Radiocommunications Licence Conditions (Scientific Licence) Determination 2023

This instrument, the Radiocommunications Licence Conditions (Scientific Licence) Determination 2023, sets licence conditions that apply to scientific licences issued under the Act and replaces an earlier instrument from 2015 (s 1; s 4). It commences at the start of the day after it is registered on the Federal Register of Legislation (s 2). The instrument is made under subsection 110A(2) of the Act (s 3).

Mechanically, the Determination does four things. First, it declares that, subject to the exception in s 6(3), every scientific licence is subject to the conditions specified in sections 7 and 8 (s 6(1)). Those provisions impose substantive operational constraints: a list of permissible primary purposes for operation of transmitters under a scientific licence (s 7), and an identification/call sign requirement with limited exceptions (s 8). Second, it deals with scientific non assigned stations that were authorised under scientific licences in force immediately before commencement: those licences remain subject to the Part 3 conditions of the 2015 Determination and remain confined to the frequencies specified in the 2015 Determination, but that transitional arrangement is time-limited to 12 months from commencement (s 9(1)-(2)). Third, it repeals the Radiocommunications Licence Conditions (Scientific Licence) Determination 2015 (s 4). Fourth, it clarifies that references to other legislative instruments mean the instruments as in force from time to time and to other instruments or writings as in force or existing from time to time (s 5).

The instrument is short and focused: it creates two core operational licence conditions (purpose and call sign) applicable to scientific licences, preserves limited transitional treatment for pre-existing scientific non assigned stations under the 2015 instrument for 12 months, and otherwise replaces the 2015 Determination. It does not itself set out enforcement sanctions, technical emission parameters, frequency assignments, or other operational details; it relies on the Act and other instruments for definitions and, where a specific condition has been inserted into an individual licence under the Act, it allows that licence-specific condition to prevail to the extent of any inconsistency (s 6(3)).

The Determination anchors around a compact set of concepts and cross-references. It operates by making conditions of scientific licences and by cross-referencing definitions and other instruments rather than by restating technical or definitional material.

Scientific licence as a concept is central, but the Determination does not define it. Instead, it relies on definitions that are in the Act and in determinations made under the Australian Communications and Media Authority Act 2005, as indicated in the instrument (s 6 note 1; s 6 note 2). The instrument also relies on the Act for definitions such as equipment, radiocommunication and radiocommunications transmitter (s 6 note 1). A related concept is scientific non assigned station; the Determination treats such stations distinctly in s 6(2) and in s 9, and notes that other instruments may define that term (s 6 note 2).

Two operative conditions are the Determination’s substantive core. The “purpose of operation” condition restricts permitted uses of transmitters operated under a scientific licence to a list of activities such as research, investigation, instruction, demonstration, testing, trials of new technology, radio propagation path testing, and repair and maintenance (s 7). The wording requires that a transmitter must be operated “primarily” to perform one of the listed purposes (s 7). The “call sign” condition requires transmission of the relevant call sign, or another form of identification that clearly identifies the transmitter, at the start of each transmission or series of transmissions, subject to two narrow exceptions: where the transmission is inaudible or where the mode of transmission makes identification impracticable (s 8(1)-(3)). The Determination defines “relevant call sign” as the call sign specified in the licence by the ACMA at the time the licence was issued (s 8(4)).

The instrument contains an application/inconsistency rule: if a scientific licence contains a condition specified in the licence under paragraph 107(1)(g) of the Act, or imposed under paragraph 111(1)(a) of the Act, and that licence-specific condition is inconsistent with a condition in the Determination, then the licence-specific condition prevails to the extent of the inconsistency (s 6(3)). This preserves the primacy of individually-tailored licence terms inserted under the specified Act provisions. The Determination also clarifies how references to other instruments should be read, that is as references to the instruments as in force from time to time (s 5).

