RAIL SAFETY (NATIONAL UNIFORM LEGISLATION) REGULATIONS 2013

The Regulations operate by specifying technical instruments, procedural preconditions, sample handling and certification. These are the main concepts and how the Regulations define and apply them.

• Prescribed breath analysis instrument (reg 3). The Regulations explicitly prescribe a particular type of breath analysis device: a Dräger Alcotest 7110. The definition is narrow: it includes any device with the trade names "Dräger Alcotest", "Drager Alcotest" or "Draeger Alcotest" associated with number "7110". This fixes the statutory term "breath analysis instrument" (used in s 10(1) of the Act) to that branded instrument family for the purposes of the Northern Territory Regulations.
• BrAC-BAC correspondence (reg 4). The Regulations treat readings expressed as BrAC and BAC as numerically identical for the specified unit conversions. The table gives three explicit matched values: 0.05 BrAC equals 0.05 BAC, 0.08 equals 0.08, and 0.15 equals 0.15. The Note clarifies that the results are identical except for the unit of measurement. This is an evidentiary rule: it determines how instrument readings are to be interpreted or transposed into blood alcohol concentration equivalents for regulatory purposes.
• Authorised person procedures (reg 5). The authorised person has specified preparatory and operational duties when performing breath analysis: switch on the instrument and wait for the display to show "READY TO START" (reg 5(1)); provide a new mouthpiece for each breath sample (reg 5(2)); and refrain from testing if there are reasonable grounds to suspect consumption within the prior 15 minutes (reg 5(3)). The concept of "authorised person" and the Part 4, Division 2 context derive from the Act; the Regulations supply the operational steps.
• Blood-sample pathway (reg 6). The Regulations prescribe where and by whom blood samples are to be taken: a health practitioner at a hospital or health centre (defined by reference to the Medical Services Act 1982). The authorised person must arrange transport and be present during the taking of the sample (reg 6(1) and (6)). The Regulations therefore create a chain from the field (authorised person) to a clinical setting (health practitioner in hospital/health centre).
• Sample division, sealing and certification (reg 7). Health practitioners are required to divide samples into three approximately equal portions, separately containerise and seal those portions, mark them with an identification number and sign a certificate recording specific items (reg 7(1)-(2)). Two containers plus the certificate must be provided to the authorised person, while the third is for the worker or retained on the worker’s behalf (reg 7(3)).
• Analyst certification and Regulator reporting (reg 9). Analysts (or their supervisors) must produce a signed certificate containing detailed analytic information including concentrations, drug types, factors affecting accuracy and other relevant information (reg 9(1)). The signed certificate must be provided to or retained on behalf of the Regulator, and copies must be made available to the health practitioner and the worker (reg 9(2)-(3)). The Regulator is permitted to provide a copy to the worker’s employer if the certificate shows a prescribed BAC or a prohibited drug in the sample (reg 9(4)). The Regulations thus establish evidentiary documentation and the flow of analytic results into regulatory and employer channels.

Other concepts that appear are definitions by reference. The Regulations adopt the term worker to mean a rail safety worker (reg 2). Hospital and health centre are defined by reference to the Medical Services Act 1982 (reg 6(7)). Several procedural and documentary concepts , sample identification number, sealing, certificate content , are defined by the required actions rather than by separate glossary entries.

These concepts collectively structure a chain of custody and evidentiary trail from initial field testing to laboratory analysis and regulator/employer notification. The Regulations prioritise named instrument conformity, standardised pre-test checks, controlled clinical collection of blood samples, duplication of sample portions for worker access and independent analysis, and detailed certification from both the collector and the analyst.

The Regulations allocate duties, options and reporting flows among a limited set of actors. The primary parties affected and the concrete duties that fall to them under the Regulations are these.

