Radiocommunications Licence Conditions (Area-Wide Licence) Determination 2020

The Determination relies on several recurring legal-technical concepts that determine how duties apply in practice.

• Area-wide licence: The instrument is framed as conditions for "area-wide licences" under subsection 110A(2) (clause 6). The conditions operate by being attached to those licences and so create ongoing obligations for licensees to operate in accordance with the specified rules.
• Frequency band segmentation and endpoints: The instrument treats ranges precisely. Clause 5B prescribes that a frequency-range identifier includes the higher but not the lower number; that technical rule affects the application of sub-band limits (s 5B).
• Inner-footprint and outer-footprint areas: These are defined as aggregations of HCIS blocks listed in Schedules 2 and 3. Multiple constraints depend on whether a transmitter is located inside an inner-footprint or outer-footprint area (e.g. power caps in cl 1 and radiated mean-power tables in cl 10).
• Device categories: The instrument distinguishes base stations, earth stations, indoor transmitters and other fixed or mobile transmitters. Several obligations apply only to certain categories (for example, maximum power caps exempt earth stations, cl 1(4); prohibition on mobile operation applies to 27.5-30 GHz, cl 2).
• Low risk transmitter: Defined in Schedule 1 cl 1A and elaborated in cl 4(2). Devices in this class (very low power, indoor, or certain fixed non-base stations) are exempt from the Register-entry requirement and some other duties.
• The Register and Register Determination: Clause 4 cross-references the Radiocommunications (Register of Radiocommunications Licences) Determination 2017 and makes listing device-level details a precondition to operation for non-exempt transmitters (cl 4(1)). The Register fields required map to subsections 10(4)-(7) of the Register Determination.
• RALI MS 46 and ACMA advisory instruments: Clause 5 makes operation subject to RALI MS 46 coordination, PFD and device-boundary requirements (clause 5). The Determination treats RALI MS 46 as a baseline technical instrument but provides a permission pathway in clause 16 to deviate where necessary.
• Synchronisation and timing: Clause 6 requires a licensee whose device is experiencing or creating interference above a compatibility threshold to adopt an uplink-downlink timing configuration consistent with Appendix A of RALI MS 46 and to synchronise timing with the other devices within a prescribed period.
• Interference thresholds, measurement and priority: Clause 6 cross-refers to the Radiocommunications Advisory Guidelines (Managing Interference to Spectrum Licensed Receivers - 26 GHz Band) 2020 for the compatibility requirement threshold; Note 1 to cl 6 records ACMA's stated practice to give priority to devices registered first in time while disputes are being resolved.
• Co-existence with space and earth receive stations: Clause 10 requires compliance with specific ITU and radiated mean-power limits by elevation angle and frequency band. Clause 11 blocks operation in particular HCIS areas for 25.5-27 GHz and mandates coordination under RALI MS 46 for certain fixed non-base transmitters.
• Unwanted emissions framework: Clause 15 sets multi-tiered unwanted-emission limits depending on whether a transmitter is a base station, earth station, or other, and whether operation commenced before or after 1 September 2027. Different tables and measurement bandwidths apply depending on offset from licence band edges and on frequency ranges.
• Administrative permission and review: Clause 16 creates a defined application path to ACMA for permission to operate otherwise than in accordance with RALI MS 46 requirements relating to matters in clause 5, with statutory timeframes for ACMA decision (30 days), reconsideration (30 days) and a right to apply to the Administrative Appeals Tribunal for review (cl 16(6), (13)-(15)). Applications may be subject to ACMA charges under section 60 of the ACMA Act (cl 16(3)(c)).

These concepts combine regulatory, technical and administrative mechanisms. The instrument makes technical interference management (RALI MS 46, compatibility thresholds, synchronisation) enforceable as licence conditions and embeds a process-based role for the ACMA in approving otherwise non-compliant operation (clause 16). The HCIS lists in Schedules 2 and 3 concretise geographic limits, converting a technical spatial policy into specific block identifiers.

The Determination identifies and binds a set of actors directly and indirectly.

