Radiocommunications Spectrum Marketing Plan (3.4 GHz unallocated lots band) 2017

Definitions and mapping: The instrument defines the 3.4 GHz band and the more limited 3.4 GHz (unallocated lots) band with precise frequency ranges and ties geographic scope to ACMA’s Australian Spectrum Map Grid (ASMG) via the hierarchical cell identifier scheme (HCIS) (section 5; Schedule 2). Regions offered for allocation are enumerated in Schedule 2 and identified by HCIS cell identifiers. The instrument notes pictorial maps are indicative only and disclaims responsibility for map accuracy (Schedule 2, note). The numerical convention for frequency ranges includes the higher but not the lower boundary (section 7).

Allocation mechanism: Licence allocation is primarily by simple clock auction, as described in the allocation determination (section 10(1)). The instrument provides for an administrative shortcut where the ACMA may offer a licence at a pre-determined price when it is satisfied only one applicant has nominated a lot as preferred before auction rounds commence (section 10(2)). Lots not allocated at auction or via pre-determined price are subject to post-auction allocation in Schedule 4 of the allocation determination (section 10(3)).

Lot and region structure: The ACMA has divided the unallocated-lots band into individual lots listed in Schedule 1. Each lot is defined by region, frequency range and bandwidth (section 11; Schedule 1 Table 1). Examples include Lot 26 (ADEL02) for 3439-3442.5 MHz in Adelaide (3.5 MHz) and Lot 28 (BRIB02) for 3542.5-3575 MHz in Brisbane B (32.5 MHz). Regions are described via HCIS identifiers in Schedule 2 (section 11(1); Schedule 2 Table 1).

Licence form and term: Licences issued under this instrument must include core licence conditions mandated by section 66 of the Act (section 17(1)). Licences issued after auction or pre-determined price allocation commence on issue and expire on 13 December 2030 (section 16(1)). Licences allocated under the post-auction process commence on the later of the date in the post-auction application, the date issued or 1 February 2018, and also expire on 13 December 2030 (section 16(2)).

Technical conditions: The instrument sets out emission limits outside the licence area (Schedule 3) and emission limits outside the licensed band (Schedule 4). Both Schedules allow licensees to comply with written agreements that set alternative emission limits between the licensee and all affected frequency-adjacent and area-adjacent licensees (Schedule 3(1); Schedule 4(1)). Schedule 4 distinguishes non-spurious emissions and spurious emissions, with separate numerical limits tied to frequency offset ranges and specified measurement bandwidths (Schedule 4 clauses 2 and 3, Tables 1-4). Measurement concepts used throughout are defined in section 5 (for example true mean power, occupied bandwidth, front-to-back ratio).

Registration and exemptions: Licences will include a transmitter registration condition requiring compliance with Part 3.5 of the Act (section 20(1)). The instrument specifies two narrow exemptions from registration under subsection 20(2): (a) transmitters with maximum EIRP less than or equal to 25 dBm per occupied bandwidth; or (b) transmitters with maximum EIRP always less than or equal to 44 dBm per occupied bandwidth, with antenna phase centre ≤10 metres above ground and antenna front-to-back ratio ≥20 dB (section 20(2)(a),(b)).

Market and trading architecture: The instrument permits third-party use and trading in accordance with the Act (sections 25 and 26). It references existing trading rules under section 88 of the Act, namely the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 (section 26 note). The sample spectrum licence in Schedule 5 illustrates typical conditions but is expressly not exhaustive (section 21).

Interoperability and interference management: The instrument points to Radiocommunications Advisory Guidelines (Managing Interference from Spectrum Licensed Transmitters , 3.4 GHz Band) 2015 and Radiocommunications Advisory Guidelines (Managing Interference to Spectrum Licensed Receivers , 3.4 GHz Band) 2015 as means of coordinating services (section 22). It also cross-references the Radiocommunications (Unacceptable Levels of Interference , 3.4 GHz Band) Determination 2015 for registration certificate purposes (section 20 note 3).

Administrative cross-reference architecture: Many operational details, including auction timing, applicant information requirements, first and second auction rounds and post-auction processes, are located in the allocation determination and other legislative instruments to which this instrument refers (sections 5 definitions, 6, 10, 13). The instrument therefore functions as a focal marketing plan that interlocks with the allocation determination and the wider Act.