Finally, the Determination includes a transitional scheme for existing scientific non assigned stations: licences in force immediately before commencement that authorised such stations on frequencies specified in the 2015 Determination remain subject to the Part 3 conditions of that 2015 instrument and remain limited to the frequencies specified in it, but this transitional status lapses after 12 months (s 9(1)-(2)). A note indicates that from the commencement of the Radiocommunications (Science and Research) Class Licence 2023, operation of scientific non assigned stations authorised by a scientific licence is authorised by that class licence, and that existing scientific licences will continue in force until their expiry (s 9 note). Those are the main structural concepts to apply when interpreting duties and compliance paths under the instrument.

The Determination applies directly to holders of scientific licences and, during a transitional window, to holders of scientific licences that previously authorised scientific non assigned stations under conditions and frequencies specified in the 2015 Determination (s 6(1)-(2); s 9(1)-(2)). Where a licence authorises operation of a radiocommunications transmitter, the licensee is subject to the two core conditions (purpose and call sign) unless a licence-specific condition under the cited Act provisions is inconsistent, in which case the licence-specific condition prevails (s 6(1); s 6(3)).

Operators and personnel who actually operate radiocommunications transmitters under a scientific licence are directly affected by the operational rules. Section 7 places an operational constraint: an operator must not operate a transmitter under a scientific licence unless the transmitter is operated primarily to perform one of the enumerated activities. That means researchers, laboratory technicians, field teams conducting propagation studies, demonstrators, equipment testers, contractors doing repair and maintenance, and educators running instructional transmissions would fall within the permitted list when acting “primarily” for those purposes (s 7).

Section 8 affects persons operating transmitters by requiring transmission of the “relevant call sign” at the start of each transmission or series of transmissions, unless the transmission is inaudible or the mode makes identification impracticable. The relevant call sign is specified in the licence by the ACMA at issue (s 8(2)-(4)). Thus, the ACMA’s role in specifying the call sign is an affecting factor for licence-holders: the identification duty is anchored to what ACMA specified at licence issuance (s 8(4)).

Holders of pre-existing scientific licences that authorised scientific non assigned stations are affected by the transitional arrangement in s 9. Those licences remain subject to Part 3 of the 2015 Determination and may operate only on the frequencies that were specified for such operation in the 2015 Determination, but that transitional arrangement ceases to have effect after 12 months from commencement (s 9(1)-(2)). The instrument’s note clarifies that, from the commencement of the Radiocommunications (Science and Research) Class Licence 2023, the class licence will authorise operation of such stations, but that existing scientific licences continue until expiry (s 9 note).

Indirectly affected parties include parties who design, manufacture, supply or test radiocommunications equipment intended for use under a scientific licence, because the permitted purposes under s 7 include testing, trials of new technology and demonstration (s 7). Licence applicants and counsel preparing licence conditions should note the inconsistency rule (s 6(3)): individuals or organisations negotiating licence terms under the Act’s relevant paragraphs (107(1)(g) and 111(1)(a)) can have conditions specified in a licence that override the Determination to the extent of inconsistency.

The Determination creates specific duties tied to the operation of radiocommunications transmitters under a scientific licence and recognises certain rights through the consistency rule and through exemptions.

Primary duties

• Duty to operate for permitted primary purposes: Section 7 mandates that a person must not operate a radiocommunications transmitter under a scientific licence unless the transmitter is operated primarily to perform one of the enumerated activities: research into radiocommunications; investigation of radiocommunications; instruction in radiocommunications; demonstration of equipment; testing of equipment; trials of new radiocommunications technology; radio propagation path testing; or repair and maintenance of the transmitter (s 7). The adverb “primarily” is part of the statutory text (s 7) and therefore shapes compliance measurement.
• Duty to identify station by call sign or clear identification: Section 8 requires transmission of the “relevant call sign, or another form of identification that clearly identifies the radiocommunications transmitter” at the start of each transmission, or at the start of each series of transmissions (s 8(2)). The relevant call sign is defined as the call sign specified in the licence by the ACMA at the time the licence was issued (s 8(4)).

