This instrument is short and conceptually narrow. Its main legal concepts are accreditation, delegation of certificate-issuing functions to accredited private persons, and permissive fee-charging for services those accredited persons provide. The instrument uses and cross-refers to statutory concepts in the Act rather than defining them anew; for example the defined term "frequency assignment certificate" in this instrument expressly links back to the Act’s separate subsections for spectrum licences and apparatus licences (s 4, definition of frequency assignment certificate). Likewise, "interference impact certificate" is defined purely by reference to subsection 145(3) of the Act (s 4).

Key conceptual elements and the text that establishes them:

• Accreditation as the gate: an "accredited person" is defined by reference to two accreditation types laid down in the Radiocommunications Accreditation (General) Rules 2021 (s 4). The instrument therefore relies on that separate instrument to set the criteria for who may act as an accredited person.
• Delegated certificate-issuing authority: section 6 confers on accredited persons the power to issue specified certificates that otherwise are features of the Act’s licensing framework. The instrument does not itself restate the legal effects of the Act’s certificate types; it simply authorises accredited persons to issue them (s 6(1)-(3)).
• Fee-authorisation without schedule: section 7 permits accredited persons to charge fees for certain certificates (s 7(1)-(2)). The rules do not prescribe fee amounts, methods for calculation, controls on collection, or auditing requirements. The only substantive constraint is the prohibition on charging a fee that would amount to taxation (note to s 7).
• Interdependence with the Act and another legislative instrument: the instrument repeatedly references the Act and the Radiocommunications Accreditation (General) Rules 2021, making its legal operation co-dependent on those instruments. The instrument contains an explicit provision about references to other instruments being to the instrument as in force from time to time (s 5).

Conceptually, the instrument moves some certificate-issuing activity away from the statutory text’s default administrative locus by allowing accredited non‑Act bodies or persons to perform those acts, subject to holding the requisite accreditation. The scope of that delegated authority is strictly limited to the certificate types listed in s 6 and, for specific accreditation holders, further limited to the single specified licence type noted in the accreditation instrument (s 6(2)). The instrument’s governance approach is permissive rather than prescriptive: it grants powers and fee authority but leaves the detailed operational rules to accreditation instruments and the Act’s referenced subsections.

The instrument directly affects three discrete groups identified in its text: accredited persons, certificate recipients or applicants, and the corpus of rules and procedures in the Act and the Radiocommunications Accreditation (General) Rules 2021 that govern accreditation and certificate content.

Accredited persons

• The instrument defines an accredited person as a person who holds either a General Licensing Accreditation or a Specific Licensing Accreditation as specified in paragraph 7(1)(a) and (b) of the Radiocommunications Accreditation (General) Rules 2021 (s 4). The rules therefore affect any person who obtains or seeks these accreditations under that separate instrument. Those accredited persons obtain the legal authority to issue specific certificates under s 6 and to charge fees under s 7, within the limits the instrument sets.

Applicants, licence-holders and affected users of spectrum or apparatus licences

• The certificate types referenced in the instrument are the frequency assignment certificates mentioned in subsections 60(7A) and 100(4A) of the Act and the interference impact certificate mentioned in subsection 145(3) of the Act (s 6(1)). Although this instrument does not itself define who will apply for or receive those certificates, the natural implication from the cross-references is that entities who require frequency assignment certificates for spectrum licences or apparatus licences, and entities who require an interference impact certificate as mentioned in the Act, are affected because they may obtain those certificates from an accredited person rather than only from the body that administers the Act. In economic terms, those applicants or licence holders will be the parties that pay fees where the accredited person chooses to charge one, because the instrument authorises fee-charging in relation to issuance (s 7).

Administrators of the Act and related instruments

• The instrument expressly operates under and in relation to the Radiocommunications Act 1992 (s 3), and it refers to the Radiocommunications Accreditation (General) Rules 2021 for the definition of accreditation types (s 4). The administrators or agencies responsible for those instruments are affected in the sense that the practical locus of issuing certain certificates may shift to accredited persons. The instrument itself does not name or identify an administering agency; the Act and the other rules it cross-refers to will determine administrative procedures and oversight.

