• The Act’s grant in s 2 is framed broadly: constructors may provide “necessary, proper and usual works and conveniences in connection therewith.” That phrase authorises ancillary facilities reasonably necessary to the railway’s functioning. The text does not define those phrases, so the scope of “necessary” or “proper” would be a matter of factual and, if litigated, legal interpretation. The Act itself imposes no regulatory oversight mechanism for that exercise of discretion.

Administrative interactions

• The requirement that the whole be located as shown on the cited C.E. Plans (Fourth Schedule) means that constructors have the duty to consult or rely on those deposited plans for alignment. The Act thereby creates an administrative interface with the Public Works Act mapping regime (Fourth and Fifth Schedule notes).

Absences that matter as de facto constraints

• The Act contains no penalty or enforcement provisions, no statutory mechanisms for acquisition or compensation, and no explicit assignment of responsibility to any department, authority or private entity. Those silences in the statute mean that duties normally associated with carrying out construction projects must be found elsewhere in the statute book or in administrative practice, not in this Act.

In short, the Act grants the legal right to build and to deviate within specified corridors, defines the location by reference to deposited plans, and carves out a specific exclusion from another statute, while leaving the burdens of funding, procurement, compulsory acquisition, compensation and regulatory compliance to be supplied by other laws or administrative processes.

The Railways (Standard Gauge) Construction Act 1961 contains no express offences, sanctions, enforcement powers or penalty schema. The Act’s text focuses on authorisation and mapping of routes, and does not create a standalone enforcement regime.

Absence of penalty provisions

• Nowhere in the Act are criminal penalties, civil sanctions, enforcement agencies, inspection powers, or infringement procedures specified. The operative sections (s 2, s 3, s 4) authorise conduct (construction, deviation, non‑application of a particular provision) and do not accompany those permissions with enforcement provisions.

Implications for enforcement

• Because the Act itself imposes no penalties or enforcement mechanisms, compliance with its terms (for example, constructing along the lines described, or observing the limits of authorised deviation) would be enforced, if at all, through other statutory provisions or general law remedies. The Act’s lack of enforcement machinery implies that remedies for breach or disputes (for example over alignment, trespass, acquisition, or interference with rights) must be pursued under other statutes (for example the Public Works Act 1902 where relevant), common law causes of action, or contractual arrangements , none of which are set out in this Act. The Act does, however, tie the authorised location to plans deposited pursuant to s 96 of the Public Works Act 1902 (Fourth and Fifth Schedule notes), which suggests the Public Works Act’s administrative apparatus may be engaged in the location process.

Interaction with the Public Works Act and other statutes

• Section 3 expressly operates “notwithstanding anything contained in the Public Works Act 1902” to permit prescribed deviations from parts of the First Schedule route. That phrase signals that where a conflict might arise between the deviation rights in this Act and the Public Works Act, the 1961 Act’s deviation authorisation controls. The Act does not, however, provide its own enforcement authority to police or adjudicate deviation disputes; enforcement would therefore be through whatever mechanisms the Public Works Act, other statutes, or the civil law provide for disputes over the use of mapped land or deviations.

No specified administrative regulator or designated enforcing authority

• The Act does not name a minister, department or statutory authority as the constructing or enforcing party. There is therefore no single statutory official to whom administrative enforcement powers are delegated within the text. Practical enforcement and oversight would be an inter‑statutory matter or depend on executive arrangements outside the Act.

Consequences for third parties

• For landholders, the absence of penalties in the Act does not mean there are no remedies. Disputes about interference with property rights, acquisition, access or compensation were not resolved within this instrument; they would need to be pursued under other legislation or common law. The Act itself neither prescribes nor limits those other remedies.

In summary, the statute authorises works and creates mapping and deviation rules, but it contains no self‑standing penalty or enforcement regime. Enforcement, dispute resolution and remedial rights, where required, must be sought under other statutes or legal processes referenced or engaged by the Act (notably the Public Works Act 1902 through the deposited plans reference) or under general law.

The Act interacts with the Public Works Act 1902 and the State Transport Co‑ordination Act 1933 by way of explicit cross‑references and exceptions, and it situates authorised construction in relation to earlier railway Acts and deposited C.E. Plans. The statutory text itself defines the scope of those interactions.