• Rail safety workers (worker). The Regulations apply to "worker" defined as a rail safety worker (reg 2). Workers are the persons who may be required under Part 4 of the Act to provide breath or blood samples. The Regulations give workers specific rights: the worker may request a blood sample be taken (reg 6(1)), and the worker has a right to the third container of the blood sample if requested (reg 7(3)(b)(i)). The Regulations also impose indirect obligations on workers by specifying how tests are performed and by whom, and by creating a certified record that can be provided to their employer via the Regulator (reg 9(4)).
• Authorised persons. The Regulations place several procedural obligations on authorised persons using breath analysis instruments under the Act: turn the instrument on and ensure "READY TO START" appears (reg 5(1)); provide an unused mouthpiece for each sample (reg 5(2)); and refuse or defer a breath analysis if the authorised person suspects on reasonable grounds the worker drank within the previous 15 minutes (reg 5(3)). When a blood sample is required or requested, the authorised person must arrange for the worker to be taken to a hospital or health centre for a health practitioner to take the blood sample (reg 6(1)). The authorised person must also be present when the health practitioner takes the sample (reg 6(6)). The Regulations therefore ascribe both operational and oversight roles to authorised persons.
• Health practitioners. When a health practitioner takes a blood sample under Part 4 of the Act they have specific handling and documentation duties: divide the sample into three approximately equal portions, place each in separate containers, seal and mark them with an identification number, and sign a certificate with specified particulars (reg 7(1)-(2)). They must then make two containers and the certificate available to the authorised person and arrange the third container according to the worker’s request or retain it on the worker’s behalf (reg 7(3)).
• Analysts and laboratory personnel. Persons who perform or supervise analyses must sign a certificate listing discrete items (identification number, the person performing or supervising the analysis, date received, concentration of alcohol if detected, type of drug if detected, any factors affecting accuracy, other relevant info) (reg 9(1)). The signed certificate must be given to or retained for the Regulator and copies made available to the health practitioner and the worker (reg 9(2)-(3)). Analysts therefore have duties both in technical analysis and in statutory documentation/reporting.
• The Regulator. The Regulations designate the Regulator as the recipient of analysts’ signed certificates (reg 9(2)). The Regulator is explicitly empowered to give a copy of the signed certificate to the rail transport operator who employs the worker if the certificate indicates the prescribed BAC or a prohibited drug was present in the sample (reg 9(4)). The Regulations thus create a reporting channel from labs to regulator and onward to employers where positive findings are present.
• Rail transport operators. Operators are indirect recipients of certified results. The Regulations permit the Regulator to provide positive-result certificates to operators (reg 9(4)). The Regulations do not prescribe any operator duties directly; they only provide for the Regulator to pass information to operators.
• Hospitals and health centres. A worker must be taken to a hospital or health centre for blood sampling (reg 6(1)). The Regulations define hospital and health centre by reference to the Medical Services Act 1982 (reg 6(7)), thereby bringing clinical institutions subject to state definitions into the procedural chain. The practical implication is that blood samples must be taken in defined clinical settings by health practitioners recognised under that Act.

Who bears costs and logistical burdens is not specified in the Regulations. The Regulations require an authorised person to make arrangements to take the worker to hospital or a health centre (reg 6(1)) and to be present at the taking of the sample (reg 6(6)), but the text does not specify who pays for transport, clinical fees or laboratory analysis. That silence creates a gap that must be filled by operational policy, employer practice or other legal instruments outside these Regulations.

The Regulations therefore distribute procedural duties across field enforcement (authorised persons), clinical collectors (health practitioners), laboratory staff (analysts), the Regulator and employers, while granting specific procedural rights to the worker (request a blood sample; receive the third container; obtain copies of analytic certificates).

The Regulations are primarily procedural and documentary. They list precise duties for authorised persons, health practitioners and analysts, and confer a small set of rights on workers. Below are the key duties and rights with their regulation cites and the operational consequences implied by the text.

Authorised person duties (reg 5 and reg 6)

• Instrument preparation: before use an authorised person must ensure the breath analysis instrument is turned on and the instrument displays the words "READY TO START" (reg 5(1)(a)-(b)). Operational consequence: the authorised person must verify device readiness and likely be familiar with device start-up and diagnostics.
• Mouthpiece provision: an authorised person must provide an unused mouthpiece for each sample (reg 5(2)). Operational consequence: authorised persons must stock, store and document disposable mouthpieces and ensure one is supplied per sample.
• 15-minute rule: an authorised person must not carry out a breath analysis if the authorised person suspects, on reasonable grounds, the worker has consumed alcohol within the 15 minutes immediately before the proposed time for carrying out the breath analysis (reg 5(3)). Operational consequence: authorised persons must form and record a reasonable-grounds assessment before testing; this is a prohibition contingent on subjective suspicion but constrained by the "reasonable grounds" standard.
• Blood-sample arrangements and presence: if a blood sample is required or requested, the authorised person must make arrangements to take the worker to a hospital or health centre for a health practitioner to take the sample (reg 6(1)), and must be present when the health practitioner takes the sample (reg 6(6)). Operational consequence: authorised persons must coordinate clinical appointments and attend to witness the draw, creating a presentational requirement and possible logistical burden.