Directly affected participants

• Prospective applicants and bidders: persons who intend to apply to take part in the simple clock auction under the allocation determination are affected by auction timing, the applicant information package and the ACMA’s advertising of the auction (sections 10, 12 and 13). The instrument makes clear the ACMA will publish application details and provide an applicant information package with the requirements specified in subsection 28(1) of the allocation determination (section 13(1)).
• Successful licensees: parties allocated lots at auction, by pre-determined price offer or through the post-auction process will be issued spectrum licences that commence on issue (subject to the special post-auction start date rules) and expire on 13 December 2030 (sections 15 and 16). Licensees must pay the balance of the pre-determined price or the balance of the winning price before issue (section 15(1)).
• Existing licensees adjacent in frequency or area: those operating under frequency-adjacent or area-adjacent licences are identified as "affected licensees" in Schedules 3 and 4 because their technical rights and obligations are relevant to emission-limit agreements (Schedule 3(1), Schedule 4(1)).

Entities with operational roles

• ACMA: allocates lots, issues licences, registers licences, may refuse registration under the Act and applies conditions; the instrument is made under ACMA’s authority under section 39 of the Act (section 3), and repeatedly invokes ACMA responsibilities in registration (section 24), issuance (sections 15-16) and variation (section 17(2) note). The ACMA also administers trading rules by instrument (section 26 note).
• Auction manager: the allocation determination governs auction rounds and the auction manager sets the start dates and times for rounds referenced in section 10; the instrument defers to the allocation determination for specific auction mechanics and the auction manager’s operational schedules.

Indirectly affected groups

• Third-party operators: licensees may authorise other persons to operate devices under their licence subject to Division 1 of Part 3.2 of the Act (section 25). Third-party operators therefore acquire obligations arising from the principal licence conditions, registration requirements and emission limits where authorised.
• Equipment manufacturers and installers: the instrument’s technical definitions and measurement requirements (section 5; Schedules 3 and 4) affect product specifications, certification and site deployment practices, including antenna specifications (front-to-back ratio) and testing methods (true mean power measurements).
• Buyers and sellers in secondary markets: trading and assignment of licences must comply with Division 5 of Part 3.2 and section 85 of the Act referencing trading rules under section 88 (section 26). Interested purchasers must factor in licence term limits, emission constraints, registerability of transmitters and the sample licence conditions.

Who bears costs and who decides

• Financial cost of acquisition: bidders and, if successful, licensees pay auction prices or pre-determined prices to the ACMA; the licence will only be issued after the relevant balance is paid (section 15). The instrument’s note in section 10(1) places the financial risk of participating in the auction on participants, noting neither the ACMA nor the Commonwealth accepts liability for loss to participants.
• Compliance and technical costs: licensees pay measurement, certification and potential mitigation costs to meet emission limits, register transmitters or obtain certificates under subsection 145(3) of the Act using the Radiocommunications (Unacceptable Levels of Interference , 3.4 GHz Band) Determination 2015 (section 20 note 3).
• Who decides: the ACMA decides on allocation processes and, where only one applicant is identified for a lot before auction rounds commence, may offer allocation at a pre-determined price (section 10(2)). The allocation determination and auction manager control detailed timing and procedures (sections 10 and 13).

Geographic incumbency and mapping uncertainty: Regions are defined by HCIS identifiers (Schedule 2). The instrument warns the pictorial map is indicative and disclaims responsibility for its accuracy (Schedule 2 note). That places the burden on applicants to determine geographic footprints precisely from HCIS listings and the ASMG.

Key duties imposed on licensees

• Payment duty before issue: the ACMA will issue a spectrum licence to the allocated person as soon as practicable after the person pays the balance of either the pre-determined price or the winning price as relevant (section 15(1)). Payment is a precondition to issuance, not a post-issuance obligation.
• Compliance with core licence conditions: licences must include the core conditions required by section 66 of the Act and described in section 17(1), which cover the authorised part(s) of spectrum, maximum permitted emissions outside the part(s) of spectrum, the geographic area within which operation is authorised, and maximum permitted emissions outside that area. Those core conditions will be included in licences issued under this instrument (section 17(2) confirms).
• Observe emission limits: licensees must ensure emissions outside the geographic area comply with Schedule 3 or any written agreement specifying different limits (Schedule 3(1)-(2)); must ensure emissions outside the band comply with Schedule 4 non-spurious and spurious limits unless an agreement applies (Schedule 4(1)-(3)); and must take account of measurement bandwidths and offset definitions in the relevant tables. Table-based limits differ by offset ranges and specified bandwidths.
• Register transmitters: each licence will include a condition prohibiting operation without meeting registration requirements under Part 3.5 of the Act (section 20(1)). Section 20 includes notes that the ACMA may refuse to register a transmitter if it could cause an unacceptable level of interference (note 1 to section 20).
• Ensure exempt devices do not cause harmful interference: a licence condition will require licensees to ensure any transmitter exempt from registration under subsection 20(2) does not cause harmful interference to other devices in the 3.4 GHz band (section 19(4)).