Public Works Act 1902

• Section 3 is an express exception to the Public Works Act 1902. It states: “Notwithstanding anything contained in the Public Works Act 1902, it shall be lawful to deviate from that portion of the line as described in the First Schedule … to the extent of 10 miles on either side … 5 miles on either side … and to deviate from the balance of such line at a distance of one mile on either side thereof.” The “notwithstanding” formulation indicates that where the Public Works Act might otherwise constrain deviation, the 1961 Act grants specific statutory power to deviate within the enumerated lateral limits (s 3). That is a direct, priority‑conferring clause in favour of the 1961 Act’s deviation rights.

• At the same time, the Schedules link the authorised location to C.E. Plans “deposited pursuant to section 96 of the Public Works Act 1902.” The Fourth Schedule says the whole is to be located as shown in red on C.E. Plans 54405-54407 “deposited pursuant to section 96 of the Public Works Act 1902.” The Fifth Schedule makes a like reference to C.E. Plan 51753. That indicates the 1961 Act uses the Public Works Act procedures for fixing and recording precise alignment even while carving out specific deviation authorities from the Public Works Act’s other provisions. The combined effect is (a) reliance on the Public Works Act’s plan‑depositing machinery for location certainty, and (b) express statutory override of other Public Works Act provisions to permit specified lateral deviation (Fourth and Fifth Schedule notes; s 3).

State Transport Co‑ordination Act 1933

• Section 4 states that the provisions of section 11(7) of the State Transport Co‑ordination Act 1933 “do not apply to the construction of the several railways authorised by this Act.” This is a carve‑out: the legislature removed the application of a single provision of the 1933 Act to the works authorised here. The effect is narrow; it does not amend or repeal other parts of the State Transport Co‑ordination Act and does not otherwise displace that Act. The Act’s note indicates that the State Transport Co‑ordination Act 1933 was subsequently repealed and replaced by later Acts, but the 1961 Act’s text itself performs the limited non‑application for the provision in question (s 4; Notes).

Other railway Acts and pre‑existing statutory lines

• The Schedules repeatedly reference earlier enacted railways and linked Acts. For example, the First Schedule refers to the “3 feet 6 inches gauge railway built under Act number 55 Victoriae 12 of 1892” and the Midland Railway Company’s railway built under other numbered Acts. The Fourth Schedule references the Spearwood‑Cockburn Cement railway constructed under Act number 33 of 1961 and railway Acts dating back to late 19th and early 20th centuries. These textual references show the Act is designed to integrate with the statutory fabric of earlier railway authorisations and to describe routes in relation to previously authorised lines (Schedules).

Statute revision and repeal notes

• The Notes appended to the Act record later statutory changes to those older Acts: several of the historical Acts are noted as repealed by later Statute Law Revision Acts or related legislation. Those editorial notes indicate that although the 1961 Act’s Schedules refer to historical statutes that may have been repealed later, the 1961 Act itself relies on the physical and locational realities of existing lines and leased land rather than on the continued life of those earlier statutes (Notes).

Operational and administrative interplay

• Because the Act contains no procedural detail for acquisition, compensation, environmental processes, procurement or operation, those matters must be handled under other statutes or administrative instruments. The Act’s explicit reliance on the Public Works Act for plan deposit, and its carve‑out from a provision of the State Transport Co‑ordination Act, are the principal statutory interactions included in the text (s 3; s 4; Fourth and Fifth Schedule notes).

In effect, the 1961 Act sits within a network of older and contemporaneous statutes: it borrows mapping procedures from the Public Works Act, it exempts its authorised works from a specific clause of the State Transport Co‑ordination Act, and it references the physical location of lines established under prior railway Acts. The Act therefore functions as a route‑specific enabling measure, designed to be implemented in combination with other statutes and administrative processes.

The Act’s Notes include a compilation table and marginal notes recording amendments and reprints. The text itself bears editorial marks showing where substantive changes were made. The following summary confines itself to what the Act’s compilation notes and marginal annotations state.

Original enactment and first amendment

• The Railways (Standard Gauge) Construction Act 1961 was enacted as No. 27 of 1961, assented to on 30 October 1961, and commenced on that day (Compilation table).