• Licensees of area-wide licences: Primary addressees. The conditions apply to "every area-wide licence" under subsection 110A(2) (clause 6). They carry obligations to register device details, to observe power and steering limits, to manage interference, to keep records for certain transmitters, and to seek ACMA permissions where RALI MS 46 compliance is problematic (cl 4, cl 1, cl 6, cl 14, cl 16).
• Operators of devices under spectrum licences and apparatus licences: They are counterparties in coordination and interference-dispute scenarios. Clause 6 triggers synchronisation duties when interference occurs between devices under an area-wide licence and devices under another area-wide licence or a 26 GHz spectrum licence. Clause 7 governs co-sited interaction with spectrum or apparatus-licence devices.
• ACMA: The Australian Communications and Media Authority plays multiple roles. ACMA can request location and power information (section 7), grant or refuse permissions to depart from RALI MS 46 (clause 16), approve application forms and manners (cl 16(4)-(5)), charge fees under s 60 of the ACMA Act (cl 16(3)(c)), and receive records on request (cl 14(2)). The instrument references ACMA advisory instruments and expresses an ACMA practice of prioritising devices registered earlier during dispute resolution (cl 6 Note 1).
• Holders of 26 GHz band spectrum licences: They are explicitly referenced in clause 6 and clause 5 as parties with which area-wide licence holders must coordinate (e.g. synchronisation, RALI MS 46 coordination matters).
• Operators of earth stations and earth receive stations: Subject to special rules. Certain power limits exempt earth stations (cl 1(4)), yet earth receive stations attract co-existence constraints (clause 11) and earth station operation is prohibited in part of the 25.25-27 GHz band (clause 13), with a narrow exception for standard frequency and time signal-satellite services (cl 13(2)-(3)).
• Operators of body scanners under the specified class licence: Clause 12 forbids harmful interference to devices operating under the Radiocommunications (Body Scanning - Aviation Security) Class Licence 2018. That imposes a protective duty on area-wide licensees.
• Equipment manufacturers, integrators and site managers: Indirectly affected because the Determination mandates technical configurations (elevation angle steering limits, radiated mean-power ceilings, unwanted-emission limits) and record elements like antenna model, gain, polarisation, azimuth and elevation (clause 14). Site managers are specifically referenced as the party to coordinate with under co-siting conditions (clause 7(e)-(f)).
• Inspectors and those exercising powers under the Act: Clause 14(2) obliges licensees to provide records to the ACMA or an inspector on request, so inspectors exercising inspection powers under relevant law will interact with the record-keeping duties.

Who pays and who decides. Licensees bear operational compliance costs: registration, measurement and record-keeping, equipment design choice to meet power and steering limits, and potentially fees for ACMA permissions under clause 16(3)(c). The ACMA decides on permissions and retains discretion to impose conditions, refuse, or accept with conditions; the instrument prescribes timelines, reconsideration and AAT review rights (cl 16).

Geography matters. Operators with devices sited in HCIS blocks listed in Schedules 2 and 3 face differentiated constraints: inner-footprint areas carry stricter local radiated-mean-power limits and different power caps (cl 1, cl 10). Clause 11 lists HCIS identifiers where operation in 25.5-27 GHz is prohibited. The Schedules are exhaustive lists of HCIS blocks and therefore fix geographic application with block-level precision.

The Determination creates positive duties on licensees and procedural rights for applicants and review applicants. Key duties and rights are as follows.

Principal duties

• Register before operating, unless exempt: A licensee must not operate a transmitter under an area-wide licence unless the device details required by subsections 10(4)-(7) of the Register Determination are entered in the Register and the transmitter complies with those entries (Schedule 1 cl 4(1)). Exemptions for "low risk transmitters" are specified in cl 4(2).
• Provide location and power information on request: Under s 7, ACMA or any other person may request in writing the location of all area-wide stations and their maximum total radiated power, and the licensee must provide the information within ten business days unless the device is a mobile station or the information is already in the Register (s 7(1)-(3)).
• Observe maximum total radiated power limits: Schedule 1 cl 1 sets detailed caps by sub-band and footprint status (for example, no greater than 45 dBm/200 MHz for 24.7-27 GHz generally, 30 dBm/200 MHz inside inner-footprint areas for 27-27.5 GHz, and so on; see cl 1(1)-(3) and cl 1(4) exemption for earth stations).
• Operate only at fixed locations in 27.5-30 GHz: A licensee must not operate a transmitter in 27.5-30 GHz while the transmitter is in motion (cl 2).
• Prohibit non-earth base transmitters in 29.5-30 GHz: Licensees must not operate non-earth-station transmitters in 29.5-30 GHz (cl 3).
• Manage interference across the licensee's devices: Clause 8 requires a licensee to manage interference between devices under the same area-wide licence and between devices operated under other licences held by the licensee or under class licences (clause 8).
• Avoid causing harmful interference by low risk transmitters: Clause 9 obliges licensees to ensure low risk transmitters do not cause harmful interference to receivers operated under other licences.
• Comply with RALI MS 46: Clause 5 requires operation to be consistent with requirements in RALI MS 46 on coordination, PFD limits, device boundaries, and interference with specific deep-space complexes, subject to clause 16 permissions.
• Observe co-existence limits with space and earth receive stations: Clause 10 imposes ITU-R Resolution 242 compliance and sets multiple radiated maximum true mean power limits by elevation angle and footprint. Clause 11 prohibits operation in certain HCIS areas in 25.5-27 GHz and requires RALI MS 46 coordination for certain fixed non-base transmitters.
• Keep records for certain high-powered outdoor fixed user-equipment transmitters: Clause 14(1) requires keeping geographic location, emission frequency and designator, antenna details (manufacturer, model, gain, polarisation, azimuth, elevation, height), maximum true mean power and maximum EIRP, and to provide copies to ACMA or an inspector on request (clause 14(1)-(2)).
• Meet unwanted-emission limits: Clause 15 prescribes different unwanted-emission limits for base stations, earth stations and other transmitters across multiple tables, and different limits depending on first operation before or after 1 September 2027.

