What it does
This Act sanctions the construction of a specific railway line from Maldon to Port Kembla in New South Wales, described in Schedule 1 as the scheduled work. The scheduled work includes a main line of about 36 kilometres from Maldon on the Main Southern Railway through the Illawarra Range to a junction with the Unanderra to Moss Vale Railway near Dombarton Loop, then a further 15 kilometres along existing railway corridors via Coniston Triangle to the Inner Harbour line at Port Kembla, plus sidings, loops, loading facilities, access ways, electric power transmission cables, and any modifications or deviations the Authority deems necessary or desirable. Transport for NSW and the Transport Asset Manager of New South Wales are jointly constituted as the Authority and are empowered to carry out the scheduled work, including entering into contracts and doing anything they consider necessary for that purpose. The Act sets a cost cap for the work exclusive of land acquisition at $160,000,000, with a permitted overrun of no more than 10 per cent. The scheduled work is deemed an authorised work under the Public Works Act 1912, with the Authority as the Constructing Authority, but several sections of that Act are expressly excluded from applying, including provisions that would ordinarily require ministerial approval or impose other constraints. The Act overrides the Local Government Act 1993, the Environmental Planning and Assessment Act 1979, and any environmental planning instrument, allowing the Authority to use acquired land and erect structures according to its own determinations and specifications. Part 5 of the Environmental Planning and Assessment Act 1979 (concerning environmental impact assessment for activities) continues to apply, with the Authority as the determining authority. The Act grants special powers to close roads by notice published in the Gazette with the Governor’s approval, subject to ensuring reasonable access to land, and extinguishes all rights of use and dedication upon publication, vesting the land in the Authority without any compensation claim arising. The Authority is exempt from giving notice of intention to blast rock during construction and cannot be restrained by injunction for nuisance caused by blasting or other necessary operations. Any act done before commencement that could lawfully have been done had the Act been in force is retrospectively validated.