Limited rights or permissions given to licensees

• Right to authorise third parties: licensees may authorise others to operate devices under their licence in accordance with Division 1 of Part 3.2 of the Act (section 25). The instrument does not alter the statutory framework for third-party authorisations but confirms the licence allows delegation consistent with the Act.
• Right to trade or assign: licensees may assign or otherwise deal with whole or part of a licence in accordance with Division 5 of Part 3.2 and the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 under section 88; assignments must comply with the rules required by section 85 of the Act (section 26).
• Right to negotiate alternative emission limits: licensees may enter into written agreements with affected frequency-adjacent and area-adjacent licensees that specify different maximum permitted emission limits in place of the default tables in Schedule 3 and Schedule 4 (Schedule 3(1); Schedule 4(1)). This creates a contractual route to tailor interference arrangements, provided all affected parties join the agreement.

Discretionary powers retained by ACMA

• ACMA may refuse transmitter registration where operation could cause an unacceptable level of interference under subsection 145(1) of the Act (note to section 20). The instrument also notes the ACMA may determine acceptable levels of interference by written instrument under subsection 145(4) of the Act (note to section 20).
• ACMA may vary core conditions with a licensee’s agreement under section 72 of the Act (note to section 17).
• ACMA registers licences in accordance with Part 3.5 and re-issues licences per Division 4 of Part 3.2; it notes re-issued licences can differ in lot composition and conditions, and licensees should not assume identical re-issue terms (section 29).

Ancillary duties referenced to other instruments

• Compliance with allocation determination and applicant information package requirements for taking part in the auction (section 13(1) and note to section 10). The instrument defers to the allocation determination for auction procedures, applicant eligibility, and post-auction allocation processes.
• Compliance with advisory guidelines for coordination and interference management is encouraged (section 22). The advisory guidelines are listed in definitions and are registered instruments.

Measurement and technical duties

• Use of measurement methods that are in accordance with good engineering practice is signalled in the definition of maximum true mean power (section 5 note). Measurement bandwidths, offsets and front-to-back ratios are specified and must be observed to determine compliance with emissions rules in Schedules 3 and 4.

Procedural rights and constraints

• Pre-determined price allocation right for applicant when ACMA is satisfied only one applicant has nominated a preferred lot before auction rounds commence, but this is a right the ACMA may exercise, not an entitlement of the applicant (section 10(2)). The ACMA’s ability to offer pre-determined price allocation is a procedure that can speed allocation where competition is absent.

Express enforcement mechanisms in the instrument

• The instrument itself does not set out new criminal penalties or specific monetary fines. Enforcement and penalties generally reference the Act’s mechanisms. For example, licences are to include core conditions required by section 66 of the Act (section 17(1)) and ACMA’s power to refuse registration is referenced through subsection 145(1) of the Act (note to section 20). The instrument therefore relies on statutory enforcement and sanctioning powers under the Act rather than creating separate sanctions within the marketing plan instrument.

Administrative enforcement and controls

• Refusal to register transmitters: the ACMA may refuse to include transmitter details in the Register if it is satisfied operation could cause an unacceptable level of interference (note to section 20 referencing subsection 145(1) of the Act). Refusal to register prevents lawful operation of the transmitter under the licence because operation without registration would breach the licence condition described in section 20(1).
• Licence variation, suspension and cancellation: the instrument expressly notes that licences are for a fixed term but, in accordance with the Act, may be resumed or cancelled before expiry (section 16 notes). The mechanism and grounds for resumption or cancellation are matters under the Act, not further specified in this marketing plan.
• Conditions on operation: breach of licence conditions (for example emission limits in Schedules 3 and 4 or registration requirements in section 20) would place a licensee in breach of the licence. Enforcement of licence conditions is performed under the Act’s regulatory mechanisms; the instrument does not itself create an enforcement regime.

