Radiocommunications (Public Mobile Telecommunications Services Surveillance Device) Exemption Determination 2011

The Determination is narrowly drafted and contains several practical pitfalls and compliance traps that arise from its conditional structure, cross-references, and role-based thresholds. The following are the principal “gotchas” evident from the instrument’s text.

1. Exemption is limited to Parts 3.1, 4.1 and 4.2 only. The Determination repeatedly states the exemption applies to those specific Parts of the Radiocommunications Act (see cll 4(1), 5(1), 6(1), 7(1), 8(1)). It does not relieve actors from obligations under other parts of the Act, nor does it modify or remove obligations under other federal laws. Practitioners must identify whether the conduct in question implicates other radiocommunications provisions before assuming the Determination provides protection.

2. Training precondition may be operationally strict. For investigators, technicians and maintenance officers the role definitions require that the person “has been trained in the use of the PMTS surveillance device” (cll 4(2)(c), 5(2)(c), 7(2)(c)). The Determination does not define the content, form or recordkeeping standard for that training. Absent clear, contemporaneous documentation demonstrating training, an enforcement or litigation context could put actors at risk of falling outside the exemption.

3. “In the course of” limitation. Each exemption is framed to apply where the act or omission occurs in the course of a specified activity (investigation, training, maintenance, provision of expertise or supply) (see cll 4(3)(a), 5(3)(a), 6(4), 7(3), 8(3)(a)). Acts taken outside the immediate course of those activities , for example, using the device for a private purpose, using the device for an activity that is not part of a formal NSWCC investigation, or possessing the device beyond what the written agreement contemplates , will not be covered.

4. Supplier prohibition on use or operation. Suppliers are exempt only for supply or possession for the purpose of supply and only where the act does not involve the supplier’s use or operation of the device (cll 8(1)-(3)). If a supplier performs testing that amounts to operation, or if a supplier remotely operates a device while delivering it, that activity may not fall within the exemption unless it can be shown to be supply-conforming under the written agreement.

5. Reliance on external authorisations. For investigators, the Determination makes the exemption contingent on either a surveillance device warrant or the protection of s 16 of the NSW Controlled Operations Act (cl 4(3)(c)). If an investigator operates the device without such authorisation or protection, the Radiocommunications Act parts remain applicable. That means operational planning must secure the relevant warrant or controlled operations protection in advance.

6. Interplay with state laws and multi-jurisdictional operations. The Determination explicitly warns that device use must comply with the laws of the jurisdiction where the device is used or operated (cl 5 note). Where NSWCC staff operate devices in other states or territories, they face potentially different surveillance device regimes and warrant requirements. The Determination’s federal exemption does not immunise cross-border activity from those state-specific laws.

7. Commissioner/Assistant Commissioner approval as a gating mechanism. Technicians providing technological expertise to ACC, AFP or state police forces require approval by the Commissioner or an Assistant Commissioner (cl 5(3)(b)). The Determination makes the exemption conditional on that internal approval; lack of recorded approval could be decisive in enforcement or litigation.

8. Narrow device definition. The PMTS surveillance device is defined as a data surveillance device designed to interact with items used in the delivery of public mobile telecommunications services (cl 3). Devices that target other telecommunication modalities or that do not fit this functional description may be outside the Determination’s scope. Practitioners should analyse the device’s technical capabilities against the definition.

9. No specification of recordkeeping or evidence standard. The Determination requires factual conditions (training, approvals, written agreements, warrants) but it does not state a recordkeeping standard or evidentiary list. To rely on the exemption in a contested context, actors will need contemporaneous documentary evidence of training, approvals, authorisations and contractual terms.

10. No express indemnity or civil immunity. The Determination provides an exemption from specific parts of the Radiocommunications Act but does not assert any broader immunity from civil claims, human rights constraints, or state penalties. Any party relying on the Determination should not assume it displaces other legal liabilities.

These “gotchas” require meticulous procedural controls: documentation of training, strict adherence to internal approval processes, advance securing of warrants or controlled-operations protections when required, cautious supplier contract drafting that explicitly addresses the limitation on supplier operation, and legal clearance when operating outside NSW or across jurisdictions.

To rely on the Determination’s exemptions, organisations and individuals should implement concrete operational and compliance steps that map to the instrument’s conditional criteria. The following checklist-style guidance is drawn directly from the Determination’s clauses.