Health practitioner duties (reg 7)

• Division and handling: when taking a blood sample under Part 4 of the Act, the health practitioner must divide the sample into three approximately equal portions, place each in a separate container, seal each container and mark them with the sample’s identification number (reg 7(1)(a)-(d)). Operational consequence: clinicians must follow a three-sample protocol, seal and mark containers, and apply an identification system.
• Certificate: the health practitioner must sign a certificate specifying the sample identification number, the worker’s name and address (to the extent known), the name of the health practitioner and whether they are a medical practitioner, a registered nurse or a qualified person, and when and where the sample was taken (reg 7(2)(a)-(d)). Operational consequence: clinicians must create and retain a clinical certificate with those minimum contents.
• Distribution: the health practitioner must make two containers and the signed certificate available to the authorised person, and either give the third container to the worker on request or retain it on the worker’s behalf otherwise (reg 7(3)(a)-(b)). Operational consequence: clinicians must follow precise distribution instructions that provide the worker with an opportunity to possess a sample.

Analyst duties (reg 9)

• Analytic certificate content: the person who performed or supervised the analysis must sign a certificate detailing a specific set of items: sample identification number; name of person and whether they are an analyst or employee and whether they performed the analysis or supervised it; laboratory receipt date; alcohol concentration if detected; drug type if detected; any factors that might adversely affect accuracy/validity; and any other information appropriate (reg 9(1)(a)-(g)). Operational consequence: labs must capture and record a broad set of metadata and analytic conclusions and include adverse-factor commentary.
• Record retention and disclosure: the signed certificate must be given to, or retained on behalf of, the Regulator (reg 9(2)); a copy must be made available to the health practitioner and the worker (reg 9(3)). Operational consequence: analysts and laboratories must institute document flows to the Regulator and to clinical collectors and workers.
• Regulator-to-operator disclosure: the Regulator may provide a copy of the signed certificate to the rail transport operator who employs the worker if the certificate indicates the prescribed BAC or a prohibited drug was present (reg 9(4)). Operational consequence: positive analytic results may be disclosed by the Regulator to employers; analysts must therefore be prepared for the possible use of certificates by employers.

Worker rights (reg 6 and reg 7 and reg 9)

• Request a blood sample: a worker may request a blood sample be taken (reg 6(1)). Operational consequence: workers can seek blood testing rather than be limited solely to authorised-person-initiated testing.
• Third container entitlement: if the worker requests, the health practitioner must give the third container to the worker; otherwise the practitioner must retain it on the worker’s behalf (reg 7(3)(b)(i)-(ii)). Operational consequence: workers have an explicit right to possession of one portion of their blood sample.
• Copies of analytic certificates: a copy of the signed certificate must be made available to the health practitioner who took the sample and the worker (reg 9(3)). Operational consequence: workers have access to lab reporting for review or independent analysis.

Documentary chain-of-custody duties

• Identification numbers and sealing: both health practitioners and analysts rely on the identification number required by reg 7(1)(d) and reg 9(1)(a) to link the collector’s certification to the analyst’s findings. Sealing and marking duties are aimed at preserving evidentiary integrity.
• Content disclosure obligations: health practitioner certificates and analyst certificates have mandatory fields and must be routed to authorised persons and the Regulator respectively (reg 7(2)-(3); reg 9(1)-(3)).

What the Regulations do not stipulate

• The Regulations do not set out penalties for non-compliance within the instrument. They also do not specify accreditation requirements for laboratories, retention periods for samples or certificates, the precise meaning of "qualified person" in reg 7(2)(c) beyond the categories listed, nor who bears financial costs associated with transport, clinical fees or analysis. The absence of these rules means operational policies or other legal instruments will need to address them.

These duties and rights create a structured evidentiary process from initial breath testing through clinical blood draws to laboratory certification and Regulator/employer notification, with discrete responsibilities for authorised persons, clinicians and analysts and specific entitlements for workers.

