(1) A radiocommunications transmitter must not be operated if its maximum duty cycle exceeds: (a) for operation between 6 am and midnight local time – 0.001%, averaged over one hour, on any given frequency; (b) for operation between midnight and 6 am local time – 0.1%, averaged over one hour, on any given frequency. (2) In this clause, where a radiocommunications transmitter is operated during a period (the total period), the duty cycle is the ratio (expressed as a percentage) of: (a) the period the transmitter was operated; to (b) the total period.
Note: The maximum possible value of the duty cycle is 100%. The value of the duty cycle will be less than 100% if the radiocommunications transmitter was not continuously operated during the total period.
