Radiocommunications (Register of Radiocommunications Licences) Determination 2017

The Determination revolves around a set of technical, administrative and inter‑instrument concepts that determine what appears in the Register and how related objects are classified. Those concepts are defined in the Determination itself and by reference to other instruments.

Key definitional building blocks:

• Emission designator: For transmitters operated under apparatus licences or spectrum licences, an emission designator is to be determined in accordance with the International Telecommunication Union’s (ITU) Radio Regulations (s 7(1)). For spectrum licences, “necessary bandwidth” in the Radio Regulations is to be read as effective occupied bandwidth (s 7(2)). The Determination therefore imports internationally standardised labelling and metric methodology by reference rather than re‑defining them.
• Effective occupied bandwidth and emission centre frequency: These are technical measures linked to transmitter emissions; effective occupied bandwidth is defined as the minimum width containing 99% of the true mean power of the transmitter’s emission (s 5). Emission centre frequency is the midpoint between the upper and lower limits of that bandwidth (s 5).
• Group of transmitters and group of receivers: Two or more fixed transmitters/receivers are to be treated as a group only if several exacting conditions are met, including same centre frequency and emission designator, common communication purpose (same counterpart receivers/transmitters), identical antenna type/model/manufacturer, antenna locations on the same structure within 20 metres of the phase centre, and identical ACMA‑assigned antenna identification number (s 8(1)(a)-(e); s 9(1)). The Determination also prevents duplication by excluding transmitters/receivers already recorded as part of an existing group in the Register (s 8(2), s 9(2)). Location of a group is to be calculated in accordance with the relevant s.145 determination (s 8(3), s 9(3)), linking grouping and spatial coordinates to a separate interference standard instrument.
• Register items and scope by licence type: The instrument differentiates the Register fields to be maintained for apparatus licences (general, and special rules for fixed licences in s 10A), spectrum licences (s 11) and devices under spectrum licences (s 12). For each it sets lists of administrative identifiers (client numbers, licence numbers, registration numbers), device characteristics (emission designator, power metrics, polarisation, antenna characteristics) and site attributes (site identification number, name, address, coordinates and the precision of those coordinates). It also requires ACMA to record whether the site falls into a high, medium or low density area as defined by the Tax Determination (s 10(7), s 12(4), s 10(5) etc).
• Interdependence with other instruments: The Determination repeatedly cross‑references other instruments. The Tax Determination defines what constitutes high/medium/low density areas (s 5(2)(a)-(c) and note). The Radiocommunications Licence Conditions (Fixed Licence) Determination is specified as the definitional source for terms used in s 10A (s 10A(7)). s.145 determinations are treated as legislative instruments that define how group locations and unacceptable levels of interference are to be worked out (s 5 note; s 8(3), s 9(3), s 11(b),(h), s 12(5)(11)).
• Exemptions and conditional inclusions: A recurring structural concept is that, for certain licence types (area‑wide licence, area‑wide receive licence, and PTS licence), particular Register fields “need not contain” device, antenna or site details unless the licence itself or an instrument made under subsection 110A(1) or (2) of the Act explicitly requires such details (see s 10(4A), s 10(5A), s 10(6A), s 10(7A) and mirrored provisions in s 10A(1)-(6)). This creates a conditional information requirement that depends on licence‑specific conditions or secondary instruments.
• Administrative identifiers: The Determination assumes and mandates a number of ACMA‑assigned identifiers as core linking keys: the client number for licensees and accredited persons, licence numbers, registration numbers for devices, antenna identification numbers, site identification numbers, and an identification code for the frequency band in spectrum licences (s 10(2)-(7); s 11; s 12(1)-(4)). These identifiers are the glue for indexing records in the Register.
• Accreditation and interference certificates: For a transmitter operated under a spectrum licence, the Register must, if applicable, show the client number of the accredited person who issued the interference impact certificate under subsection 145(3) of the Act (s 12(1)(6)). The Determination therefore integrates the accredited person regime into Register entries, tying device registration to certification processes external to the Register.

These concepts combine to make the Register a structured dataset mixing administrative identifiers, internationally aligned technical metrics, site geolocation with precision, and linkages to external determinations that set interference tolerances and tax‑based area classifications. The Determination therefore implements an approach in which ACMA compiles both legal/administrative metadata and detailed radio engineering parameters, with conditional omissions for some licence types where the policy requires less granularity unless specified otherwise.

The Determination allocates responsibilities and creates data dependencies that affect several identifiable actors directly, and others indirectly.