Administrative rights and procedures

• Apply for permission to depart from RALI MS 46 requirements: Clause 16 permits licensees to apply in writing to ACMA to operate otherwise than RALI MS 46 would require on matters set out in clause 5. Applications must comply with ACMA-approved form and manner and be accompanied by any ACMA charge under s 60 of the ACMA Act (clause 16(2)-(5)).
• Expect ACMA decision within 30 days: ACMA must decide whether to grant permission within 30 days after application or a longer period agreed with the licensee (cl 16(6)). ACMA may grant permission, grant subject to conditions, or refuse (cl 16(8)).
• Reconsideration and AAT review: Licensees can seek reconsideration within 30 days of receiving a refusal or conditional permission; ACMA must reconsider within 30 days and may affirm, revoke or vary the original decision (cl 16(11)-(13)). Written notice of decisions and reasons must be given within 14 days (cl 16(10), (14)). Decisions described in cl 16(14)(b) may be reviewed by application to the Administrative Appeals Tribunal (cl 16(15)).
• Right to synchronise or require synchronisation within time limits when resolving interference: Clause 6 sets a deadline for synchronisation: the later of 14 days after the interference was first reported in writing to the licensee of the first licence, or an alternative day agreed with the other licensee (cl 6(2)). The licensee of the first licence must then implement uplink-downlink configurations or equivalent sequences and synchronise timing with the other devices (cl 6(1)(e)-(f)).

Notice and information duties

• ACMA must be given written reasons when refusing or imposing conditions on permissions and specified rights to request reconsideration and AAT review are communicated within 14 days (cl 16(10), (14)).
• Clause 7 requires licensees to provide requested location and power information within ten business days, subject to Register inclusion exemptions (s 7(2)-(3)).

Taken together, the Determination converts technical operating practices into enforceable licence conditions and establishes an administrative route to depart from some technical baselines, with prescribed timelines, notice requirements and review pathways.

The Determination itself primarily creates licence conditions and administrative processes; it does not set out standalone criminal penalties or monetary fines within its text. Enforcement and remedial mechanics are embedded through condition compliance, ACMA powers and inspection records.

What the instrument provides

• Licence conditions and contravention: The instrument expressly states that the clauses are conditions of licences under subsection 110A(2) (clause 6). Failure to comply with these conditions is, in ordinary statutory regimes, a contravention of licence conditions created under the Act. The Determination cross-references the Register Determination and other instruments (cl 4 Note 1; ss 5A-5B).
• ACMA information and inspection powers: Clause 7 allows ACMA or any other person to request location and maximum radiated power details, with a ten-business-day compliance window (s 7(1)-(2)). Clause 14(2) requires licensees to provide records kept under clause 14 to the ACMA or an inspector "as soon as practicable". These provisions presuppose ACMA's inspection and enforcement functions under the parent Act and the ACMA Act, though the Determination does not itself restate those statutory powers.
• Permission pathway and conditions: Clause 16 gives ACMA the power to grant permissions to operate in ways inconsistent with certain RALI MS 46 requirements, and to impose conditions on such permissions (cl 16(8)). That is a forward-looking regulatory control that can be used to shape compliance as an alternative to enforcement action.
• Reconsideration and AAT review: The instrument gives licensees administrative rights of reconsideration by ACMA and merits review by the Administrative Appeals Tribunal for certain final decisions (cl 16(11)-(15)). Those rights are procedural protections that interact with enforcement: they allow licence-holders to challenge refusals and conditional permissions.

What the instrument does not specify

• No monetary fines or specific sanctions set out in the Determination text: The Determination does not itself prescribe specific pecuniary penalties, suspension mechanisms, or criminal offences. It attaches conditions and references ACMA processes and registers, but the text does not list penalty amounts or refer to particular enforcement sections of the parent Act.
• Enforcement is therefore by reference: Enforcement consequences of contravening licence conditions are realised through the parent Act's enforcement tools, ACMA administrative powers, and existing statutory penalty provisions that the Determination does not reproduce. The instrument’s silence on explicit fines means practitioners must look to the Act and ACMA enforcement provisions to determine specific legal consequences for contraventions.