The Regulations themselves are procedural and do not specify particular penalties or enforcement remedies within their text. They implement and expand procedural detail for powers that originate in the Rail Safety (National Uniform Legislation) Act 2012 (the Act), and as such enforcement and penalty mechanisms for contraventions of the Act (including misuse or non-compliance with testing powers) would be found in the Act rather than these Regulations. The Regulations do, however, create several enforcement- and evidentiary-related mechanisms that affect how information flows and can thus influence enforcement action taken under the Act.

Enforcement-related mechanics present in the Regulations

• Regulator receipt of certificates (reg 9(2)). Analysts must give or retain signed analytic certificates for the Regulator. That requirement creates an evidentiary record under the Regulator’s control, which enforcement officers or investigators operating under the Act would likely draw upon in any compliance proceedings.
• Regulator-to-operator disclosure (reg 9(4)). The Regulator is expressly permitted to give a copy of a signed certificate to the rail transport operator who employs the worker if the certificate indicates the prescribed BAC or a prohibited drug was present. This provision directly supports employer-side disciplinary or safety-management responses by providing the operator with certified analytic evidence.
• Documentary formalities (reg 7 and reg 9). The Regulations require specific contents for certificates prepared by health practitioners (reg 7(2)) and analysts (reg 9(1)), including explicit mention of any factors that might adversely affect accuracy or validity (reg 9(1)(f)). Those formal statements can be used as admissible evidence or as the basis for enforcement decisions by the Regulator or legal proceedings under the Act.

Absence of explicit penalties in the Regulations

• The Regulations do not list fines, criminal offences, or administrative penalties for failing to comply with the procedural requirements they impose (for example, failing to provide an unused mouthpiece, failing to divide a blood sample into three portions, or failing to sign and provide certificates). Because the Regulations are subordinate legislation implementing procedures under the Act, any penalties for contraventions of the testing regime would be located in the Act. The Regulations therefore operate primarily to standardise process and documentary proof rather than to provide stand-alone sanctioning provisions.

Practical enforcement consequences arising from the Regulations

• Evidence admissibility and integrity. By prescribing specific certificates and chain-of-custody steps (sealing, identification numbers, signed certificates), the Regulations are setting the framework that will determine whether analytic results can be trusted, disclosed and used in regulatory or employer actions.
• Information flow to employers. The express permission for the Regulator to provide positive-result certificates to rail transport operators (reg 9(4)) is an enforcement-adjacent mechanism. It does not itself discipline a worker, but it provides operators with certified proof that can trigger employment or safety-management responses, likely governed by workplace policy or other law.
• Reliance on the Act for punitive consequences. Any direct sanctions or further procedural enforcement power (for example, compelling attendance, imposing penalties for refusal to submit to a test) are matters for the Act. The Regulations supply the detailed mechanics that enforcement officers and courts will use when assessing whether procedures were properly followed and whether evidence is reliable.

In summary, the Regulations create documentary and procedural frameworks that support enforcement actions under the Rail Safety (National Uniform Legislation) Act 2012 but do not themselves prescribe penalties. They supply the evidentiary scaffolding that the Regulator and employers will use in consequences under the Act and internal policies.

The Regulations operate as subordinate instruments under the Rail Safety (National Uniform Legislation) Act 2012 (the Act) and explicitly reference at least one other statute for defined terms. The interactions evident from the text are these.