Entities not directly named but indirectly affected

• Because the instrument authorises fee charging without setting maximums or requiring publication of fees, downstream commercial counterparties and competitors who rely on frequency assignments or need interference impact certificates may experience changes in cost and timing when they seek those certificates. The instrument does not itself regulate invoicing, timetables, dispute resolution, or fee review processes; those matters will be determined by accreditation rules, the Act’s procedures, or by the market arrangements between applicants and accredited persons.

Geographic, temporal and contractual boundaries

• The instrument’s commencement is contingent (s 2) and the definitions rely on other instruments as in force from time to time (s 5). Therefore, the set of persons affected at any given time depends on whether the Radiocommunications Accreditation (General) Rules 2021 are registered and on which accreditations have been granted under those rules.

In short, the primary legally affected actors are holders or prospective holders of the two accreditation types and persons who need the specific certificates named in s 6; practical economic effects may extend to licence applicants, licence-holders and market counterparties who bear the fees that accredited persons may choose to impose (s 6-7).

The instrument creates a compact set of duties and rights for accredited persons and places indirect duties on applicants insofar as they must engage with accredited persons to obtain certificates.

Rights conferred on accredited persons

• Right to issue certificates: A person holding a General Licensing Accreditation has the right to issue three classes of certificate: frequency assignment certificates mentioned in subsection 60(7A) of the Act, frequency assignment certificates mentioned in subsection 100(4A) of the Act, and interference impact certificates mentioned in subsection 145(3) of the Act (s 6(1)). A person holding a Specific Licensing Accreditation has the right to issue the second class , frequency assignment certificates mentioned in subsection 100(4A) , but only for the specified licence type to which their accreditation relates (s 6(2)). The instrument clarifies that the narrower right under s 6(2) does not limit the broader rights under s 6(1) (s 6(3)).
• Right to charge fees: Accredited persons are expressly authorised to charge fees for certain acts. Those holding a General Licensing Accreditation may charge for issuing a frequency assignment certificate mentioned in subsection 100(4A) and for issuing an interference impact certificate mentioned in subsection 145(3) (s 7(1)). Those holding a Specific Licensing Accreditation may charge for issuing a frequency assignment certificate mentioned in subsection 100(4A) for the specified type of licence to which their accreditation relates (s 7(2)). A normative constraint appears as a note that any fee charged must not be such as to amount to taxation (note to s 7).

Duties and constraints on accredited persons

• The instrument imposes no explicit procedural duty, record-keeping duty, or fee-publishing duty within its text. It does, however, implicitly require accredited persons to hold the specified accreditation types to exercise the powers (s 4; s 6). That duty to hold accreditation ties accredited persons to whatever accreditation requirements are set out in the Radiocommunications Accreditation (General) Rules 2021, because those external rules define the content of the accreditation types by reference (s 4). The instrument further constrains fee-charging by the prohibition against imposing fees that would be a taxation equivalent (note to s 7); the instrument does not define what constitutes taxation.

Duties and expectations on applicants/recipients of certificates

• The instrument itself does not impose procedural obligations on applicants beyond the implication that applicants must engage with accredited persons who may issue the certificates. Applicants thereby take on the practical duty to negotiate fees with accredited persons where fees are charged (s 7). The instrument does not provide a statutory remedy or review mechanism for applicants dissatisfied with a fee or a refusal to issue a certificate; recourse and oversight will depend on the Act, the accreditation rules, or other instruments that govern those processes.

Interplay of rights and duties across instruments

• Because the instrument operates by reference to specific subsections of the Act (s 4; s 6) and to the separate accreditation rules (s 4), the full set of duties and rights for issuance, form, effect and validity of any certificate will be governed both by the Act’s subsections (for example 60(1), 60(7A), 100(4A), 145(3) as mentioned) and by the accreditation rules that qualify who may act. The instrument grants rights to accredited persons but leaves the operational details to other statutory texts.