Directly affected actors:

• ACMA (Australian Communications and Media Authority): ACMA is the decision‑maker and data custodian. The Determination prescribes what ACMA must include in the Register for each licence and device class (s 10, s 10A, s 11, s 12, s 13). ACMA assigns a range of identifiers that the Register uses as primary keys: client numbers, licence numbers, device registration numbers, antenna identification numbers, site identification numbers and frequency band identification codes (s 10(2)-(7); s 11; s 12).
• Licence holders: Holders of apparatus licences, fixed licences and spectrum licences must expect that ACMA will record specified administrative and technical details about their licences and devices. The Act requires ACMA to include at least the licensee’s name and postal address and licence start/expiry dates; this Determination adds further detailed fields ACMA is to maintain (see s 10 note and s 11 note). Licence holders must supply or facilitate the supply of technical parameters (antenna model/manufacturer, forward gain, beamwidth, polarisation, transmitter power, emission designator, site coordinates and coordinate precision) where the licence requires those details to be registered under the Act or licence conditions (s 10(5), s 10A(3)-(5), s 12(3)-(6)).
• Accredited persons: Where interference impact certificates under subsection 145(3) of the Act are required to register a transmitter under a spectrum licence, the accredited person’s client number must be recorded in the Register (s 12(1)(6)). Accredited persons therefore become identifiable within the Register entries for devices they certify.
• Equipment suppliers and antenna manufacturers: The Register requires manufacturers’ model and manufacturer details and technical antenna characteristics (s 10(6), s 10A(4), s 12(3)). Those data typically originate from manufacturers or installers; equipment suppliers may therefore be affected in terms of providing or verifying accurate model, gain, beamwidth and front‑to‑back ratio metrics.
• Licensees seeking to register receivers under spectrum licences: The Determination contemplates that licensees may register receivers, and if they do, the Register must contain specific receiver details akin to transmitter parameters (s 12(1), s 12(6)). This gives licensees an option (or obligation, depending on licence conditions) to enter receiver data into an administrative register.

Indirectly affected actors:

• Tower and site operators and landlords: The Register requires site identifiers, addresses and coordinates with stated precision, and a site density classification derived from a Tax Determination (s 10(7), s 12(4)). Site operators may be asked to provide coordinates or to facilitate antenna identification and location data.
• Radio network and system designers: The grouping rules (s 8, s 9) and s.145 determinations used to calculate group location mean network designers must align deployment and labelling practices to comply with the group definitions, particularly when intending to register groups of transmitters or receivers.
• Tax and compliance functions: The Determination explicitly uses the Tax Determination to classify site density (s 5(2), s 10(7)). Entities affected by levy/tax regimes that reference site density (outside this Determination) will need consistent site classification across both registers.
• Users of the Register data: The Determination structures what data will be available in the Register, which will affect downstream users , for engineering coordination, spectrum planning, co‑existence analysis and possibly third‑party commercial products , although the Determination itself does not specify access rules to the Register (its focus is on content).

Specific groups with special treatment:

• Holders of area‑wide licences, area‑wide receive licences, and PTS licences: For these licence types, the Determination repeatedly provides that certain device, antenna and site details “need not” be included in the Register unless the licence itself or an instrument under s 110A(1) or (2) requires those details (s 10(4A), 10(5A), 10(6A), 10(7A), and in s 10A(6) and notes). These licence holders therefore face asymmetric informational obligations compared with other licence types.
• Holders of fixed licences with point‑to‑multipoint systems or point‑to‑multipoint stations: Several exemptions and clarifications in s 10A exempt, for example, the need to register transmitters other than base stations for point‑to‑multipoint systems and to exclude any transmitter details for fixed licence (point to multipoint system) in some cases (s 10A(2)-(4)).

Who decides and what they must do:

• ACMA decides the identifiers to be assigned, what the Register contains and whether particular information is required under licence conditions or instruments under s 110A; ACMA also assigns and records special conditions and advisory notes in the licence entries (s 10(3)).
• Accredited persons issue interference impact certificates under subsection 145(3) of the Act; the Register records the accreditation client number for such persons (s 12(1)(6)).
• Licensees or applicants who register devices must supply information such as device emission designators, power metrics, antenna parameters and site coordinates, where registration is required (s 10(4), s 12(5)).

In short, the Determination places ACMA at the centre of data collection and maintenance, requires licence holders and accredited persons to provide or enable the creation of technical and locational data, and offers exemptions that create different burdens for particular licence classes. The immediate administrative cost is therefore carried by ACMA and by licensees (and their technical service providers) who must prepare and supply accurate, granular technical and geospatial metadata for the Register.

This Determination prescribes what ACMA must include in the Register and thereby implies duties on ACMA and practical obligations for licensees and accredited persons, though it does not itself create criminal offences or civil penalties within its text.