• Reliance on the Act for statutory authority and context. The Regulations repeatedly refer to provisions of the Act. They prescribe matters for the definition of breath analysis instrument in s 10(1) of the Act (reg 3), they prescribe the numerical equivalence in the context of s 10(4) of the Act (reg 4), and they instruct authorised persons who are exercising powers under Part 4, Division 2 of the Act (reg 5). The Regulations therefore function as implementation detail for the Act’s testing and evidentiary powers. Enforcement and penalty structures will be governed by the Act.
• Cross-reference to the Medical Services Act 1982 for setting clinical locales. Regulation 6(7) defines "health centre" and "hospital" by reference to the Medical Services Act 1982 (reg 6(7)). Specifically, a health centre is a health centre within the meaning of the Medical Services Act 1982, and a hospital is a hospital declared under s 6(2) of that Act. This cross-reference binds the blood-sampling requirement to clinical settings that are defined and regulated under the Medical Services Act. The practical effect is that blood draws required under the rail-safety regime must occur in state-recognised medical facilities.
• Interaction with regulatory roles under the Act. The Regulations make the Regulator the repository of analyst certificates and allow the Regulator to disclose results to employers (reg 9(2)-(4)). The Regulator’s functions, powers and duties are set out in the Act; the Regulations slot into that institutional architecture by defining how and when the Regulator will receive evidence and pass it to operators.
• Amendment statutes listed in the endnotes. The endnotes record interactions introduced by later statutes that affected the Regulations: the Medical Services Amendment Act 2019 (Act No. 17, 2019) (assent 30 May 2019; commenced 31 May 2019 s 2), and the Transport Legislation Amendment Act 2022 (Act No. 1, 2022) (assent 1 March 2022; commenced 4 May 2022) (endnotes 2 and 4). The Transport Legislation Amendment Act 2022 contains a repeal of reg 8 (endnote 4 lists r 8 rep Act No. 1, 2022, s 51). These cross-references show that the Regulations have been maintained in the context of broader statute amendments and that their definitions of clinical settings and the relationship to health practitioners are influenced by parallel amendments to medical services law.
• No standalone interaction with criminal procedure or evidentiary codes within the instrument. The Regulations state procedural steps for testing and signing certificates but do not themselves define admissibility rules in civil or criminal proceedings or interaction with evidence statutes. Those interactions will be interpreted in the light of the Act and general evidentiary rules and case law, none of which are contained in the Regulations.
• Silence on accreditation and sample retention rules. The Regulations require analysts to sign certificates and provide certain information (reg 9(1)) but do not themselves prescribe laboratory accreditation standards, retention periods for samples, or chain-of-custody documentary forms beyond the minimum items listed. Interaction with laboratory accreditation regimes, privacy law, or evidentiary retention rules will therefore be mediated by other instruments or policy.

Overall, the Regulations are expressly interstitial: they slot into the Act’s test-and-enforcement architecture and rely on the Medical Services Act 1982 to define clinical premises. They do not attempt to recreate or displace broader statutory frameworks for enforcement, evidence or medical regulation; rather, they specify how the Act’s testing powers are to be operationalised in clinical and laboratory settings recognised by the Medical Services Act.

The Regulations were originally made in 2013 and have been subsequently amended. The instrument provides an endnote summary and a list of amendments; the concrete timeline and amendment references in the source are these.

• Original instrument: Rail Safety (National Uniform Legislation) Regulations (SL No. 1, 2013), notified 11 February 2013, commenced 11 February 2013 (endnote 2).
• First noted amendment instrument: Rail Safety (National Uniform Legislation) Regulations (SL No. 1, 2015), notified 18 March 2015, commenced 18 March 2015 (endnote 2).
• Subsequent related amendments arising from other Acts:
  • Medical Services Amendment Act 2019 (Act No. 17, 2019), assent 30 May 2019, commenced 31 May 2019 (s 2) (endnote 2). The endnotes list that r 6 was amended by Act No. 17, 2019, s 14 (endnote 4).
  • Transport Legislation Amendment Act 2022 (Act No. 1, 2022), assent 1 March 2022, commenced 4 May 2022 (Gaz S20, 29 April 2022) (endnote 2). The instrument records that r 8 was repealed by Act No. 1, 2022, s 51 (endnote 4).
• General formal amendments by interpretation statute: the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) made general amendments of a formal nature to rr 1 and 6 (endnote 3).

Specific regulation amendments recorded in the endnotes (endnote 4)

• r 6 amended by SL No. 1, 2015, r 3; and by Act No. 17, 2019, s 14.
• r 7 amended by SL No. 1, 2015, r 4.
• r 8 repealed by Act No. 1, 2022, s 51.

What the amendment history conveys

• The Regulations have been subject to both subordinate and primary-legislation-driven amendments. The 2015 subordinate instrument amended provisions including regs 6 and 7. Later primary legislation (Medical Services Amendment Act 2019) further amended content (r 6). The 2022 Transport Legislation Amendment Act removed r 8 entirely.
• The endnotes themselves indicate formal housekeeping amendments by the Interpretation Legislation Amendment Act 2018 to rr 1 and 6, suggesting the Regulations were kept aligned with broader interpretive and formatting standards.