Administration and oversight

• The instrument contains no express duty that accredited persons report to or are supervised by a particular agency in relation to the exercise of these powers. Any administrative oversight, complaint handling, or enforcement mechanism must therefore be found in the Act or the Radiocommunications Accreditation (General) Rules 2021, which this instrument references but does not replicate.

In summary, the instrument confers specific issuance and charging rights on accredited persons (s 6-7), conditions those rights on holding the relevant accreditations (s 4), and leaves procedural detail and oversight largely to the Act and the separate accreditation rules it references.

This instrument is procedural and permissive; it does not itself establish penalties, enforcement mechanisms, inspection powers, criminal offences, administrative sanctions or review processes. The instrument’s text is limited to authorising accredited persons to issue certain certificates and to charge fees for specified certificates. There is no provision in the instrument that prescribes penalties for failure to comply with its terms, nor is there any express enforcement regime contained within its text.

What is present in the instrument that bears on enforcement and remedies:

• Reliance on the Act and other instruments: Because the rules operate under section 313B of the Radiocommunications Act 1992 (s 3) and repeatedly cross-refer to specific subsections of the Act (s 4; s 6), any penalties, enforcement powers, or remedies connected to certificates or accreditation will be found in the Act and in the Radiocommunications Accreditation (General) Rules 2021 rather than in this instrument. For example, the substantive legal effect and any conditions for validity of a "frequency assignment certificate" are matters in the Act as referenced in the definitions (s 4). This instrument does not displace those provisions.
• Fee constraint only: The sole normative constraint within the instrument is that "any fee charged under section 7 must not be such as to amount to taxation" (note following s 7). That constraint functions as a legal limit on the content of fees but the instrument does not specify sanctions for breach of that constraint. Enforcement of that constraint would therefore be through the legal system or through the Act’s general enforcement architecture, which this instrument does not reproduce.
• References to other instruments "as in force": Section 5 provides that references to other legislative instruments are references to those instruments "as in force from time to time" (s 5). That approach means that any later amendments to the Act or the Radiocommunications Accreditation (General) Rules 2021 can alter the enforcement landscape, but the present instrument does not itself add or reduce enforcement options.

Practical implications for enforcement practitioners and compliance officers

• To identify the specific penalties or enforcement routes available in relation to certificates issued by accredited persons, a reader must consult the Act and the Radiocommunications Accreditation (General) Rules 2021, as this instrument defers those matters to those instruments (s 3, s 4, s 5).
• If an accredited person were to charge a fee that "amounts to taxation", the instrument does not set out an administrative sanction; enforcement would depend on whether the fee contravenes statutory limitations in other instruments or general principles enforceable in court. The instrument therefore leaves enforcement to the broader legal framework rather than stipulating mechanisms internally.

In sum, enforcement and penalties connected to the conduct authorised or constrained by this instrument are not specified here; the instrument delegates substantive enforcement questions to the Act and to other instruments and to the ordinary legal processes by which statutory limits are enforced.

This instrument is explicitly cross-referential and relies on a network of other statutory provisions and instruments for its legal effect. The text makes repeated, textual links to the Radiocommunications Act 1992 and to the Radiocommunications Accreditation (General) Rules 2021, and it adopts a standard statutory drafting convention for references to other instruments. The interaction points in the instrument are concrete and limited.