Duties imposed on ACMA by the Determination:

• Maintain specific fields in the Register for each licence type: ACMA must ensure the part of the Register relating to apparatus licences contains the detailed items listed in s 10 (administrative, device, antenna and site details) and the Register relating to spectrum licences contains the items in s 11, and that device‑level details under spectrum licences are captured per s 12. For fixed licences, ACMA must include the details set out in s 10A.
• Assign identifiers and record them: ACMA is responsible for assigning client numbers, licence numbers, registration numbers, antenna IDs and site IDs that the Register entries use as primary identifiers (s 10(2), s 10(5), s 10(6), s 10(7), s 12(1)-(4)).
• Reflect licence status and conditions: ACMA must record licence status (e.g. suspended), special conditions and advisory notes (s 10(3), s 10A(1)(e)-(g), s 11).
• Respect conditional exemptions: ACMA must treat area‑wide, area‑wide receive and PTS licences according to the “need not contain” carve‑outs unless those licences or instruments under s 110A require otherwise (s 10(4A)-(7A), s 10A(6)).

Duties and practical obligations that fall on licensees and related actors:

• Provide technical and administrative data where the licence and the Act require registration: The Determination lists fields that will appear in the Register; while it is ACMA’s duty to maintain the Register, in practical terms licensees must provide accurate details about their devices and sites for ACMA to record, including emission designators, transmitter power, antenna characteristics, azimuth and antenna tilt, and site coordinates with stated precision (s 10(4)-(7), s 10A(2)-(5), s 12(5)-(6)).
• If registering a transmitter under a spectrum licence, ensure an interference impact certificate is obtained where required: The Register entry for a transmitter must include the ACMA client number of the accredited person who issued the interference impact certificate under subsection 145(3) of the Act (s 12(1)(6)). The Determination therefore presupposes compliance with the accredited person certification regime in the Act.
• Provide manufacturer and model data for antennas: The Register requires antenna identification numbers and technical antenna characteristics (s 10(6), s 10A(4), s 12(3)). These data will ordinarily be supplied by equipment vendors, installers or licensees.
• Decide whether to register receivers under spectrum licences: For spectrum licences, the Determination makes receiver registration optional in form by stating that the Register must contain the listed details “if a licensee registers a receiver” (s 12(1)). Licensees therefore have a procedural choice which can carry data obligations if exercised.
• Ensure group registration eligibility: Licensees wishing to register groups of fixed transmitters or receivers must satisfy the strict grouping criteria (s 8, s 9), including identical antenna identification and co‑location within 20 metres of phase centres.

Rights and procedural implications:

• ACMA’s recording discretion is bounded by the Determination: ACMA must include the specified items, but the Determination allows ACMA discretion not to include certain details for specified licence types unless a licence or instrument requires them (s 10(4A)-(7A) and s 10A(6)). That is a procedural right for licensees of those licence classes to avoid certain disclosure, contingent on licence wording.
• Licensees’ basic identification and licence term information is protected as part of the Register under the Act: The Determination notes that the Act already requires ACMA to include licensee name and postal address and licence dates (see the notes to s 10 and s 11). The Determination therefore supplements, but does not displace, those statutory minimums.
• Linkages to other instruments affect what must be recorded: The Determination requires recording of titles of s.145 determinations and of co‑ordination guidelines issued under s 262 where relevant (s 11). This gives licensees advance notice that other legislative instruments will shape how their entries are interpreted and used.

What the Determination does not do (important limits):

• It does not specify enforcement mechanisms or penalties; the text contains no offence provisions (the authority for the Determination is the Radiocommunications Act , s 3 , but penalties and enforcement provisions would be contained in the Act itself, not in this Determination).
• It does not itself create accreditation requirements; instead it references accreditation and interference impact certificates created under other sections of the Act (for example subsection 145(3) and s 263), and requires the Register to record identifiers that link to those regimes (s 12(1)(6)).

In short, the Determination places a duty on ACMA to populate and maintain a detailed Register containing specific administrative, technical and locational metadata for licences and devices. Licensees, accredited persons and equipment suppliers must furnish the data required for those entries; for certain licence classes there is an exemption unless the licence or an instrument specifically imposes registration requirements.

The Determination itself is a legislative instrument made under the Radiocommunications Act 1992 (see s 3) and primarily specifies administrative content obligations for the Register. It does not create specific offences, express civil penalties, or set out enforcement processes within its own text. The Determination relies on the Act for authority and, implicitly, for enforcement mechanisms.

What the Determination states and implies about enforcement:

• Delegated instrument, not the enforcement locus: The Determination is an instrument prescribing the content of the Register. Its operation is authorised by sections 144, 147 and 149 of the Radiocommunications Act 1992 (s 3). Enforcement, sanctions and offences are matters governed by the Act itself; the Determination does not replicate or restate those provisions.
• Link to certification and accreditation regimes: The Determination requires the Register to include the ACMA client number of an accredited person who issued an interference impact certificate under subsection 145(3) of the Act when applicable (s 12(1)(6)). Non‑compliance with requirements to obtain an interference impact certificate or to be accredited are matters under the Act’s accreditation and interference regimes, and would be enforced under the Act’s provisions concerning accreditation, certification and compliance, rather than by this Determination directly.
• Licence conditions matter for registration obligations: Multiple “need not contain” clauses make the inclusion of certain entries conditional on licence terms or instruments made under subsection 110A(1) or (2) of the Act (see s 10(4A), 10(5A), 10(6A), 10(7A), s 10A(6)). Where a licence or an instrument prescribes registration requirements, those licence conditions will typically be enforceable under the Act or under the terms of the licence. Any sanction for failing to comply with licence conditions would therefore derive from the Act or from licence enforcement mechanisms authorised by the Act.
• Recordkeeping and ACMA’s duties: The Determination imposes a duty on ACMA to maintain specified records in the Register. ACMA’s failure to maintain the Register as required would be a failure to perform statutory functions under the Act and could be subject to administrative remedies and review under the usual public law frameworks governing agency action, though the Determination itself does not set out remedies.

Practical enforcement considerations arising from the Determination:

• Indirect enforcement via linked legal instruments: Because the Determination integrates data from s.145 determinations, accredited person certificates, and licence conditions, enforcement of the system will be a combination of (a) ACMA‑level administrative management of the Register, (b) enforcement of accreditation and interference requirements under the Act, and (c) enforcement of licence conditions under the Act. The Determination makes no standalone enforcement rules.
• Evidence and audit implications: The Register is a compilation of identifiers and technical parameters ACMA is required to maintain. That record will likely be used by ACMA for spectrum coordination, interference investigations, and compliance audits. The Determination’s specification of data fields (for example the requirement to record the accredited person’s client number when an interference impact certificate is issued , s 12(1)(6)) indicates the Register is intended to form evidential links between certification and registered operation.
• No explicit private rights of action: The Determination does not create private enforcement mechanisms. Any private rights or remedies arising from incorrect entries or failures to register will depend on the Act’s provisions and established administrative law principles, not on the Determination itself.

What readers should do to evaluate enforcement risk:

• Check the Radiocommunications Act: For specific penalties and enforcement processes that apply when Register content is incorrect or incomplete, or when accredited person rules are breached, consult the Radiocommunications Act 1992 and the licence conditions issued under it. The Determination is content‑specifying; enforcement follows the Act.
• Review licence terms: Because the inclusion of many fields is conditional on licence wording or instruments under s 110A, actual registration obligations , and therefore potential non‑compliance consequences , depend heavily on the licence document. Licence holders should review their own licences for registration obligations.
• Monitor related legislative instruments: s.145 determinations, accreditation rules and the Tax Determination are all legislative instruments that influence Register operation. Enforcement outcomes may hinge on parameters in those instruments.

In short, this Determination prescribes what ACMA must record but leaves the enforcement of registration obligations and any sanctions to the Radiocommunications Act and to licence terms and other legislative instruments that it references.

This Determination is interwoven with the Radiocommunications Act 1992 and with a number of other legislative instruments and references to international rules. It sets content that must be recorded in the Register but repeatedly depends on, and imports meanings from, other laws and instruments.

Direct interactions specified in the Determination:

• Radiocommunications Act 1992: The Determination is made under ss 144, 147 and 149 of the Act (s 3). The notes to ss 10 and 11 explicitly state that the Act already requires ACMA to include the licensee’s name and postal address and licence dates in the Register (s 10 note; s 11 note). The Determination exercises delegated rule‑making authority under those specific Act provisions to determine further details ACMA must store. References in the Determination to subsection 145(3), s 71, s 110A, s 262 and s 263 of the Act indicate it operates within the Act’s wider architecture: s.145 determinations, interference impact certificates, co‑ordination guidelines, licence conditions and accreditation all feed into what the Register must contain (see s 5 definition of interference impact certificate; s 11(b)-(h); s 12(1)(6)).
• ITU Radio Regulations: Emission designators and the measurement format of power and bandwidth are to follow the Radio Regulations published by the International Telecommunication Union (s 7(1)-(2)). The Determination therefore imports international technical standards for emission designation and bandwidth metrics.
• Corporations Act 2001: The Determination uses the term ACN with the meaning given in section 9 of the Corporations Act 2001 (s 5). That links corporate identification in the Register to corporate law identifiers.
• Radiocommunications (Interpretation) Determination 2015 and other internal Definitions: The Determination notes that a number of expressions are defined either in the Act or in the Radiocommunications (Interpretation) Determination 2015 (s 5 note 2), including ACMA, fixed licence, PTS licence, transmitter, receiver, and others, so readers must consult those instruments for the exact substance of those terms.
• Tax Determination (Radiocommunications (Transmitter Licence Tax) Determination 2025): The Determination relies on the Tax Determination for the meaning of area labels (high, medium, low density) and geographic area names such as Sydney, Melbourne, Brisbane, Perth, Adelaide, Newcastle, and others (s 5(2)). It also says the Tax Determination is a legislative instrument available on the Federal Register (s 5 note 1). Because site density classification appears in many Register entries (s 10(7), s 12(4), s 10A(5)(g), etc), the Register’s site‑density metadata is governed by the Tax Determination’s definitions.
• Radiocommunications Licence Conditions (Fixed Licence) Determination 2025: Section 10A(7) identifies that several expressions used in that section come from the Radiocommunications Licence Conditions (Fixed Licence) Determination 2025 (or a later replacement). This ties the fixed‑licence Register content to the fixed‑licence conditions instrument.