Narrow exceptions and qualifications

• Exceptions for inaudible transmissions and impracticable modes: Section 8(3) creates a narrow carve-out. A person operates a station in accordance with the call sign condition if the station is operated to transmit information that is inaudible, or using a mode of transmission such that it is not practicable to identify the station in accordance with s 8(2). The exceptions are expressed in the affirmative: if one of those conditions applies, the operator is taken to be operating in accordance with the call sign condition (s 8(3)).
• Licence-specific conditions prevail where inconsistent: Section 6(3) gives precedence to any condition specified in the licence under paragraph 107(1)(g) of the Act or imposed under paragraph 111(1)(a) of the Act where such a licence-specific condition is inconsistent with a condition in this Determination. The instrument therefore recognises the right of the licensing process under the Act to insert bespoke conditions that displace the Determination to the extent of inconsistency (s 6(3)).

Transitional rights/entitlements

• Pre-existing non assigned stations are permitted to continue under Part 3 of the 2015 Determination and on frequencies specified in that instrument, for up to 12 months from commencement (s 9(1)-(2)). The instrument’s note states that operation of such stations is authorised by the Radiocommunications (Science and Research) Class Licence 2023 from its commencement, and that existing licences continue until expiry (s 9 note).

The Determination does not expressly state penalties, sanctioning measures, administrative enforcement steps, or procedures for breach within its text. The instrument is made under subsection 110A(2) of the Act (s 3), and it frames the conditions as conditions of scientific licences (s 6(1)). That placement is significant: the Determination imposes licence conditions, but does not itself prescribe the consequences of non‑compliance; enforcement, penalties, and remedial powers, if any, are matters handled under the Act and related regulatory instruments rather than within this Determination’s text.

Because the Determination declares that scientific licences are subject to the conditions in ss 7 and 8 (s 6(1)), non‑compliance with those conditions will be a failure to comply with licence conditions as framed by the Determination. The instrument expressly allows for licence-specific conditions made under paragraph 107(1)(g) or imposed under paragraph 111(1)(a) of the Act to prevail to the extent of inconsistency (s 6(3)), which implies that the regulator can, through licence terms, create tailored obligations and thereby also define bespoke enforcement consequences via the Act’s mechanisms. The Determination itself does not enumerate remedial steps such as suspension, revocation, infringement notices or criminal offences.

Readers must therefore treat enforcement as anchored to the Act and associated regulatory powers. The instrument’s note in s 5 points readers to the Acts Interpretation Act 1901 and to section 314A of the Act, signalling that other statutory provisions and the Act should be consulted for interpretive and enforcement matters (s 5 notes). The instrument contains a specific procedural nexus to ACMA: the relevant call sign is the call sign specified in the licence by the ACMA at time of issue (s 8(4)), which reflects ACMA’s role in licence specification and therefore in the administrative process that underpins any enforcement action.

Practical implications of the absence of penalties in the Determination

• The Determination creates clear behavioural expectations (ss 7-8) but leaves enforcement mechanisms to the primary statute and to licence terms. That means compliance assessment, remedies and sanctioning procedures will be found outside the text of this Determination.
• The inconsistency clause (s 6(3)) enables licence-specific conditions to displace Determination conditions; licence-holders and the ACMA therefore have a route to create enforceable deviations through the Act’s licensing powers (s 6(3)).

The Determination is explicitly designed to work with other statutory instruments and the Act rather than to be a standalone code. Section 5 sets a textual rule about references: a reference to any other legislative instrument is a reference to that instrument as in force from time to time, and references to other kinds of instruments or writings are similarly to be read as in force or existing from time to time (s 5). The instrument also includes interpretive notes directing the reader to the Acts Interpretation Act 1901 and to the Legislation Act 2003 for rules on references to Commonwealth Acts and legislative instruments (s 5 notes). The Determination also references section 314A of the Act in a note (s 5 note 3), signalling further statutory cross-linkage.

Operationally, the Determination defers to definitions contained in the Act and in determinations under the ACMA Act 2005. Section 6 notes that expressions such as equipment, radiocommunication and radiocommunications transmitter are defined in the Act (s 6 note 1), and that other expressions, including scientific licence and scientific non assigned station, may be defined in a determination under subsection 64(1) of the ACMA Act 2005 (s 6 note 2). That means the Determination uses external definitional regimes and will inherit any changes to those definitions as those other instruments are amended, consistent with s 5.