Practical enforcement levers implied by the Determination

• ACMA can require information and records (s 7, cl 14(2)) and can refuse or condition permissions under cl 16(8). Noncompliance with Register-entry conditions is an express condition of operation (cl 4(1)), so operating without required listing is a failure to comply with licence conditions.
• The Determination signals that management of interference is an operational duty (clauses 6-9). Failure to manage interference could therefore be framed as non-compliance with licence conditions requiring management or non-interference, which ACMA may address under its supervisory powers.
• Administrative relief is available: where a licensee seeks to depart from RALI MS 46, ACMA decision-making and review routes are specified, providing a non-enforcement path to lawful deviation (cl 16).

Implementation and enforcement risk

• Ambiguities about measurement and proof: The Determination sets technical thresholds (dBm/200 MHz, elevation angles, PFD limits) and cross-references RALI MS 46 and ITU instruments. Enforcement will depend on technical measurement practices and on the ACMA’s interpretation of the underlying technical instruments.
• Resource and timing implications: ACMA must decide permissions within 30 days absent agreement, and must reconsider within 30 days on review applications (cl 16(6), (13)). If ACMA uses its discretion to impose conditions or refuses, affected licensees have AAT review rights (cl 16(15)), which elongates resolution timelines and shifts enforcement into administrative litigation.

In short, the Determination converts many operational controls into enforceable licence conditions and builds procedural administrative controls and review rights into the permission regime, but it does not itself set specific monetary penalties or criminal sanctions; such sanctions, if any, must be located in the Act or other statutes referenced by the Determination.

The Determination deliberately cross-references and depends on other instruments and statutory frameworks. Its application and interpretation therefore sit in a network of instruments.

Primary cross-references contained in the instrument

• The Acts Interpretation Act 1901 and the Legislation Act 2003: Clause 5A(Notes) directs readers to s 10 of the Acts Interpretation Act 1901 and subsection 13(1) of the Legislation Act 2003 for rules applying to Commonwealth Acts and legislative instruments. This situates the Determination in the broader statutory interpretation regime (cl 5A Note 1).
• The Radiocommunications (Register of Radiocommunications Licences) Determination 2017: Clause 4 requires device details to be entered into the Register and explicitly references the Register Determination subsections 10(4)-(7) and notes that subclause (1) is a condition of a kind referred to in subsections 10(4A), (5A), (6A) and (7A) of the Register Determination (cl 4(1) Note 1).
• RALI MS 46: Clause 5 mandates compliance with requirements in RALI MS 46 on specified matters (coordination, PFD limits, device boundary locations, interference with the Canberra and New Norcia Deep Space complexes, maximum numbers of transmitters) and clause 16 creates a permission pathway to depart from RALI MS 46 requirements that relate to clause 5 matters (clauses 5, 16). The Determination thereby integrates ACMA’s advisory standards into licence conditions while allowing ACMA to permit departures.
• Radiocommunications Advisory Guidelines (Managing Interference to Spectrum Licensed Receivers - 26 GHz Band) 2020: Clause 6 cross-refers to Schedule 2 of those Guidelines for the compatibility requirement threshold that triggers synchronisation (cl 6).
• ITU instruments: Clause 10 requires compliance with resolves 2.1 and 2.2 of ITU-R Resolution 242 (WRC-19) for operation in 24.7-27.5 GHz and adopts ITU Radio Regulations unwanted-emission requirements for earth stations in cl 15(4), subject to specified exceptions (cl 10(1), cl 15(4)-(5)).
• Radiocommunications (Spectrum Re-allocation - 26 GHz Band) Declaration 2019: Clause 5(d) and multiple notes reference this Declaration for named areas and device-boundary definitions; clause 15 cross-references the Declaration’s named areas for unwanted-emission exceptions (cl 5(d), cl 15(3)-(5)).
• Radiocommunications (Body Scanning - Aviation Security) Class Licence 2018: Clause 12 requires licensees not to cause harmful interference to devices operating under that class licence.

How the Determination relies on other instruments for normative content

• Technical thresholds and compatibility criteria are often defined outside the Determination: the compatibility threshold that triggers synchronisation is not recited in this instrument; instead the Determination instructs application of Schedule 2 to the Advisory Guidelines or any instrument that replaces it (cl 6(b)). Similarly, RALI MS 46 contains coordination and device-boundary methods that the Determination imports by reference (clause 5).
• Measurement standards and unwanted-emission baselines are drawn from ITU Radio Regulations and from the Determination’s own tables. For earth stations, compliance with Appendix 3 of the ITU Radio Regulations is set as the standard (cl 15(4)) with specified local exceptions (cl 15(5)).