Mechanisms of interaction:

• “As in force from time to time” rule for cross‑references: The Determination states that references to any other legislative instrument are to that instrument as in force from time to time (s 6(a)). This means changes in the Tax Determination, Radio Licence Conditions Determination or other instruments will flow through to how Register entries are defined and classified without needing amendment of this Determination.
• Conditional obligations linked to licence wording and s 110A instruments: Several provisions condition Register content on whether a licence or an instrument made under s 110A of the Act requires inclusion (for area‑wide and PTS licences and equivalents, see s 10(4A)-(7A), s 10A(6)). That creates a legal interaction in which licence‑specific instruments (which may be made under other parts of the Act) determine whether the Register contains certain items.
• Use of s.145 determinations for spatial calculation and interference parameters: The Determination delegates the calculation of group locations to s.145 determinations and requires the Register to record parameters used to work out unacceptable levels of interference under the relevant s.145 determination (s 8(3), s 9(3), s 12(5)(11)). Thus, the Register entries will be interpreted in the context of separate interference threshold instruments which are themselves legislative instruments.

Operational interactions to note:

• Data flow between accreditation and registration regimes: The requirement to record the accredited person’s client number where an interference impact certificate is issued (s 12(1)(6)) links the accreditation regime (s 263 of the Act) to the Register, creating an auditable trail between certification and registration.
• Interaction with administrative law and publication rules: Section 6 explicitly points to the Acts Interpretation Act 1901 and the Legislation Act 2003 for rules on references to Commonwealth Acts and legislative instruments (s 6 note 1). Practically, this means the Determination’s references to other instruments are to be interpreted in accordance with established legislative drafting rules and notice regimes.

Limitations and dependencies:

• The Determination repeatedly refers to other instruments but does not reproduce their content. For example, the specific numerical parameters in s.145 determinations and the precise geographic boundaries in the Tax Determination determine how the Register’s fields are to be interpreted in practice. Users of the Register therefore need to consult those instruments in addition to this Determination.
• Because cross‑references are to instruments “as in force from time to time” (s 6), the legal meaning of certain item fields (for example the definition of a “high density area”) may change as later instruments amend the referenced determinations.

In sum, the Determination functions as a schema for data ACMA must hold, but most of the schema’s operational meaning is supplied by related legislative instruments and by international regulatory standards that the Determination imports by reference.

The Determination document itself includes endnotes that explain that the compilation includes an amendment history and that amending laws are annotated in the legislation history (Endnote 3 and Endnote 4). The text provided names the instrument as the Radiocommunications (Register of Radiocommunications Licences) Determination 2017 (s 1), and it expressly refers to later‑dated legislative instruments in its operative text (for example the Radiocommunications (Transmitter Licence Tax) Determination 2025 in the definition of Tax Determination and the Radiocommunications Licence Conditions (Fixed Licence) Determination 2025 referenced in s 10A(7)). These internal references indicate the Determination is structured to remain operable alongside later instruments.

Key points from the Determination about amendments and replacement instruments:

• References to other instruments are dynamic: Section 6 provides that references to any other legislative instrument or other instrument are to that instrument “as in force from time to time” (s 6(a)-(b)). That means the Determination’s cross‑references are designed to track later amendments or replacements to those instruments without requiring a standalone amendment to the Determination.
• Express accommodation of later replacements: Several explicit textual formulations allow for the “later instrument” to replace named determinations. Examples include the definitions in s 5 for “Tax Determination” and the references in s 10A(7) that permit a later instrument to replace the Radiocommunications Licence Conditions (Fixed Licence) Determination 2025 for definition purposes. These clauses indicate that the drafters anticipated updates and provided for automatic incorporation of certain future instruments.
• Endnote structure for amendment records: The endnotes (Endnote 1-4) explain that the compilation includes an amendment history and legislation history and that misdescribed amendments are treated in a particular editorial way under section 15V of the Legislation Act 2003. This signals that the published compilation will annotate amending laws and identify if amendments were misdescribed and not incorporated.