Contractual enforcement avenues

• Agreements about emission limits: the instrument authorises licensees to enter into bilateral or multilateral written agreements with affected licensees setting alternative emission limits to those in Schedules 3 and 4 (Schedule 3(1); Schedule 4(1)). These agreements are contractual arrangements whose breach would be a private law matter between signatories, in addition to any regulatory implications from failing to meet licence conditions.

Trade and assignment compliance

• The instrument refers to Division 5 of Part 3.2 of the Act and the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 as the statutory and rule framework for assignments and trading (section 26). Compliance with those statutory trading rules is necessary to effect legal transfers; non-compliance could render a purported assignment ineffective and expose parties to enforcement under the Act.

Signals about liability and risk allocation

• Risk of participating in auction: the instrument’s note (section 10(1)) states neither the ACMA nor the Commonwealth accepts liability for any loss or damage suffered by participants in the auction and recommends participants obtain independent legal, technical and financial advice. This allocates financial and legal risk to bidders and signals limited administrative remediation from the ACMA for auction outcomes or processes.

Indirect enforcement links to other determinations

• The note to section 20 references the Radiocommunications (Unacceptable Levels of Interference , 3.4 GHz Band) Determination 2015 as the standard to be used for issuing certificates by accredited persons under subsection 145(3) of the Act. That determination, in turn, will be operational in ACMA’s assessment of whether registration should be refused for interference concerns.

What the instrument does not detail

• It does not list specific penalties or infringement notices for particular breaches; those are part of the Act and other instruments. The marketing plan therefore operates as a specification and delegating instrument, with enforcement relying on the Act’s existing regulatory toolbox and the ACMA’s exercise of statutory powers such as registration refusal, licence variation, cancellation and trading regulation.

Primary statutory anchor: the Act

• The instrument is made under section 39 of the Radiocommunications Act 1992 (section 3). It repeatedly relies on the Act for authority to include core conditions (section 17 references section 66 of the Act), registration requirements (section 20 references Part 3.5), trading and assignment provisions (section 26 references Division 5 of Part 3.2 and section 88), third-party operation (section 25 references Division 1 of Part 3.2), licence variation (section 17 note referencing section 72) and re-issue procedures (section 29 referencing Division 4 of Part 3.2). The instrument is therefore a subordinate instrument operating within the Act’s regulatory architecture.

Linkage to the allocation determination and designation notice

• Allocation procedures, applicant eligibility, the auction system, first and second rounds, post-auction allocation, pre-determined price mechanics and application content requirements are in the Radiocommunications (Spectrum Licence Allocation - Multi-band Auction) Determination 2017, to which the instrument defers repeatedly (sections 5 definitions; sections 10 and 13). The designation notice (Radiocommunications (Spectrum Designation,2 GHz and 3.4 GHz Bands) Notice 2017) is used to ascertain corresponding areas for some frequency ranges in the 3.4 GHz unallocated-lots band (section 5 definition for 3.4 GHz (unallocated lots) band).

Standards and technical determinations

• The instrument refers to advisory guidelines for managing interference (section 5 definitions and section 22). Those advisory guidelines are separate, registered instruments that provide coordination measures. It also references the Radiocommunications (Unacceptable Levels of Interference , 3.4 GHz Band) Determination 2015 as the standard used in issuing certificates for transmitter registration (section 20 note 3). Measurement and testing methods are required to conform to "good engineering practice" as signalled in the definition of maximum true mean power (section 5 note).

Trading rule instruments

• The instrument references the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 as the instrument establishing rules under section 88 of the Act for trading in spectrum licences (section 26 note). Assignments and dealings must comply with those statutory rules.

Register and administrative instruments

• Licence registration details are governed by Part 3.5 and the Radiocommunications (Register of Radiocommunications Licences) Determination 2017 (section 24 note). The instrument requires ACMA to register licences in accordance with Part 3.5 of the Act (section 24).

Gaps and delegation: what this instrument leaves to others

• Auction mechanics, application forms, timing, deposit rules and post-auction allocation procedures are not set out in detail here; the instrument relies on the allocation determination for those matters (section 13; section 10(1)). That concentrates auction procedural authority in the allocation determination and the auction manager.
• Many operational technical rules are in external guidelines and determinations, for example unacceptable interference levels and advisory guidelines; compliance therefore requires cross-referencing multiple documents outside this instrument.