Primary dependencies and cross-references

• Radiocommunications Act 1992: The instrument is made under section 313B of the Act (s 3), and it references specific Act subsections to define the certificates that accredited persons may issue. The definition of "frequency assignment certificate" in the instrument points to procedures determined under subsection 60(1) and to the purpose set out in subsection 60(7A) for spectrum licences, and to subsection 100(4A) for apparatus licences (s 4). The instrument also references the interference impact certificate described in subsection 145(3) of the Act (s 4; s 6(1)(c)). Those references mean that the form, legal effects, and procedural prerequisites for the certificates are located in the Act’s subsections, not in this instrument.
• Radiocommunications Accreditation (General) Rules 2021: The definitions of General Licensing Accreditation and Specific Licensing Accreditation are not elaborated in this instrument but are supplied by paragraph 7(1)(a) and (b) of the Radiocommunications Accreditation (General) Rules 2021 (s 4). The definition of "specified type of licence" similarly depends on the instrument of accreditation given under subsection 7(2) of the Radiocommunications Accreditation (General) Rules 2021 (s 4). Therefore, who can hold accreditation, the scope of accreditation, and the procedural and substantive requirements for accreditation are governed by that separate instrument.
• Statutory interpretation acts and other Acts: Section 5 of this instrument clarifies that references to other legislative instruments mean the instruments "as in force from time to time" (s 5(a)), and references to non-legislative instruments or writings are likewise dynamic (s 5(b)). The notes to s 5 remind readers that Commonwealth Acts should be read with section 10 of the Acts Interpretation Act 1901 and with subsection 13(1) of the Legislation Act 2003 for application of the Acts Interpretation Act to legislative instruments, and they cite section 314A of the Act (s 5, notes). These references indicate that standard rules of construction and the dynamic application of other texts will influence how this instrument operates in practice.

Functional interactions and gaps

• Delegation of act performance: The instrument effectively delegates the act of issuing certain certificates to accredited persons. The legal status of those certificates, and any conditions on their issue or effect, will be governed by the Act subsections to which they refer. This means the interaction is one of authorising authorised private actors to perform acts that are meaningful under the Act, rather than of changing the Act itself.
• Fee setting and fiscal law: The instrument authorises fee-charging but contains no mechanism for fee approval, oversight, publication, or dispute resolution. The only fiscal legal constraint it imposes is the non-taxation note (note to s 7). How that interacts with Commonwealth fiscal law or with principles governing fees under other statutes is not addressed in the instrument; any such interaction would depend on the Act, the accreditation rules, or other Commonwealth law.
• Temporal and contingent interaction: Commencement is tied to the commencement of Schedule 5 to the Radiocommunications Legislation Amendment (Reform and Modernisation) Act 2020, to registration of the Radiocommunications Accreditation (General) Rules 2021, and to registration of this instrument itself (s 2). Consequently, the instrument’s operation depends on the sequencing and interaction of multiple enactments.
• Dynamic amendment effect: Because references to other instruments are to their form "from time to time" (s 5), later amendments to the Act or to the accreditation rules can change who is accredited, what certificates are covered, and the procedural requirements, without this instrument being amended.

Practical consequence for legal advisors

• To advise on the legal effect of a certificate issued by an accredited person, counsel must read the Act subsections cited in the instrument in tandem with the accreditation rules. This instrument signals that the substantive consequences of issuing a certificate derive from the Act and the accredited person's compliance with the accreditation instrument, not from these rules alone.

The instrument itself contains limited historical material. The text records the date it was made and by whom, and sets a commencement rule that ties the instrument’s coming-into-force to three events. There are no further amendments recorded within the text provided.

Recorded provenance and commencement

• The instrument was made by Paul Fletcher, Minister for Communications, Urban Infrastructure, Cities and the Arts, and is dated 1 June 2021 (instrument heading and signature block).
• Section 2 sets a conditional commencement rule. The instrument commences on the later of: (a) the commencement of Schedule 5 to the Radiocommunications Legislation Amendment (Reform and Modernisation) Act 2020; (b) the day after the Radiocommunications Accreditation (General) Rules 2021 is registered on the Federal Register of Legislation; and (c) the day after this instrument is registered on the Federal Register of Legislation (s 2).

No internal amendment entries

• The instrument contains no schedules of amendment, no revoked provisions, and no archival notes of prior versions or prior amendments. The only temporal information in the instrument is the original date and the commencement contingencies set out in s 2. There are no textual amendments within the instrument itself.

Interaction with amendments elsewhere

• The instrument’s operation is expressly tied to the commencement of Schedule 5 to the Radiocommunications Legislation Amendment (Reform and Modernisation) Act 2020 and to registration of the Radiocommunications Accreditation (General) Rules 2021 (s 2). Any amendment history relevant to the operation of this instrument will therefore also be recorded in those instruments and in the Federal Register of Legislation entries for them, but those records are not reproduced in this instrument.