Administrative and adjudicative intersections

• ACMA Act s 60: Clause 16(3)(c) makes applications subject to any ACMA charge determined under s 60 of the Australian Communications and Media Authority Act 2005. That imports ACMA’s charging power into the application process.
• Administrative Appeals Tribunal: Clause 16(15) gives a statutory right to apply to the AAT for review of specified ACMA decisions under the permission regime. That integrates administrative merits review procedures into the Determination.
• Parent Act enforcement and inspector powers: The Determination presumes the existence of ACMA and inspector powers to request records and to enforce licence conditions, and cross-references the Register and other instruments. The Determination itself does not restate the Act's enforcement sanctions but operates within that statutory enforcement architecture.

Practical interpretive consequences

• Many substantive technical obligations are operationalised by non-legislative instruments or international instruments. Practitioners must therefore read the Determination together with RALI MS 46, the Advisory Guidelines, the ITU instruments and the Register Determination to determine precise obligations (see clauses 5, 6, 10, 15, 4(1) Note 1).
• The Determination signals that ACMA’s discretionary decision-making and charging powers under the ACMA Act will shape when and how deviations are permitted (cl 16(3)(c), (6)-(9)).
• Geographic rules are concrete and exhaustive within Schedules 2 and 3; practitioners must match HCIS identifiers in Schedules 2-3 with site block identifiers under the Australian Spectrum Map Grid 2012 to determine inner/outer footprint status and forbidden zones (Schedule 2, Schedule 3, notes).

In essence, the Determination is an integrating instrument that binds licence holders to a network of technical standards, spatial definitions and administrative processes spread across ACMA instruments and international radio regulations.

The Determination text supplied does not include an internal amendment schedule, consolidated amendment list, or version chronology within its content. The instrument itself contains notes pointing to the Acts Interpretation Act 1901, the Legislation Act 2003, and specific external instruments, but it does not record prior amendments or their dates in the body of the text provided.

What the text does show that is relevant to amendment and future change

• Reference-to-instruments approach: Clause 5A prescribes that references to legislative instruments are to those instruments "as in force from time to time" and that other instruments or writings are referenced as "in force or existing from time to time." That is an interpretive clause designed to allow the Determination to operate with changing versions of the external instruments it references (cl 5A). The practical effect is that updates to RALI MS 46, the Register Determination, the Advisory Guidelines, ITU instruments or the Radiocommunications Declaration may change operational obligations without this Determination being formally amended.
• The permission mechanism: Clause 16 permits departures from RALI MS 46 requirements by ACMA permission. That mechanism acts as a de facto path to adapt operations on a case-by-case basis in lieu of immediate textual amendment.
• Fixed-date operational thresholds: Clause 15 differentiates unwanted-emission limits based on whether a transmitter was first operated before or on/after 1 September 2027 (see tables 8-9 and 13-14). That fixed date is a built-in temporal amendment point: devices first operated on or after 1 September 2027 face stricter unwanted-emission limits in specified bands. The Determination therefore itself contains a temporal transition point affecting operations and compliance costs.
• Cross-references to replaceable instruments: Clause 6 refers to "Schedule 2 to the Radiocommunications Advisory Guidelines (Managing Interference to Spectrum Licensed Receivers - 26 GHz Band) 2020, or any instrument that replaces that instrument" when defining the compatibility requirement. That again contemplates replacement or update of the referenced Advisory Guidelines.
• Notes identifying source documents as available "as in force on the day it commenced": The Determination’s Notes cite instruments "as in force on the day it commenced" at several points (cl 5(d) note about the Radiocommunications (Spectrum Re-allocation - 26 GHz Band) Declaration 2019). That signals which versions were contemporaneous with this Determination, but also leaves open later revisions by relying on the clause 5A in-force-from-time-to-time rule for some references.

Limitations in the provided text

• No edit history included: The supplied text does not include a schedule of prior amendments, commencement date, or the serial/registration details that usually appear on the Federal Register of Legislation. Therefore, practitioners must consult the Federal Register of Legislation or ACMA sources for the instrument’s legislative history, commencement date and subsequent amendments.
• No transitional provisions other than specified dates: Except for the 1 September 2027 date in unwanted emissions, the Determination does not include explicit transitional arrangements, grandfathering clauses beyond the "first operated before/on or after" distinctions, or savings clauses for devices installed or permitted under earlier arrangements.