Cross-reference consequences for compliance

• Applicants and licensees must operate across a matrix of instruments: this marketing plan sets lot boundaries, emission-limit defaults and licence-term rules, but the allocation determination governs how entities acquire the licences, and other determinations and guidelines govern registration, trading and interference thresholds. Practically, that increases transaction and compliance costs because parties must consult several registered instruments in addition to the Act to understand their full legal obligations.

Express amendment record in the instrument

• The instrument as provided carries the date 2017 in its title and states in sections 1 and 2 that it is the Radiocommunications Spectrum Marketing Plan (3.4 GHz unallocated lots band) 2017 and that it commences the day after registration. No own-text amendments or historical amendments are shown in the instrument text provided. The instrument contains cross-references to other instruments from 2012 to 2017, for example the Australian Spectrum Map Grid 2012 and the Radiocommunications (Spectrum Licence Allocation - Multi-band Auction) Determination 2017.

Dependencies on instruments with their own histories

• The instrument incorporates by reference, or otherwise depends upon, several other legislative instruments whose amendment histories are separate. Examples include:
  • Radiocommunications (Spectrum Licence Allocation - Multi-band Auction) Determination 2017, which is the source of auction rules, applicant definitions and post-auction processes referred to at multiple points (sections 5, 10 and 13);
  • Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012, which establishes the framework for trading and assignments referenced in section 26; and
  • Radiocommunications (Unacceptable Levels of Interference , 3.4 GHz Band) Determination 2015 and the advisory guidelines, which are referenced in section 5 definitions and the note to section 20 as the standard to be used in certificate issuance and interference assessment.

Implications of no recorded amendments in this instrument

• The instrument itself does not include an amendment history or schedule of past versions. Users should therefore assume the text presented is the operative text as made in 2017, but must verify on the Federal Register of Legislation whether subsequent instruments, variations or repeals have been made. The instrument explicitly notes in section 6(1) that references to other legislative instruments are to those instruments "as in force from time to time", which implies interdependence with instruments that may be amended later.

Practical compliance note on versioning

• Because the instrument cross-references standards and other legislative instruments, changes to those external instruments (for example, the allocation determination, trading rules, register determination, or interference determinations) will affect how this instrument operates in practice. The instrument’s own silence on amendment history means practitioners should track amendments to the Act and all incorporated determinations and guidelines.

No in-text retrospective amendments or transitional provisions shown

• The instrument does not contain explicit transitional measures beyond the commencement and the special post-auction licence commencement date of 1 February 2018 for post-auction allocations (section 16(2)). There are no explicit amendment clauses, savings or transitional schedules included in the text provided.

Instrument text and litigation

• The marketing plan as presented contains no references to past, pending or decided litigation. It does not cite cases, judicial decisions or administrative appeals relating to its content. The instrument is an administrative subordinate instrument that sets processes and technical limits; it does not record litigation history in its text.

Where disputes or litigation would logically arise under the instrument

• Disputes likely to give rise to litigation would, based on the instrument’s references, engage the Radiocommunications Act 1992 and the other determinations it cites. Areas of potential dispute include: ACMA decisions to refuse transmitter registration under subsection 145(1) of the Act (noted in the note to section 20); licence cancellation, resumption or variation under provisions of the Act referred to in the instrument (for example the notes to sections 16 and 17); and the conduct of the auction under the allocation determination, where the instrument’s section 10(1) note expressly disclaims ACMA liability for auction losses.

Procedural context for legal review

• The instrument authorises administrative decisions by the ACMA that are made pursuant to the Act and accompanying determinations. Legal challenges to those decisions would therefore implicate the statutory review routes and general administrative law principles applicable to ACMA decision-making under the Act. The instrument itself does not alter or specify judicial review procedures.

Practical consequence of absent litigation record

• Because the instrument contains no litigation history, practitioners should not infer settled legal interpretation from this instrument alone. Interpretive questions about emission limits, registration refusals, auction process fairness or the meaning of HCIS-defined regions may ultimately be resolved in administrative decisions or litigation that is not recorded in the instrument. Where a party requires certainty, the instrument’s cross-references mean contemporaneous decisions, policy materials and the allocation determination will be material, and judicial interpretation of the Act or these instruments may further refine legal obligations.

Mapping and geographic uncertainty

• The regions in Schedule 2 are described using HCIS identifiers in the ASMG. The instrument includes an "indicative pictorial representation" and disclaims responsibility for the map’s accuracy (Schedule 2 note). Relying on the pictorial map rather than precise HCIS identifiers or the ASMG could lead to erroneous assumptions about coverage. Applicants should use HCIS identifiers, not the illustrative map, to determine geographic area (Schedule 2).