• The Railways (Standard Gauge) Construction Act Amendment Act 1963 (No. 64 of 1963) amended the original Act. The marginal annotations record multiple substantive insertions and amendments credited to the 1963 Act: section 2 was amended by No. 64 of 1963 s 3; section 3 was inserted by No. 64 of 1963 s 4; the First, Third, Fourth and Fifth Schedules were inserted or modified by No. 64 of 1963 ss 5-8; the Second Schedule was deleted by No. 64 of 1963 s 6. Those marginal notes indicate the 1963 Act materially re‑worked the 1961 Act’s schedules and added the deviation provision now found at s 3.

Reprint and formatting standardisation

• The Notes record a reprint: “Reprint 1: The Railways (Standard Gauge) Construction Act 1961 as at 14 Mar 2003” which includes the amendments made by the 1963 Act. The compilation table lists this reprint as part of the official consolidated text as at that date.

• The Standardisation of Formatting Act 2010 (No. 19 of 2010) made formatting amendments to the Act. The compilation table lists Standardisation of Formatting Act 2010 s 5, with assent on 28 June 2010 and a later commencement date for formatting changes (11 September 2010). Marginal notes in the schedules show a “Heading inserted: No. 19 of 2010 s. 5,” indicating that the 2010 Act’s changes were typographical or formatting in nature , for example, headings inserted before schedules , rather than substantive policy changes.

Marginal insertions and deletions

• The text records where specific sections and schedules were inserted, amended or deleted by the 1963 Act (see marginal notes adjacent to s 2, s 3, and the Schedules). The Second Schedule was deleted under the 1963 amendment (marginal note).

References to repeal of other Acts in Notes

• The Act’s Notes also record that some of the Acts referred to in the Schedules (for example the State Transport Co‑ordination Act 1933 and various nineteenth‑century railway Acts) were repealed by later Statute Law Revision Acts or replaced by new transport co‑ordination statutes. These notes do not amend the 1961 Act’s operational provisions but explain the legislative history of the statutes cited in the Schedules (Notes 2, 3, 6).

Net effect of amendments

• The substantive 1963 amendments expanded or clarified the route descriptions and added the deviation clause now at s 3; they also deleted and restructured schedules. Later alterations have been formatting and consolidation rather than substantive policy changes, as indicated by the 2010 Standardisation of Formatting Act entry.

For any user relying on the Act, the compilation table and marginal notes included in the Act’s printed reprint should be consulted to identify which parts of the current text derive from the 1963 amendments and which are simply formatting updates from 2010.

The statutory text and the Notes provided contain no record of litigation, judicial interpretation, or case law arising under the Railways (Standard Gauge) Construction Act 1961. The Act’s internal notes and compilation table supply only legislative amendment history and references to later statutory repeals of other Acts cited in the Schedules; they do not report decisions, proceedings, or authoritative judicial constructions.

What the source does and does not provide

• Present in the source: the Act’s operative provisions, Schedules, plan references, amendment marginalia and compilation table. These materials are legislative and editorial. The Notes include which earlier or later Acts repealed various historic statutes that are referenced in the Schedules. None of these materials record litigation or court determinations about the meaning, scope, validity or application of the 1961 Act’s provisions.

• Absent from the source: any reported case names, citations, judicial reasoning, tribunal decisions, injunctions, statutory challenges, or declaratory proceedings arising from the construction, alignment, deprivation of rights, or application of the Act’s deviation or non‑application clauses. There are no references to disputes between the State and private parties, nor any administrative appeals recorded in the text provided.

Implications for research and practice

• Because the Act’s text contains no litigation history, practitioners, researchers or journalists wanting to know how courts have interpreted the phrases “necessary, proper and usual works and conveniences,” the deviation margins in s 3, or the effect of the s 4 exclusion should search the judicial databases, court records and administrative tribunal decisions external to this printed text. The Act itself does not disclose whether or how its provisions were litigated or applied in particular construction projects.

• The absence of litigation records in the text may reflect that disputes were resolved administratively, settled privately, or litigated without resulting in high‑profile reported decisions; the statute’s Notes neither affirm nor disprove those possibilities. The only reliable statement supported by the Act’s text is that no litigation history is contained within this Act as published.

In short, the provided statute contains no litigation history; any authoritative account of judicial treatment of the Act must be sought in external case law resources.

Several potentially consequential features , silences and narrowly phrased exceptions , appear in the Act’s text and schedules. Those items are concrete legal mechanics rather than editorial judgements; practitioners should note them when advising clients or planning projects.