Practical takeaway

To determine the amendment history, sequence of versions, and any subsequent changes after the version supplied, users must consult the Federal Register of Legislation and the ACMA. The Determination anticipates interaction with evolving external instruments and builds in at least one explicit temporal cut-off for emission limits, while relying on ACMA’s permission powers and the "as in force from time to time" interpretation for other dynamic elements.

The text provided contains no judicial or tribunal decisions, and it does not itself name any cases or record litigation. The instrument does, however, build in administrative review rights which create potential litigation pathways, and it cross-references other instruments that may themselves have generated disputes. The Determination explicitly creates adjudicative routes as follows.

Statutory and administrative review pathways within the Determination

• Reconsideration by ACMA: Clause 16(11)-(13) permits a licensee to apply in writing for ACMA to reconsider an original decision refusing permission or giving permission subject to conditions. ACMA must reconsider within 30 days and may affirm, revoke or vary the decision.
• AAT review: Clause 16(15) provides a right for a licensee to apply to the Administrative Appeals Tribunal for review of decisions that ACMA must notice under clause 16(14)(b). This supplies a merits-review avenue for licensees dissatisfied with ACMA’s reconsideration-stage outcomes or original decisions in specified circumstances.

Potential disputes and sources of litigation

• Conflicts on interpretation of RALI MS 46 and Advisory Guidelines: Clause 5 imports requirements from RALI MS 46 and clause 6 refers to Advisory Guidelines for compatibility thresholds. Disputes about technical interpretation, measurement methods or whether actual interference exceeds the compatibility threshold could be the subject of administrative review or tribunal litigation following ACMA decisions.
• Permission refusals and conditioned permissions: Clause 16(8) empowers ACMA to refuse permission or to impose conditions. Given the provision for reconsideration and AAT review, litigation potential exists when ACMA imposes conditions that materially constrain operation or refuses an application.
• Enforcement action for contravening licence conditions: Because the Determination establishes licence conditions, any enforcement action taken by ACMA under the parent Act for alleged contraventions could lead to administrative hearings or judicial review, though the Determination itself does not supply examples.

Absence of reported cases in the text

• The Determination does not cite precedents nor does it record any litigation outcomes. It mentions the AAT review right but does not document any decisions or reported litigation about the Determination or its predecessor instruments.

Practical steps for practitioners

• If a licensee faces an adverse ACMA decision under clause 16, the immediate statutory route is reconsideration by ACMA within 30 days and, if necessary, application to the AAT under clause 16(15). For enforcement actions based on licence-condition contraventions, the licensee will need to map the parent Act’s enforcement provisions and ACMA processes to litigation strategy; those are outside this Determination’s text.
• Because the Determination imports technical standards from RALI MS 46, the Advisory Guidelines and ITU instruments, disputes are likely to be technical in nature, implicating expert evidence on measurement, PFD, beam steering, and compatibility thresholds.

In sum, while the Determination itself does not recount litigation history, it establishes administrative review rights that form the likely route for disputes and potential AAT proceedings.

This section flags provisions that practitioners must not overlook because they materially affect compliance, technical design or administrative risk.

1. Frequency-range endpoint rule flips inclusivity: Clause 5B states that a range identifier "includes the higher, but not the lower, number." This is not the usual inclusive both-ends convention; it means that an instrument specifying 24.7 GHz-27 GHz, for example, applies at 27.000... GHz but not at 24.7 GHz itself. Misunderstanding this could lead to off-by-a-hertz compliance errors in transmitter configuration.

2. Register precondition to operation with narrow low-risk exemptions: Clause 4(1) makes entry of specified device details into the Register a precondition to operating under an area-wide licence. The exemption in cl 4(2) for low risk transmitters is precise: power ≤23 dBm/occupied bandwidth, indoor transmitters meeting PFD rules, or fixed non-base stations with >23 and ≤35 dBm per occupied bandwidth. Devices that are close to these thresholds cannot rely on informal practice; they must be classified and registered correctly.

3. The ACMA can demand device locations and power within ten business days: Section 7 requires provision of location and maximum total radiated power within ten business days upon written request, with only very narrow carve-outs. Failing to reply promptly is a compliance risk (s 7(1)-(2)).

4. Geographic lists are exhaustive and granular: Schedules 2 and 3 list HCIS identifiers in exhaustive tables. Determining whether a site is inside an inner-footprint, outer-footprint or a prohibited area requires precise HCIS mapping to the Australian Spectrum Map Grid 2012. Mis-mapping can change applicable power limits and whether operation is prohibited (cl 10, cl 11, Schedules 2-3).