The Determination also establishes a hierarchy between its conditions and licence-specific conditions inserted under particular provisions of the Act. Section 6(3) provides that if a condition is specified in a scientific licence under paragraph 107(1)(g) of the Act, or imposed on the licence under paragraph 111(1)(a) of the Act, and that licence condition is inconsistent with a condition in the Determination, the licence-specified condition prevails to the extent of the inconsistency (s 6(3)). This preserves the pre-eminence of individually negotiated or administratively imposed licence conditions under the Act.

The Determination repeals the 2015 Determination (s 4) but retains limited transitional interactions with it. Section 9 keeps licences that were in force immediately before commencement that authorised scientific non assigned stations on frequencies specified in the 2015 Determination subject to the Part 3 conditions of the 2015 Determination and to operation only on those frequencies, but this transitional rule ceases after 12 months (s 9(1)-(2)). The instrument contains an explicit note linking the transition to the Radiocommunications (Science and Research) Class Licence 2023: from that class licence’s commencement, operation of those stations is authorised by the class licence, while existing scientific licences continue until expiry (s 9 note). That indicates an intended interaction among the Repeal, the new Determination, and the class licence regime, but the Determination itself does not restate the class licence terms.

This Determination is short and records only a small set of explicit changes relative to the instrument it replaced. The principal amendment action is repeal of the earlier Determination. Section 4 expressly repeals the Radiocommunications Licence Conditions (Scientific Licence) Determination 2015 (F2015L01284) (s 4). The Determination itself commences at the start of the day after it is registered on the Federal Register of Legislation (s 2).

There are no other amending provisions within the text: the Determination does not amend other instruments directly, nor does it contain schedules that alter technical tables or frequency allocations within its own text. Instead, it replaces the 2015 Determination and establishes new, concise licence conditions (ss 7-8) while providing a transitional mechanism for licences in force immediately before commencement that authorised scientific non assigned stations on frequencies specified in the 2015 instrument (s 9(1)-(2)).

The transitional provision in s 9 is itself time‑limited: subsection (2) states that subsection (1) ceases to have effect after the end of the 12 month period commencing at the time this instrument commenced (s 9(2)). That creates a clear, single-step amendment effect for licences to which the transitional rule applies: they remain subject to Part 3 of the 2015 Determination only for the specified 12 month period after commencement of the 2023 Determination (s 9(1)-(2)).

The Determination relies on dynamic references (s 5) so its interactions with other instruments will track amendments to those instruments: s 5 provides that a reference to any other legislative instrument is a reference to that instrument as in force from time to time and the same rule applies to other kinds of instruments or writings (s 5). The instrument does not itself preclude subsequent amendment by the ACMA or by Parliament under the Act. Any future changes in the Act, the ACMA Act, the Radiocommunications (Science and Research) Class Licence 2023, or other instruments will interact with this Determination in accordance with the cross-references established in s 5 and s 6 notes.

No other historic amendments, prior versions, or amendment dates are recorded in the text beyond the explicit repeal of the 2015 Determination and the commencement timing in s 2. The instrument’s brevity means its amendment history is modest: repeal of the 2015 Determination, commencement upon registration, and a 12‑month transitional recognition for certain pre-existing licences (s 2; s 4; s 9).

The Determination itself contains no references to litigation, case law, judicial interpretation, or administrative appeals. It does not cite any cases and does not record any disputes or prior adjudications related to its text or its predecessor instrument. The instrument is declarative and administrative in character: it sets licence conditions and transitional arrangements without invoking or summarising litigation.

Because the Determination is made under subsection 110A(2) of the Act (s 3) and because it relies on definitions and enforcement regimes in the Act and in determinations under the ACMA Act (s 5 notes; s 6 notes), any litigation about compliance, interpretation or enforcement would arise under those primary statutes or in reviewing administrative decisions made by ACMA. The Determination itself does not describe remedies or judicial review pathways; it therefore provides no internal litigation history.