Auction timing and pre-determined price allocation

• The ACMA may, before the auction manager sets the start date and time for first and second auction rounds, offer a lot at a pre-determined price if only one applicant nominated that lot as preferred (section 10(2)). Applicants who assume all lots will be subject to open auction might find a lot allocated at pre-determined price earlier than expected. The instrument places the procedural control of start dates with the auction manager via the allocation determination, so auction sequencing and opportunities to alter strategies may be constrained (section 10(1)).

Payment condition precedent to issue

• Licences are issued "as soon as practicable" only after the successful applicant pays the balance of the relevant price to the ACMA (section 15(1)). Failure to make payment promptly can delay issuance and therefore delay rights to operate. The instrument does not specify late-payment remedies or grace periods; those may be in the allocation determination or auction rules, so participants must check those instruments.

Complex emission-limit regime and measurement subtleties

• Emission limits outside area (Schedule 3) and outside band (Schedule 4) differ by offset ranges, specified bandwidths and categories (non-spurious versus spurious). For example, Schedule 4 Table 1 contains a gap in the first row for 0 kHz ≤ foffset < 5 MHz where no radiated maximum is stated for the 100 kHz specified bandwidth; careful reading is required to avoid misapplying the tables. Measurement definitions such as "true mean power", "occupied bandwidth" and placement of the -3 dB point for foffset are technical and prescriptive (section 5 and Schedule 4 clause 2), so engineers and compliance officers must map signal characteristics precisely to the table structure.

Registration exemptions are narrow and conditional

• Subsection 20(2) sets out two exemptions from transmitter registration. The second exemption is conditional on three requirements: maximum EIRP ≤ 44 dBm per occupied bandwidth; antenna phase centre ≤ 10 metres above ground; and antenna front-to-back ratio ≥ 20 dB. These are cumulative conditions, not alternatives, and deployment that strays on any element will remove the exemption and require registration. Moreover, licence conditions will still require exempt transmitters not to cause harmful interference (section 19(4)), so practical deployment still carries interference risk.

Agreement necessity and unanimity risk

• Both Schedule 3(1) and Schedule 4(1) require any written agreement that specifies alternative emission limits to be between the licensee and "all affected licensees of frequency-adjacent licences and area-adjacent licences". Reaching unanimity among all affected licensees may be time-consuming or impossible, particularly where many adjacent holders exist. The default emission limits therefore may be the only practical option in many instances, constraining operations near sensitive adjacencies.

Interaction with other instruments and versioning risk

• The marketing plan defers many procedural and technical matters to other determinations and guidelines, which it references "as in force from time to time" (section 6(1)). If those other instruments change, the practical legal regime governing auctions, trading, registration and unacceptable interference also changes. Applicants and licensees must track versions of the allocation determination, advisory guidelines and the unacceptable-interference determination.

Licence expiry and re-issue uncertainty

• Licences expire on 13 December 2030 (section 16). The instrument warns that re-issued licences are unlikely to take the same form as originally issued and conditions may change upon re-issue (section 29(2)). Holders should not assume continuity of lot composition, licence term length or conditions at re-issue, which introduces asset risk for long-lived investments.

Trading compliance and assignment formalities

• Assignments must comply with statutory trading rules (section 26). Parties may mistakenly assume a private sale alone is sufficient; statutory procedures and ACMA rules must be followed, which can delay or affect transactional value.

Liability and auction risks

• The note in section 10(1) disclaims ACMA and Commonwealth liability for auction losses and advises independent advice. This allocates the financial and legal risk of auction participation to applicants and warns against assuming administrative recourse for auction outcomes or process errors.

Measurement practice ambiguity

• The definition of maximum true mean power refers to good engineering practice for estimation of measurement accuracy, measurement procedure and adjustments (section 5 note). That phrase is open-ended; licensees should seek clarity on acceptable accredited measurement methods because differing laboratory interpretations could lead to compliance disputes or enforcement actions.

Before the auction

• Read this marketing plan alongside the allocation determination. This instrument defers to the allocation determination for the auction procedures, applicant definitions and post-auction processes (sections 10 and 13). Obtain and study the applicant information package the ACMA will make available; subsection 28(1) of the allocation determination specifies what must be in that package (section 13(1)).
• Map desired coverage to HCIS identifiers. Use the ASMG and HCIS identifiers in Schedule 2 to determine the exact geographic area for each lot. Do not rely on the pictorial map provided for indicative purposes; the ACMA disclaims responsibility for map accuracy (Schedule 2 note). Confirm boundaries with ACMA data and technical advisors.