No designated constructing authority, funding or procedural framework

• The Act authorises construction (s 2) but does not name any agency, minister, railway authority or private party responsible for carrying out the works, nor does it appropriate funds or create procurement procedures. This absence means the statutory power to build exists independently of any express statutory funding or administrative chain. Parties assuming the Act authorises expenditure, acquisition or operation should confirm the existence of separate enabling financial or administrative instruments outside this text.

Reliance on Public Works Act for mapping but exception for deviation

• The Schedules tie location to C.E. Plans deposited “pursuant to section 96 of the Public Works Act 1902,” and s 3 says deviation is lawful “notwithstanding anything contained in the Public Works Act 1902.” The combination means the Act both relies on Public Works Act procedures for recording alignment and disapplies unspecified other Public Works Act provisions to permit deviation. The practical effect is that the Act fixes location via the Public Works Act’s plan deposit mechanism but gives statutory latitude to shift alignment within narrow corridors , a point that may be overlooked if one assumes plan deposit rigidly fixes the only permissible alignment.

Quantified but non‑uniform deviation rights

• Section 3 sets different lateral limits for different segments of the First Schedule , 10 miles each side for Kalgoorlie-Koolyanobbing, 5 miles each side for Koolyanobbing-East Northam, and 1 mile each side for the remainder. Those different margins are precise statutory constraints and not generalised statements of flexibility. Advisers must map these distinct corridors carefully rather than applying a single radius or buffer to the entire line.

No express acquisition or compensation machinery in this Act

• The Act authorises construction “with all necessary, proper and usual works and conveniences,” but contains no specific provisions for compulsory acquisition, vesting, compensation, temporary occupation or rights of entry. Standard acquisition processes, compensation calculations, and procedures for objection or appeal are absent from the text and must therefore be located in other statutes. Assuming acquisition will proceed under the Act without reference to other laws is a potential trap.

No enforcement or penalties

• The Act contains no enforcement provisions. That means that if an authorised work is not located as provided, or deviation limits are exceeded, the Act does not itself prescribe a penalty or enforcement remedy. Remedies, if any, must be found in other legislation or in the common law. Parties should not rely on the Act to provide an enforcement mechanism.

Intersections with historically repealed Acts referenced in Schedules

• The Schedules refer to earlier railway Acts and gauge designations, some of which the Notes state were later repealed. The textual references in the Schedules describe physical alignments relative to existing rail lines created under those earlier Acts. Users must be attentive to the fact that the Schedule’s referential language may point to physical infrastructure whose statutory underpinning has changed; the Act’s legal authority to run parallel or junction remains via the 1961 authorisation, but the legal status of the pre‑existing lines should be checked in their current legislative form.

No recorded litigation history in the Act

• The Act’s print contains no litigation history. If a party needs precedential guidance on how courts have interpreted phrases such as “necessary, proper and usual works and conveniences,” they must seek case law outside the Act. Assuming settled judicial interpretation without checking external sources is risky.

Maps and plan numbers are decisive textual anchors

• The C.E. Plan numbers referenced (54405, 54406, 54407, 51753) are the textual anchors for location. Where physical surveys, cadastral data or later plan amendments exist, reliance on the exact deposited plans in the Public Works Act archive will be critical. The Act’s language makes those plans the statutory reference point for alignment.

Narrow non‑application of State Transport Co‑ordination Act provision

• Section 4 removes the application of s 11(7) of the State Transport Co‑ordination Act 1933 specifically to these works. That is a precise exemption, not a wholesale displacement of the State Transport Co‑ordination Act’s regulatory framework. Assume only the particular clause is excluded unless and until other statutory text says otherwise.

In short, the Act grants strong route‑specific permissive powers while omitting many of the conventional procedural, fiscal and enforcement details typically associated with major public works statutes. Those omissions are themselves legal facts that must be accounted for in planning and advice.

Because the Act is brief and principally permissive, compliance involves attending to the textual location, the deviation limits, the deposited plans, and the statutory exclusions. The Act itself prescribes a small set of compliance anchors; other statutory and administrative obligations will need to be satisfied under separate laws.

Comply with the authorised location as recorded

• The Fourth Schedule states the whole of the railways referred to in the Schedules are “to be located as shown in red on maps marked C.E. Plans numbered 54405, 54406 and 54407 deposited pursuant to section 96 of the Public Works Act 1902.” The Fifth Schedule similarly references C.E. Plan 51753. Compliance therefore requires locating the physical works in accordance with those deposited plans. Parties should obtain certified copies of the cited C.E. Plans from the Public Works Act records and use them as the primary alignment reference (Fourth and Fifth Schedule notes).

