What it does
This instrument, Radiocommunications (Spectrum Re-allocation) Declaration No. 1 of 2011, is a ministerial declaration made under the Radiocommunications Act 1992. The Minister, Stephen Michael Conroy, states he acted having had regard to a recommendation from the Australian Communications and Media Authority under subsection 153F(1) of the Act and makes the Declaration under subsection 153B(1) of the Act, as recorded in the instrument preamble. The Declaration identifies two contiguous frequency ranges, 703 MHz to 748 MHz and 758 MHz to 803 MHz, as parts of the spectrum to be subject to re-allocation under Part 3.6 of the Act, see subsection 4(1). Subsection 4(5) prescribes the mechanism for re-allocation: those parts may be re-allocated only by issuing spectrum licences under Subdivision B of Division 1 of Part 3.2 of the Act.
Geography is specified with precision. Subsection 4(2) applies the Declaration to a National Area defined by the polygonal boundary given in Table A of the Schedule, while expressly excluding the Mid West Radio Quiet Zone, the coordinates of which are set out in Table B of the Schedule. The schedule states that coordinates use the Geocentric Datum of Australia 1994. The re-allocation period and deadline are time‑bounded. Subsection 4(3) fixes the re-allocation period as beginning on 2 November 2011 and ending on 31 December 2014 for each area specified in subsection 4(2). Subsection 4(4) sets the re-allocation deadline as 31 December 2013. Commencement is the day after registration on the Federal Register of Legislative Instruments, per section 2. The Declaration also defines terms by reference to the Act in section 3, for example that "Act" means the Radiocommunications Act 1992 and that "re-allocation period" and "re-allocation deadline" have the meanings given by section 153B of the Act.
Mechanically, therefore, the Declaration does four things. First, it designates specific frequency bands for re-allocation under Part 3.6. Second, it defines the spatial scope of the Declaration with the National Area polygon and an explicit exclusion, the Mid West Radio Quiet Zone. Third, it sets fixed temporal windows for re-allocation (a period and a deadline). Fourth, it prescribes the legal instrument for re-allocation, spectrum licences issued under Subdivision B of Division 1 of Part 3.2 of the Act. The Declaration itself contains no grant of licences, pricing, or administrative detail about how the ACMA is to allocate licences; it confines itself to the designation of bands, area, dates, and the legal form of re-allocation.