Practical implications for users:

• Check the Federal Register of Legislation and the ACMA’s consolidated instrument list: Because the Determination relies on the Tax Determination and fixed licence conditions determination as they stand “from time to time,” licensees and advisers need to consult the current versions of those instruments to understand the Register’s operational definitions. The Determination’s notes themselves point practitioners to the Federal Register of Legislation (s 5 note 1; s 7 note).
• Expect content to be affected by later instruments: The presence of numerous cross‑references to later legislative instruments means that changes to the Tax Determination, s.145 determinations, or the fixed licence conditions could alter the content that ACMA is required to hold or how fields are to be interpreted (for example changes in area classification rules or in how s.145 determinations calculate group locations).
• Maintain a watchlist of relevant instruments: A practical compliance approach is to monitor the Tax Determination, s.145 determinations relevant to held spectrum licences, the Radiocommunications Licence Conditions (Fixed Licence) Determination and any instruments made under s 110A of the Act. s 6 emphasises that references are current‑state references.

What the Determination does not provide about amendment history:

• The text provided does not include a list of prior amendments to the Determination itself, nor dates of any amendments or repeals of parts of this Determination. It notes the compilation will include amendment history but those entries are not present in the extract provided.
• There is no narrative of prior legislative changes in the operative text; the endnotes state that those histories are compiled and annotated in the legislation history and amendment history sections of the published compilation.

In short, the Determination is drafted to operate alongside and incorporate changes from other instruments over time, and the formal amendment record for the Determination is to be found in the published compiled version and on the Federal Register of Legislation. Practitioners should therefore treat the Determination as part of an evolving legislative ecosystem and verify the current versions of the instruments it references.

The Determination, as provided, contains no references to judicial decisions or litigation arising from it. It does not identify any cases, nor does it purport to summarise litigation concerning its operation. The document’s endnotes explain that the compilation includes amendment and legislation history materials, but they do not include judicial outcomes.

Key points about litigation and review pathways implied by the Determination:

• No cases named in the instrument: The Determination does not cite any court decisions or tribunal determinations. It therefore does not summarise legal interpretations or contested issues adjudicated in the courts or tribunals.
• Administrative law remedies exist outside the Determination: Because the Determination is a legislative instrument made under the Act (s 3), decisions by ACMA under the Act and the Determination will be reviewable in the usual administrative law channels (for example merits review or judicial review), where those remedies are available under the Radiocommunications Act or other procedural law. The Determination itself does not set those review paths, but its status as a legislative instrument means affected persons will have administrative law avenues to challenge ACMA action that relies on this Determination.
• Enforcement and compliance disputes would be upstream: Any dispute over whether required details have been included in the Register, or over the interpretation of grouping criteria or whether a device must be registered, will likely involve the Act’s licence and enforcement provisions, accreditation rules and s.145 determinations. Again, the Determination does not itself identify litigation but will be a relevant statutory instrument in disputes about what the Register should contain.

Practical guidance in the absence of reported litigation:

• Treat the Determination as prescriptive but connected to broader statutory regimes: Where a contested decision arises , for example, whether ACMA should include or exclude certain fields for an area‑wide licence, or whether a set of transmitters form a legally registrable group under s 8 , those disputes will turn on this Determination’s text read together with the Act and related instruments.
• Recordkeeping for potential disputes: Given the Determination’s emphasis on identifiers (client numbers, ACMA assigned IDs), affected parties should maintain copies of certificates and identifiers, and document the basis on which a transmitter or receiver was or was not registered, to support any administrative review.

Because there are no cases named in the instrument and no litigation narrative provided, the Determination delivers the operative rules and leaves legal contestation and interpretation to be developed through applications, licence processes and, if needed, administrative or judicial review under the Act.

The Determination contains a number of provisions that create non‑obvious operational consequences and pitfalls for licensees, equipment vendors and advisers. These are the practical “gotchas” to watch for.

1. Extensive technical fields but conditional exemptions

• The Register requires very granular technical and site fields: emission designator, effective occupied bandwidth, emission centre frequency, transmitter power metrics (including EIRP where applicable), antenna forward gain, 3 dB beamwidth, front to back ratio, antenna size, type, model and manufacturer, antenna height, azimuth, polarisation and antenna tilt, and precision of coordinates (s 10(4)-(7), s 10A(3)-(5), s 12(3)-(6)). Collecting and verifying these fields can be operationally demanding.
• Yet many of those fields “need not” be included for area‑wide licences, area‑wide receive licences and PTS licences unless the licence or an instrument under s 110A requires them (s 10(4A), 10(5A), 10(6A), 10(7A), s 10A(6)). That creates asymmetry across licence types and potential confusion about when information must be supplied.

2. Grouping rules are strict and precise

• To register a group of fixed transmitters or receivers, every element in s 8(1) or s 9(1) must be met: identical centre frequency and emission designator, common communication counterpart, identical antenna make/model, antenna co‑located on the same structure and within 20 metres of all phase centres, and identical ACMA antenna identification numbers. Missing any one of these exact requirements means the group cannot be registered as such (s 8(1), s 9(1)).
• In addition, a transmitter/receiver that is already recorded as part of a group in the Register cannot be included in another group (s 8(2), s 9(2)). Practically, this requires checking the Register for pre‑existing group records before applying for group registration.