Practitioners seeking precedential or interpretive guidance must look to the Act, to decisions about licence conditions under the Act, and to any administrative law challenges to ACMA licensing decisions or to enforcement actions that reference the Determination’s conditions (s 3; s 6(3)). The Determination’s text points users to related statutory materials (s 5 notes) but contains no reported cases or litigation references. In short, the instrument’s litigation history section is empty: no cases, no appeals, and no adjudicative content are contained within the Determination itself.

The Determination is concise but contains phrasing and cross-references that create interpretive and compliance traps for licensees and operators. The following items are practical “gotchas” that arise directly from the instrument’s text.

1. “Primarily” in the purpose test (s 7)

• Section 7 restricts operation to transmitters operated “primarily to perform” one of the listed activities. The inclusion of the adverb “primarily” introduces a threshold that is fact‑sensitive. Operators who use transmitters for multiple purposes will need to be able to demonstrate that the principal or dominant purpose is one of the listed activities. The Determination does not define “primarily”; so whether a mixed-use activity complies will depend on interpretation under the Act or in licence-specific terms.

2. Call sign timing and “series of transmissions” (s 8(2))

• The call sign must be transmitted “at the start of each transmission, or at the start of each series of transmissions.” The instrument does not define “series of transmissions.” Operational practice will require licence-holders to adopt a clear internal definition of what constitutes a series for their activities, because occasional bursts or sequences may be treated differently than single transmissions in compliance checks.

3. Narrow exceptions to identification (s 8(3))

• The Determination permits exceptions where a station transmits information that is inaudible, or uses a mode such that identification is not practicable (s 8(3)). Those exceptions are not broad; they are framed as affirmative compliance pathways. Operators should document why a particular transmission is inaudible or why the mode makes identification impracticable to rely on the exception. The Determination does not supply procedural guidance on proof or record-keeping.

4. Relevant call sign fixed at time of issuance (s 8(4))

• The definition of “relevant call sign” ties the duty to the call sign specified by the ACMA at the time the licence was issued (s 8(4)). If a licence is silent as to the call sign, or if the call sign is changed, the operator needs to ensure the licence reflects that specification; otherwise compliance could be uncertain. The Determination does not set a mechanism for changing the specified call sign post-issue within its text.

5. Licence-specific conditions can override (s 6(3))

Compliance with this Determination is primarily about aligning licence operation and operational practices with the two substantive conditions (ss 7-8), checking for licence-specific overriding conditions (s 6(3)), and attending to the transitional rules for pre-existing non assigned stations (s 9). Practical steps, grounded in the instrument text, are as follows.

1. Check the licence for bespoke conditions

• Review the scientific licence to see whether it contains conditions specified under paragraph 107(1)(g) of the Act or imposed under paragraph 111(1)(a) of the Act. If such conditions exist and are inconsistent with the Determination, they prevail to the extent of the inconsistency (s 6(3)). Compliance must be measured against those licence terms as well as against ss 7-8.

2. Ensure primary purpose is one of the listed activities and document it

• Section 7 requires that transmitters be operated primarily for one of the listed purposes. Operators should document the primary purpose of each transmitter deployment, including project plans, logbooks, test reports, experiment designs, or instructional syllabi demonstrating that the dominant use is within the enumerated list (s 7). Where operations are mixed-use, maintain contemporaneous records showing the primary purpose.

3. Implement call sign procedures and recordkeeping

• Adopt operational procedures to transmit the relevant call sign, or another form of identification that clearly identifies the transmitter, at the start of each transmission or each series of transmissions (s 8(2)). Keep identification logs that record when call signs were broadcast, the form used, and any reliance on the exceptions in s 8(3). If your operations will involve modes or inaudible transmissions covered by s 8(3), document technical reasons and operational measures that make identification impracticable or that the transmission is inaudible.

4. Verify the “relevant call sign” in the licence

• The relevant call sign is the call sign specified in the licence by the ACMA at the time the licence was issued (s 8(4)). Confirm the licence specifies a call sign; if not, seek clarification from ACMA or record the authorised identification form. If a change to the call sign is needed, pursue the administrative route in the licence terms or with ACMA as appropriate.
