What it does
This legislative instrument creates a time-limited, conditional exemption from specified parts of the Radiocommunications Act 1992 for acts or omissions by certain persons when implementing electronic counter measures associated with the security of named visiting dignitaries. Mechanically, the Determination does three things.
First, it exempts an act or omission by a “relevant person” from all of Part 3.1, all of Part 4.1 and all of Part 4.2 of the Act where the conditions in section 8 are met (see s7). The instrument therefore operates by removing the application of those identified Parts of the Act to particular conduct, rather than by creating new powers to authorise interference or by amending the Act itself.
Second, it gives the Australian Communications and Media Authority (ACMA) an administrative power, exercisable by notifiable instrument, to name a person as a “visiting dignitary” and to specify a corresponding “dignitary security period” (s9(1)). The instrument conditions that power, including a list of categories of persons who may be named (s9(2)) and an upper limit of 14 days on any dignitary security period (s9(3)). The power is therefore exercisable by ACMA subject to the statutory constraints expressed in s9.
Third, the instrument is time-limited both in application and in existence. It commences at the start of the day after registration on the Federal Register of Legislation (s2) and is automatically repealed at the start of the day that is the fifth anniversary of commencement (s4). The exemption itself is also temporally bounded at the incident level by the dignitary security period that ACMA specifies, which must not exceed 14 days (s9(3)).
The instrument is made under subsection 27(2) of the Act and is explicit about its limited scope: it applies only when the act or omission is in the performance of functions or duties in relation to the Australian Federal Police, a state or territory police force, or the defence, security or international relations of Australia (s8(2)), and when the act is in relation to implementation of electronic counter measures associated with the security of a visiting dignitary and occurs during the dignitary security period (s8(3)). The definition of “relevant person” is supplied by the instrument (s5).