Readers should note that the endnotes provide the authoritative list of notifications and commencements for these Regulations as of the instrument’s reprint date, and that certain content has been amended or repealed over time. The Regulations as reprinted incorporate those changes up to the last stated commencement date (4 May 2022 for the 2022 Act).

The Regulations do not record any litigation history in the text provided. The instrument contains no citations to cases, no summaries of judicial interpretation, and no references to decisions that have considered the Regulations. The source therefore documents no litigation or court authorities that interpret or apply the Regulations.

Practical implications of the absence of litigation history in the instrument

• The absence of case citations in the Regulations means that practitioners must rely on the plain terms of the Regulations, the parent Act, and general evidentiary and administrative law when advising on compliance, admissibility and dispute resolution. Any novel or contested points arising from the Regulations (for example, the legal effect of the BrAC-BAC numerical equivalence in reg 4, or what constitutes "reasonable grounds" for reg 5(3)’s 15-minute rule) will need to be resolved in the first instance by administrative decisions or litigation under the Act, none of which are recorded here.
• Where the Regulations cross‑refer to other statutes (for example, the Medical Services Act 1982), litigation over those statutes’ definitions or application may indirectly affect how the Regulations operate. For example, disputes about whether an institution qualifies as a hospital under s 6(2) of the Medical Services Act 1982 could determine whether a particular blood draw complied with reg 6(1). Any such litigation would appear in case law databases or subsequent statutory reprints rather than in the Regulations themselves.

Until judicial interpretation or administrative guidance is available, disputes over evidentiary sufficiency, certificate content, the permissibility of disclosure under reg 9(4), or the sufficiency of steps taken by authorised persons will be assessed against the plain text of the Regulations and the Act.

The Regulations are concise and prescriptive, but several implementation and interpretation issues arise from their text. Below are potential practical “gotchas” and the concrete mechanisms by which they may create friction, ambiguity or operational risk. Each point ties directly to the Regulation cited.

1. Narrow prescription of breath analysis instrument (reg 3)

• The Regulations prescribe the device type as the Dräger Alcotest 7110 family. Procurement of other devices or use of other brands/equipment is not covered by these Regulations for the purposes of the Act’s definition. Practitioners should note that the Regulations’ choice of a single prescribed instrument can create compatibility or replacement issues if an authorised person uses a different instrument. The Regulation’s text does not say whether other devices are permissible or how they might be prescribed; it simply prescribes the Dräger 7110 family.

2. Numeric equivalence of BrAC and BAC (reg 4)

• The table in reg 4 equates BrAC values (g/210 L) with BAC values (g/100 ml) numerically. That conversion is short and categorical in the Regulation, but the Regulation supplies only three worked examples and the Note; it does not set out a general conversion formula or explain how to treat intermediate values. Interpreters must take the Regulation’s statement at face value: the numerical value expressed as BrAC corresponds to the same numerical value expressed as BAC, as shown by the examples. The brevity of the treatment leaves open questions, for instance, about rounding conventions or how to handle values not explicitly tabulated.

3. 15-minute suspicion rule (reg 5(3))

• Authorised persons must not test if they suspect, on reasonable grounds, the worker consumed alcohol within the previous 15 minutes. The rule is conditional and subjective: it depends on the authorised person’s belief and the "reasonable grounds" test. There is no prescribed form of documentation for that reasonable-grounds assessment in the Regulation. This creates a potential evidentiary challenge: if an instrument reading follows shortly after the 15-minute window, a court or employer could scrutinise whether the authorised person had reasonable grounds for deferring the test or for going ahead. The Regulation does not define "reasonable grounds" or supply examples.

4. Responsibility to arrange clinical attendance (reg 6(1)) and presence requirement (reg 6(6))

• An authorised person must "make arrangements" for the worker to be taken to a hospital or health centre and must be present during the taking of the sample. The Regulation does not define what "make arrangements" requires (e.g. whether transport and scheduling are sufficient), nor does it address who bears costs, which may give rise to disputes in practice. The requirement to be present during the draw creates practical scheduling and transport obligations that may be burdensome, particularly in remote or night-time operations.