Implication for researchers or compliance officers

• To establish whether the instrument is in force at a particular date, one must check the commencement dates of the two external instruments identified in s 2 and the registration date of this instrument. The instrument itself does not list those dates, it simply ties commencement to them.
• Any later amendments to the Radiocommunications Act 1992 or to the Radiocommunications Accreditation (General) Rules 2021 may affect the operation of this instrument because the instrument cross‑references those instruments "as in force from time to time" (s 5). Therefore, a complete amendment history relevant to the instrument’s operation requires checking the Federal Register of Legislation entries for the Act, Schedule 5 to the 2020 Amendment Act, this instrument, and the accreditation rules.

In summary, the instrument records its own making and a conditional commencement rule but contains no internal amendment history; the broader amendment context is located in the external instruments the instrument references.

The text of the Radiocommunications (Issuing of Certificates and Charging of Fees) Rules 2021 provided here contains no litigation history. It does not mention any judicial decisions, administrative determinations, appeals, or precedent cases that interpret its provisions. The instrument does not identify any pending or past litigation concerning its interpretation or validity.

Practical notes for legal researchers

• Because the instrument defers much of its substantive effect to provisions of the Radiocommunications Act 1992 and to the Radiocommunications Accreditation (General) Rules 2021, litigation that tests the operation of the functions authorised by this instrument is more likely to arise under those instruments or under general administrative law principles applied to actions taken pursuant to the Act. Any such litigation would not be recorded within this instrument itself.
• To discover litigation connected to the exercise of the powers enabled by this instrument, a researcher must search case law and administrative tribunal decisions that concern:
  • the validity or effect of frequency assignment certificates under subsections 60(7A) or 100(4A), or the interference impact certificate mentioned in subsection 145(3) of the Act, and
  • disputes relating to accreditation decisions or to fees charged by accredited persons under arrangements established pursuant to the Radiocommunications Accreditation (General) Rules 2021.

Limitations of the instrument for litigation use

• The instrument provides no internal guidance on dispute resolution, review, or appeal rights related to an accredited person’s conduct. Any judicial review or other challenge would proceed against the background of the Act, the accreditation rules, and general principles of administrative law. Because those instruments are not reproduced here, the instrument alone cannot be used to identify the full set of legally available remedies or precedents.

Recommended next steps to locate litigation

• Check tribunal and court databases for cases referring to subsections 60(7A), 100(4A), 145(3) of the Radiocommunications Act 1992, or for cases concerning the Radiocommunications Accreditation (General) Rules 2021.
• Check whether administrative determinations or reviews concerning the exercise of accreditation functions have reached merits review or judicial review forums.

In short, there is no litigation history in the instrument’s text; any litigation relevant to the points covered by the instrument will be found in external case law concerning the Act and the accreditation rules it cross-references.

Several points of legal and practical ambiguity in the instrument can produce compliance or commercial risk if not attended to. The instrument is short and defers many questions to the Act or to the Radiocommunications Accreditation (General) Rules 2021. These referrals create specific "gotchas" that practitioners and compliance officers should note.

1. Commencement is contingent and layered (s 2)

• The instrument commences only on the later of three events, including the commencement of Schedule 5 to another Act and registration of the Radiocommunications Accreditation (General) Rules 2021. Practitioners cannot assume the rules are immediately operative simply because the instrument was made on 1 June 2021. Confirm the effective date by checking the Federal Register of Legislation entries for Schedule 5 to the Radiocommunications Legislation Amendment (Reform and Modernisation) Act 2020, for the Radiocommunications Accreditation (General) Rules 2021, and for this instrument (s 2).

2. Accreditation content is external (s 4)

• The ability to issue certificates and to charge fees is tied to holding either a General Licensing Accreditation or a Specific Licensing Accreditation as specified in the Radiocommunications Accreditation (General) Rules 2021. The instrument does not state how one obtains those accreditations, what qualifications or obligations they impose, or whether accreditations are revocable. Those details live in the external rules and can create practical surprises if not reviewed alongside this instrument.