1. Confirm role status and perform role-based onboarding (clauses 4-7)

• Ensure that any person who intends to rely on the exemptions is a member of NSWCC staff and is performing a function or duty in relation to the NSWCC, as required by the role definitions in clauses 4(2), 5(2), 6(2)-(3), and 7(2). Maintain HR records that confirm employment or staff status and the functions or duties performed.

2. Document and evidence training (clauses 4(2)(c), 5(2)(c), 7(2)(c))

• For investigators, technicians and maintenance officers who must be “trained in the use of the PMTS surveillance device,” establish a documented training program and create certificates or training logs. Record the training content, trainer identity, date, and the specific device type covered to demonstrate compliance with the training precondition.

3. Secure and record authorisations required for investigative use (clause 4(3)(c))

• Before a NSWCC investigator uses or operates a PMTS device, ensure that the use is authorised either by a surveillance device warrant under the Surveillance Devices Act 2007 (NSW) (as referenced in cl 3) or is covered by the protection conferred by section 16 of the Law Enforcement (Controlled Operations) Act 1997 (NSW) (cl 4(3)(c)). Keep copies of warrants or controlled-operations authorisations with operational records.

4. Follow internal approval processes for technical assistance (clause 5(3)(b)-(c))

• Where NSWCC technicians intend to provide technological expertise to the Australian Crime Commission, Australian Federal Police or a state or territory police force, obtain written approval from the Commissioner or an Assistant Commissioner. • Suppliers must have a written agreement with the NSWCC to qualify for the exemption. Supplier contracts should (a) be in writing; (b) specify the scope of supply, delivery, and possession for supply; (c) expressly state that the supplier will not use or operate the device (to preserve the supplier exemption’s limitation in cl 8(3)(b)); and (d) include compliance clauses requiring adherence to applicable state surveillance laws. Keep signed copies of the written agreement readily available.

6. Limit supplier activities to supply and possession for supply (clause 8(3)(b))

• Operationally segregate supplier activities so that device testing, configuration or acceptance testing that would constitute “use or operation” is either performed by NSWCC technicians under the Determination’s exemptions or is framed contractually as supply-only activity that does not amount to device operation by the supplier.

7. Maintain operational records demonstrating “in the course of” activities (various clauses)

• Since the exemptions apply only to acts “in the course of” an NSWCC investigation, training, maintenance or supply, maintain contemporaneous operation logs, mission briefs, training schedules, maintenance tickets, and investigation records tying use of the device to the specified activity. These records are the evidentiary foundation for establishing that the exemption applies.

8. Coordinate cross-jurisdictional legal clearances (clause 5 note)

• If device use, operation or testing will occur outside NSW, obtain legal clearances demonstrating compliance with the laws of the jurisdiction where the device is used or operated. The Determination’s note in clause 5 explicitly warns that other state laws will govern device use; compliance with those laws is required even where the Determination provides a federal exemption.

9. Implement compliance review and audit trails

• Set up periodic internal audits to confirm that all uses of PMTS devices are supported by the required training, approvals, warrants, written agreements and records. Because the Determination does not specify recordkeeping standards, adopt conservative documentation practices that would satisfy an enforcement inquiry: training records, signed approvals, warrant copies, written supplier agreements, and contemporaneous operation logs.

10. Limit the device’s technical scope to the Determination’s definition (clause 3)

• Ensure the PMTS surveillance device in use fits the instrument’s functional definition (a data surveillance device designed to search for, identify, locate and track items used in the delivery of public mobile telecommunications services). Where a device has broader or different capabilities, legal advice should be sought before relying on the Determination.

11. Ensure internal governance over Commissioner/Assistant Commissioner approvals

• Create and document an internal process for granting Commissioner or Assistant Commissioner approvals (cl 5(3)(b)). That process should include written application templates, assessment criteria, and retention of approval records.

12. Legal review before any novel operational deployments

• For any operational deployment that raises borderline questions about whether the activity is “in the course of” an investigation, training, maintenance, supply, or is otherwise within the Determination’s scope, obtain legal advice and record that advice to support operational decisions.

Following these steps maps the Determination’s textual conditions into operational controls. Compliance depends on demonstrable documentary proof of role, training, approvals, authorisations and written agreements and on contemporaneous logging tying device use to the specified NSWCC activities. The Determination’s explicit deference to jurisdictional surveillance laws also requires that entities secure any necessary local warrants or approvals before relying on the federal exemption.
