sec.18 Acting National Rail Safety Regulator
The South Australian Minister may appoint an Acting National Rail Safety Regulator (who may, or may not, be a non‐executive member or a member of the staff of ONRSR) to act in the office of the Regulator and a person so appointed has, while so acting, all the functions and powers of the Regulator. An Acting Regulator may act in the office of the Regulator— during a vacancy in the office of the Regulator (whether or not an appointment has previously been made to the office); or during any period, or during all periods, when the Regulator— is absent from duty or from Australia; or is, for any reason, unable to exercise the duties of the office; or if the Regulator is disqualified from acting in relation to a particular matter—in relation to that matter. Anything done by or in relation to a person purporting to act under an appointment is not invalid merely because— the occasion for the appointment had not arisen; or there is a defect or irregularity in connection with the appointment; or the appointment had ceased to have effect; or the occasion to act had not arisen or had ceased.