3. Certificate meaning and consequences are not in this instrument (s 4; s 6)

• The instrument authorises issuance of certificates that the Act describes in other subsections. The instrument does not restate the legal content, preconditions, or downstream legal effects of the certificates. For example, the frequency assignment certificates are linked to subsection 60(7A) for spectrum licences and to subsection 100(4A) for apparatus licences (s 4). A person relying on a certificate should check the Act for matters such as the certificate’s form, conditions and legal consequences.

4. Fee-authority with no procedural guardrails (s 7)

• The instrument permits accredited persons to charge fees for issuing specified certificates but sets no methodology for setting fees, no requirement to publish fees, no cap, no dispute-resolution process, and no record-keeping obligations. The only textual constraint is that fees must not amount to taxation (note to s 7). That phrase is legally indeterminate in this instrument. Credential holders and payers need to consider how to resolve disputes over fee levels and whether any other statutory or common law constraints apply.

5. "Must not be such as to amount to taxation" is undefined (note to s 7)

• The instrument’s single substantive check on fees is a prohibition against fees that would constitute taxation. The instrument does not elaborate the test or the consequences of contravention. Determining whether a fee "amounts to taxation" may require legal analysis against other Commonwealth law or judicial criteria not provided here. That uncertainty creates commercial risk for both accredited persons and payers.

6. Specific Licensing Accreditation scope depends on accreditation instrument (s 4; s 6(2))

• The term "specified type of licence" is defined by the instrument of accreditation given under subsection 7(2) of the Radiocommunications Accreditation (General) Rules 2021 (s 4). If an accreditation instrument is drafted narrowly, a Specific Licensing Accreditation holder may be confined to a single licence type. The instrument’s s 6(3) clarifies that subsection (2) does not limit subsection (1), but this only means the General Accreditation remains broader; licence-type-specific limits still apply for specific accreditation holders.

7. No internal enforcement machinery or remedies (entire instrument)

• The instrument contains no enforcement provisions, no sanctions for noncompliance, and no internal disputes mechanism. Practitioners must look elsewhere for remedies and enforcement.

8. Dynamic references to other instruments (s 5)

• Because references to other legislative instruments are to those instruments "as in force from time to time" (s 5), changes to the Act or to the accreditation rules can alter the practical ambit of who can issue certificates or charge fees. Entities relying on the instrument must monitor external instruments for changes.

9. Delegation of typically administrative functions to accredited persons

• The instrument authorises private or non-statutory accredited persons to perform acts that affect licences under the Act. That transfer of function can raise contractual, insurance, professional indemnity and conflict-of-interest issues for entities contracting with accredited persons. These operational issues are not addressed in the instrument.

10. Absence of procedural detail on certificate issue

• The instrument does not set the process or timeline for issuing certificates, or the documentation required from applicants. Those gaps will create negotiation points between applicants and accredited persons and may lead to inconsistent practices if not addressed in accreditation rules or supplementary guidance.

These "gotchas" are not speculative; they are specific implications of the instrument’s text and its choice to defer detail to the Act and to the accreditation rules. Practitioners should cross-reference the Act and the Radiocommunications Accreditation (General) Rules 2021 to resolve each point before relying on or implementing the instrument’s powers.

Complying with the Radiocommunications (Issuing of Certificates and Charging of Fees) Rules 2021 requires attention to accreditation prerequisites, the Act subsections that define the certificates, the instrument’s commencement conditions, and the fee constraint. The instrument itself is short and delegates operational detail elsewhere, so compliance is a multi-step process involving cross-referencing other instruments that the rules reference.

Step 1 , Confirm commencement

• Do not assume the instrument is in force. Check the Federal Register of Legislation for the registration dates and commencement dates of: (a) Schedule 5 to the Radiocommunications Legislation Amendment (Reform and Modernisation) Act 2020; (b) the Radiocommunications Accreditation (General) Rules 2021; and (c) this instrument (s 2). The rules commence on the later of those events (s 2).