5. Different power caps for nearly identical sub-bands depending on footprint and device category: Schedule 1 cl 1 sets 45 dBm/200 MHz for 24.7-27 GHz generally, but 30 dBm/200 MHz inside inner-footprint areas for 27-27.5 GHz, 42 dBm/200 MHz in outer-footprint for 27-27.5 GHz, and 30 dBm/200 MHz for 27.5-29.5 GHz. Earth stations are excluded from cl 1(1)-(3) by cl 1(4). Ensure device classification and footprint status are correct; the wrong classification can produce a large compliance gap.

6. Steering and elevation angle limits are complex and intersect with power thresholds: Clause 10 contains multiple tables (Tables 1-5) setting radiated maximum true mean power by elevation angle and footprint. Those limits apply only above certain total radiated-power thresholds and are contingent on whether an antenna's highest gain is above the horizontal plane or whether electronic steering directs beams above the horizontal plane. Small changes in antenna mechanical tilt or steering logic can create non-compliance.

7. Mobility restriction in 27.5-30 GHz: Clause 2 forbids operating a transmitter in 27.5-30 GHz while in motion. That means mobile deployments, vehicular base stations or drone-based operation are prohibited in that band. Devices intended for mobility must be resited or use different bands.

8. Temporal cut-off for unwanted-emission limits: Clause 15 differentiates unwanted-emission limits for devices first operated before 1 September 2027 and those first operated on/after that date. This creates a "first-operated" registration-dependent discontinuity. Licensees should retain evidence of first operation dates and register accurately, because different obligations apply.

9. Synchronisation duty can be imposed quickly: If interference above the compatibility threshold is reported in writing, the licensee of the first licence must manage the interference by synchronising with other devices by the later of 14 days after written notice or an agreed alternative day (cl 6(1)-(2)). This is a short operational window for systems that may require planning across multiple operators.

10. ACMA discretion and charges: Clause 16 allows ACMA to require applications in specified forms, to charge under s 60 of the ACMA Act, and to impose different applicable requirements than those sought by the applicant (cl 16(3)-(9)). Applicants should budget for possible ACMA fees and the risk ACMA may add conditions.

11. Low risk transmitter definition uses both PFD and total radiated power metrics: "Indoor transmitter" is defined in terms of power flux density at points 2 metres from the outside surface with different PFD thresholds across sub-bands (Schedule 1 cl 1A). Measuring PFD at those points is a practical testing burden; operators must be able to demonstrate compliance.

12. Co-existence with body scanners and other protected services: Clause 12 prohibits harmful interference to devices under the Radiocommunications (Body Scanning - Aviation Security) Class Licence 2018. Even low-risk deployments must take care near airports and security screening areas.

13. Permission decisions are reviewable but only after initial reconsideration steps: The right to AAT review is not automatic for every ACMA decision under clause 16; it applies after specific notifications and reconsideration sequences set out in cl 16(10)-(15). Procedural time limits must be carefully observed to preserve review rights.

14. The Determination imports external technical standards that evolve: Clauses 5 and 6 refer to RALI MS 46 and Advisory Guidelines "or any instrument that replaces that instrument." Licensees must monitor not only this Determination but also updates to those referenced instruments to know if technical baselines have shifted.

Each of these points can produce significant compliance cost, technical rework or exposure to administrative decisions. Practitioners advising operators must check RC register entries, HCIS mapping, device category, first-operation dates, and ACMA forms/fees before bringing new equipment into service.

Compliance requires a combination of technical, administrative and operational steps. Below is a practical checklist and explanation grounded in the Determination’s text.

1. Classify devices and map sites

• Determine whether each transmitter is a base station, earth station, indoor transmitter, mobile station, fixed transmitter that is not a base station, or a low risk transmitter. The Determination’s definitions for indoor transmitter and low risk transmitter are in Schedule 1 cl 1A and cl 4(2).
• Map each antenna site to HCIS block identifiers and determine whether a site is inside an inner-footprint or outer-footprint area using Schedules 2 and 3 and the Australian Spectrum Map Grid 2012 (Schedule 2/3 notes). This drives footprint-specific power and elevation-angle limits (cl 1, cl 10).

2. Register required device details before operation

• For transmitters not qualifying as low risk under cl 4(2), enter the required details in the Register as per cl 4(1) and the Register Determination subsections 10(4)-(7). The Register entries must include transmitter details, spectrum use details, antenna details and site details (cl 4(1)).
• Ensure the Register entries accurately reflect first-operation dates because unwanted-emission obligations depend on whether a transmitter was first operated before or on/after 1 September 2027 (cl 15 tables 8-9 and 13-14).