Bid preparation and finance

• Prepare to comply with auction financial rules in the allocation determination and be ready to pay the balance of the pre-determined price or winning price before issue (section 15(1)). Ensure financial approvals, escrow or payment authorities align with auction timing; the instrument signals payment is a precondition to issuance and does not specify administrative leeway for late payment.

Technical compliance and equipment

• Audit equipment and deployment plans against definition metrics: occupied bandwidth, true mean power, maximum EIRP and front-to-back ratio (section 5). If intending to rely on the registration exemption in subsection 20(2)(b), ensure antenna phase centre will be ≤10 metres and front-to-back ratio ≥20 dB at all times and that maximum EIRP will not exceed 44 dBm per occupied bandwidth.
• Prepare testing plans to demonstrate compliance with emission limits in Schedule 3 and Schedule 4. Understand the particular offset ranges and measurement bandwidths in the tables. Use accredited laboratories and measurement methods consistent with "good engineering practice" and be ready to supply certificates under subsection 145(3) of the Act referencing the Radiocommunications (Unacceptable Levels of Interference , 3.4 GHz Band) Determination 2015 (section 20 note 3).

Interference management and agreements

• Identify all potentially affected frequency-adjacent and area-adjacent licensees early. If operational plans could breach the default emission limits, seek to negotiate written agreements specifying alternative limits. Remember that Schedule 3 and Schedule 4 require the agreement to be between the licensee and all affected licensees, so compile a complete list and contact details from the Register and engage stakeholders proactively.
• Consult the advisory guidelines referenced in section 22 for coordination procedures that will be acceptable to ACMA and adjacent licensees.

Registration and operations

• Where registration is required, lodge transmitter details in the Register per Part 3.5 of the Act and the Radiocommunications (Register of Radiocommunications Licences) Determination 2017 (section 24 note). Anticipate that the ACMA may refuse registration on interference grounds under subsection 145(1) of the Act as noted in section 20; plan mitigations and prepare technical justification to address interference concerns if requested by ACMA.
• For devices exempted under subsection 20(2), keep technical evidence on-site and available to show compliance with the exemption conditions and be prepared to remedy any harmful interference noted by other licensees or the ACMA (section 19(4)).

Licence management and secondary markets

• If contemplating assignment, compliance with Division 5 of Part 3.2 and the Radiocommunications (Trading Rules for Spectrum Licences) Determination 2012 is required (section 26). Engage legal counsel experienced in trading rules early to ensure assignments are effective and meet notification and approval requirements.
• If delegating operation to third parties, ensure authorization documents and operational contracts comply with Division 1 of Part 3.2 and incorporate licence condition compliance requirements, emission limits and registration protocols (section 25).

Record-keeping and audit preparedness

• Maintain records of measurements, certificates, agreements with adjacent licensees, registration filings, and correspondence with ACMA. These records will be important in the event of an ACMA compliance assessment or dispute under the Act.
• Consider insurance and indemnities for auction participation risks. The instrument expressly disclaims ACMA and Commonwealth liability for auction losses (section 10(1) note).

Regulatory change monitoring

• Given the instrument’s reliance on other determinations "as in force from time to time" (section 6(1)), set a monitoring process for amendments to the allocation determination, the advisory guidelines, the trading rules and the unacceptable-interference determination. Changes to those instruments can change auction procedures, trading costs and registration standards.

Operational planning for expiry and re-issue

• Plan operational and commercial life cycles around the fixed expiry date of 13 December 2030 (section 16). Do not assume automatic re-issue or identical re-issue terms; section 29(2) warns conditions and lot composition may change upon re-issue. Consider the asset horizon in investment decisions and contractual commitments tied to licence duration.

Practical checklist summary

• Obtain the applicant information package and allocation determination, confirm HCIS cells for intended lots, prepare finance and bids for the auction mechanism defined in the allocation determination, ensure technical designs meet emission tables or negotiate agreements with all affected licensees, register transmitters where required or verify exemption compliance, comply with charging and residency conditions that will appear in licences (section 19(1)), and maintain contemporaneous technical and contractual records to demonstrate compliance to ACMA.