Respect the deviation corridors in section 3

• For the First Schedule route, any deviation must be within the lateral limits set by s 3: up to 10 miles either side for the Kalgoorlie-Koolyanobbing portion, 5 miles either side for Koolyanobbing-East Northam, and 1 mile either side for the balance of that line. If a proposed alignment lies outside those statutory corridors, the authorisation in this Act will not cover it and additional legislative or administrative approvals will be required. Compliance planning should map the statutory buffers precisely and use them as constraints for survey, engineering and land acquisition work (s 3).

Account for the s 4 exclusion from the State Transport Co‑ordination Act 1933

• The Act declares s 11(7) of the State Transport Co‑ordination Act 1933 does not apply to construction authorised by this Act (s 4). Parties relying on the protection or obligations under s 11(7) must be aware of its non‑application. Conversely, where administrative or regulatory requirements might have been triggered by s 11(7), constructors should not assume those apply to the works authorised here. Review of the substance of s 11(7) (by reference to its text as it stood at the relevant time) is necessary to determine what processes are exempted; the 1961 Act does not itself supply those details (s 4).

Engage Public Works Act procedures as necessary

• Because the Act references plan deposit under the Public Works Act, compliance will involve interaction with the Public Works Act administrative processes for plan lodgement and survey accuracy. Ensure the relevant C.E. Plans are current, available and accord with practical survey outcomes, and that any modifications to plans follow the procedures required under the Public Works Act.

Identify and secure external statutory authorities for acquisition, compensation and environmental compliance

• The 1961 Act contains no express compulsory acquisition, compensation, environmental assessment or permitting regime. Compliance therefore requires securing any necessary land rights, easements, planning and environmental approvals under applicable statutes (for example, laws governing land acquisition, environmental protection, building and planning) , none of which are contained in this Act. Practitioners should identify which external statutes apply to compulsory acquisition and consenting in the relevant localities and ensure those processes are commenced and completed in parallel with any reliance on the 1961 Act’s construction authorisation.

Obtain and rely on the correct version of the Act

• The Act was amended by the 1963 Amendment Act and has a reprint as at 14 March 2003; the Standardisation of Formatting Act 2010 effected formatting changes. To ensure compliance with the current operative wording, obtain the consolidated or reprinted text that incorporates the 1963 amendments and any subsequent formal reprints. The marginal notes in the text indicate which provisions were inserted or amended by No. 64 of 1963 and which headings were inserted by No. 19 of 2010; practitioners should consult those reprints for authoritative versioning (Compilation table; marginal notes).

Cross‑check route descriptions against existing infrastructure

• The Schedules describe the authorised lines in relation to existing railway corridors, stations and leased areas (for example Broken Hill Pty. Co. Ltd. lease near Koolyanobbing; connections to Commonwealth railway at Kalgoorlie). Compliance planning should include verification of the current status of those adjacent or referenced railways and leases and any necessary agreements for junctions, crossings or parallels.

Document scope of ancillary works

• The Act authorises “necessary, proper and usual works and conveniences” connected with the railways (s 2). To avoid dispute about whether ancillary facilities fall within that scope, document the functional necessity of such works and the engineering rationale linking them to the authorised main line. Where doubt exists, seek the relevant statutory powers elsewhere (for example, planning permits, landowner agreements).

Record keeping and plan custody

• Keep certified copies of the C.E. Plans and any survey updates, and ensure all construction activity is traceable to the deposited plan reference numbers. The Act makes those plan references the statutory anchors for location.

Legal risk management

• Because the Act lacks penalties and acquisition mechanisms, maintain active legal oversight of third party rights to ensure compulsory acquisition or compensation obligations are correctly invoked under the appropriate statutes. Do not rely on the 1961 Act alone to cure acquisition or compensation deficiencies.

In short, compliance under the Act requires strict observance of the mapped alignments and deviation corridors, coordination with the Public Works Act mapping regime, and the parallel fulfilment of acquisition, environmental and permitting obligations under other laws. The Act supplies location authority and deviation limits; the practical execution of the works must be supported by external statutory and administrative processes.