3. Location calculations and interference parameters depend on s.145 determinations

• The Determination defers the calculation of group location to relevant s.145 determinations (s 8(3), s 9(3)) and requires that device entries include parameters used to work out unacceptable levels of interference under the s.145 determination (s 12(5)(11)). Users must therefore consult the specific s.145 determination applicable to their licence to understand how location and interference thresholds are computed; the Determination alone is insufficient to determine those outcomes.

4. Reliance on other instruments that may change definitions

• Site density categories (high, medium, low) come from the Tax Determination (Radiocommunications (Transmitter Licence Tax) Determination 2025 or its later replacement) (s 5(2), notes). Because s 6 establishes that references to other instruments are to their versions “from time to time” (s 6), changes to the Tax Determination will alter whether a site appears as high, medium or low density in the Register without needing an amendment to this Determination.
• Similarly, definitions relied upon from the Radiocommunications Licence Conditions (Fixed Licence) Determination 2025 (s 10A(7)) may change the meaning of fixed licence fields.

5. ACMA identifiers are central and must be obtained/used consistently

• The Register records many ACMA‑assigned identifiers (client numbers, antenna IDs, site IDs, registration numbers). These identifiers are central keys; failure to obtain and correctly use them in applications will complicate registration and may delay or misclassify entries (s 10(2)-(7), s 12(1)-(4)).

6. Accredited person linkage creates an auditable chain

• For a transmitter under a spectrum licence, the Register must include the ACMA client number of the accredited person who issued an interference impact certificate under subsection 145(3) of the Act (s 12(1)(6)). Licensees and accredited persons should appreciate that certificate issuance will be recorded in the Register and thus creates an auditable linkage between certification and registration.

7. Receiver registration is optional but consequential

• For spectrum licences, receiver details are required only “if a licensee registers a receiver” (s 12(1)). Registering receivers may be voluntary in some circumstances but, if done, requires the same level of technical detail as transmitters. Licensees must weigh the consequences and obligations before opting to register receivers.

8. Point‑to‑multipoint and point‑to‑multipoint system exemptions

• For fixed licences, several categories of transmitters need not be registered (for example, radiocommunications transmitters other than base stations operated under a fixed licence (point to multipoint station) need not be registered; and for fixed licence (point to multipoint system), no transmitter details need be registered) (s 10A(2), notes). Practitioners must understand the exact licence subclass to know what must be registered.

9. Precision of coordinates is required

• The Register requires not just latitude and longitude but also the precision of coordinates (s 10(7)(d), s 12(4)(4)). That raises practical questions about GPS accuracy, datum standards and how ACMA will display and rely on precision information.

10. No explicit public access terms or data‑protection rules in this Determination

• The Determination prescribes what ACMA must contain in the Register but does not address public access, confidentiality, or data‑protection regimes. Where privacy or commercial sensitivity concerns arise, those will need to be addressed under the Act, ACMA policies or other applicable law.

In short, the Determination mandates a rich set of technical and administrative data, ties registration to external certifications and determinations, and creates asymmetric obligations across licence types. The operational challenges are often in the detail: obtaining manufacturer antenna parameters, coordinating ACMA identifiers, checking for pre‑existing group records, and aligning submissions with applicable s.145 determinations and Tax Determinations.

Complying with the Determination requires a structured process: identify the licence class, map required fields to available data, obtain any required certifications and ACMA identifiers, and submit or maintain accurate records with ACMA. Below is a practical compliance checklist tied to the Determination’s provisions.

1. Identify licence class and applicable carve‑outs

• Determine whether the licence is an apparatus licence, a fixed licence (and which fixed subclass), a spectrum licence, or a class licence (s 10, s 10A, s 11, s 13). The Register’s required fields differ across these classes.
• Check whether the licence is an area‑wide licence, an area‑wide receive licence or a PTS licence, because for those licence types many device, antenna and site details “need not” be included unless the licence or an instrument under s 110A requires them (s 10(4A)-(7A), s 10A(6)). If you hold such a licence, read the licence conditions and any instrument under s 110A carefully.

2. Map required fields against your assets

• For apparatus licences and other licence types, collate the administrative identifiers ACMA requires: licensee client number, trading name, ACN (if a company) (s 10(2); s 11).
• For each licence, capture the licence number, date of effect, licence callsign, licence type, status, special conditions and advisory notes (s 10(3); s 10A(1); s 11).
• For each device intended to be registered, assemble technical data as listed in s 10(4)-(5), s 10A(2)-(4), and s 12(5)-(6): emission designator (per ITU Radio Regulations), effective occupied bandwidth, emission centre frequency, EIRP or transmitter power, power expression form, antenna height above ground, azimuth, polarisation, antenna tilt, and whether the device is part of a group (s 7; s 12(5)). Ensure antenna parameters (forward gain in dBi, 3 dB beamwidth, front‑to‑back ratio in dB, size, type, model, manufacturer) are available (s 10(6), s 12(3)).
• For site entries, obtain site identification numbers from ACMA, site name, site address and latitude/longitude with precision, and classify whether the site is within a high, medium or low density area as defined by the Tax Determination (s 10(7), s 12(4)). Use the Tax Determination’s definitions to classify the site (s 5(2)).