Step 2 , Secure and understand the required accreditation

• If you intend to issue certificates or to charge fees for certificates, obtain either a General Licensing Accreditation or a Specific Licensing Accreditation as specified in paragraph 7(1)(a) or (b) of the Radiocommunications Accreditation (General) Rules 2021 (s 4).
• Review the Radiocommunications Accreditation (General) Rules 2021 in full to identify application requirements, eligibility criteria, obligations, conditions, and revocation or suspension powers associated with the accreditation. The instrument ties issuance authority to those accreditations (s 4; s 6).

Step 3 , Map which certificates you may lawfully issue

• If you hold General Licensing Accreditation, you are authorised to issue:
  • frequency assignment certificates mentioned in subsection 60(7A) of the Act;
  • frequency assignment certificates mentioned in subsection 100(4A) of the Act; and
  • interference impact certificates mentioned in subsection 145(3) of the Act (s 6(1)).
• If you hold Specific Licensing Accreditation, you are authorised to issue a frequency assignment certificate mentioned in subsection 100(4A) of the Act but only for the specified type of licence to which your accreditation relates (s 6(2)). Confirm the precise licence type in your accreditation instrument (s 4).

Step 4 , Read the Act subsections that define certificate content and effect

• The instrument instructs issuance of certificates that the Act defines or references (s 4). To comply substantively, read subsections 60(1) and 60(7A) for spectrum licence frequency assignment certificates, subsection 100(4A) for apparatus licence frequency assignment certificates, and subsection 145(3) for interference impact certificates. Those subsections will set out any conditions precedent, forms, or consequences attached to the certificates that you will issue.

Step 5 , Determine fee approach and legal constraints

• If you intend to charge for issuing a certificate, ensure that the fee you charge is authorised by the instrument and is not one that "amounts to taxation" (s 7; note to s 7).
• Because the instrument does not define the taxation test, take legal advice to determine how fee levels relate to Commonwealth principles of fees and charges and to any statutory guidance that might apply in the Act or in other financial legislation.
• Consider drafting a fee schedule and a terms-of-service document that sets out what the fee covers, billing arrangements, refund conditions, and dispute resolution procedures to reduce commercial uncertainty between you and applicants.

Step 6 , Operational and documentation controls

• Even though the instrument does not stipulate record-keeping and process times, implement internal procedures to document certificate applications, assessments, issuance decisions, the fee charged, invoices, and applicant communications. Retain documents necessary to demonstrate compliance with accreditation obligations and with the Act requirements referenced by the certificates (s 4; s 6).
• If you are a Specific Licensing Accreditation holder, ensure your processes only cover the specified licence type authorised in your accreditation instrument (s 4; s 6(2)).

Step 7 , Monitor and manage legal risk

• Because the instrument contains no internal enforcement regime, ensure you are aware of the enforcement and review provisions in the Act and in the Radiocommunications Accreditation (General) Rules 2021. Confirm whether decisions you make can be subject to merits review, administrative review, or judicial review under the Act and other applicable laws.
• Be alert to the risk that fees may be challenged as amounting to taxation or as unlawful if they exceed statutory bounds in other instruments. Maintain insurance and dispute resolution mechanisms accordingly.

Step 8 , Keep monitoring external instruments and amendments

• Section 5 establishes that references to other instruments are to those instruments "as in force from time to time" (s 5). Monitor the Act and the accreditation rules for amendments that might change accreditation requirements, the scope of certificate types, procedural obligations, or fee constraints.

Step 9 , Communicate with applicants

• Provide clarity to applicants about the legal status of the certificate you will issue by referencing the relevant Act subsection (for example, subsection 100(4A) or 60(7A) or 145(3)) and by documenting the certification process, the fee, and any conditions on the certificate’s use. This will reduce contractual and operational disputes.

Step 10 , If in doubt, obtain written legal advice

• Because the instrument leaves substantive questions to the Act and to the accreditation rules and does not define the taxation test for fees, seek formal legal advice to confirm compliance before issuing certificates or charging significant fees.

Following these steps will align practical operations with the instrument’s text. The central recurring compliance requirement is to hold the relevant accreditation under the Radiocommunications Accreditation (General) Rules 2021 and to ensure that any fee charged is consistent with the instrument’s single substantive constraint that it must not amount to taxation (s 4; s 6; s 7).