3. Observe power and unwanted-emission limits

• Configure transmitter total radiated power not to exceed the caps in Schedule 1 cl 1 for the relevant frequency ranges and footprint statuses; ensure earth station exemptions are applied correctly (cl 1(1)-(4)).
• Implement mechanical and electronic- steering controls to avoid prohibited elevation angles and to meet the radiated maximum true mean power limits in clause 10 tables for the applicable frequency and footprint. Where a device directs its beam via electrical steering, the clause treats electronically steered maximum radiation direction as the "direction of maximum radiation" for compliance (cl 10(1) Note 2).
• Apply the unwanted-emission limits applicable to your device type and operation start date per clause 15. For base stations, different tables apply depending on frequency offsets and whether the device was first operated before or after 1 September 2027 (cl 15(7)-(10)). For earth stations and other transmitters, follow the corresponding tables (cl 15(11)-(15)).

4. Maintain records and be prepared for inspection

• For fixed transmitters that are not base stations with maximum total radiated power >23 dBm and ≤35 dBm per occupied bandwidth, keep the record set in clause 14(1): site coordinates, emission centre frequency, emission designator, full antenna details (manufacturer, model, gain, polarisation, azimuth, elevation, and height), maximum true mean power and maximum EIRP (cl 14(1)). Provide these promptly if requested by ACMA or an inspector (cl 14(2)).
• Keep documentary evidence of "first operation" dates to support which emission regimes apply under clause 15.

5. Design operational procedures for interference events

• Create a written incident-reporting and escalation process so that when interference exceeding the compatibility requirement is detected (per Advisory Guidelines Schedule 2), the licensee can begin synchronisation or coordination within the time limits in clause 6. Note that the licensee of the first licence has a synchronisation duty by the later of 14 days after written notice or an agreed alternative day (cl 6(1)-(2)).
• For co-sited scenarios where antenna phase centres are within 200 metres and interference is not due to non-compliant operation, create processes to manage interference with the other licence-holder or site manager as required by clause 7.

6. Coordinate under RALI MS 46 and use ACMA permission procedure when needed

• Integrate RALI MS 46 coordination procedures into deployment planning (clause 5). Where a planned operation would be inconsistent with RALI MS 46 on clause 5 matters, apply to ACMA for permission under clause 16 before operating. Prepare applications in any ACMA-approved form and manner and budget for charges under s 60 of the ACMA Act (cl 16(2)-(5), (3)(c)).
• Monitor ACMA’s 30-day decision timeframe for permissions and the 30-day reconsideration window after refusal; be ready to request reconsideration within 30 days of a refusal or conditional permission (cl 16(6), (11)-(13)). Preserve rights to apply to the AAT where clause 16(14)(b) applies (cl 16(15)).

7. Maintain technical compliance and testing capability

• Arrange for measurement capability to demonstrate compliance with PFD thresholds, elevation-angle radiated-power limits and unwanted-emission specifications. The Determination’s limits are expressed in dBm EIRP, dBW/m2, and EIRP over specified bandwidths; test methods consistent with RALI MS 46 and the referenced ITU instruments should be used (cl 1A; clause 10 and clause 15).
• For indoor-transmitter claims, be prepared to demonstrate PFD at points two metres from the outside surface consistent with the indoor transmitter definition in Schedule 1 cl 1A.

8. Protect critical services

• Avoid operations that could cause harmful interference to body scanners (clause 12), and be aware of the HCIS identifiers in clause 11 that prohibit operation in 25.5-27 GHz. If operating near deep-space complexes (Canberra or New Norcia), observe the interference protections referenced in clause 5(e).

9. Governance and documentation

• Keep a compliance register mapping device IDs to Register entries, technical measurement records, PFD calculations, antenna mechanical settings, steering limits, site HCIS mapping, ACMA correspondence, permission applications, and first-operation proofs.
• Have a named contact authorised to receive ACMA written requests under s 7, to provide required data within ten business days, and to respond to ACMA permission notices promptly to preserve statutory timeframes.

10. Practical deployment workstream sequencing

• Before procurement: Confirm target band, footprint status, whether mobility will be needed (cl 2), and whether the device will be a base station, earth station or other.
• During procurement: Require equipment specs that support required EIRP, steering limits, and unwanted-emission masks consistent with clause 15.
• Before operation: Enter required Register details for non-exempt devices (cl 4), secure any ACMA permissions needed under clause 16, and ensure records for high-powered fixed devices are established (cl 14).
• After operation: Maintain measurement logs, be prepared to synchronise timing or adopt uplink-downlink configurations quickly if interference disputes arise (cl 6), and keep ACMA informed as required.

Compliance is therefore a bundle of technical engineering controls, precise registration and record-keeping, timely coordination with neighbouring licensees, and use of the ACMA permission and review processes where RALI MS 46 requirements pose operational constraints.