5. Three-part sample protocol and worker control (reg 7)

• Health practitioners must divide the sample into three approximately equal parts and provide two containers and the certificate to the authorised person, and the third to the worker on request (reg 7(1)-(3)). The "approximately equal" phrasing leaves room for minor variation; however, it may create disputes about whether a sample was divided properly if a laboratory result later depends on volume. The Regulation also creates a worker right to a sample portion, which can be useful for independent testing, but leaves open practical questions about chain of custody, storage and transport of the worker’s sample portion.

6. Analyst certificate obligations including adverse-factor disclosure (reg 9(1)(f))

• Analysts must record any factors relating to the sample or analysis that might adversely affect accuracy or validity. That provision creates an obligation that could be used by an analyst to qualify results and perhaps reduce their utility for enforcement. It also places an evidentiary duty on analysts to document laboratory limitations , a potential mechanism for defence strategies or disputes over test reliability.

7. Regulator may pass results to employers only if "prescribed BAC or a prohibited drug was present" (reg 9(4))

• The Regulation allows the Regulator to provide a copy of the signed certificate to the rail transport operator if the certificate indicates the prescribed BAC or a prohibited drug was present. What constitutes a "prescribed BAC" or which drugs qualify as "prohibited" is governed by the Act or other instruments, not spelled out here. That creates a threshold question: analysts and regulators must determine whether a finding reaches the threshold for employer notification, but the triggering definitions are external to these Regulations.

8. Absence of rules on laboratory accreditation, sample retention, or chain-of-custody forms

• The Regulations do not require laboratories to be accredited to a particular standard, do not set minimal retention periods for samples or specify detailed chain-of-custody documentation beyond identification numbers and certificates. This omission means that issues about laboratory competence, retention for re-analysis, or the precise chain-of-custody trail will be handled under other laws or policies. In practice this can produce litigation or disputes when sample handling or lab competence is contested.

9. No penalties set in the Regulations

• The Regulations do not specify sanctions for failure to comply with their steps. That leaves remedial power to the Act and potentially to courts and employers, but requires stakeholders to map procedural non-compliance to Act-based sanctions or contractual/employer responses.

10. Amendment and repeal history

• r 8 was repealed by the Transport Legislation Amendment Act 2022 (endnote 4). The text of r 8 is not present in the reprint, and the effect of its repeal may have operational consequences depending on what r 8 previously prescribed. Practitioners should be alert to changes recorded in the endnotes and to any consequential policy or practice changes driven by the 2019 and 2022 amendments.

Each of these "gotchas" arises directly from a textual gap, a conditional duty, or a narrowly framed prescription in the Regulations. They are not conclusive objections to the Regulations’ intent; they are practical points that employers, authorised persons, health practitioners, labs and workers will need to address when implementing the testing regime.

The Regulations set discrete, actionable steps for authorised persons, health practitioners and analysts. Below is a compliance-oriented checklist that follows the Regulations’ procedural sequence. The checklist is limited to the duties, rights and documentation the Regulations actually prescribe; it does not impose extraneous obligations beyond the instrument.

For authorised persons (reg 3, reg 5, reg 6)

1. Use a prescribed breath analysis instrument. Ensure the device used is the Dräger Alcotest 7110 family as described in reg 3(1)-(2).
2. Prepare the instrument before each breath test. Turn the instrument on and confirm the display shows "READY TO START" (reg 5(1)(a)-(b)).
3. Provide consumables. Supply an unused mouthpiece for each sample in the breath analysis (reg 5(2)).
4. Apply the 15-minute rule. Do not conduct a breath analysis if you suspect, on reasonable grounds, the worker consumed alcohol within the 15 minutes immediately before the proposed test time (reg 5(3)). Develop an internal process to record the authorised person’s reasonable-grounds decision.
5. If a blood sample is required or requested, arrange clinical sampling. Make arrangements for the worker to be taken to a hospital or health centre as defined under the Medical Services Act 1982, for a health practitioner to take the blood sample (reg 6(1), reg 6(7)).
6. Be present at the blood draw. Ensure the authorised person attends the clinical setting and is present when the health practitioner takes the sample (reg 6(6)).
7. Secure chain of custody. When provided with two containers and the health practitioner’s certificate, retain them in secure storage and ensure documentation links the containers’ identification number to the worker and the incident.