3. Obtain ACMA identifiers and certificates

• Apply to ACMA for client numbers, licence numbers, registration numbers, antenna IDs and site IDs as required by the Register schema (s 10(2), s 10(5)-(7), s 12(1)-(4)).
• For transmitters under spectrum licences that require interference impact certificates, procure the interference impact certificate from an accredited person under subsection 145(3) of the Act. Record the accredited person’s ACMA client number for inclusion in the Register (s 12(1)(6)).

4. Check grouping eligibility before applying

• If intending to register a group of fixed transmitters or receivers, verify strict group conditions: same centre frequency and emission designator, operated for communicating with the same counterparts, identical antenna type/model/manufacturer, on the same structure and within 20 metres of the phase centres, and identical ACMA antenna identification number (s 8(1); s 9(1)). Also confirm none of the devices are already part of a group recorded in the Register (s 8(2); s 9(2)).
• Determine how the group location will be calculated by checking the relevant s.145 determination referenced for that licence (s 8(3); s 9(3)).

5. Prepare coordinate and precision data

• For site coordinates, ensure you can provide latitude and longitude with a statement of the precision of those coordinates (s 10(7)(d); s 12(4)(4)). Confirm the datum (e.g., GDA2020) and the level of horizontal accuracy to record the appropriate precision.

6. Align emission designation and bandwidth with ITU rules

• Use the ITU Radio Regulations to determine emission designators and the form in which power and bandwidth are to be expressed (s 7). For spectrum licences, treat “necessary bandwidth” in the Radio Regulations as effective occupied bandwidth (s 7(2)).

7. Review licence terms and instruments under s 110A

• Confirm whether your licence or any instruments made under s 110A require the inclusion of fields that would otherwise be exempt for area‑wide, area‑wide receive or PTS licences (s 10(4A)-(7A), s 10A(6)). If such instruments exist, ensure you comply with them.

8. Maintain records for audits and updates

• Keep copies of interference impact certificates, equipment specifications (antenna model performance charts), installation surveys showing antenna azimuth and tilt, and GPS logs showing coordinate precision. ACMA’s Register entries will be indexed by identifiers you obtain and by dates/times of registration (s 12(1)(7)), so retain evidence supporting those entries.
• Update ACMA when device status changes (for example, when a licence is suspended or a device ceases operation), as the Register must show licence status and device status fields (s 10(3), s 10(4)(e), s 11).

9. Consider privacy and commercial sensitivity

• The Determination prescribes what ACMA must contain, but it does not set out access controls or confidentiality regimes. If you have commercially sensitive information among the required fields (for example, exact antenna models or EIRP), check the Act and ACMA policy on access, or seek a licence condition under s 71 or an instrument under s 110A where appropriate.

10. Monitor related instruments and regulatory updates

• Because the Determination references other instruments “as in force from time to time” (s 6), maintain a watch on updates to the Tax Determination, s.145 determinations relevant to your spectrum, the Radiocommunications Licence Conditions (Fixed Licence) Determination referenced in s 10A(7), and any ACMA guidelines under s 262. Changes to those instruments may change how the Register fields are interpreted or what must be included (s 11(b), s 11(g)-(h), s 12(5)(11)).

11. Use a checklist when submitting registration material

• For each transmitter (s 12(5)): collect emission centre frequency, emission designator, effective occupied bandwidth, EIRP or transmitter power, power expression form, antenna height, azimuth, polarisation, antenna tilt, parameters relevant to the applicable s.145 determination and whether the device is part of a group.
• For antennas (s 12(3) / s 10(6)): obtain or request antenna identification number from ACMA, forward gain (dBi), 3 dB beamwidth (degrees), front‑to‑back ratio (dB), antenna size, type, model and manufacturer.
• For sites (s 12(4) / s 10(7)): obtain ACMA site ID, site name and address, latitude/longitude and precision, and site density classification.

12. Seek clarification and early engagement with ACMA

• Given the number of technical fields and the interplay with other instruments and certificates, early engagement with ACMA can reduce iteration. Ask ACMA about expectations for coordinate precision, the process for obtaining ACMA IDs, how group entries are represented in the Register, and whether your licence contains any s 110A instruments that alter Register content obligations.

Following this structured approach aligns operational steps with the Determination’s prescriptions and integrates the other instruments the Determination references. The core compliance tasks are to map assets to the required fields, obtain ACMA identifiers and necessary certificates, and keep records that support the Register entries and any future audits.