For health practitioners taking the sample (reg 6 and reg 7)

1. Follow the three-part sample protocol. Divide the blood sample into three approximately equal portions, place each in a separate container and seal each container (reg 7(1)(a)-(c)).
2. Mark identification. Mark each container with the sample’s identification number (reg 7(1)(d)).
3. Sign the collector’s certificate. Sign a certificate that specifies the identification number, the worker’s name and address (to the extent known), your name and occupational category (medical practitioner, registered nurse or qualified person), and the date, time and place the sample was taken (reg 7(2)(a)-(d)).
4. Distribute as required. Make two containers and the signed certificate available to the authorised person; give the third container to the worker if requested or otherwise retain it on the worker’s behalf (reg 7(3)(a)-(b)).
5. Maintain clinical records. Keep a local clinical record that documents the division, sealing and identification steps to support any later evidentiary needs.

For analysts and laboratories (reg 9)

1. Ensure sample identification continuity. The analyst certificate must contain the identification number marked on the container (reg 9(1)(a)). Link laboratory records to the health practitioner’s collector certificate.
2. Complete the analyst certificate in full. The person who performed or supervised the analysis must sign a certificate specifying: the identification number, the name and capacity of the person performing/supervising, the date the sample was received by the laboratory, the concentration of alcohol if detected, the type of drug if detected, any factors that might adversely affect accuracy or validity, and any other relevant information (reg 9(1)(a)-(g)).
3. Deliver the certificate to the Regulator and to the worker and health practitioner. Give or retain the signed certificate for the Regulator (reg 9(2)), and make a copy available to the health practitioner and the worker (reg 9(3)).
4. Be prepared for disclosure to employers. If the certificate indicates the prescribed BAC or a prohibited drug was present, the Regulator may provide a copy of the certificate to the rail transport operator who employs the worker (reg 9(4)). Ensure that lab processes anticipate this potential downstream use and document any analytical caveats clearly.

For rail transport operators and compliance officers

1. Expect regulated reporting. Understand that the Regulator may receive analytic certificates and may share positive-result certificates with you (reg 9(2)-(4)). Have policies in place that explain how operator actions will proceed on receipt of such a certificate (while ensuring any action complies with employment law and privacy obligations outside the Regulations).
2. Coordinate with authorised persons. Draft operating procedures that allocate responsibility for arranging clinical transportation and attending the blood draw to an authorised person, as the Regulations require the authorised person to make arrangements and be present (reg 6(1) and (6)).
3. Address cost and logistical gaps. The Regulations do not allocate costs for transport, clinical or laboratory fees. Operators should document who bears these costs in workplace policies or enterprise agreements.

Recordkeeping, training and policy recommendations aligned to the Regulations

• Train authorised persons on device start-up, display indications ("READY TO START"), mouthpiece handling, and on documenting "reasonable grounds" for the 15-minute rule (reg 5).
• Maintain a stock of unused mouthpieces and a log showing when mouthpieces were supplied for tests (reg 5(2)).
• Implement standardised chain-of-custody forms that capture the identification number, container sealing, transfer to authorised person, receipt dates and signatures at each handover point (reg 7 and reg 9).
• Ensure health practitioners are informed of the three-part sample requirement and the distribution obligations so that clinical practice aligns with the Regulations (reg 7).
• Require laboratories/analysts to adopt certificate templates that capture all required items in reg 9(1) and to document any factors that might impair accuracy or validity explicitly.
• Incorporate the Regulations into the safety management system so that breath and blood testing procedures are consistent with workplace disciplinary and privacy procedures. The Regulations supply procedural detail but do not specify employer-side consequences; those must be aligned with employment contracts, industrial instruments and the Act.

Limitations and operational gaps to address in compliance planning

• The Regulations are silent on accreditation and retention periods for samples; hence operators and regulators should specify which laboratories will be used and how long sample portions will be retained for potential re-testing.
• The Regulations do not address payment of clinical or laboratory costs; include explicit provisions in workplace policy or agreements.
• The Regulations’ narrow prescription of instrument type (Dräger Alcotest 7110) means procurement and device-replacement planning must ensure continued compliance or seek legislative prescription changes if alternative devices are preferred.

Following these steps will align practice with the procedural and documentary duties set out in the Regulations. Where the Regulations are silent, complementary policies, contracts and operational standards will be required to fill practical gaps (for example, retention periods, laboratory accreditation, costs and forms), recognising that those matters fall outside the text of these Regulations.
